का.जन.आ. 81.—राष्ट्रपजत, संजविान के अनुच्छेि 309 के परन्तुक द्वारा प्रित्त िज‍ तयों का प्रयोग करते हुए और

सिस्ट् त्र बल मुख् यालय जलजपकीय सेवा जनयम, 2001 को, उन बातों के जसवाय अजिक्ांत करते हुए, जिन्िें ऐसे अजिक्मण से

पिले दकया गया या करने का लोप दकया गया िै, जनम् नजलजखत जनयम बनाती िैं, अथाात्:-

संजक्षप्त नाम और प्रारंभ.- (1) इन जनयमों का संजक्षप्त नाम रक्षा मंत्रालय, सिस्ट् त्र बल मुख् यालय जलजपकीय सेवा

जनयम, 2023 िै ।

(2) ये रािपत्र में प्रकािन की तारीख को प्रवृत्त िोंगे ।

(3) लागू िोना.- ये जनयम उन व्यजियों को लागू िोंगे िो इन जनयमों से उपाबद्ध पिली अनुसूची में यथािर्िात

रक्षा मंत्रालय (सेना, नौसेना और वायुसेना) के एकीकृत मुख्यालय, रक्षा कमाचाररवृंि मुख्यालय और अंतर सेवा

संगठनों में वररष्ठ सजचवालय सिायक श्रेणी और कजनष्ठ सजचवालय सिायक श्रेणी का पि िारण दकए हुए िैं ।

पररभाषाएं.- इन जनयमों में, िब तक दक संिभा से अन् यथा अपेजक्षत न िो,–

(क)

‘’जनयुज‍ त प्राजिकारी’’ से दकसी श्रेणी के संबंि में उस श्रेणी में जनयुज‍ तयां करने के जलए केन् रीय जसजवल

सेवा (वगीकरण, जनयंत्रण और अपील) जनयम, 1965 के अिीन सि‍ त प्राजिकारी अजभप्रेत िै;

(ख) दकसी श्रेणी के संबंि में “अनुमोदित” सेवा से जनम्नजलजखत अजभप्रेत िै-

(i)

उस श्रेणी में सीिे भती दकए गए दकसी अजिकारी की ििा में, उस वषा की पिली िनवरी से िो

उस परीक्षा वषा के बाि वाले वषा की जिसके जलए सीिी भती की गई थी, उस श्रेणी में की गई जनयजमत

सेवा की अवजि या अवजियााँ, जिनके अंतगात अनुपजस्ट्थजत की वि अवजि या अवजियााँ भी िैं, जिसके िौरान

उसने जनयजमत आिार पर पि िारण दकया िोता यदि वि छुट्टी पर न िोता या ऐसा पि िारण करने के

जलए अन्यथा उपलब्ि िोता;

(ii)

उस श्रेणी में जवभागीय परीक्षा के माध्यम से भती दकए गए दकसी अजिकारी की ििा में, उस

वषा की पिली िनवरी से, जिसकी ररजियों के जलए ऐसी परीक्षा ली गई थी, उस श्रेणी गई जनयजमत सेवा

की अवजि या अवजियााँ, जिनके अंतगात अनुपजस्ट्थजत की वि अवजि या अवजियााँ सजम्मजलत िैं, जिसके

िौरान उसने जनयजमत आिार पर पि िारण दकया िोता यदि वि छुट्टी पर न िोता या ऐसा पि िारण

करने के जलए अन्यथा उपलब्ि िोता;

(iii)

जनम्नतर श्रेणी में सेवा की अवजि के आिार पर उस श्रेणी में भती दकए गए दकसी अजिकारी की

ििा में, उस वषा की पिली िनवरी से, जिस वषा में भती की गई थी, उस श्रेणी में की गई जनयजमत सेवा की

अवजि या अवजियााँ, जिनके अंतगात अनुपजस्ट्थजत की वि अवजि या अवजियााँ सजम्मजलत िैं, जिनके िौरान

उसने जनयजमत आिार पर पि िारण दकया िोता यदि वि ऐसा पि िारण करने के जलए छुट्टी पर न िोता

या अन्यथा उपलब्ि िोता;

परंतु ििां ऊपर उपखंड (i), (ii) और (iii) में वर्णात मामलों में से दकसी में जनयुजि पर पिग्रिण करने में

नब्बे से अजिक दिन का जवलंब िै, विााँ ऐसा जवलंब अजिकारी की दकसी त्रुरि के कारण निीं िोना चाजिए।

(ग)

सेवा के सिस्ट्यों के संबंि में “काडर जनयंत्रक प्राजिकारी” से रक्षा मंत्रालय का संयुि सजचव एवं मुख्य

प्रिासजनक अजिकारी अजभप्रेत िै :

(घ)

“सीिे भती दकए गए व्यजि” से ऐसा व्यजि अजभप्रेत िै िो कमाचारी चयन आयोग द्वारा आयोजित

प्रजतयोजगता परीक्षा के आिार पर या जनयम 8 में यथा जवजनर्िाष्ट अनुकंपा जनयुजि के आिार पर कजनष्ठ

सजचवालय सिायक श्रेणी में भती दकया गया िै।

(ङ)

“कताव् य पि’’ दकसी श्रेणी के संबंि में सिस्ट् त्र बल मुख् यालय जलजपकीय सेवा में सजम्मजलत सेवा में उस श्रेणी

का कोई पि अजभप्रेत िै।

(च)

“सरकार'’ से केन्रीय सरकार अजभप्रेत िै।

(छ) “श्रेणी'’ से जनयम 3 में जवजनर्िाष्ट श्रेजणयों में कोई श्रेणी अजभप्रेत िै।

(ि)

“स्ट्थायी अजिकारी” से दकसी श्रेणी के संबंि में वि व्यजि अजभप्रेत िै जिसकी प्रवेि श्रेणी में पुजष्ट की गई िै।

(झ) ''अनुसूची'’ से इन जनयमों से उपाबद्ध अनुसूची अजभप्रेत िै।

(´)

“सेवा से” सिस्ट् त्र बल मुख्यालय जलजपकीय सेवा अजभप्रेत िै।

(ि)

“अन्य जपछड़ी िाजतयों” से भारत सरकार की सेवाओं या पिों में आरक्षण के प्रयोिन के जलए केंरीय सरकार

द्वारा समय-समय पर अजिसूजचत िाजतयां या समुिायें अजभप्रेत िै।

(ठ)

“अनुसूजचत िाजतयों और अनुसूजचत िनिाजतयों” का अथा विी िोगा िो उन्िें क्मिः भारत के संजविान के

अनुच्छेि 366 के खंड (24) और खंड (25) में समनुिेजित िै।

(ड)

“जनयमों” से सिस्ट् त्र बल मुख्यालय जलजपकीय सेवा जनयम, 2023 अजभप्रेत िै।

(ढ़)

“चयन सूची” से वररष्ठ सजचवालय सिायक और कजनष्ठ सजचवालय सिायक के संबंि में ऐसी सूची अजभप्रेत

िै जिसे जवद्यमान ररजियों और ऐसी प्रत्याजित ररजियों को, जिनके वषा के िौरान िोने की संभावना िै और

जिन्िें प्रोन्नजत के जलए प्रत्येक वषा तैयार दकया िाता िै।

(ण)

“कमाचारी चयन आयोग” से सरकार द्वारा स्ट्थाजपत कमाचारी चयन आयोग अजभप्रेत िै।

(त)

“अस्ट्थायी अजिकारी” से दकसी श्रेणी के संबंि में ऐसा कोई व्यजि अजभप्रेत िै, िो उस श्रेणी में अस्ट्थायी या

स्ट्थानापन्न जनयुजि, ऐसी जनयुजि के जलए उसके जनयजमत रूप से अनुमोदित िोने के आिार पर िारण

दकया हुआ िै, या उस श्रेणी में जनयुि ऐसा अजिकारी, जिसे अभी पररवीक्षा से ििाया िाना िै।

सेवा का गठन-

(1) सेवा में िो श्रेणी िोंगे, अथाात् :-

(क) वररष्ठ सजचवालय सिायक श्रेणी जिसके अंतगात वररष्ठ सजचवालय सिायक अकृजत्यक चयन श्रेणी भी िै; और

(ख) कजनष्ठ सजचवालय सिायक श्रेणी

(2) िोनों श्रेजणयों के पि केंरीय जसजवल सेवा, समूि ‘ग’ – अनुसजचवीय के रूप में वगीकृत

अरािपजत्रत पि

िोंगे। िोनों श्रेजणयों के पि अचयन पि िोंगे।

सेवा की प्राजिकृत पि संख् या और उसका पुनर्वालोकन.-

(1)

सेवा के श्रेजणयों में प्राजिकृत पि संख्या िूसरी अनुसूची में जवजनर्िाष् ि दकए गए अनुसार िोगी।

(2)

केन्रीय सरकार, उपजनयम (1) में अंतर्वाष्ट दकसी बात के िोते हुए भी:

(क)

सेवा की जवजभन् न श्रेजणयों के कताव् य पिों में समय-समय पर पररविान अथवा पररवतान कर

सकेगी;

(ख)

रक्षा मंत्रालय के एकीकृत मुख् यालय (सेना, नौसेना, वायु सेना), रक्षा कमाचाररवृन्ि मुख्यालय

और अंतर सेवा संगठन का कोई पि काडर में सजम्मजलत दकया िा सकेगा यदि ऐसे पिों से िुड़े कृत्य ऐसे

िैं िो काडर जनयंत्रक प्राजिकारी की राय में पि के िारक से सारत: विी अिाताएं, प्रजिक्षण और अनुभव

रखने की अपेक्षा करते िैं, िो सेवा के कताव्य पिों के िारकों के जलए आवश्यक िै या िो सेवा में पिले से

सजम्मजलत दकसी कताव्य पि को सेवा से अपवर्िात करते िैं।

सेवा में जनयुजि.- सेवा के कजनष्ठ सजचवालय सिायक श्रेणी में जनयुजि जनम्नजलजखत ितों के अिीन िोगी:

(1)

ऐसे िांच िो केन्रीय सरकार द्वारा आवश्यक समझी िाए,

(2)

व्यजि, ऐसी जचदकत्सीय परीक्षा के पश्चात, िो सरकार द्वारा जवजित की िाए, ऐसी दकसी मानजसक या

िारीररक त्रुरि से मुि पाया िाता िै जिनसे सेवा के कताव्यों के जनवािन में बािा पड़ने की संभावना िै, और

(3)

जनरिाता : वि व्यजि -

(क)

जिसने ऐसे व्यजि से, जिसका पजत या जिसकी पत्नी िीजवत िै, जववाि दकया िै, या

जववाि की संजविा की िै; या

(ख)

जिसने अपने पजत या अपनी पत्नी के िीजवत िोते हुए दकसी व्यजि से जववाि दकया

िै, या

जववाि की संजविा की िै;

सेवा में जनयुजि का पात्र निीं िोगा :

परंतु यदि सरकार का यि समािान िो िाता िै दक ऐसा जववाि ऐसे व्यजि और जववाि के

अन्य पक्षकार को लागू स्ट्वीय जवजि के अिीन अनुज्ञेय िै और ऐसा करने के अन्य आिार िै तो वि दकसी व्यजि को

इस जनयम के प्रवतान से छूि िे सकेगी।

कताव्य पि का श्रेणी अजिकारी द्वारा िाररत दकया िाना.- प्रत्येक कताव्य पि, िब तक दक उसे जनयम 4 के अिीन

सेवा से अपवर्िात घोजषत न कर दिया गया िो या उसे दकसी कारण से प्रास्ट्थगन रखा गया िो, समुजचत श्रेणी के दकसी

अजिकारी द्वारा िाररत दकया िाएगा।

सेवा में जनयुजि की पद्धजत.-

(1)

सेवा के पि तीसरी अनुसूची में ििााये गए अनुसार भरे िाएंगे।

(2)

यदि कमाचारी चयन आयोग द्वारा आयोजित प्रजतयोजगता परीक्षाओं के पररणामों के आिार पर कजनष्ठ

सजचवालय सिायक श्रेणी में जनयुजि के जलए अर्िात अभ्यर्थायों की पयााप्त संख्या उपलब्ि निीं िै तो ररजियां या तो अंजतम

रूप से भरी िा सकेगी या जनयजमत आिार पर ऐसी रीजत में भरी िा सकेगी िो सरकार द्वारा जवजनजश्चत की िाए ।

(3)

कजनष्ठ सजचवालय सिायक श्रेणी और वररष्ठ सजचवालय सिायक श्रेणी में ररजियां भरी िाने में सरकार

द्वारा समय-समय पर इस संबंि में िारी आिेिों के अनुसार, यथाजस्ट्थजत, अनुसूजचत िाजतयों, अनुसूजचत िनिाजतयों,

अन्य जपछड़े वगों, भूतपूवा सैजनकों और दकन्िीं जविेष प्रवगों के जलए आरक्षण िोगा।

अनुकंपा जनयुजियां.- तीसरी अनुसूची में दकसी बात के िोते हुए भी जनयुि प्राजिकारी, एक वषा में िोने वाली

कजनष्ठ सजचवालय सिायक श्रेणी की ररजियों को, इन जनयमों में यथा उपबंजित के जसवाय उस सरकारी सेवक के, जिसकी

अपनी सेवा की अवजि के िौरान मृत्यु िो िाती िै या जिसे केन्रीय सरकार द्वारा िारी आिेिों या अनुिेिों के अनुसार

जचदकत्सीय आिारों पर सेवाजनवृत्त कर दिया िाता िै तो पुत्र या पुत्री या पत्नी या पजत या भाई या बिन की जनयुजि द्वारा

भर सकेगा।

प्रजतयोजगता परीक्षा के जलए जनयम.- तीसरी अनुसूची में जनर्िाष्ट प्रजतयोजगता परीक्षाओं के जलए जिसमें कमाचारी

चयन आयोग द्वारा आयोजित सीजमत जवभागीय परीक्षाएं भी सजम्मजलत िै, के जलए जनयम केन्रीय सरकार (कार्माक, लोक

जिकायत और पेंिन मंत्रालय के कार्माक और प्रजिक्षण जवभाग) द्वारा समय-समय पर इस प्रयोिन के जलए अजिसूजचत

जनयम िोंगे।

10.

पररवीक्षा.-

(1)

सेवा के कजनष्ठ सजचवालय सिायक श्रेणी में सीिी भती की पद्धजत के माध्यम से चयजनत प्रत्येक व्यजि को

आरंभ में पररवीक्षा पर जनयुि दकया िाएगा िो पररवीक्षा की अवजि भती की तारीख से िो वषा िोगी।

(2)

पररवीक्षा के िौरान सेवा के दकसी सिस्ट्य से ऐसा प्रजिक्षण लेने और ऐसी परीक्षाएं उत्तीणा करने की

अपेक्षा की िा सकेगी, िो सरकार समय-समय पर जवजित करे।

(3)

सेवा के कजनष्ठ सजचवालय सिायक श्रेणी में जनयुि प्रत्येक व्यजि, िो उपजनयम (2) के अिीन जवजित

परीक्षाएं उत्तीणा निीं करता, तब तक पररवीक्षा पर बना रिेगा िब तक वि ऐसी परीक्षाएं उत्तीणा निीं करता या उसे

सरकार द्वारा ऐसी परीक्षाएं उत्तीणा करने से जविेष रूप से छूि निीं िे िी िाती।

परंतु ऐसे व्यजि जिनके जवरुद्ध कोई जवभागीय या जवजिक कायावाजियां लंजबत िैं, पररवीक्षा पर बने रिेंगे।

(4)

यदि जनयुजि प्राजिकारी ठीक समझता िै तो उपजनयम (1) में जवजनर्िाष्ट पररवीक्षा की अवजि दकसी

मामले में बढ़ाई या घिाई िा सकती िै, दकन्तु पररवीक्षा में जवस्ट्तार की कुछ अवजि उपजनयम(3) में यथाजवजनर्िाष्ट के

जसवाय केन्रीय सरकार द्वारा समय-समय पर दकए गए अनुिेिों के अनुसार िो वषा या सामान्य अवजि के जवस्ट्तार के िो

गुने से अजिक निीं िोगी।

11.

पुजष्ट.- कजनष्ठ सजचवालय सिायक श्रेणी में जनयुि व्यजि, पररवीक्षा या उसके दकसी जवस्ट्तार के पूरा िोने पर यदि

वे पिले से श्रेणी में पुष्ट निीं िै और यदि वे श्रेणी के जलए उपयुि समझे िाते िैं तो श्रेणी में पुष्ट दकए िाएंगे।

12.

पररवीक्षा पर व्यजियों की सेवोन्मुि या प्रत्यावतान.-

(1)

सेवा के कजनष्ठ सजचवालय सिायक श्रेणी में जनयुि ऐसा कोई अजिकारी, जिसका केंरीय सरकार या

दकसी राज्य सरकार के अिीन दकसी पि पर िारणाजिकार निीं िै, िब वि पररवीक्षा पर िै, सूचना के जबना

दकसी भी समय सेवान्मुि दकया िा सकेगा, यदि;

(क)

पररवीक्षा के िौरान उसके काया जनष्पािन या आचरण के आिार पर उसे सेवा में

आगे रखने के जलए अनुपयुि समझा िाता िै, या

(ख)

उसकी राष्ट्रीयता, आयु, स्ट्वास्ट््य, िैजक्षक अिाताओं या पूवावृतों के संबंि में दकसी

सूचना की प्राजप्त पर, जनयुजि प्राजिकारी का यि समािान िो िाता िै दक वि सेवा का

सिस्ट्य बनने के जलए अपात्र िै या अन्यथा अनुपयुि िै।

(2)

सेवा के कजनष्ठ सजचवालय सिायक श्रेणी में जनयुि ऐसा कोई अजिकारी, िो केंरीय सरकार या दकसी

राज्य सरकार के अिीन दकसी पि पर िारणाजिकार रखता िै, पररवीक्षा के िौरान उपजनयम (1) में जवजनर्िाष्ट

पररजस्ट्थजतयों में से दकसी के िोने पर, दकसी भी समय ऐसे पि पर प्रत्यावर्तात दकया िा सकेगा।

13.

ज्येष्ठता.-

(1)

रक्षा मंत्रालय, सिस्ट् त्र बल मुख् यालय जलजपकीय सेवा जनयम, 2023 के प्रारम्भ िोने पर सेवा के सिस्ट्यों

की ज्येष्ठता, इन जनयमों के आरंभ से पूवा उनकी अपने-अपने श्रेजणयों यथाअविाररत ज्येष्ठता िोगी।

परंतु यदि सेवा की दकसी सिस्ट्य की ज्येष्ठता, रक्षा मंत्रालय, सिस्ट् त्र बल मुख् यालय जलजपकीय सेवा जनयम,

2023 के आरंभ से पूवा जवजनर्िाष्ट रूप से अविाररत निीं की गई िै तो यि केंरीय सरकार द्वारा उस समय

जवद्यमान जनयमों के अनुसार अविाररत की िाएगी।

परंतु यि और दक ििां पिले से जवद्यमान जनयमों के संिभा में, ज्येष्ठता का पुनर्नायतन करने और संबजन्ित मामलों

के संबंि में, दकसी न्यायालय या अजिकरण द्वारा कोई जनणाय या जनिेि पिले िी िारी दकया िा चुका िै, विााँ इन जनयमों

के प्रारम्भ से पूवा जवद्यमान जनयमों के अनुसार पिले से प्रारम्भ प्रदक्या को पूरा करने के जलए आवश्यक कायावािी या ऐसी

कायावािी जिसे आवश्यक समझा िाये, की िाएगी।

(2)

इन जनयमों के प्रारम्भ के पश्चात सेवा के िोनों श्रेजणयों में जनयुि दकए गए व्यजियों की ज्येष्ठता, केंरीय

सरकार द्वारा समय-समय पर िारी दकए गए सािारण आिेिों या अनुिेिों के अनुसार अविाररत की िाएगी।

(3)

कजनष्ठ सजचवालय सिायक श्रेणी में सीिे भती दकए िाने वाले व्यजियों और प्रोन्नत व्यजियों की सापेक्ष

ज्येष्ठता केंरीय सरकार द्वारा समय-समय पर िारी दकए गए सािारण आिेिों या अनुिेिों के अनुसार अविाररत की

िाएगी।

14.

वेतन मैरर‍स में स्ट्तर.- सेवा के श्रेजणयों से संबद्ध वेतन मैरर‍स में स्ट्तर जनम्नजलजखत िोंगे, अथाात्:

(1) वररष्ठ सजचवालय सिायक – वेतन मैरर‍स में स्ट्तर-4 (25500-81100 रू.) और वररष्ठ सजचवालय सिायक

(अकृजत्यक चयन श्रेणी)- वेतन मैरर‍स में स्ट्तर-6 (35400-112400 रू.)

(2) कजनष्ठ सजचवालय सिायक - वेतन मैरर‍स में स्ट्तर-2 (19900-63200 रू.)

15.

वेतन मैरर‍स में स्ट्तर का जवजनमय.- श्रेजणयों के अजिकाररयों का वेतन मैरर‍स में स्ट्तर और वेतन वृजद्ध, मूल

जनयमों या तत्समय प्रवृत वेतन से संबजन्ित अन्य जनयमों के अनुसार जवजनयजमत दकया िाएगा।

16.

जवजनमय.- केंरीय सरकार, इन जनयमों को प्रभावी करने के प्रयोिन के जलए, ऐसे सभी मामलों को, जिनके जलए

उपबंि करना आवश्यक या समीचीन िै, उपबंजित करने के जलए, ऐसे जवजनमय बना सकेगी, िो इन जनयमों से असंगत न

िो।

17.

अवजिष्ट मामले.- ऐसे मामले के संबंि में, िो इन जनयमों या जवजनयमों अथवा उनके अिीन दकए गए या िारी

आिेिों या जविेष आिेिों के अंतगात जवजनर्िाष्ट रूप से निीं आते, सेवा के सिस्ट्य सािारण जसजवल सेवाओं को लागू जनयमों,

जवजनयमों और आिेिों द्वारा िाजसत िोंगे।

18.

जिजथल करने की िजि.- ििां केंरीय सरकार की यि राय िै दक ऐसा करना आवश्यक या समीचीन िै, विााँ वि

उसके जलए िो कारण िै लेखबद्ध करके, इन जनयमों के दकसी उपबंि में से दकसी को दकसी वगा या प्रवगा के व्यजियों की

बाबत आिेि द्वारा जिजथल कर सकेगी।

19.

व्यावृजत.- इन जनयमों की कोई भी बात, ऐसे आरक्षण, आयु-सीमा में छूि और अन्य ररयायतों पर प्रभाव निीं

डालेगी, जिनका केंरीय सरकार द्वारा इस संबंि में समय-समय पर िारी दकए गए आिेिों के अनुसार अनुसूजचत िाजतयों,

अनुसूजचत िनिाजतयों, अन्य जपछड़े वगों, भूतपूवा सैजनकों और अन्य जविेष प्रवगा के व्यजियों के जलए उपबंि करना

अपेजक्षत िै।

20.

उसने पररवीक्षा के अवजि सफलतापूवाक पूरी कर ली

िो और या तो उसने िंकण की परीक्षा उत्तीणा कर

ली िो या जवजित प्रदक्या के अनुसार उसे उत्तीणा

कजनष्ठ सजचवालय सिायक श्रेणी में कम

से कम आठ वषा की अनुमोदित जनरंतर

सेवा।

रिप्पण: वररष्ठ सजचवालय सिायक के

चयन सूची तैयार करने के जलए वररष्ठ

सजचवालय सिायक श्रेणी में प्रोन्नजत के

प्रयोिन के जलए अनुमोिन सेवा उस

में जिन्िोंने अपनी अिाक या पात्रता पूरी कर ली िै

प्रोन्नजत के जलए जवचार दकया िा रिा िो विााँ उनसे

ज्येष्ठ व्यजियों के संबंि में भी जवचार दकया िाएगा

परंतु यि तब िबदक उनके द्वारा की गई ऐसी अिाक

या पात्रता सेवा अपेजक्षत अिाता या पात्रता सेवा

आिे से अजिक से या िो वषा से, इसमें से िो भी कम

िो, कम न िो और उन्िोंने अपनी पररवीक्षा की

अवजि सफलतापूवाक पूरी कर ली िो और या तो

उन्िोंने िंकण परीक्षा उत्तीणा कर ली िो या जवजित

प्रदक्या के अनुसार उसे उत्तीणा करने से छूि प्रिान

कर िी गई िो।

(ख) पच्चीस प्रजतित ररजियां कमाचारी चयन

आयोग द्वारा आयोजित सीजमत जवभागीय

प्रजतयोजगता परीक्षा के पररणामों में उनकी योग्यता

के क्म के आिार पर चयजनत श्रेणी के व्यजियों में से

भरी िाएगी। इस कोिे से भरी न गई ररजियां उि

खंड (क) में यथा जवजनर्िाष्ट ज्येष्ठता कोिे में

अपयोजित कर िी िाएगी।

रिप्पण : वररष्ठ सजचवालय सिायक श्रेणी की

आन्तररक ज्येष्ठता के अविारण के प्रयोिन के जलए

प्रत्येक वषा एक सूची तैयार की िाएगी जिसमें उि

वगा (क) से तीन व्यजि और वगा (ख) से एक व्यजि

की भती करते हुए उन व्यजियों के नाम उपिर्िात

करके और आगे ऐसा अनुसरण दकया िाएगा।

जनणाायक तारीख पर उन्िोंने कजनष्ठ

सजचवालय सिायक श्रेणी पर कम से

कम पााँच वषा की जनरंतर अनुमोदित

सेवा की िो।

परंतु यदि वि सीजमत जवभागीय

िाएंगी, और

(ii) िस प्रजतित ररजियां, बहुकाया कमाचाररवृंि के

समूि ‘ग’ में से ज्येष्ठता-सि-उपयुिता के आिार पर

समूि ‘ग’ की श्रेणी के ऐसे बहुकाया

कमाचाररवृंि जिन्िोंने दकसी

मान्यताप्राप्त बोडा से कक्षा बारिवीं की

परीक्षा उत्तीणा की िो और जिन्िोंने

बहुकाया कमाचाररवृंि के समूि ‘ग’ के पि

वेतन मैरर‍स के स्ट्तर-1 (18000-

56900रु॰) पर कम से कम तीन वषा की

जनयजमत सेवा की िो।

समूि ‘ग’ की श्रेणी के ऐसे बहुकाया

रिप्पण 1 : यदि खंड (क) में मि (i) के अिीन दकसी

कारण से समुजचत संख्या में व्यजि उपलब्ि निीं िै,

तो ऐसे भरी निीं िा सकने वाली ररजियां खंड (क)

में मि (ii) में जवजनर्िाष्ट रीजत से भरी िा सकेंगी और

उसी प्रकार से पश्चातवती वषा में ररजियों को भरी

िाएगी और दकसी कारण से ररजियां िो भरी न िा

सकने के कारण िेष िैं, यदि कोई िै, खंड (ख) में

जवजनर्िाष्ट रीजत से भरी िा सकेगी।

(ख) िेष ररजियां, िो उि खंड (क) के परंतुक और

जनयम 8 के अनुसार जनयुजि प्राजिकारी द्वारा

अविाररत की िाएं, केन्रीय सरकार द्वारा समय-

समय पर अजिसूजचत जनयमों के अनुसार कमाचारी

चयन आयोग द्वारा इस प्रयोिन के जलए आयोजित

प्रीजतयोजगता परीक्षाओं के आिार पर सीिी भती

द्वारा भरी िाएंगी।

रिप्पण 2: ऊपर खंड (क)(i), (क)(ii) और खंड (ख)

में जनर्िाष्ट व्यजियों की पारस्ट्पररक ज्येष्ठता, तीन

समूिों में से प्रत्येक के जलए जनयम कोिा के अनुसार,

जनयुि प्राजिकारी द्वारा बनाए गए रोस्ट्िर के

अनुसार जवजनयजमत दकया िाएगा, जिसमें आरंभ में

ऊपर जनर्िाष्ट खंड (क)(ii) में जनर्िाष्ट एक व्यजि को

जलया िाएगा, जिसके पश्चात खंड (क)(i) से एक

व्यजि, तत्पश्चात खंड (ख) से आठ व्यजि जलया

िाएगा और उसी प्रकार आगे भी की िाएगी।

NOTIFICATION

New Delhi, the 19th July, 2023

S.R.O 81.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in

supersession of the Armed Forces Headquarters Clerical Service Rules, 2001, except as respects things done or

omitted to be done before such supersession, the President hereby makes the following rules, namely: -

Short title and commencement.- (1) These rules may be called the Ministry of Defence, Armed Forces

Headquarters Clerical Service Rules, 2023.

(2)

They shall come into force on the date of their publication in the Official Gazette.

(3)

Application.- These rules shall apply to the persons holding the posts in the Senior Secretariat

Assistant Grade and Junior Secretariat Assistant Grade in the Integrated Headquarters of the Ministry of

Defence (Army, Navy and Air), Defence Staff Headquarters and Inter Service Organisations as shown in the

First Schedule annexed to these rules.

Definitions.- In these rules, unless the context otherwise requires,-

(a)

“appointing authority” in relation to any Grade means the authority empowered under the Central

Civil Service (Classification, Control and Appeal) Rules, 1965 to make appointments to that Grade;

(b)

“approved service” in relation to any Grade means-

(i)

in respect of an officer recruited directly to that Grade, period or periods of regular Service

rendered in that Grade, including period or periods of absence during which he would have held a

post on regular basis in that Grade but for his being on leave or otherwise not being available to hold

such post, from the first day of January of the year, following the year of the examination for direct

recruitment was held;

(ii)

in respect of an officer recruited to that Grade through departmental examination, period or

periods of regular Service rendered in that Grade including period or periods of absence during

which he would have held a post on regular basis in that Grade but for his being on leave or

otherwise not available to hold such post, from the first day of January of the year for which such

examination was held;

(iii) in respect of an officer recruited to that Grade on the basis of length of Service in the lower

Grade, period or periods of regular service rendered in that Grade, including period or periods of

absence during which he would have held a post on regular basis in that Grade but for his being on

leave or otherwise not being available to hold such post, from the first day of January of the year for

which the recruitment was made:

Provided that where there is a delay of more than ninety days in joining an appointment, in

any of the cases mentioned in sub-clauses (i), (ii) and (iii) above, such delay should not be due to

any fault on the part of the officer.

(c)

"cadre controlling authority" in relation to the members of the service means the Joint Secretary and

Chief Administrative Officer in the Ministry of Defence;

(d)

"direct recruit" means a person recruited to the Junior Secretariat Assistant Grade on the basis of a

competitive examination held by the Staff Selection Commission or recruited through compassionate

appointment as specified in rule 8;

(e)

"duty post" in relation to any Grade means a post of that Grade included in the Armed Forces

Headquarters Clerical Service;

(f)

"Government" means the Central Government;

(g)

"Grade" means any of the Grades specified in rule 3;

(h)

"Permanent Officer" in relation to any Grade means a person who has been confirmed in the entry

Grade;

(i)

"Schedule" means a Schedule annexed to these rules;

(j)

"Service" means the Armed Forces Headquarters Clerical Service;

(k)

"other backward classes" means the castes or communities notified by the Central Government from

time to time for the purpose of reservation in services or posts in the Government of India;

(l)

"Scheduled Castes and Scheduled Tribes" shall have the same meaning as are assigned to them in

clause (24) and (25) respectively at article 366 of the Constitution of India;

(m)

“Rules” means the Armed Forces Headquarters Clerical Service Rules, 2023;

(n)

"Select List" in relation to Senior Secretariat Assistant and Junior Secretariat Assistant means the

list prepared for promotion to the respective Grades to fill the existing and anticipated vacancies likely to

occur during the year and are decided to be filled by promotion.

(o)

"Staff Selection Commission" means the Staff Selection Commission set up by the Government;

(p)

'temporary officer' in relation to any Grade means a person holding a temporary or officiating

appointment in that Grade on the basis of his being, regularly approved for such appointment or an officer

appointed to a Grade who is yet to be removed from probation.

Composition of the Service.—

(1)

There shall be two Grades in the Service, namely:-

(a)

Senior Secretariat Assistant Grade including Senior Secretariat Assistant Non Functional

Selection Grade; and

(b)

Junior Secretariat Assistant Grade;

(2)

The posts in both the Grades shall be Non-Gazetted posts classified as Central Civil Service, Group

‘C’ Ministerial. The posts in both the Grades shall be non-selection posts.

Authorised Strength of the Service and its review-

(1)

The authorised strength of the Grades of the Service shall be as specified in the Second Schedule.

(2)

Notwithstanding anything contained in Sub-rule (1) the Central Government may :-

(a)

from time to time make temporary additions or alterations to the duty posts in various

Grades of the service;

(b)

any post in the Integrated Headquarters of the Ministry of Defence (Army, Navy and Air),

Defence Staff Headquarters and Inter Service Organisations may be encadred if the functions

attached to such posts are such as require, in the opinion of the cadre controlling authority, the

holder of the post to possess substantially the same qualifications, training and experience as those

necessary for the holders of duty posts in the Service or exclude from the service any duty post

already included in the Service.

Appointment to the Service.- Appointment to the Junior Secretariat Assistant Grade of the Service shall be

subject to following conditions :-

(1)

Such enquiry as may be considered necessary by the Central Government;

(2)

person is found to be free from any mental or physical defect, after such medical examination as the

Central Government may prescribe, which is likely to interfere with the discharge of the duties of the Service;

(3)

Disqualification.- No person.-

(a)

who has entered into or contracted a marriage with a person having a spouse living; or

(b)

who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to Service:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal

law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any

person from the operation of this rule.

Duty post to be held by Grade officer.- Every duty post shall, unless declared to be excluded from the

Service under rule 4 or held in abeyance for any reason, be held by any officer of the appropriate Grade.

Method of recruitment in the Service.-

(1) The posts of Service shall be filled as shown in the Third Schedule.

(2) If sufficient number of qualified candidates are not available for appointment to the Junior Secretariat

Assistant Grade on the results of competitive examinations held by the Staff Selection Commission, the

vacancies may be filled either provisionally or on a regular basis in such manner as may be decided by the

Central Government.

(3) There shall be reservation in filling up the vacancies in Junior Secretariat Assistant Grade and Senior

Secretariat Assistant Grade for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the

ex-servicemen and other special categories as the case may be in accordance with the orders issued by the

Central Government from time to time in this regard.

Compassionate appointments.- Notwithstanding anything contained in the Third Schedule, the appointing

authority may fill the vacancies in the Junior Secretariat Assistant Grade arising in a year, otherwise than as provided

for in these rules, by appointment of a son or daughter or wife or husband or brother or sister of a Government servant

who dies during the period of his service or is retired on medical grounds as per orders or instructions issued by the

Central Government.

Rules for competitive examination.- The rules for the competitive examinations including Limited

Departmental Competitive Examinations held by the Staff Selection Commission referred to in the Third Schedule

shall be as notified by the Central Government (Department of Personnel and Training in the Ministry of Personnel,

Public Grievances and Pensions) for the purpose from time to time.

10.

Probation.- (1) Every person recruited to the Junior Secretariat Assistant Grade of the Service through direct

recruitment mode shall initially be appointed on probation, the period of probation being two years from the date of

recruitment.

(2)

During probation, a member of the Service may be required to undergo such training and to pass

such tests as the Government may from time to time, prescribe.

(3)

Every person appointed to the Junior Secretariat Assistant Grade who does not pass such tests as

prescribed under sub-rule (2) shall continue to be on probation till he passes such tests or till he has been

specially exempted by the Government from passing such tests:

Provided that persons, against whom any departmental or legal proceedings are pending, shall continue to be

on probation.

(4)

The period of probation specified in sub-rule (1), may be extended or curtailed in any case, if the

appointing authority deems fit, but the total period of extension of probation shall not exceed two years or

double the normal period of extension as per the Central Government instructions issued from time to time

except as specified in sub-rule (3).

11.

Confirmation.- Persons appointed to the Junior Secretariat Assistant Grade shall, on completion of the

probation or any extension thereof, be confirmed in the Grade if considered fit and if not already confirmed in the

entry Grade.

12.

Discharge or reversion of persons on probation.-

(1)

An officer appointed to the Junior Secretariat Assistant of the Service who has no lien on any post

under the Central Government or any State Governments shall, while on probation, be liable to be discharged

from service at any time without notice, if-

(a)

on the basis of his performance or conduct during probation, he is considered unfit for

further retention in the Service; or

(b)

on the receipt of any information relating to his nationality, age, health educational

qualifications or antecedents, the appointing authority is satisfied that he is ineligible or otherwise

unfit for being a member of the Service.

(2)

An officer appointed to the Junior Secretariat Assistant Grade of the Service who holds a lien on a

post under the Central Government or any State Governments may, while on probation, be reverted to such

post at any time in any of the circumstances specified in sub-rule (1).

13.

Seniority.- (1) The seniority of the members of the Service on commencement of the Armed Forces

Headquarters Clerical Service Rules, 2023, shall be the seniority in their respective Grades as determined

before commencement of these rules:

Provided that if seniority of any member of the Service had not been specifically determined before

commencement of the Armed Forces Headquarters Clerical Service Rules, 2023, it shall be determined by

the Central Government in accordance with the then prevailing rules:

Provided further that where a judgment or direction has already been issued by a court or tribunal

with regard to refixation of seniority and related matters in the context of the rules subsisting earlier,

necessary action to complete the process already initiated or action as deem fit necessary shall be taken in

accordance with the rules subsisting prior to the commencement of these rules.

(2) The seniority of persons appointed to both the Grades of the Service after commencement of these rules

shall be determined in accordance with the general orders or instructions issued by the Central Government

from time to time.

(3) Relative seniority of direct recruits and promotees in the Grade of Junior Secretariat Assistant shall be

determined in accordance with the general orders or instructions issued by the Central Government from the

time to time.

14.

Level in pay matrix.- The level in the pay matrix attached to the Grades of Service shall be as follows,

namely:-

(1) Senior Secretariat Assistant in level-4 in the pay matrix (Rs. 25500-81100) and Senior Secretariat

Assistant (Non Functional Selection Grade) in level-6 in the pay matrix (Rs. 35400- 112400); and

(2) Junior Secretariat Assistant in level-2 in the pay matrix (Rs. 19900-63200).

15.

Regulation of level in pay matrix.- The level in the pay matrix and increments of officers of the Grades

shall be regulated in accordance with the Fundamental Rules or other rules in force relating to level in the pay matrix.

16.

Regulations.- The Central Government may make regulations not inconsistent with these rules to provide

for all matters for which provision is necessary or expedient for the purpose of giving effect to these rules.

17.

Residuary matters .- In regard to matters not specifically covered by these rules or by regulations or orders

made or issued thereunder, or by special orders, the members of the service shall be governed by the rules,

regulations, and orders applicable to the Civil Services in general.

18.

Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it

may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any

class or category of persons.

19.

Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions

required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-

Servicemen and other special categories of persons in accordance with the orders issued by the Central Government

from time to time in this regard.

20.

Interpretation.- If any question arises relating to the interpretation of these rules or the regulations made

thereunder it shall be referred to the Central Government for decision.

21.

Overriding effect of the rules. — Any rules or orders in force immediately before commencement of these

rules shall not apply to the extent they are inconsistent or repugnant to these rules.

22.

Composition of Departmental Promotion Committee.- The composition of the Departmental Promotion

Committee for the Service shall be as indicated in the Fourth Schedule.

appointment to that Grade, in the order of their

Seniority subject to rejection of the unfit:

Provided that any person appointed to

Junior Secretariat Assistant Grade of the

service shall be eligible for promotion to

Senior Secretariat Assistant Grade only if he

has successfully completed the probation and

has either passed the typing test, or has been

exempted in accordance with the prescribed

procedure, from passing it:

Provided further that where juniors who

have completed their qualifying or eligibility

service are being considered for promotion,

their seniors shall also be considered provided

they are not short of the requisite qualifying or

eligibility service by more than half of such

requisite qualifying or eligibility service or two

years whichever is less and have successfully

completed their probation and has either

passed the typing test or has been exempted in

accordance with the prescribed procedure,

from passing it.

(b) twenty-five per cent. of the vacancies shall

be filled from amongst persons of the Junior

Secretariat Assistant Grade selected on the

results of Limited Departmental Competitive

Examination held by the Staff Selection

Commission in the order of their merit.

Unfilled vacancies of this quota shall be

diverted to Seniority quota as specified in

clause (a) above.

Note : For the purpose of determining inter-se

seniority in the Senior Secretariat Assistant

Grade a select list shall be prepared every year

indicating the names of persons as per the

vacancies filled by including three persons

from the category (a) above followed by one

person from the category (b) and so on.

Non Functional Selection Grade on

shall be regulated according to the quotas fixed

िो और उन्िोंने अपने ऐसे कजनष्ठ व्यजियों सजित, जिन्िोंने ऐसी

अिाक या पात्रता सेवा पिले िी पूरी कर ली िै, अगली उच्चतर

श्रेणी में प्रोन्नजत के जलए अपनी पररवीक्षा की अवजि सफलतापूवाक

पूरी कर ली िो ।

रिप्पण 2: पोषक प्रवगा के ऐसे जवभागीय अजिकारी, िो प्रोन्नजत

की सीिी पंजि में िै, प्रजतजनयुजि पर जनयुजि के जलए जवचार

दकए िाने के पात्र निीं िोंगे । इसी प्रकार प्रजतजनयुि व्यजि

प्रोन्नजत द्वारा जनयुजि के जलए जवचार दकए िाने के पात्र निीं

िोंगे ।

रिप्पण 3: प्रजतजनयुजि की अवजि, जिसके अंतगात केंरीय सरकार

के उसी या दकसी अन्य संगठन या जवभाग में इस जनयुजि से ठीक

पिले िाररत दकसी अन्य काडर बाह्य पि पर प्रजतजनयुजि की

S.R.O. 82.— In exercise of the powers conferred by the proviso to Article 309 of the Constitution, and in

supersession of the Ministry of Defence, Defence Accounts Department (Private Secretary) Recruitment Rules, 2013

except as respects things done or omitted to be done before such supersession, the President hereby makes the

following rules regulating the method of recruitment for the post of Private Secretary in the Defence Accounts

Department namely: -

Short title and commencement: - (1) These rules may be called the Ministry of Defence, Defence Accounts

Department (Private Secretary) Recruitment Rules, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

Number of posts, classification and level of pay: -

The number of the said posts, its classification and level in the pay matrix thereto shall be as specified in

column (2) to (4) of the Schedule annexed to these rules.

Method of Recruitment, age limit, qualification etc.: -

The method of recruitment to the said post, age limit, qualifications and other matters connected therewith shall be as

specified in column 5 to 12 of the said Schedule.

Disqualifications: - No person,

(a) Who has entered into or contracted a marriage with a person having a spouse living; or

(b) Who, having a spouse living, has entered into or contracted a marriage with any person shall be eligible

Promotion:

Stenographer Grade-I in the pay level-06

with five years regular service in the grade;

and having successfully completed two

weeks training in relation to the duties of

higher post imparted at various Regional

Training Centers functioning under the

Deputation:

Officers holding the post of Stenographer

under the Central Government: (a) (i)

holding analogous post on regular basis in

the parent cadre or department; or (ii) with

five years’ service in the grade rendered

after appointment thereto on a regular basis

in posts in Level-6 ( Rs. 35,400 - 1,12,400 )

or equivalent in the parent cadre or

department.

Standard

Note1 :Where juniors who have completed

their qualifying or eligibility service are

being considered for promotion, their senior

would also be considered provided they are

not short of the requisite qualifying or

eligibility service by more than half of such

three years. The Maximum age limit for

appointment by deputation shall be Not

exceeding 56 years as on the last date of

receipt of applications.
