आ.अ. 142.—यतः, उत्तर प्रिेि राज्य की 346-मुबारकपुर जविान सभा क्षेत्र के सािारण जनवािचन 2022

अजिसूचना नं. 99/61-2022 दिनांक 10.02.2022 के िररए की गई थी।

यतः लोक प्रजतजनजित्व अजिजनयम, 1951 की िारा 78 के अनुसार, जनवािचन लड़ने वाले प्रत्येक अभ्यथी को,

जनवािजचत अभ्यथी के जनवािचन की तारीख से 30 दिनों के भीतर जनवािचन व्यय के अपने लेखे की सिी प्रजत जिला जनवािचन

अजिकारी को िाजखल करनी िोती िै; और

यतः 346-मुबारकपुर जविान सभा जनवािचन क्षेत्र के ररटर्निंग अजिकारी द्वारा उक्त जनवािचन का पररणाम

10 माचि, 2022 को घोजित दकया गया था। इस प्रकार, जनवािचन व्यय का लेखा िाजखल करने की अजन्तम तारीख

यतः, जिला जनवािचन अजिकारी, आिमगढ़, उत्तर प्रिेि के द्वारा प्रस्ट्तुत संवीक्षा ररपोटि और संयुक्त मुख्य जनवािचन

अजिकारी, उत्तर प्रिेि द्वारा पत्र सं. 287/जनवािचन व्यय सेल/जव0स0सा0जन0-2022/पत्रा0-01/2021 के िररए अग्रेजित

दिनांक 27/04/2022 की ररपोटि के अनुसार श्री नरेन्र ससंि चौिान िो उत्तर प्रिेि जविान सभा का सािारण जनवािचन

2022 के जनवािचन क्षेत्र 346-मुबारकपुर से लड़ने वाले अभ्यथी िैं, जवजि द्वारा यथापेजक्षत रीजत से अपने जनवािचन व्यय का

कोई भी लेखा िाजखल करने में जवफल रिे िैं; और,

यतः, जिला जनवािचन अजिकारी, आिमगढ़, उत्तर प्रिेि, और मुख्य जनवािचन अजिकारी, उत्तर प्रिेि की उक्त

ररपोटों के आिार पर भारत जनवािचन आयोग द्वारा जनवािचनों का संचालन जनयम 1961 के जनयम 89 के उप जनयम (5) के

अंतगित जनवािचन व्यय प्रस्ट्तुत निीं करने के जलए श्री नरेन्र ससंि चौिान को कारण बताओ नोरटस सं. 76/उत्तर प्रिेि-

जव.स./2022/सीईएमएस-III, दिनांक 13.12.2022 िारी दकया गया था; और

यतः, जनवािचनों का संचालन जनयम 1961 के जनयम 89 के उप-जनयम (6) के अनुसार, दिनांक 13.12.2022 के

उपयुिक्त कारण बताओ नोरटस के िररए श्री नरेन्र ससंि चौिान को जनिेि दिया गया था दक वे इस नोरटस के प्राप्त िोने के

20 दिनों के अंिर लेखा न प्रस्ट्तुत कर पाने के कारणों को स्ट्पष्ट करते हुए जलजखत रूप में अपना अभ्यावेिन प्रस्ट्तुत करें और

साथ िी, जनवािचन व्यय का अपना लेखा िाजखल करें; और

यतः, जिला जनवािचन अजिकारी, आिमगढ़ द्वारा अपने पत्र संख्या 831/जनवािचन-जन.व्यय लेखा/2023-24 के

िररए आयोग को सूचना िी गई की उक्त नोरटस अभ्यथी द्वारा दिनांक 16.01.2023 को प्राप्त दकया गया था; और,

यतः, जिला जनवािचन अजिकारी, आिमगढ़ द्वारा दिनांक 28.06.2023 के पत्र संख्या 857/जनवािचन-

आवंटन/2022-23 के िररए प्रस्ट्तुत की गई अनुपूरक संवीक्षा ररपोटि में यि बताया गया िै दक श्री नरेन्र ससंि चौिान ने न

तो कोई भी अभ्यावेिन और न िी अपने जनवािचन व्यय का लेखा िाजखल दकया िै। इसके अजतररक्त उन्िोंने भारत जनवािचन

आयोग का सम्यक् नोरटस जमलने के उपरांत उक्त जवफलता के जलए न तो कोई कारण बताया िै और न िी कोई स्ट्पष्टीकरण

दिया िै; और,

यतः, आयोग का यि समािान िो गया िै दक श्री नरेन्र ससंि चौिान जनवािचन खचों का लेखा िाजखल करने में

जवफल रिे िैं और उनके पास इस जवफलता के जलए कोई भी उजचतकारण अथवा औजचत्य निीं िै; और

यत:, लोक प्रजतजनजित्व अजिजनयम,1951 की िारा 10क में अनुबंजित दकया गया िै दक:-

"यदि जनवािचन आयोग का समािान िो िाता िै दक कोई व्यजक्त -

(क)

जनवािचन व्ययों का लेखा उस समय के भीतर और उस रीजत में िैसी इस अजिजनयम के द्वारा या अिीन अपेजक्षत

िै, िाजखल करने में असफल रिा िै; तथा

(ख)

उस असफलता के जलए कोई अच्छा कारण या न्यायोजचत्य निीं रखता िै, तो जनवािचन आयोग िासकीय रािपत्र

में प्रकाजित आिेि द्वारा उसको जनरर्िित घोजित करेगा और ऐसा व्यजक्त उस आिेि की तारीख से तीन विि की

कालावजि के जलए जनरर्िित िोगा।

अतः, अब लोक प्रजतजनजित्व अजिजनयम, 1951 की िारा 10क के अनुसरण में भारत जनवािचन आयोग एतद्द्वारा

घोिणा करता िै दक उत्तर प्रिेि राज्य के 346-मुबारकपुर जविान सभा जनवािचन क्षेत्र से उत्तर प्रिेि राज्य में जविान सभा

के सािारण जनवािचन, 2022 में जनवािचन लड़ने वाले अभ्यथी श्री नरेन्र ससंि चौिान जनवासी ग्राम – मुिम्मिपुर,

मु. सागापाली, पोस्ट्ट – िािीपुर बरेसर, जिला – गािीपुर को इस आिेि की तारीख से तीन विि की अवजि के जलए संसि

के दकसी भी सिन अथवा राज्य अथवा संघ राज्य-क्षेत्र की जविान सभा अथवा जविान पररिि् का सिस्ट्य चुने िाने अथवा

िोने के जलए जनरर्िित िै।

New Delhi, the 18th July, 2023

O.N. 142.—WHEREAS, the General Election to 346-Mubarakpur Legislative Assembly of Uttar Pradesh,

2022 was announced by Notification No. 99/61-2022 dated 10.02.2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at

an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account

of his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 346-Mubarakpur Assembly Constituency was

declared by the concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of

Election Expenses was 09^th April, 2022; and,

WHEREAS, as per the scrutiny report submitted by the District Election Officer, Azamgarh, Uttar Pradesh

and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan Vayy Cell/GE-

LA/2022/Patra-01/2021, dated 27^th April, 2021, Shri Narendra Singh Chauhan, a contesting candidate of

Uttar Pradesh from 346-Mubarakpur Assembly Constituency of Uttar Pradesh, has failed to lodge account of his

election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Azamgarh, Uttar Pradesh and the

Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP-LA/2022/CEMS-III dated 13.12.2022 was issued

under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to

Shri Narendra Singh Chauhan for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 13.12.2022, Shri Narendra Singh Chauhan was directed to submit his

representation in writing with explaining the reasons for not lodging the account and to lodge account of election

expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 16.01.2023. The acknowledgment receipt has

been submitted to the Commission by the District Election Officer, Azamgarh, vide its letter no. 831/निर्वाचि-नि.व्यय

लेखव/2023-24; and,

WHEREAS, the District Election Officer, Azamgarh in his Supplementary Report, vide its letter

857/निर्वाचि-आर्ंटि/2022-23 dt. 28.06.2023 has reported that Shri Narendra Singh Chauhan has neither submitted

any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the

Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Narendra Singh Chauhan has failed to lodge the

account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b)

has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Narendra Singh Chauhan resident of Village - Baisadiha, Post

– Mundwar, Tehsil – Phoolpur, Dist - Azamgarh a contesting candidate from 346-Mubarakpur Assembly

Constituency of the State of Uttar Pradesh in the General Election to the Legislative Assembly 2022 to be disqualified

for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the

Legislative Council of a State or Union Territory for a period of three years from the date of this order.

मुंडवर, तिसील – फूलपुर, जिला – आिमगढ़ को इस आिेि की तारीख से तीन विि की अवजि के जलए संसि के दकसी भी

सिन अथवा राज्य अथवा संघ राज्य-क्षेत्र की जविान सभा अथवा जविान पररिि् का सिस्ट्य चुने िाने अथवा िोने के जलए

जनरर्िित िै।

यतः, जिला जनवािचन अजिकारी,मेरठ, उत्तर प्रिेि के द्वारा प्रस्ट्तुत संवीक्षा ररपोटि दिनांक 08.04.2022 और

संयुक्त मुख्य जनवािचन अजिकारी, उत्तर प्रिेि द्वारा पत्र सं. 287/जनवािचन व्यय सेल/जव0स0सा0जन0-2022/पत्रा0-

01/2021 के िररए अग्रेजित दिनांक 27/04/2022 की ररपोटि के अनुसार श्री नसीम िो उत्तर प्रिेि जविान सभा का

सािारण जनवािचन 2022 के जनवािचन क्षेत्र 43-जसवालखास से लड़ने वाले अभ्यथी िैं, जवजि द्वारा यथापेजक्षत रीजत से

अपने जनवािचन व्यय का कोई भी लेखा िाजखल करने में जवफल रिे िैं; और,

यतः, जिला जनवािचन अजिकारी, मेरठ, उत्तर प्रिेि, और मुख्य जनवािचन अजिकारी, उत्तर प्रिेि की उक्त ररपोटों

के आिार पर भारत जनवािचन आयोग द्वारा जनवािचनों का संचालन जनयम 1961 के जनयम 89 के उप जनयम (5) के अंतगित

जनवािचन व्यय प्रस्ट्तुत निीं करने के जलए श्री नसीम को कारण बताओ नोरटस सं. 76/उत्तरप्रिेि/जव.स./2022/

सीईएमएस-III, दिनांक 02.03.2023 िारी दकया गया था; और

यतः, जनवािचनों का संचालन जनयम 1961 के जनयम 89 के उप-जनयम (6) के अनुसार, दिनांक 02.03.2023 के

उपयुिक्त कारण बताओ नोरटस के िररए श्री नसीम को जनिेि दिया गया था दक वे इस नोरटस के प्राप्त िोने के 20 दिनों के

अंिर लेखा न प्रस्ट्तुत कर पाने के कारणों को स्ट्पष्ट करते हुए जलजखत रूप में अपना अभ्यावेिन प्रस्ट्तुत करें और साथ िी,

जनवािचन व्यय का अपना लेखा िाजखल करें; और

यतः, जिला जनवािचन अजिकारी,मेरठ द्वारा अपने दिनांक 27.06.2023 के पत्र संख्या 503/29-1490 के िररए

आयोग को सूचना िी गई की उक्त नोरटस अभ्यथी के पुत्र श्री सुऐब द्वारा दिनांक 28.04.2023 को प्राप्त दकया गया था;

और,

यतः, जिला जनवािचन अजिकारी,मेरठ द्वारा दिनांक 28.07.2023 के पत्र संख्या 585/29-1490 के िररए प्रस्ट्तुत

की गई अनुपूरक संवीक्षा ररपोटि में यि बताया गया िै दक श्री नसीम ने न तो कोई भी अभ्यावेिन और न िी अपने

जनवािचन व्यय का लेखा िाजखल दकया िै। इसके अजतररक्त उन्िोंने भारत जनवािचन आयोग का सम्यक् नोरटस जमलने के

उपरांत उक्त जवफलता के जलए न तो कोई कारण बताया िै और न िी कोई स्ट्पष्टीकरण दिया िै; और,

यतः, आयोग का यि समािान िो गया िै दक श्री नसीम जनवािचन खचों का लेखा िाजखल करने में जवफल रिे िैं

और उनके पास इस जवफलता के जलए कोई भी उजचत कारण अथवा औजचत्य निीं िै; और

यत:, लोक प्रजतजनजित्व अजिजनयम,1951 की िारा 10क में अनुबंजित दकया गया िै दक:-

"यदि जनवािचन आयोग का समािान िो िाता िै दक कोई व्यजक्त -

(क)

जनवािचन व्ययों का लेखा उस समय के भीतर और उस रीजत में िैसी इस अजिजनयम के द्वारा या अिीन

अपेजक्षत िै, िाजखल करने में असफल रिा िै; तथा

(ख)

उस असफलता के जलए कोई अच्छा कारण या न्यायोजचत्य निीं रखता िै, तो जनवािचन आयोग िासकीय

रािपत्र में प्रकाजित आिेि द्वारा उसको जनरर्िित घोजित करेगा और ऐसा व्यजक्त उस आिेि की तारीख से तीन

विि की कालावजि के जलए जनरर्िित िोगा।

अतः, अब लोक प्रजतजनजित्व अजिजनयम, 1951 की िारा 10क के अनुसरण में भारत जनवािचन आयोग एतद्द्वारा

घोिणा करता िै दक उत्तर प्रिेि राज्य के 43-जसवालखास जविान सभा जनवािचन क्षेत्र से उत्तर प्रिेि राज्य में जविान सभा

के सािारण जनवािचन, 2022 में जनवािचन लड़ने वाले अभ्यथी श्री नसीम जनवासी ग्राम व पोस्ट्ट – िसड सुल्तानपुर,

जवकास खण्ड – सरूरपुर,तिसील सरिना, मेरठ, को इस आिेि की तारीख से तीन विि की अवजि के जलए संसि के दकसी

O.N. 144.—WHEREAS, the General Election to 43- Sivalkhas Legislative Assembly of Uttar Pradesh,

2022 was conducting Notification No. 28/61-2022 dated 14^th January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at

an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account

of his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 43- Sivalkhas Assembly Constituency was declared

by the concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of Election

Expenses was 09^th April, 2022; and,

WHEREAS, as per the scrutiny report dt. 08.04.2022 submitted by the District Election Officer, Meerut,

Uttar Pradesh and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan

Vayy Cell/GE-LA/2022/Patra-01/2021, dated 27^th April, 2021, Shri Nasim, a contesting candidate of Uttar Pradesh

from 43- Sivalkhas Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in

the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Meerut, Uttar Pradesh and the

Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP/LA/2022/CEMS-III dated 02.03.2023 was issued

under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri

Nasim for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 02.03.2023, Shri Nasim was directed to submit his representation in writing with

explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the

date of receipt of the notice; and,

WHEREAS, the said notice was received by his son Shri Suheb on 28.04.2023. The acknowledgment

receipt has been submitted to the Commission by the District Election Officer, Meerut, vide its letter no.503/29-1490

dt. 27.06.2023; and,

WHEREAS, the District Election Officer, Meerut in his Supplementary Report, vide its letter 585/29-1490

dt. 28.07.2023 has reported that Shri Nasim has neither submitted any representation nor any statement of account of

election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished

neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Nasim has failed to lodge the account of election expenses

and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b)

has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Nasim resident of Village - Jasad Sultanpur, Tehsil-Sardhana,

Meerut, a contesting candidate from 43- Sivalkhas Assembly Constituency of the State of Uttar Pradesh in the

General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being a member of

either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory

for a period of three years from the date of this order.

आ.अ. 145.—यतः, उत्तर प्रिेि राज्य की 46-दकठौर जविान सभा क्षेत्र के सािारण जनवािचन 2022 अजिसूचना

नं. 28/61-2022 दिनांक 14.01.2022 के िररए की गई थी।

यतः लोक प्रजतजनजित्व अजिजनयम, 1951 की िारा 78 के अनुसार, जनवािचन लड़ने वाले प्रत्येक अभ्यथी को,

2022 को घोजित दकया गया था। इस प्रकार, जनवािचन व्यय का लेखा िाजखल करने की अजन्तम तारीख 09 अप्रैल, 2022

थी; और

यतः, जिला जनवािचन अजिकारी,मेरठ, उत्तर प्रिेि के द्वारा प्रस्ट्तुत संवीक्षा ररपोटि दिनांक 08.04.2022 और

was conducting Notification No. 28/61-2022 dated 14^th January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at

an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account

of his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 46- Kithore Assembly Constituency was declared by

the concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of Election

Expenses was 09^th April, 2022; and,

Vayy Cell/GE-LA/2022/Patra-01/2021, dated 27^th April, 2021, Shri Zaid, a contesting candidate of Uttar Pradesh

from 46- Kithore Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in

the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Meerut, Uttar Pradesh and the

Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP/LA/2022/CEMS-III dated 02.03.2023 was issued

under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri

Zaid for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 02.03.2023, Shri Zaid was directed to submit his representation in writing with

explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the

date of receipt of the notice; and,

WHEREAS, the said notice was pasted at the address given by the candidate on 02.05.2023. The

acknowledgment receipt has been submitted to the Commission by the District Election Officer, Meerut, vide its

letter no.503/29-1490 dt. 27.06.2023; and,

WHEREAS, the District Election Officer, Meerut in his Supplementary Report, vide its letter 585/29-

1490 dt. 28.07.2023 has reported that Shri Zaid has neither submitted any representation nor any statement of

account of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has

furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Zaid has failed to lodge the account of election expenses

and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b)

has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Zaid resident of H.No. 34, Ward No.1,Mohalla Harijano

Wala, Kithore, Meerutt, a contesting candidate from 46- Kithore Assembly Constituency of the State of Uttar

Pradesh in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for being

a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or

Elections Rules, 1961 by the Election Commission of India to Sh. Alimamad Ishak Palani, for not lodging of

account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of

Elections Rules, 1961, Sh. Alimamad Ishak Palani, was directed to submit his representation in writing to the

Commission explaining the reason for not lodging the account and also to lodge account of election expenses with the

District Election Officer, Jamnagar within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Jamnagar vide his letter no.EMC/Jam/GJ-LAE-22/Candidate ECI

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at

an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election

Officer, an account of his election expenses which shall be true copy of the account kept by him or his election agent

under Section 77 of the said act; and

WHEREAS, the result of the election for 80-Jamjodhpur Assembly Constituency of Gujarat, was declared

by the Returning Officer on 8^th December, 2022 and hence the last date for lodging the account of Election Expenses

was 7^th January, 2023; and

WHEREAS, as per the report submitted by the District Election Officer, Jamnagar and forwarded by the

Chief Electoral Officer, Gujarat vide their letter no. ELC/2922/LA-37/CHH(Exp. Cell) dated 30.01.2023, Sh. Juneja

Sabbirbhai Ibrahimbhai, a contesting candidate from 80-Jamjodhpur Assembly Constituency of Gujarat, 2022, has

failed to lodge account of his election expenses, as required under law; and

WHEREAS, on the basis of the said reports of the District Election Officer, a Show-Cause notice No.

76/GJ-LA/12(80)/2023/CEMS-IV, dated 09.06.2023 was issued under sub rule (5) of Rule 89 of the Conduct of

Elections Rules, 1961 by the Election Commission of India to Sh. Juneja Sabbirbhai Ibrahimbhai, for not lodging

of account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of

Elections Rules, 1961, Sh. Juneja Sabbirbhai Ibrahimbhai, was directed to submit representation in writing to the

Commission explaining the reason for not lodging the account and also to lodge account of election expenses with the

District Election Officer, Jamnagar within 20 days from the date of receipt of the notice; and

WHEREAS, the District Election Officer, Jamnagar vide his letter no. EMC/Jam/GJ-LAE-22/Candidate

ECI Notice/80/2023 dated 11.07.2023 has informed that the said notice was received by the candidate on 20.06.2023;

and

WHEREAS, the District Election Officer, Jamnagar in his supplementary report dated 11.07.2023

forwarded by the Chief Electoral Officer, Gujarat, vide letter no. ELC/2922/AC-80/CHH(Exp. Cell) dated 21.07.2023

has reported that Sh. Juneja Sabbirbhai Ibrahimbhai has neither submitted any representation nor any statement of

account of election expenses even after receipt of the Show Cause Notice dated 09.06.2023 of the Election

Commission of India; and

WHEREAS, after receipt of the said notice, Sh. Juneja Sabbirbhai Ibrahimbhai has neither furnished any

reason nor any explanation to the Election Commission of India, for failure to lodge the account of election expenses

as prescribed under law; and

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Juneja

Sabbirbhai Ibrahimbhai has failed to lodge account of election expenses and has not furnished any reason or

justification for the failure to do so; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

यतः, जिला जनवािचन अजिकारी, मेरठ, उत्तर प्रिेि, और मुख्य जनवािचन अजिकारी, उत्तर प्रिेि की उक्त ररपोटों

के आिार पर भारत जनवािचन आयोग द्वारा जनवािचनों का संचालन जनयम 1961 केजनयम 89 के उप जनयम (5) के अंतगित

जनवािचन व्यय प्रस्ट्तुत निीं करने के जलए श्री भूपेन्र ससंि को कारण बताओ नोरटस सं. 76/उत्तरप्रिेि-

यतः, जनवािचनों का संचालन जनयम 1961 के जनयम 89 के उप-जनयम (6) के अनुसार, दिनांक 02.03.2023 के

उपयुिक्त कारण बताओ नोरटस के िररए श्री भूपेन्र ससंि को जनिेि दिया गया था दक वे इस नोरटस के प्राप्त िोने के 20 दिनों

के अंिर लेखा न प्रस्ट्तुत कर पाने के कारणों को स्ट्पष्ट करते हुए जलजखत रूप में अपना अभ्यावेिन प्रस्ट्तुत करें और साथ िी,

यतः, आयोग का यि समािान िो गया िै दक श्री भूपेन्र ससंि जनवािचन खचोंका लेखा िाजखल करने में जवफल रिे

िैं और उनके पास इस जवफलता के जलए कोई भी उजचतकारण अथवा औजचत्य निीं िै; और

Chief Electoral Officer, Uttar Pradesh, a Show-Cause notice, 76/UP/LA/2022/CEMS-III dated 02.03.2023 was issued

under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Shri

Bhupendra Singh for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 02.03.2023, Shri Bhupendra Singh was directed to submit his representation in

WHEREAS, the said notice was pasted at the address given by the candidate in the presence of 2 local

residencies on 19.07.2023. The acknowledgment receipt has been submitted to the Commission by the District

Election Officer, Meerut, vide its letter no.650/29-1490 dt. 16.08.2023; and,

WHEREAS, the District Election Officer, Meerut in his Supplementary Report, vide its letter 650/29-

1490 dt. 16.08.2023 has reported that Shri Bhupendra Singh has neither submitted any representation nor any

statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of

India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Bhupendra Singh has failed to lodge the account of

election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses, within the time and in the manner required by or

under this Act, and

(b)

has no good reason or justification for the failure, the Election Commission shall, by order published in

the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period

of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Bhupendra Singh resident of Village - Baafar, Tehsil and

Dist.-Meerut, a contesting candidate from 43- Sivalkhas Assembly Constituency of the State of Uttar Pradesh in the

यतः, 82-द्वारका जविान सभा जनवािचन क्षेत्र के जनवािचन पररणाम ररटर्निंग अजिकारी द्वारा 08 दिसम्बर, 2022

को घोजित दकया गया था और इस प्रकार जनवािचन व्यय के लेखे िाजखल करने की अजन्तम तारीख 07 िनवरी, 2023 थी;

और

यतः, जिला जनवािचन अजिकारी, िेवभूजम द्वारका के द्वारा प्रस्ट्तुत और मुख्य जनवािचन अजिकारी, गुिरात द्वारा

पत्र सं .ELC/2922/LA-37/CHH (Exp. Cell) दिनांक 30 िनवरी, 2023 के िररए अग्रेजित की गई ररपोटि के अनुसार

31 अगस्ट्त, 2023 और ई-मेल दिनांक 22.09.2023 के माध्यम से सूजचत दकया िै दक उक्त नोरटस उम्मीिवार को

04.07.2023 को प्राप्त हुआ िै; और

यत :, जिला जनवािचन अजिकारी ,िेवभूजम द्वारका, द्वारा अपनी अनुपूरक ररपोटि दिनांक 17.08.2023 िो मुख्य

जनवािचन अजिकारी, गुिरात पत्र सं0 ELC/2922/AC-82/CHH (Exp. Cell) दिनांक 31 अगस्ट्त, 2023 के द्वारा

अग्रेजित कर भेिी गई ररपोटि में यि बताया गया िै दक श्री दकिोर खीमाभाई चावड़ा ,ने भारत जनवािचन आयोग के दिनांक

09.06.2023 के कारण बताओ नोरटस की प्राजप्त के बाि भी न तो कोई अभ्यावेिन और न िी अपने जनवािचन व्यय के खाते

का कोई जववरण प्रस्ट्तुत दकया िै; और

यत :, उक्त नोरटस प्राप्त िोने के बाि, श्री दकिोर खीमाभाई चावड़ा ने कानून के तित जनिािररत खाते को ििि करने

में जवफलता के जलए भारत के चुनाव आयोग को न तो कोई कारण और न िी कोई स्ट्पष्टीकरण प्रस्ट्तुत दकया िै; और
