आ.अ. 162.—यतः, उत्तराखण्ड राज्य की 49-सल्ट जविान सभा क्षेत्र के सािारण जनवााचन, 2022 अजिसूचना

नं. 464/उत्तरा0-जव0स0/2022 दिनांक 21.01.2022 के िररए की गई थी।

यतःलोक प्रजतजनजित्व अजिजनयम, 1951 की िारा 78 के अनुसार, जनवााचन लड़ने वाले प्रत्येक अभ्यथी को,

जनवााजचत अभ्यथी के जनवााचन की तारीख से 30 दिनों के भीतर जनवााचन व्यय के अपने लेखे की सिी प्रजत जिला जनवााचन

अजिकारी को िाजखल करनी िोती िै; और

यतः 49-सल्ट जविान सभा जनवााचन क्षेत्र के ररटर्निंग अजिकारी द्वारा उक्त जनवााचन का पररणाम10माचा, 2022

को घोजषत दकया गया था। इस प्रकार, जनवााचन व्यय का लेखा िाजखल करने की अजन्तम तारीख 09 अप्रैल, 2022 थी; और

यतः, जिला जनवााचन अजिकारी, अल्मोङा, उत्तराखण्ड के द्वारा प्रस्ट्तुत और मुख्य जनवााचन अजिकारी, उत्तराखण्ड

द्वारा पत्र सं. 2782/XXV-53/2022 िेिरािून के िररए अग्रेजषत दिनांक 22/04/2022 की ररपोटा के अनुसार श्री भोले

िंकर आयाा (एडवोकेट) िो उत्तराखण्ड जविान सभा का सािारण जनवााचन 2022 के जनवााचन क्षेत्र 49-सल्ट से लड़ने वाले

अभ्यथी िैं, जवजि द्वारा यथापेजक्षत रीजत से अपने जनवााचन व्यय का कोई भी लेखा िाजखल करने में जवफल रिे िैं; और,

यतः, जिला जनवााचन अजिकारी, अल्मोङा, उत्तराखण्ड, और मुख्य जनवााचन अजिकारी, उत्तराखण्ड की उक्त

ररपोटों के आिार पर भारत जनवााचन आयोग द्वारा जनवााचनों का संचालन जनयम 1961 के जनयम 89 के उप जनयम (5) के

अंतगात जनवााचन व्यय प्रस्ट्तुत निीं करने के जलए श्री भोले िंकर आयाा (एडवोकेट) को कारण बताओ नोरटस

सं. 76/उत्तराखण्ड-जव.स./49/2022/सी.ई.एम.एस.-III, दिनांक 20 अक्टूबर, 2022 िारी दकया गया था; और

यतः, जनवााचनों का संचालन जनयम 1961 के जनयम 89 के उप-जनयम (6) के अनुसार, दिनांक 20 अक्टूबर,

2022 के उपयुाक्त कारण बताओ नोरटस के िररए श्री भोले िंकर आयाा (एडवोकेट) को जनिेि दिया गया था दक वे इस

नोरटस के प्राप्त िोने के 20 दिनों के अंिर लेखा न प्रस्ट्तुत कर पाने के कारणों को स्ट्पष्ट करते हुए जलजखत रूप में अपना

अभ्यावेिन प्रस्ट्तुत करें और साथ िी, जनवााचन व्यय का अपना लेखा िाजखल करें; और

यतः, जिला जनवााचन अजिकारी, अल्मोङा द्वारा अपने दिनांक 16.02.2023 के पत्र संख्या 88/29-जनवााचन व्यय

लेखा (जव0स0सा0जन0-2022) के िररए आयोग को सूचना िी गई की उक्त नोरटस अभ्यथी द्वारा दिनांक 17.11.2022 को

प्राप्त दकया गया था; और,

यतः, जिला जनवााचन अजिकारी, अल्मोङा द्वारा दिनांक 16.02.2023 के पत्र संख्या 88/29-जनवााचन व्यय लेखा

(जव0स0सा0जन0-2022) के िररए प्रस्ट्तुत की गई अनुपूरक संवीक्षा ररपोटा दिनांक 15.02.2023 में यि बताया गया िै दक

श्री भोले िंकर आयाा (एडवोकेट) ने न तो कोई भी अभ्यावेिन और न िी अपने जनवााचन व्यय का लेखा िाजखल दकया िै।

इसके अजतररक्त उन्िोंने भारत जनवााचन आयोग का सम्यक् नोरटस जमलने के उपरांत भी उक्त जवफलता के जलए न तो कोई

कारण बताया िै और न िी कोई स्ट्पष्टीकरण दिया िै;और,

यतः, आयोग का यि समािान िो गया िै दक श्री भोले िंकर आयाा (एडवोकेट) जनवााचन खचों का लेखा िाजखल

करने में जवफल रिे िैं और उनके पास इस जवफलता के जलए कोई भी उजचत कारण अथवा औजचत्य निीं िै; और

यत:, लोक प्रजतजनजित्व अजिजनयम,1951 की िारा 10क में अनुबंजित दकया गया िै दक:-

"यदि जनवााचन आयोग का समािान िो िाता िै दक कोई व्यजक्त -

(क)

जनवााचन व्ययों का लेखा उस समय के भीतर और उस रीजत में िैसी इस अजिजनयम के द्वारा या अिीन अपेजक्षत िै,

िाजखल करने में असफल रिा िै; तथा

(ख)

उस असफलता के जलए कोई अच्छा कारण या न्यायोजचत्य निीं रखता िै, तो जनवााचन आयोग िासकीय रािपत्र

में प्रकाजित आिेि द्वारा उसको जनरर्िात घोजषत करेगा और ऐसा व्यजक्त उस आिेि की तारीख से तीन वषा की

कालावजि के जलए जनरर्िात िोगा;

अतः, अब लोक प्रजतजनजित्व अजिजनयम, 1951 की िारा 10क के अनुसरण में भारत जनवााचन आयोग एतद्द्वारा

घोषणा करता िै दक उत्तराखण्ड राज्य के 49-सल्ट जविान सभा जनवााचन क्षेत्र से उत्तराखण्ड राज्य में जविान सभा के

सािारण जनवााचन, 2022 में जनवााचन लड़ने वाले अभ्यथी श्री भोले िंकर आयाा (एडवोकेट) जनवासी पुत्र श्री सािो राम

आयाा, ग्राम-नैकणा, पोस्ट्ट ऑदफस-पैजसया, तिसील-सल्ट, जिला-अल्मोड़ा, को इस आिेि की तारीख से तीन वषा की अवजि

के जलए संसि के दकसी भी सिन अथवा राज्य अथवा संघ राज्य-क्षेत्र की जविान सभा अथवा जविान पररषि् का सिस्ट्य चुने

िाने अथवा िोने के जलए जनरर्िात िै।

ORDER

New Delhi, the 23rd March, 2023

O.N. 162.—WHEREAS, the General Election to 49-Salt Legislative Assembly of Uttarakhand, 2022 was

held vide Notification No. 464/ Uttarakhand - LA /2022 dated 21^st January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of

his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 49-Salt Assembly Constituency was declared by the

concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of Election Expenses

was 09^thApril, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Almora, Uttarakhand and

forwarded by the Chief Electoral Officer, Uttarakhand vide their letter No. 2782/XXV-53/2022, dated 22^th April,

2021, Sh. Bhole Shankar Arya (Advocate), a contesting candidate of Uttarakhand from 49-Salt Assembly

Constituency of Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under

law; and,

WHEREAS, on the basis of the reports of the District Election Officer Almora, Uttarakhand and the Chief

Electoral Officer, Uttarakhand, a Show-Cause notice, 76/ Uttarakhand -LA /2022/49/CEMS-III dated 20.10.2022

was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India

to Sh. Bhole Shankar Arya (Advocate) for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 20.10.2022, Sh. Bhole Shankar Arya (Advocate) was directed to submit his

representation in writing with explaining the reasons for not lodging the account and to lodge account of election

expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 17.11.2022. The acknowledgment receipt has

been submitted to the Commission by the District Election Officer, Almora, vide its letter No. पत्र संख्या 88/29-

जनवााचन व्यय लेखा (जव0स0सा0जन0-2022) dated 16.02.2023; and,

WHEREAS, the District Election Officer, Almora in his Supplementary Report date 15.02.2023 vide its

letter No. 16.02.2023 के पत्र संख्या 88/29-जनवााचन व्यय लेखा (जव0स0सा0जन0-2022) has reported that Sh. Bhole Shankar

Arya (Advocate) has neither submitted any representation nor any statement of account of election expenses. Further,

after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor

explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Sh. Bhole Shankar Arya (Advocate) has failed to lodge the

account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required

under this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be

disqualified and any such person shall be disqualified for a period of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Sh. Bhole Shankar Arya (Advocate) resident of S/O Sadho Ram

Arya, Village- Naikana, Post Office- Pesiya, Tehsil- Salt, District- Almora, a contesting candidate from 49-Salt

Assembly Constituency of the State of Uttarakhand in the General Election to the Legislative Assembly 2022 to be

disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative

Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this

order.

श्री लजलत मोिन ससंि ने न तो कोई भी अभ्यावेिन और न िी अपने जनवााचन व्यय का लेखा िाजखल दकया िै। इसके

O.N. 164.—WHEREAS, the General Election to 49-Salt Legislative Assembly of Uttarakhand, 2022 was

held vide Notification No. 464/ Uttarakhand - LA /2022 dated 21^st January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of

his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 49-Salt Assembly Constituency was declared by the

concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of Election Expenses

was 09^thApril, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Almora, Uttarakhand and

forwarded by the Chief Electoral Officer, Uttarakhand vide their letter No. 2782/XXV-53/2022, dated 22^th April,

2021, Sh. Rakesh Nath, a contesting candidate of Uttarakhand from 49-Salt Assembly Constituency of

Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Officer Almora, Uttarakhand and the Chief

Electoral Officer, Uttarakhand, a Show-Cause notice, 76/ Uttarakhand -LA /2022/49/CEMS-III dated 20.10.2022

was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India

to Sh. Rakesh Nath, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 20.10.2022, Sh. Rakesh Nath, was directed to submit his representation in writing

with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from

the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 28.11.2022. The acknowledgment receipt has

been submitted to the Commission by the District Election Officer, Almora, vide its letter No. पत्र संख्या 88/29-

WHEREAS, the District Election Officer, Almora, in his Supplementary Report date 15.02.2023 forward

vide its letter No. 16.02.2023 के पत्र संख्या 88/29-जनवााचन व्यय लेखा (जव0स0सा0जन0-2022) has reported that Sh. Rakesh

Nath, has neither submitted any representation nor any statement of account of election expenses. Further, after

receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for

the said failure; and,

WHEREAS, the Commission is satisfied that Sh. Rakesh Nath has failed to lodge the account of election

expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses, within the time and in the manner required by or under this

Act, and

(b)

has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Sh. Rakesh Nath resident of S/O Paan Singh, Village-Gangaura,

Post Office- Dabhara, Tehsil- Bhikiyasain, District- Almora, a contesting candidate from 49-Salt Assembly

Constituency of the State of Uttarakhand in the General Election to the Legislative Assembly 2022 to be disqualified

to Sajid Ali, for not lodging the account of Election Expenses; and,

O.N. 167.—WHEREAS, the General Election to 37-Pauri (SC) Legislative Assembly of Uttarakhand, 2022

was held vide Notification No. 464/Uttarakhand -LA/2022 dated 21^st January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of

his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 37-Pauri (SC) Assembly Constituency was declared by

the concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of Election

Expenses was 09^thApril, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Pauri Garhwal, Uttarakhand and

forwarded by the Chief Electoral Officer, Uttarakhand vide their letter No. 2782/XXV-53/2022, dated 22^th April,

2021, Sh. Hari Kumar, a contesting candidate of Uttarakhand from 37-Pauri (SC) Assembly Constituency of

Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Officer Pauri Garhwal, Uttarakhand and

the Chief Electoral Officer, Uttarakhand, a Show-Cause notice, 76/Uttarakhand -LA/2022/37/CEMS-III dated

20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election

Commission of India to Sh. Hari Kumar, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 20.10.2022, Sh. Hari Kumar, was directed to submit his representation in writing

with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from

the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate’s brother Sh. Ganesh Lal, on 07.11.2022. The

acknowledgment receipt has been submitted to the Commission by the District Election Officer, Parui Garhwal, vide

its letter 1662/29-E.E/2022 dated 29.11.2022; forwarded by Chief Electoral Officer, Uttarakhand, letter

no.891/XXV-22(II)/2008 date15.06.2023; and,

WHEREAS, the District Election Officer, Pauri Garhwal, in his Supplementary Report vide its letter

No. 1662/29-E.E/2022 dated 29.11.2022; forwarded by Chief Electoral Officer, Uttarakhand, letter no. 891/XXV-

22(II)/2008 dated 15.06.2023 and District Election Officer, Pauri Garhwal letter No. 497/29-EE/2022 dated

27.06.2023 has reported that Sh. Hari Kumar has neither submitted any representation nor any statement of account

of election expenses. Further, after receipt of the due notice of the Election Commission of India, he has furnished

neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Sh. Hari Kumar, has failed to lodge the account of election

expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Sh. Hari Kumar resident of Village- Singori, P.O. Singori Patti

Katulsyun, Tehsil- Srinagar District- Pauri Garhwal, a contesting candidate from 37-Pauri (SC) Assembly

Constituency of the State of Uttarakhand in the General Election to the Legislative Assembly 2022 to be disqualified

for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the

Legislative Council of a State or Union Territory for a period of three years from the date of this order.

Election Commission of India hereby declares Shahban resident of Sikandarpur Village- Imlikhera Dharmpur,

Tehsil- Roorkee, District- Haridwar, a contesting candidate from 30-Piran Kaliyar Assembly Constituency of the

State of Uttarakhand in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as

and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a

State or Union Territory for a period of three years from the date of this order.

कुमार, िो उत्तराखण्ड जविान सभा का सािारण जनवााचन 2022 के जनवााचन क्षेत्र 26-बी.एच.ई.एल. रानीपुर से लड़ने

अंतगात जनवााचन व्यय प्रस्ट्तुत निीं करने के जलए श्री अिय कुमार, को कारण बताओ नोरटस सं. 76/उत्तराखण्ड-

जव.स./26/2022/सी.ई.एम.एस.-III, दिनांक 20 अक्टूबर, 2022 िारी दकया गया था; और

2022 के उपयुाक्त कारण बताओ नोरटस के िररए श्री अिय कुमार, को जनिेि दिया गया था दक वे इस नोरटस के प्राप्त िोने

और साथ िी, जनवााचन व्यय का अपना लेखा िाजखल करें; और

दिनांक 12.04.2023 िो मुख्य जनवााचन अजिकारी के पत्र सं0 891/XXV-22(II)/2008 दिनांक15.06.2023 के द्वारा

अग्रेजषत कर आयोग को सूचना िी गई दक उक्त नोरटस अभ्यथी की पत्नी श्रीमती ररचा चौिान, द्वारा दिनांक 03.11.2022

को प्राप्त दकया गया था; और,

दिनांक 12.04.2023 िो मुख्य जनवााचन अजिकारी पत्र सं0 891/XXV-22(II)/2008 दिनांक15.06.2023 के द्वारा

अग्रेजषत कर भेिी गई अनुपूरक ररपोटा दिनांक 11.04.2023 में यि बताया गया िै दक श्री अिय कुमार, ने न तो कोई भी

O.N. 170.—WHEREAS, the General Election to 26-B.H.E.L Ranipur Legislative Assembly of Uttarakhand,

2022 was held vide Notification No. 464/Uttarakhand -LA/2022 dated 21^st January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of

his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 26-B.H.E.L Ranipur Assembly Constituency was

declared by the concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of

Election Expenses was 09^thApril, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Haridwar, Uttarakhand and

forwarded by the Chief Electoral Officer, Uttarakhand vide their letter No. 2782/XXV-53/2022, dated 22^th April,

2021, Sh. Ajay Kumar, a contesting candidate of Uttarakhand from 26-B.H.E.L Ranipur Assembly Constituency

of Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Officer Haridwar, Uttarakhand and the

Chief Electoral Officer, Uttarakhand, a Show-Cause notice,76/Uttarakhand -LA/2022/26/CEMS-III dated

20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election

Commission of India to Sh. Ajay Kumar, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 20.10.2022, Sh. Ajay Kumar, was directed to submit his representation in writing

with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from

the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate’s wife Smt. Richa Chauhan on 03.11.2022. The

acknowledgment receipt has been submitted to the Commission by the District Election Officer, Haridwar, vide its

letter No.347/29-40-(जनवाा0 व्यय लेखा)/2022 dated 12.04.2023; forwarded by Chief Electoral Officer, Uttarakhand,

letter vide no.891/XXV-22(II)/2008 dated 15.06.2023; and,

WHEREAS, the District Election Officer, Haridwar, in his Supplementary Report dated 11.04.2023 vide its

letter No. 347/29-40-(जनवाा0 व्यय लेखा)/2022 dated 12.04.2023 forwarded by Chief Electoral Officer, Uttarakhand,

letter no. 891/XXV-22(II)/2008 dated 15.06.2023 has reported that Sh. Ajay Kumar has neither submitted any

representation nor any statement of account of election expenses. Further, after receipt of the due notice of the

Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Sh. Ajay Kumar, has failed to lodge the account of election

expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

acknowledgment receipt has been submitted to the Commission by the District Election Officer, Haridwar, vide its

Election Commission of India, he has furnished neither any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Shri Gulbahar, has failed to lodge the account of election

expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act, and

(b) has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

any such person shall be disqualified for a period of three years from the date of the order”;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Gulbahar, Village- Iqbalpur Kamelpur, P.O. Salempur

Rajputan, Tehsil- Roorkee a contesting candidate from 31-Roorkee Assembly Constituency of the State of

Uttarakhand in the General Election to the Legislative Assembly 2022 to be disqualified for being chosen as and for

being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or

Union Territory for a period of three years from the date of this order.

अजिकारी को िाजखल करनी िोती िै; और

यतः 45-गंगोलीिाट (अ0िा0) जविान सभा जनवााचन क्षेत्र के ररटर्निंग अजिकारी द्वारा उक्त जनवााचन का

पररणाम10 माचा, 2022 को घोजषत दकया गया था। इस प्रकार, जनवााचन व्यय का लेखा िाजखल करने की अजन्तम तारीख

09 अप्रैल, 2022 थी; और

यतः, जिला जनवााचन अजिकारी, जपथौरागढ़, उत्तराखण्ड के द्वारा प्रस्ट्तुत और मुख्य जनवााचन अजिकारी,

उत्तराखण्ड द्वारा पत्र सं. 2782/XXV-53/2022 िेिरािून के िररए अग्रेजषत दिनांक 22/04/2022 की ररपोटा के अनुसार

श्रीमती रेखा, िो उत्तराखण्ड जविान सभा का सािारण जनवााचन 2022 के जनवााचन क्षेत्र 45-गंगोलीिाट (अ0िा0) से

लड़ने वाले अभ्यथी िैं, जवजि द्वारा यथापेजक्षत रीजत से अपने जनवााचन व्यय का कोई भी लेखा िाजखल करने में जवफल रिे

िैं; और,

यतः, जिला जनवााचन अजिकारी, जपथौरागढ़, उत्तराखण्ड, और मुख्य जनवााचन अजिकारी, उत्तराखण्ड की उक्त

ररपोटों के आिार पर भारत जनवााचन आयोग द्वारा जनवााचनों का संचालन जनयम 1961 केजनयम 89 के उप जनयम (5) के

अंतगात जनवााचन व्यय प्रस्ट्तुत निीं करने के जलए श्रीमती रेखा, को कारण बताओ नोरटस सं. 76/उत्तराखण्ड-

जव.स./45/2022/सी.ई.एम.एस.-III, दिनांक 20 अक् तूबर, 2022 िारी दकया गया था; और

2022 के उपयुाक्त कारण बताओ नोरटस के िररए श्रीमती रेखा, को जनिेि दिया गया था दक वे इस नोरटस के प्राप्त िोने के

साथ िी, जनवााचन व्यय का अपना लेखा िाजखल करें; और

यतः, जिला जनवााचन अजिकारी, जपथौरागढ़ द्वारा अपने पत्र संख्या 1256/29-(जनवााचन व्यय लेखा)/2022

दिनांक 17.09.2022 िो मुख्य जनवााचन अजिकारी के पत्र सं0 891/XXV-22(II)/2008 दिनांक15.06.2023 के द्वारा

अग्रेजषत कर आयोग को सूचना िी गई दक उक्त नोरटस दिनांक 04.11.2022 को अभ्यथी के घर पर कोई भी मौिूि निी

िोने के कारण मकान के सिि िृश्य भाग पर नोरटस चस्ट्पा कर साथ िी नोरटस की सूचना अभ्यथी के मो0 7466824255

पर व्िाटसप के माध्यम से भी भेि दिया गया था।; और,

यतः, जिला जनवााचन अजिकारी, जपथौरागढ़ द्वारा अपने पत्र संख्या 484/29--(जनवााचन व्यय लेखा)/2022

दिनांक 13.09.2023 के द्वारा अग्रेजषत कर भेिी गई अनुपूरक ररपोटा में यि बताया गया िै दक श्रीमती रेखा, ने न तो कोई

यतः, आयोग का यि समािान िो गया िै दक श्रीमती रेखा, जनवााचन खचों का लेखा िाजखल करने में जवफल रिे िैं

और उनके पास इस जवफलता के जलए कोई भी उजचत कारण अथवा औजचत्य निीं िै; और

यत:, लोक प्रजतजनजित्व अजिजनयम,1951 की िारा 10क में अनुबंजित दकया गया िै दक:-

"यदि जनवााचन आयोग का समािान िो िाता िै दक कोई व्यजक्त -

(क)

िै, िाजखल करने में असफल रिा िै; तथा

(ख)

कालावजि के जलए जनरर्िात िोगा;

O.N. 173.—WHEREAS, the General Election to 45-Gangolihat (SC) Legislative Assembly of Uttarakhand,

2022 was held vide Notification No. 464/Uttarakhand -LA/2022 dated 21^st January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of

his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 45-Gangolihat (SC) Assembly Constituency was

declared by the concerned Returning Officer on 10^th March, 2022. Hence, the last date for lodging the account of

Election Expenses was 09^thApril, 2022; and,

WHEREAS, as per the report submitted by the District Election Officer, Pithoragarh, Uttarakhand and

forwarded by the Chief Electoral Officer, Uttarakhand vide their letter No. 2782/XXV-53/2022, dated 22^th April,

2021, Smt. Rekha, a contesting candidate of Uttarakhand from 45-Gangolihat (SC) Assembly Constituency of

Uttarakhand, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Officer Pithoragarh, Uttarakhand and the

Chief Electoral Officer, Uttarakhand, a Show-Cause notice,76/Uttarakhand -LA/2022/45/CEMS-III dated

20.10.2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election

Commission of India to Smt. Rekha, for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show-Cause Notice, dated 20.10.2022, Smt. Rekha, was directed to submit his representation in writing with

explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the

date of receipt of the notice; and,

WHEREAS, the said notice was pasted on 04.11.2022 in front of the candidate house as no one was present in

his house and notice was also served through whatsapp no. 7466824255. The acknowledgment receipt has been

submitted to the Commission by the District Election Officer, Pithoragarh, vide its letter No.1256/29-(जनवाा.व्यय-

लेखा)/2022 dated 17.09.2022; forwarded by Chief Electoral Officer, Uttarakhand, letter no.891/XXV-22(II)/2008

date15.06.2023; and,

WHEREAS, the District Election Officer, Pithoragarh, in his Supplementary Report forwarded vide its

letter No. 484/29-(जनवाा.व्यय-लेखा)/2022 dated 13.09.2023 reported that Smt. Rekha, neither submitted any

representation nor any statement of account of election expenses. Further, after receipt of the due notice of the

Election Commission of India, he neither furnished any reason nor explanation for the said failure; and,

WHEREAS, the Commission is satisfied that Smt. Rekha, has failed to lodge the account of election expenses

and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act, and

(b)

has no good reason or justification for the failure,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and

being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or
