(Passed on this 16^th day of October - 2025.)

As per letter dated 19/09/2024 by the Deputy Chief Labour Commissioner (Central) Jabalpur, Government

of India, Ministry of Labour, New Delhi, the reference is made to this Tribunal under section-10 of Industrial

Disputes Act, 1947 as per reference number SH-1(75)/2022 dt. 19/09/2024. The dispute under reference related to :-

“Whether the action of the management of Sub Area Manager, Badra Sub Area, South Eastern

Coalfields Ltd., Anuppur (MP) in terminating the services of Shri Ramesh Kumar, Pump Operator

w.e.f. 26-12-2022 is legal and justified? If not, what relief the workman Shri Ramesh Kumar is

entitled to?”

After registering a case on the basis of the reference, notices were sent to the parties and served. Mr. Neeraj

Kewat learned Counsel filed his Vakalatnama for management. The workman side never appeared. They did not file

even any statement of claim. None of the parties filed any pleadings or evidence.

Since, the initial burden to prove its case is on the workman side in which he fails. Hence, holding the

claim of the workman union not proved, the reference stands answered against the workman union.
