सं. 9-26/94-यू.3(ए)—जबदक, केन्द्र सरकार को शिश्वशिद्यालय अनुिान आयोग (यूजीसी) अशिशनयम, 1956 की िारा 3 के तहत

शिश्वशिद्यालय अनुिान आयोग की सलाह पर उच्चतर शिक्षा संस्थान को सम-शिश्वशिद्यालय संस्था के रूप में घोशित करने का अशिकार प्राप् त है।

2. और जबदक, केंर सरकार ने यूजीसी अशिशनयम, 1956 की िारा 3 के तहत प्रित्त िशियों का प्रयोग करते हुए, यूजीसी की सलाह

पर दिनांक 15.03.2000 की अशिसूचना संख्या 9-26/94-यू.3 के माध्यम से इलाहाबाि कृशि संस्थान (एएआई), इलाहाबाि, उत् तर प्रिेि को

सम शिश्वशिद्यालय संस्थान घोशित दकया था। इसके अशतररि, शिक्षा मंत्रालय ने संस् था के अनुरोि और यूजीसी की सलाह पर दिनांक

22.09.2009 के पत्र संख्या 13-7/2008-यू.3(ए) के माध्यम से “इलाहाबाि कृशि संस्थान” का नाम बिलकर “सैम शहशगनबॉटम कृशि, प्रौद्योशगकी

और शिज्ञान संस्थान” कर दिया।

3. और इसके अलािा जबदक, कुलसशचि, सैम शहशगनबॉटम कृशि, प्रौद्योशगकी और शिज्ञान संस्थान ने ििष 2017 में शिक्षा मंत्रालय से

सैम शहशगनबॉटम कृशि, प्रौद्योशगकी और शिज्ञान संस्थान का सम शिश्वशिद्यालय संस्थान का िजाष िापस लेने का अनुरोि दकया था, शजसमें यह

सूशचत दकया गया था दक उत्तर प्रिेि सरकार ने दिनांक 27.12.2016 के ििष 2016 के उत्तर प्रिेि अशिशनयम संख्या 35 के माध्यम से उि

संस्थान को सैम शहशगनबॉटम कृशि, प्रौद्योशगकी और शिज्ञान शिश्वशिद्यालय के नाम से राज्य शनजी शिश्वशिद्यालय स्थाशपत दकया है।

4. और जबदक, तत् कालीन यूजीसी (सम शिश्वशिद्यालय संस्थान) शिशनयम, 2010 (ििष 2016 में यथासंिोशित) के अनुसार संस्थान के

अनुरोि पर मंत्रालय में शिचार दकया गया और यह पाया गया दक यूजीसी शिशनयमों के शिपरीत सम-शिश्वशिद्यालय संस्थान को राज्य शनजी

शिश्वशिद्यालय में बिलने से पूिष मंत्रालय से अनापशत्त प्रमाण पत्र प्राप्त नहीं दकया गया।

5. और जबदक, जब यह मामला मंत्रालय के शिचारािीन था, तब संस्थान ने यूजीसी अशिशनयम, 1956 की िारा 2 (च) के तहत

शिश्वशिद्यालय की सूची में इसका नाम िाशमल करने का अनुरोि करते हुए माननीय इलाहाबाि उच्च न्द्यायालय के समक्ष ििष 2019 में एक ररट

याशचका (सी) संख्या 6583 िायर की। माननीय उच्च न्द्यायालय ने दिनांक 28.10.2025 के अपने आिेि के माध्यम से शनिेि दिया दक यूजीसी

इस तरह के समािेिन पर शिचार करेगा, बिते दक भारत सरकार की ओर से कोई शिपरीत पत्र व् यिहार न हो, और यह दक तिनुसार कोई कानूनी

बािा सूशचत की जाए।

6. और इसके अलािा जबदक, इस मामले को शिशि कायष शिभाग को उनकी शिशिक राय के शलए भेजा गया। शिशि कायष शिभाग ने राय

िी दक इस मामले में कानूनी शस्थशत का समािान हो गया है और यह मामला अब प्रिासशनक प्रकृशत का है, ऐसी रटप् पणी करते हुए दक माननीय

उच्च न्द्यायालय के शनणषय को अंशतम रूप िे दिया गया है और इसका कायाषन्द्ियन इस मंत्रालय के अशिकार क्षेत्र में आता है और इस स्तर पर दकसी

अशतररक् त कानूनी राय की आिश्यकता नहीं है।

7. अब इसशलए, केंर सरकार शिश्वशिद्यालय अनुिान आयोग अशिशनयम, 1956 की िारा 3 के अंतगषत प्रित्त िशियों का प्रयोग करते

हुए और शिश्वशिद्यालय अनुिान आयोग की सलाह पर शिचार करके, एतद्द्वारा उक् त संस् थान के अंशतम बैच में प्रिेशित शिद्यार्थषयों के उत् तीणष होने

के साथ ही दिनांक 15-03-2000 की अपनी अशिसूचना संख्या 9-26/94-यू-3 को िापस लेती है शजसके माध् यम से सैम शहशगनबॉटम कृशि,

प्रौद्योशगकी और शिज्ञान संस्थान (पूिष में इलाहाबाि कृशि संस्थान), प्रयागराज, उत्तर प्रिेि को सम शिश् िशिद्यालय संस् थान घोशित दकया गया

था। इसके अशतररक् त, सैम शहशगनबॉटम कृशि, प्रौद्योशगकी और शिज्ञान संस्थान के प्रमोटर की यह पूणष शजम्मेिारी होगी दक िे उनके द्वारा अंशतम

बैच के नामांदकत छात्रों के शहतों की रक्षा करें; पहले से उत्तीणष छात्रों के ररकॉर्ष/सामग्री को संरशक्षत करें; सैम शहशगनबॉटम कृशि, प्रौद्योशगकी और

शिज्ञान संस्थान से संबंशित आशिकाररक पत्राचार /शिकायतें प्राप्त करें/पािती िें और साथ ही संकाय कमषचाररयों और गैर-संकाय कमषचाररयों जो

सैम शहशगनबॉटम कृशि, प्रौद्योशगकी और शिज्ञान संस्थान से जुडे थे, उनके शहतों को सुरशक्षत करें।

No. 9-26/94-U.3(A)—Whereas, the Central Government is empowered under Section 3 of the University Grants

Commission (UGC) Act, 1956 to declare, on the advice of the UGC, an Institution of higher learning as an Institution deemed

to be University.

2. And whereas, in exercise of the powers conferred under section 3 of the UGC Act, 1956, the Central Government,

vide Notification No. 9-26/94-U.3 dated 15.03.2000, on the advice of UGC, had declared Allahabad Agricultural Institute

(AAI), Allahabad, Uttar Pradesh, as an Institution Deemed to be University. Further, the Ministry of Education, on the request

of the Institution and on the advice of UGC, rechristened the name of “Allahabad Agricultural Institute” to “Sam Higginbottom

Institute of Agriculture, Technology and Sciences”, vide communication No.13-7/2008-U.3(A) dated 22.09.2009.

3. And further whereas, the Registrar, Sam Higginbottom Institute of Agriculture, Technology and Sciences requested

in the year 2017 to the Ministry of Education for withdrawal of Institution deemed to be University status of Sam Higginbottom

Institute of Agriculture, Technology and Sciences informing that the Government of Uttar Pradesh, vide U.P. Act No. 35 of

2016 dated 27.12.2016, has established the said institution as a State Private University in the name of Sam Higginbottom

University of Agriculture, Technology and Sciences.

4. And whereas, the request of the Institution was considered in the Ministry as per the then UGC (Institutions Deemed

to be Universities) Regulations, 2010 (as amended in 2016) and found that no objection certificate was not obtained from the

Ministry before conversion of the Institution deemed to be University into State Private University in contrary to the UGC

Regulations.

5. And whereas, while the matter was under consideration of the Ministry, the institution filed a Writ Petition (C)

No. 6583 of 2019 before the Hon’ble High Court of Judicature at Allahabad praying for inclusion of its name in the list of

University under Section 2(f) of the UGC Act, 1956. The Hon’ble High Court, vide its order dated 28.10.2025, directed that

UGC shall consider such inclusion, subject to there being no contrary communication from the Union of India, and that any

legal impediment be communicated accordingly.

6. And further whereas, the matter was referred to Department of Legal Affairs for their legal opinion. The Department

of Legal Affairs opined that the legal position in the matter is settled and the issue is now administrative in nature, observing

that the Hon’ble High Court’s judgment has attained finality and its implementation falls within the domain of this Ministry,

with no further legal opinion required at this stage.

7. Now, therefore, in exercise of the powers conferred under Section 3 of the UGC Act, 1956, the Central Government,

considering the advice of UGC, hereby withdraws its Notification 9-26/94-U.3 dated 15.03.2000 declaring Sam Higginbottom

Institute of Agriculture, Technology and Sciences (formerly Allahabad Agricultural Institute), Prayagraj, Uttar Pradesh as an

Institution deemed to be University with effect from passing out of the last batch of admitted students. Further, it would be

sole responsibility of the promoter of Sam Higginbottom University of Agriculture, Technology and Sciences to safeguard the

interest of the last batch of students enrolled by them; to preserve the records / materials of already passed out students; to

receive / acknowledge the official communications/grievances related to Sam Higginbottom Institute of Agriculture,

Technology and Sciences and also to secure the interest of faculty staff and non-faculty staff who are/were associated with Sam

Higginbottom Institute of Agriculture, Technology and Sciences.
