आ.अ. 85.—यतः,

भारत जनवााचन आयोग द्वारा दिनांक 07.05.2024 की अजिसूचना सं0

464/ईपीएस/2024(7) के अनुसरण में ओजड़िा राज्य की लोक सभा के जलए सािारण जनवााचन 2024 आयोजित दकया

गया था; और

यतः, लोक प्रजतजनजित्व अजिजनयम, 1951 की िारा 78 के अनुसार, दकसी जनवााचन मे, जनवााचन लड़ रिा

प्रत्येक अभ्यथी, जनवााजचत अभ्यथी के जनवााचन की तारीख से 30 दिनों के भीतर जनवााचन व्यय का लेखा जिला जनवााचन

अजिकारी के पास िाजखल करेगा िो उक्त अजिजनयम की िारा 77 के अंतगात उसके द्वारा या उसके जनवााचन अजभकताा

(एिेंट) द्वारा रखे गए लेखे की एक सत्य प्रजत िोगी; और

यतः, ओजड़िा राज्य के 05-मयूरभंि (अ.ि.िा.) संसिीय जनवााचन क्षेत्र के सािारण जनवााचन, 2024 का

पररणाम ररटर्नाग ऑदिसर द्वारा दिनांक 04.06.2024 को घोजित दकया गया था और इस प्रकार जनवााचन व्यय लेखे

िाजखल करने की अजन्तम तारीख 04.07.2024 थी; और

यतः, जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के उप-जनयम (1) अंतगात, जिला जनवााचन अजिकारी,

मयूरभंि की ररपोटा दिनांक िून्य िो मुख्य जनवााचन अजिकारी, ओजड़िा से दिनांक 31.07.2024 पत्र सं0 EC-CON-

COE-0103-2024-2756 (Elec.) के द्वारा हुई थी, के अनुसार श्री अंता आलोक बास्ट्की िो ओजड़िा राज्य के 05-

मयूरभंि (अ.ि.िा.) संसिीय जनवााचन क्षेत्र, 2024 से जनवााचन लड़ने वाले अभ्यथी िै, जवजि द्वारा यथापेजक्षत रीजत से

अपने जनवााचन व्यय के लेखे िाजखल करने में असिल रिे िै; और

यतः, जिला जनवााचन अजिकारी, मयूरभंि की उक्त ररपोटा के आिार पर भारत जनवााचन आयोग द्वारा जनवााचनों

का संचालन जनयम, 1961 के जनयम 89 के उप-जनयम (5) के अंतगात श्री अंता आलोक बास्ट्की को अपने जनवााचन व्यय लेखे

प्रस्ट्तुत निीं करने के जलए कारण बताओ नोरटस सं. 76/ODISHA/PC-05/2024/CEMS-IV दिनांक 04 नवंबर,

2024 िारी दकया गया थाः, और

यतः, उपयुक्त कारण बताओ नोरटस के िररए और जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के उप-

जनयम (6) के अनुसार श्री अंता आलोक बास्ट्की को व्यय लेखा प्रस्ट्तुत न दकए िाने संबंिी कारणों को स्ट्पष्ट करते हुए,

आयोग को अपना अभ्यावेिन जलजखत रूप में प्रस्ट्तुत करने और नोरटस के प्राप्त िोने की तारीख से 20 दिनो के भीतर जिला

जनवााचन अजिकारी, मयूरभंि को अपने जनवााचन व्यय का पूणा लेखा प्रस्ट्तुत करने का जनिेि दिया गया था; और

यतः, जिला जनवााचन अजिकारी, मयूरभंि से दिनांक 03.12.2024 के पत्र सं0 6137/Elec के द्वार सूजचत

दकया िै दक उक्त कारण बताओ नोरटस श्री अंता आलोक बास्ट्की के द्वारा दिनांक 02.12.2024 को प्राप्त दकया गया था;

और

यतः, जिला जनवााचन अजिकारी, मयूरभंि ने पत्र सं0 307/Elec. दिनांक 20.03.2026 के द्वारा प्रस्ट्तुत की गई

अनुपूरक ररपोटा में यि बताया गया िै दक श्री अंता आलोक बास्ट्की ने जनवााचन व्यय का लेखा प्रस्ट्तुत निीं दकया िै। इसके

अजतररक्त, उक्त नोरटस की पावती/चस्ट्पा के उपरांत, श्री अंता आलोक बास्ट्की ने जवजि के अंतगात यथा जवजित लेखा िाजखल

करने में असिलता के जलए भारत जनवााचन आयोग को न तो कोई कारण बताया और न िी कोई स्ट्पष्टीकरण दिया िै; और

यत:, लोक प्रजतजनजित्व अजिजनयम,1951 की िारा 10क में उपबंजित दकया गया िै दक:-

"यदि जनवााचन आयोग का समािान िो िाता िै दक कोई व्यजक्त -

(क)

जनवााचन व्ययों का लेखा उस समय के भीतर और उस रीजत में िैसी इस अजिजनयम के द्वारा या अिीन अपेजक्षत

िै, िाजखल करने में असिल रिा िै; और

(ख)

उस असिलता के जलए कोई अच्छा कारण अथवा न्यायोजचत्य निीं रखता िै, तो जनवााचन आयोग, िासकीय

रािपत्र में प्रकाजित आिेि द्वारा उसको जनरर्िात घोजित करेगा और ऐसा व्यजक्त उस आिेि की तारीख से तीन

विा की कालावजि के जलए जनरर्िात िोगा।“

यतः, तथ्यों और उपलब्ि ररकाडो के आिार पर आयोग का यि समािान िो गया िै दक श्री अंता आलोक बास्ट्की

अपने जनवााचन व्यय के लेखे िाजखल करने में असिल रिे िैं उनके पास ऐसा करने में असिल रिने के जलए कोई भी उजचत

कारण अथवा औजचत्य निी िै, और

अतः, अब लोक प्रजतजनजित्व अजिजनयम, 1951 की िारा 10क के अनुसरण में भारत जनवााचन आयोग एतद्द्वारा

घोिणा करता िै ओजड़िा राज्य की लोक सभा के जलए सािारण जनवााचन, 2024 के 05-मयूरभंि

ORDER

New Delhi, the 5thJune, 2026

O.N. 85.—WHEREAS, the General Election to Lok Sabha of Odisha, 2024 was held in pursuance of the

Election Commission of India Notification No. 464/EPS/2024/(7) dated 07.05.2024; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an

account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77

of the said act; and

WHEREAS, the result of the above-mentioned elections for 05-Mayurbhanj (ST) Parliamentary Constituency of

Odisha was declared by the Returning Officer on 04.06.2024 and hence the last date for lodging the account of election

expenses was 04.07.2024; and

WHEREAS, as per the District Election Officer, Mayurbhanj, Odisha report dated NIL forwarded by the Chief

Electoral Officer, Odisha vide their EC-CON-COE-0103-2024-2756 (Elec.) dated 31.07.2024, under sub-rule (1) of Rule

89 of the Conduct of Elections Rules, 1961, Sh. Anta Alok Baskey, a contesting candidate from 05-Mayurbhanj (ST)

Parliamentary Constituency of Odisha has failed to lodge his account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Mayurbhanj, a Show-Cause notice No.

76/ODISHA/PC-05/2024/CEMS-IV, dated 04.11.2024 was issued under sub-rule (5) of Rule 89 of the Conduct of

Elections Rules, 1961 by the Election Commission of India to Sh. Anta Alok Baskey, for not lodging of his account of

election expenses; and

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of

Elections Rules, 1961, Sh. Anta Alok Baskey, was directed to submit representation in writing to the Commission

explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election

Officer, Mayurbhanj within 20 days from the date of receipt of the Notice; and WHEREAS, District Election Officer,

Mayurbhanj vide his letter no. 6137/Elec dated 03.12.2024 informed that the said notice was served to Sh. Anta Alok

Baskey on 02.12.2024; and

WHEREAS, the District Election Officer, Mayurbhanj in his Supplementary Report, vide its letter no. 307/Elec

dated 20.03.2026 has reported that Sh. Anta Alok Baskey, has not submitted his account of election expenses. Further,

after receipt of the said notice, Sh. Anta Alok Baskey, has neither furnished any reason nor explanation to the Commission

of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this

Act, and

(b) has no good reason or justification for the failure, the Election Commission shall, by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three

years from the date of the order.”

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Anta Alok Baskey has

failed to lodge his account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election

Commission of India hereby declares Sh. Anta Alok Baskey resident of At-Olidihi, Po-Bodpalsa, PS-Tiring, Dist-

Mayurbhanj, Odisha, PIN-757046, a contesting candidate from 05-Mayurbhanj (ST) Parliamentary Constituency of

General Election to the Lok Sabha of Odisha , 2024, to be disqualified for being chosen as and for being a member of

either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a

period of three years from the date of this order.

िारी दकया गया थाः, और

जनयम (6) के अनुसार श्री सुकांत िेम्रम को व्यय लेखा प्रस्ट्तुत न दकए िाने संबंिी कारणों को स्ट्पष्ट करते हुए, आयोग को

अपना अभ्यावेिन जलजखत रूप में प्रस्ट्तुत करने और नोरटस के प्राप्त िोने की तारीख से 20 दिनो के भीतर जिला जनवााचन

अनुपूरक ररपोटा में यि बताया गया िै दक श्री सुकांत िेम्रम ने जनवााचन व्यय का लेखा प्रस्ट्तुत निीं दकया िै। इसके

अजतररक्त, उक्त नोरटस की पावती/चस्ट्पा के उपरांत, श्री सुकांत िेम्रम ने जवजि के अंतगात यथा जवजित लेखा िाजखल करने

Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Sukanta Hembram, for not lodging of

his account of election expenses; and

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of

Elections Rules, 1961, Sh. Sukanta Hembram, was directed to submit representation in writing to the Commission

disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative

Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of

this order.

िािपुर की ररपोटा दिनांक िून्य िो मुख्य जनवााचन अजिकारी, ओजड़िा से दिनांक 31.07.2024 पत्र सं0 EC-CON-

COE-0103-2024-2756 (Elec.) के द्वारा हुई थी, के अनुसार श्री मंटू सेठी िो ओजड़िा राज्य के 08-िािपुर (अ.िा.)

संसिीय जनवााचन क्षेत्र, 2024 से जनवााचन लड़ने वाले अभ्यथी िै, जवजि द्वारा यथापेजक्षत रीजत से अपने जनवााचन व्यय के

लेखे िाजखल करने में असिल रिे िै; और,

यतः, जिला जनवााचन अजिकारी, िािपुर की उक्त ररपोटा के आिार पर भारत जनवााचन आयोग द्वारा जनवााचनों

का संचालन जनयम, 1961 के जनयम 89 के उप-जनयम (5) के अंतगात श्री मंटू सेठी को अपने जनवााचन व्यय लेखे प्रस्ट्तुत निीं

करने के जलए कारण बताओ नोरटस सं. 76/ODISHA/PC-08/2024/CEMS-IV दिनांक 04.11.2024 िारी दकया

गया थाः, और

जनयम (6) के अनुसार श्री मंटू सेठी को व्यय लेखा प्रस्ट्तुत न दकए िाने संबंिी कारणों को स्ट्पष्ट करते हुए, आयोग को अपना

अभ्यावेिन जलजखत रूप में प्रस्ट्तुत करने और नोरटस के प्राप्त िोने की तारीख से 20 दिनो के भीतर जिला जनवााचन

अजिकारी, िािपुर को अपने जनवााचन व्यय का पूणा लेखा प्रस्ट्तुत करने का जनिेि दिया गया था; और

यतः, जिला जनवााचन अजिकारी, िािपुर से दिनांक 19.11.2024 के पत्र सं0 7012/Elec के द्वार सूजचत दकया

िै दक उक्त कारण बताओ नोरटस श्री मंटू सेठी के द्वारा दिनांक 13.11.2024 को प्राप्त दकया गया था; और

यतः, जिला जनवााचन अजिकारी, िािपुर ने पत्र सं0 173/Elec. दिनांक 27.02.2026 के द्वारा प्रस्ट्तुत की गई

अनुपूरक ररपोटा में यि बताया गया िै दक श्री मंटू सेठी ने जनवााचन व्यय का लेखा प्रस्ट्तुत निीं दकया िै। इसके अजतररक्त,

O.N. 87.—WHEREAS, the General Election to Lok Sabha of Odisha, 2024 was held in pursuance of the

Election Commission of India Notification No. 464/EPS/2024/(7) dated 07.05.2024; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election

Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent

WHEREAS, the result of the above-mentioned elections for 08-Jajpur (SC) Parliamentary Constituency of

Odisha was declared by the Returning Officer on 04.06.2024 and hence the last date for lodging the account of

election expenses was 04.07.2024; and

WHEREAS, as per the District Election Officer, Jajpur, Odisha report dated NIL forwarded by the Chief

Electoral Officer, Odisha vide their EC-CON-COE-0103-2024-2756 (Elec.) dated 31.07.2024, under sub-rule (1) of

Rule 89 of the Conduct of Elections Rules, 1961, Sh. Mantu Sethi, a contesting candidate from 08-Jajpur (SC)

Parliamentary Constituency of Odisha has failed to lodge his account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Jajpur, a Show-Cause notice No.

76/ODISHA/PC-08/2024/CEMS-IV, dated 04.11.2024 was issued under sub-rule (5) of Rule 89 of the Conduct of

Elections Rules, 1961 by the Election Commission of India to Sh. Mantu Sethi, for not lodging of his account of

election expenses; and

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of

Elections Rules, 1961, Sh. Mantu Sethi, was directed to submit representation in writing to the Commission

explaining the reasons for not lodging the account and also to lodge account of election expenses with the District

Election Officer, Jajpur within 20 days from the date of receipt of the Notice; and

WHEREAS, District Election Officer, Jajpur vide his letter no. 7012/Elec dated 19.11.2024 informed

that the said notice was served to Sh. Mantu Sethi on 13.11.2024, and

WHEREAS, the District Election Officer, Jajpur in his Supplementary Report, vide its letter no. 173/Elec

dated 27.02.2026 has reported that Sh. Mantu Sethi, has not submitted his account of election expenses. Further,

after receipt of the said notice, Sh. Mantu Sethi, has neither furnished any reason nor explanation to the Commission

of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Mantu Sethi has

failed to lodge his account of election expenses and has no good reason or justification for the failure to do so; and

Election Commission of India hereby declares Sh. Mantu Sethi resident of AT/PO-Bainsiria, Dist-Jajpur, a

O.N. 90.—WHEREAS, the General Election to Lok Sabha of Odisha, 2024 was held in pursuance of the

Election Commission of India Notification No. 464/EPS/2024/(6) dated 29.04.2024; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an

account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77

of the said act; and

WHEREAS, the result of the above-mentioned elections for 17-Puri Parliamentary Constituency of Odisha was

declared by the Returning Officer on 04.06.2024 and hence the last date for lodging the account of election expenses was

04.07.2024; and

WHEREAS, as per the District Election Officer, Puri, Odisha report dated NIL forwarded by the Chief

Electoral Officer, Odisha vide their EC-CON-COE-0103-2024-2756 (Elec.) dated 31^st July, 2024, under sub-rule (1) of

Rule 89 of the Conduct of Elections Rules, 1961, Smt. Sobha Pandey, a contesting candidate from 17-Puri Parliamentary

Constituency of Odisha has failed to lodge her account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Puri, a Show-Cause notice No.

76/ODISHA/PC-17/2024/CEMS-IV, dated 04.11.2024 was issued under sub-rule (5) of Rule 89 of the Conduct of

Elections Rules, 1961 by the Election Commission of India to Smt. Sobha Pandey, for not lodging of her account of

election expenses; and

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of

Elections Rules, 1961, Smt. Sobha Pandey, was directed to submit representation in writing to the Commission explaining

the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer,

Puri within 20 days from the date of receipt of the Notice; and

WHEREAS, District Election Officer, Puri vide his letter no. 420/Elec dated 02.05.2025 informed that the said

notice was served to Smt. Sobha Pandey on 25.03.2025; and

WHEREAS, the District Election Officer, Puri in his Supplementary Report, vide its letter no. 444/Elec. dated

13.05.2025 has reported that Smt. Sobha Pandey, has not submitted her account of election expenses. Further, after receipt

of the said notice, Smt. Sobha Pandey, has neither furnished any reason nor explanation to the Commission of India, for

failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this

Act, and

(b) has no good reason or justification for the failure, the Election Commission shall, by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three

years from the date of the order.”

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Smt. Sobha Pandey has

failed to lodge her account of election expenses and has no good reason or justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election

Commission of India hereby declares Smt. Sobha Pandey resident of AT-Junushpatna, PO-College Square, PS-

Malgodown, Dist-Cuttack PIN-753003, a contesting candidate from 17-Puri Parliamentary Constituency of General

Election to the Lok Sabha of Odisha , 2024, to be disqualified for being chosen as and for being a member of either

House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period

of Elections Rules, 1961 by the Election Commission of India to Sh. Ram Kumar Soren for not lodging of his

account of election expenses; and

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of

Elections Rules, 1961, Sh. Ram Kumar Soren, was directed to submit representation in writing to the Commission

explaining the reasons for not lodging the account and also to lodge account of election expenses with the District

यत:, लोक प्रजतजनजित्व अजिजनयम,1951 की िारा 10क में अनुबंजित दकया गया िै दक:-

"यदि जनवााचन आयोग का समािान िो िाता िै दक कोई व्यजक्त -

O.N. 93.—WHEREAS, the General Election to Legislative Assembly of Odisha, 2024 was held in

pursuance of Notification No. 8209-EC-CON-COE-0080/2024-/Elec. dated 07.05.2024; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at

an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election

Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent

under Section 77 of the said act; and

WHEREAS, the result of the above-mentioned elections for 27-Saraskana (ST) Assembly Constituency of

Odisha was declared by the Returning Officer on 04.06.2024 and hence the last date for lodging the account of

election expenses was 04.07.2024; and

WHEREAS, as per the District Election Officer, Mayurbhanj, Odisha report forwarded by the Chief

Electoral Officer, Odisha vide its letter no. EC-CON-COE-0103-2024-12892 (Elec.) dated 07.08.2024, under sub-

rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Smt. Basanti Tudu, a contesting candidate from 27-

Saraskana (ST) Assembly Constituency of Odisha has failed to lodge her account of election expenses, as required

under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Mayurbhanj, a Show-Cause

notice No. 76/OD-LA/27/2024/CEMS-IV, dated 08.01.2025 was issued under sub-rule (5) of Rule 89 of the Conduct

of Elections Rules, 1961 by the Election Commission of India to Smt. Basanti Tudu for not lodging of her account

of election expenses; and

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of

Elections Rules, 1961, Smt. Basanti Tudu, was directed to submit representation in writing to the Commission

explaining the reasons for not lodging the account and also to lodge account of election expenses with the District

Election Officer, Mayurbhanj within 20 days from the date of receipt of the Notice; and

Whereas, District Election Officer, Mayurbhanj vide his letter no. 176/Elec dated 21.02.2025 informed that

the said notice was served to Smt. Basanti Tudu on 01.02.2025; and

WHEREAS, the District Election Officer, Mayurbhanj in his Supplementary Report, vide its letter no.

361/Elec. dated 10.04.2026 has reported that Smt. Basanti Tudu, has not submitted her account of election expenses

and further, after receipt of the said notice, Smt. Basanti Tudu has neither furnished any reason nor explanation to

the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act; and

(b)

has no good reason or justification for the failure, the Election Commission shall, by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of

three years from the date of the order.”

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Smt. Basanti

Tudu has failed to lodge her account of election expenses and has no good reason or justification for the failure to do

so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Smt. Basanti Tudu resident of At/ PO –Uparbeda, PS – Rairangpur

Rural, Dist-Mayurbhanj, Odisha. a contesting candidate from 27-Saraskana (ST) Assembly Constituency of

General Election to the Legislative Assembly of Odisha, 2024, to be disqualified for being chosen as and for being a

member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union

राइरंगपुर (अ.ि.िा.) जविान सभा जनवााचन क्षेत्र, 2024 से जनवााचन लड़नेवाले अभ्यथी िै, जवजि द्वारा यथापेजक्षत रीजत

से अपने जनवााचन व्यय के लेखे िाजखल करने में असिल रिे िै;और

का संचालन जनयम, 1961 के जनयम 89 के उप-जनयम (5) के अंतगात श्री अन्ता आलोक बास्ट्के को अपने जनवााचन व्यय लेखे

िै दक उक्त कारण बताओ नोरटस को दिनांक 30.01.2025 को श्री अन्ता आलोक बास्ट्के की चाची (रूपी टुडू) के द्वारा प्राप्त

दकया गया था; और

यतः, जिला जनवााचन अजिकारी, मयूरभंि ने अपने पत्र सं0

361/Elec. दिनांक 10.04.2026 के द्वारा प्रस्ट्तुत

की गई अनुपूरक ररपोटा में यि बताया गया िै दक श्री अन्ता आलोक बास्ट्के ने जनवााचन व्यय का लेखा प्रस्ट्तुत निीं दकया िै

O.N. 96.—WHEREAS, the General Election to Legislative Assembly of Odisha, 2024 was held in pursuance

of Notification No. 8209-EC-CON-COE-0080/2024-/Elec. dated 07.05.2024; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an

election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election

Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent

WHEREAS, the result of the above-mentioned elections for 28-Rairangpur (ST) Assembly Constituency of

Odisha was declared by the Returning Officer on 04.06.2024 and hence the last date for lodging the account of

election expenses was 04.07.2024; and

WHEREAS, as per the District Election Officer, Mayurbhanj, Odisha report forwarded by the Chief

Electoral Officer, Odisha vide its letter no. EC-CON-COE-0103-2024-12892 (Elec.) dated 07.08.2024, under sub-

rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Anta Alok Baskey, a contesting candidate from 28-

Rairangpur (ST) Assembly Constituency of Odisha has failed to lodge his account of election expenses, as required

under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Mayurbhanj, a Show-Cause

notice No. 76/OD-LA/28/2024/CEMS-IV, dated 08.01.2025 was issued under sub-rule (5) of Rule 89 of the Conduct

of Elections Rules, 1961 by the Election Commission of India to Sh. Anta Alok Baskey for not lodging of his

account of election expenses; and

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of

Elections Rules, 1961, Sh. Anta Alok Baskey, was directed to submit representation in writing to the Commission

explaining the reasons for not lodging the account and also to lodge account of election expenses with the District

Election Officer, Mayurbhanj within 20 days from the date of receipt of the Notice; and

Whereas, District Election Officer, Mayurbhanj vide his letter no. 176/Elec dated 21.02.2025 informed that

the said notice Notice was served to Aunt (Rupi Tudu) of Sh. Anta Alok Baskey on 30.01.2025; and

WHEREAS, the District Election Officer, Mayurbhanj in his Supplementary Report, vide its letter no.

361/Elec. dated 10.04.2026 has reported that Sh. Anta Alok Baskey, has not submitted his account of election

expenses and further, after receipt of the said notice, Sh. Anta Alok Baskey, has neither furnished any reason nor

explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act; and

(b)

has no good reason or justification for the failure, the Election Commission shall, by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of

three years from the date of the order.”

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Anta Alok

Baskey has failed to lodge his account of election expenses and has no good reason or justification for the failure to

do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Sh. Anta Alok Baskey resident of At- Olidihi, P.O.- Bodpalsa, P.S.-

यतः, जिला जनवााचन अजिकारी, सम्बलपुर ने पत्र सं0 2990/Elec. दिनांक 17 िरवरी,2025 के द्वारा प्रस्ट्तुत

की गई अनुपूरक ररपोटा में यि बताया गया िै दक श्री लक्ष्मण कुमार भोई ने जनवााचन व्यय का लेखा प्रस्ट्तुत निीं दकया िै।

इसके अजतररक्त, उक्त नोरटस की पावती/चस्ट्पा के उपरांत, श्री लक्ष्मण कुमार भोई द्वारा दिनांक 04.12.2024 को एक

अभ्यावेिन प्रस्ट्तुत दकया गया था, जिसके संबंि में आयोग द्वारा जिला जनवााचन अजिकारी से रटप्पजणयााँ प्राप्त करने िेतु पत्र

भेिा गया। अपनी ररपोटा में जिला जनवााचन अजिकारी ने बताया िै दक जनवााचन व्यय का लेखा प्रस्ट्तुत न कर पाने के संबंि

में अभ्यथी द्वारा दिए गए कारणों के समथान में कोई िस्ट्तावेि संलग्न निीं दकया गया िै। अतः लोक प्रजतजनजित्व

अजिजनयम, 1951 के प्राविानों के अनुसार आवश्यक कारावाई की िा सकती िै। इसके अजतररक्त, श्री लक्ष्मण कुमार भोई

द्वारा जनवााचन व्यय का कोई लेखा प्रस्ट्तुत निीं दकया गया िै।

यत:, लोक प्रजतजनजित्व अजिजनयम, 1951 की िारा 10क में उपबंजित दकया गया िैदक :-

"यदि जनवााचन आयोग का समािान िो िाता िै दक कोई व्यजक्त -

(क)

जनवााचन व्ययों का लेखा उस समय के भीतर और उस रीजत में िैसी इस अजिजनयम के द्वारा या अिीन

अपेजक्षत िै, िाजखल करने में असिल रिा िै; और

(ख)

उस असिलता के जलए कोई अच्छा कारण अथवा न्यायोजचत्य निीं रखता िै, तो जनवााचन आयोग,

िासकीय रािपत्र में प्रकाजित आिेि द्वारा उसको जनरर्िात घोजित करेगा और ऐसा व्यजक्त उस आिेि की

तारीख से तीन विा की कालावजि के जलए जनरर्िात िोगा।“

यतः, तथ्यों और उपलब्ि ररकाडो के आिार पर आयोग का यि समािान िो गया िै दक श्री लक्ष्मण कुमार भोई

कारण अथवा औजचत्य निी िै, और

घोिणा करता िै दक ओजड़िा राज्य की लोक सभा के जलए सािारण जनवााचन, 2024 के 03-सम्बलपुर संसिीय जनवााचन

क्षेत्र से जनवााचन लड़नेवाले अभ्यथी श्री लक्ष्मण कुमार भोई, एनएच-6, िारसारोड, सरला, डाकघर- िनकौड़ा, जिला-

संबलपुर, 768006 इस आिेि की तारीख से तीन विा की अवजि के जलए संसि के दक सी भी सिन अथवा राज्य अथवा

संघ राज्य-क्षेत्र की जविान सभा अथवा जविान पररिि् का सिस्ट्य चुने िाने अथवा िोने के जलए जनरर्िात िोगें।

O.N. 99.— WHEREAS, the General Election to Lok Sabha of Odisha, 2024 was held in pursuance of the

Election Commission of India Notification No. 464/EPS/2024/(6) dated 29^thApril, 2024. And

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at

an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election

Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent

under Section 77 of the said act; and

WHEREAS, the result of the above-mentioned elections for 03-Sambalpur Parliamentary Constituency of

Odisha was declared by the Returning Officer on 4^th June, 2024 and hence the last date for lodging the account of

Election Expenses was 4^th July, 2024; and

WHEREAS, as per the District Election Officer, Sambalpur, Odisha report forwarded by the Chief

Electoral Officer, Odisha vide their EC-CON-COE-0103-2024-2756 (Elec.) dated 31^st July, 2024, under sub-rule

(1) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Laxman Kumar Bhoi, a contesting candidate from 03-

Sambalpur Parliamentary Constituency of Odisha has failed to lodge his account of election expenses, as required

under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Sambalpur, a Show-Cause notice

No. 76/ODISHA/PC-03/2024/CEMS-IV, dated 04.11.2024 was issued under sub-rule (5) of Rule 89 of the Conduct

of Elections Rules, 1961 by the Election Commission of India to Sh. Laxman Kumar Bhoi for not lodging of his

account of Election Expenses; and,

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of

Elections Rules, 1961, Sh. Laxman Kumar Bhoi, was directed to submit representation in writing to the

Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with

the District Election Officer, Sambalpur within 20 days from the date of receipt of the Notice; and

Whereas, District Election Officer, Sambalpur vide his letter no. 2990/Elec dated 17.02.2025 informed

that the said notice was served to his wife on 14.11.2024, and

WHEREAS, the District Election Officer, Sambalpur in his Supplementary Report, vide its letter no.

2990/Elec. dated 17.02.2025 has reported that Sh. Laxman Kumar Bhoi, has not submitted his account of election

expenses. Further, after receipt of the said notice, Sh. Laxman Kumar Bhoi, submitted a representation dated

04.12.2024, regarding which a letter was sent by the Commission for comments from the District Election Officer. In

his report the DEO stated that the reasons submitted by the candidate about his inability to submit his accounts of

election expenses are without any supporting document. Therefore, necessary action may be taken as per provisions

under the R.P. Act, 1951. Additionally, Sh. Laxman Kumar Bhoi has not submitted any account of expenses; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

“If the Election Commission is satisfied that a person-

(a)

has failed to lodge an account of election expenses, within the time and in the manner required by or under

this Act, and

(b)

has no good reason or justification for the failure, the Election Commission shall, by order published in the

Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of

three years from the date of the order.”

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Laxman

Kumar Bhoi has failed to lodge his account of election expenses and has no good reason or justification for the

failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Sh. Laxman Kumar Bhoi resident of NH-6, Dharsa Road, Sarla,

PO- Dhankauda, Dist- Sambalpur- 768006, a contesting candidate from 03-Sambalpur Parliamentary

Constituency of General Election to the Lok Sabha of Odisha , 2024, to be disqualified for being chosen as and for

being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or

Union Territory for a period of three years from the date of this order.
