आ.अ. 105.— यतः, भारत जनवााचन आयोग द्वारा दिनांक 5 जसतम्बर, 2024 की अजिसूचना सं0
464/भा0जन0आ0/िरर0-जव0स0/2024 के अनुसरण में िररयाणा राज्य के 78-सोिना जविान सभा जनवााचन क्षेत्र के जलए
सािारण जनवााचन, 2024 आयोजित दकया गया था; और
यतः, लोक प्रजतजनजित्व अजिजनयम, 1951 की िारा 78 के अनुसार, दकसी जनवााचन में, जनवााचन लड़ने वाला
प्रत्येक अभ्यथी, जनवााजचत अभ्यथी के जनवााचन की तारीख से 30 दिनों के भीतर अपने जनवााचन व्यय का लेखा जिला
जनवााचन अजिकारी के पास िाजखल करेगा िो उक्त अजिजनयम की िारा 77 के अंतगात उसके द्वारा या उसके जनवााचन
अजभकताा (एिेंट) द्वारा रखे गए लेखे की एक सत्य प्रजत िोगी; और

यतः, िररयाणा राज्य के 78-सोिना जविान सभा जनवााचन क्षेत्र के सािारण जनवााचन का पररणाम ररटर्निंग
आदिसर द्वारा दिनांक 8 अक्तूबर, 2024 को घोजित दकया गया था और इस प्रकार जनवााचन व्यय के लेखे िाजखल करने की
अजन्तम तारीख 7 नवम्बर, 2024 थी; और
यतः, जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के उप-जनयम (1) के अंतगात, जिला जनवााचन
अजिकारी, गुरूग्राम की ररपोटा दिनांक 11.11.2024, िो मुख्य जनवााचन अजिकारी, िररयाणा से दिनांक 05.02.2025
पत्र सं0 6/Elect-Exp./GELA-HR-2024/Elec-2025/2AE-692 को प्राप्त हुई थी, के अनुसार श्री अताउल्लाि
खान िो 78-सोिना जविानसभा जनवााचन क्षेत्र से जनवााचन लड़ने वाले अभ्यथी िैं, जवजि के अंतगात यथा पेजक्षत रीजत से
अपने जनवााचन व्ययों का लेखा िाजखल करने में असिल रिे िैं और
यतः, जिला जनवााचन अजिकारी, गुरूग्राम की उक्त ररपोटा के आिार पर भारत जनवााचन आयोग द्वारा जनवााचनों
का संचालन जनयम, 1961 के जनयम 89 के उप-जनयम (5) के अंतगात श्री अताउल्लाि खान को अपने जनवााचन व्यय के
लेखे प्रस्ट्तुत निीं करने के जलए कारण बताओ नोरटस सं.76/िरर/जव.स./व्यय लेखा/2024/सी.ई.एम.एस.-1, दिनांकः 30
अप्रैल, 2025 को िारी दकया गया था, और
यतः, उपयुाक्त कारण बताओ नोरटस के िररए और जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के उप-
जनयम (6) के अनुसार श्री अताउल्लाि खान को लेखा प्रस्ट्तुत न दकए िाने संबंिी कारणों को स्ट्पष्ट करते हुए, आयोग को
अपना अभ्यावेिन जलजखत रूप में प्रस्ट्तुत करने और नोरटस के प्राप्त िोने की तारीख से 20 दिनो के भीतर जिला जनवााचन
अजिकारी, गुरूग्राम को अपने जनवााचन व्यय का लेखा प्रस्ट्तुत करने का जनिेि दिया गया था, और
यतः, जिला जनवााचन अजिकारी, गुरूग्राम से दिनांक 11.06.2025 एंव 07.05.2026 के पत्र सं0- जनवााचन-
2025/1020 एंव जनवााचन-2026/725 के द्वारा क्रमिः सूजचत दकया िै दक उक्त कारण बताओ नोरटस जवजिवत रूप से श्री
अताउल्लाि खान के भाई (श्री निर मौ.) को दिनांक 07.05.2025 को ताजमल दकया गया था और नोरटस िुबारा से उनके
जपता (श्री कायम खान) को दिनांक 09.04.2026 को ताजमल दकया गया था, और
यतः, जिला जनवााचन अजिकारी, गुरूग्राम ने पत्र सं0- जनवााचन-2026/725 दिनांक 07.05.2026 के द्वारा
प्रस्ट्तुत की गई अनुपूरक ररपोटा में यि बताया िै दक श्री अताउल्लाि खान ने जनवााचन व्यय का लेखा प्रस्ट्तुत निीं दकया िै।
इसके अजतररक्त, उक्त नोरटस की पावती के उपरांत, श्री अताउल्लाि खान ने जवजि के अंतगात यथा जवजित लेखा िाजखल
करने में अपनी असिलता के जलए भारत जनवााचन आयोग को न तो कोई कारण बताया िै और न िी कोई स्ट्पष्टीकरण दिया
िै, और
यतः, लोक प्रजतजनजित्व अजिजनयम, 1951 की िारा 10क में यि उपबंजित दकया गया िै दकः
“यदि जनवााचन आयोग का समािान िो िाता िै दक कोई व्यजक्त
(क)
जनवााचन व्ययों का लेखा उस समय के भीतर और रीजत में िैसी इस अजिजनयम के द्वारा या
अिीन अपेजक्षत िै, िाजखल करने में असिल रिा िै, और
(ख)
उस असिलता के जलए कोई अच्छा कारण अथवा न्यायोजचत्य निीं रखता िै, तो जनवााचन आयोग,
िासकीय रािपत्र में प्रकाजित आिेि द्वारा उसको जनरर्िात घोजित करेगा और ऐसा व्यजक्त उस आिेि की तारीख से तीन
विा की कालावजि के जलए जनरर्िात िोगा।
यतः, तथ्यों और उपलब्ि ररकाडों के आिार पर आयोग का यि समािान िो गया िै दक श्री अताउल्लाि खान
अपने जनवााचन व्ययके लेखे िाजखल करने में असिल रिे िैं और उनके पास ऐसा करने में असिल रिने के जलए कोई भी
उजचत कारण अथवा औजचत्य निीं िै, और
अतः, अब, लोक प्रजतजनजित्व अजिजनयम, 1951 की िारा 10क के अनुसरण में भारत जनवााचन आयोग एतद्वारा
घोिणा करता िै दक जविान सभा के सािारण जनवााचन, 2024 में िररयाणा राज्य के 78-सोिना जविान सभा जनवााचन
क्षेत्र से जनवााचन लड़नेवाले अभ्यथी श्री अताउल्लाि खान, म0 नं0 79, गांव छारोड़ा, पोस्ट्ट ऑदिस तावडू, नूिं,
िररयाणा, इस आिेि की तारीख से तीन विा की अवजि के जलए संसि के दकसी भी सिन अथवा राज्य अथवा संघ राज्य
क्षेत्र की जविानसभा अथवा जविान पररिि का सिस्ट्य चुने िाने अथवा िोने के जलए जनरर्िात िोंगे।

New Delhi, the 12th August, 2026
O.N. 105.—WHEREAS, the General Election to Legislative Assembly of Haryana, 2024 for 78-
SohnaAssembly Constituency was held in pursuance of the Election Commission of India Notification
No.464/ECI/HAR-LA/2024, dated 5th September, 2024; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at
an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election
Officer an account of his/her election expenses which shall be true copy of the account kept by him/her or his/her
election agent under Section 77 of the said act; and
WHEREAS, the result of the above-mentioned election from78-SohnaAssembly Constituency of Haryana,
was declared by the Returning Officer on 8th October, 2024 and hence the last date for lodging the account of
Election Expenses was 7th November, 2024; and
WHEREAS, as per the report dated 11.11.2024 submitted by DEO, Gurugram forwarded by the Chief
Electoral Officer, Haryana vide his letter no. 6/Elect-Exp./GELA-HR-2024/Elec-2025/2AE-692 dated 05.02.2025,
under sub-rule (1)of Rule 89 of the Conduct of Elections Rules, 1961,Sh.Ataullah Khan a contesting candidate from
78-SohnaAssembly Constituency has failed to lodge account of election expenses, as required under law; and
WHEREAS, on the basis of the said report of the District Election Officer, Gurugram a Show-Cause notice
No. 76/HR-LA/Exp. Account/2024/CEMS-I, dated 30th April, 2025was issued under sub rule (5) of Rule 89 of the
Conduct of Elections Rules, 1961 by the Election Commission of India to Sh.Ataullah Khan for not lodging of his
account of Election Expenses; and
WHEREAS, through the above said Show Cause Notice and under sub rule (6) of Rule 89 of the Conduct of
Elections Rules, 1961, Sh.Ataullah Khanwas directed to submit representation in writing to the Commission
explaining the reasons for not lodging the account and also to lodge account of election expenses with the District
Election Officer, Gurugram within 20 days from the date of receipt of the notice; and
WHEREAS,theDistrict Election Officer,Gurugram vide his letter nos. Elec-2025/1020 and Elec-2026/725
dated 11.06.2025and 07.05.2026 respectively has informed that the notice was duly served and received
bySh.Ataullah Khan’s Brother (Sh. Najar Mohd.) on 07.05.2025 and notice was again served to his Father(Sh.
Kayam Khan) on 09.04.2026; and
WHEREAS, the District Election Officer, Gurugram in his Supplementary Report, vide its letter no. Elec-
2026/725 dated 07.05.2026 has reported that Sh.Ataullah Khanhas not submitted account of election expenses.
Further, after receipt of the said notice,Sh.Ataullah Khan has neither furnished any reason nor explanation to the
Election Commission of India, for failure to lodge the account of his election expenses as prescribed under law; and
WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-
“If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses, within the time and in the manner required by or
under this Act, and
(b) has no good reason or justification for the failure, the Election Commission shall, by order published
in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three
years from the date of the order.”;
WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh.Ataullah Khan
has failed to lodge account of his election expenses and has no good reason or justification for the failure to do so; and
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the
Election Commission of India hereby declares Sh.Ataullah Khan, H.No. 79, Village Chharoda P.O. Tauru,
District Nuh, Haryana, a contesting candidate from 78-Sohna Assembly Constituencyof Haryanain General
Election to Legislative Assembly, 2024 to be disqualified for being chosen as and for being a member of either House
of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of
three years from the date of this order.
