अ.ऄ. 107.—यतः, भारत जनवााचन अयोग द्वारा ददनांक 29 ऄप्रजल, 2024 की ऄजधसूचना
सं0464/इृीएस/2024(6) के ऄनुसरण में ओजड़िा राज्य की लोक सभा के जलए साधारण जनवााचन 2024 अयोजजत
दकया गया था; और
यतः लोक प्रजतजनजधत्व ऄजधजनयम, 1951 की धारा 78 के ऄनुसार, दकसी जनवााचन मे, जनवााचन लड़ रिा प्रत्येक
ऄभ्यथी, जनवााजचत ऄभ्यथी के जनवााचन की तारीख से 30 ददनों के भीतर जनवााचन व्यय का लेखा जजला जनवााचन
ऄजधकारी के ृास दाजखल करेगा जो ईक्त ऄजधजनयम की धारा 77 के ऄंतगात ईसके द्वारा या ईसके जनवााचन ऄजभकताा
(एजेंट) द्वारा रखे गए लेखे की एक सत्य प्रजत िोगी; और

यतः ओजड़िा राज्य के 03-सम्बलृुर संसदीय जनवााचन क्षेत्र के साधारण जनवााचन, 2024 का ृररणाम ररटर्ननग
ऑदफसर द्वारा ददनांक

जून, 2024 को घोजित दकया गया था और आस प्रकार जनवााचन व्यय लेखे दाजखल करने की
ऄजन्तम तारीख 4 जुलाइ, 2024 थी; और
यतः, जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के ईृ-जनयम (1) ऄंतगात, जजला जनवााचन ऄजधकारी,
सम्बलृुर की ररृोटा ददनांक िून्य जो मु्य जनवााचन ऄजधकारी, ओजड़िा से ददनांक 31.07.2024 ृत्र सं0 EC-CON-
COE-0103-2024-2756 (Elec.) को प्राप्त हुइ थी, के ऄनुसार श्री श्रीराम ृांडे जो ओजड़िा राज्य के 03-सम्बलृुर
संसदीय जनवााचन क्षेत्र, 2024 से जनवााचन लड़ने वाले ऄभ्यथी िज, जवजध द्वारा यथाृेजक्षत रीजत से ऄृने जनवााचन व्यय के
लेखे दाजखल करने में ऄसफल रिे िज; और,
यतः, जजला जनवााचन ऄजधकारी की ईक्त ररृोटा के अधार ृर भारत जनवााचन अयोग द्वारा जनवााचनों का
संचालन जनयम, 1961 के जनयम 89 के ईृ-जनयम (5) के ऄंतगात श्री श्रीराम ृांडे को ऄृने जनवााचन व्यय लेखे प्रस्ट्तुत निीं
करने के जलए कारण बताओ नोरटस सं. 76/ODISHA/PC-03/2024/CEMS-IV ददनांक 04 नवंबर, 2024 जारी दकया
गया थाः, और
यतः, ईृयुक्त कारण बताओ नोरटस के जररए और जनवााचनों का संचालन जनयम, 1961 के जनयम 89 के ईृ-
जनयम (6) के ऄनुसार श्री श्रीराम ृांडे को व्यय लेखा प्रस्ट्तुत न दकए जाने संबंधी कारणों को स्ट्ृष्ट करते हुए, अयोग को
ऄृना ऄभ्यावेदन जलजखत प ृ में प्रस्ट्तुत करने और नोरटस के प्राप्त िोने की तारीख से 20 ददनो के भीतर जजला जनवााचन
ऄजधकारी, सम्बलृुर को ऄृने जनवााचन व्यय का ृूणा लेखा प्रस्ट्तुत करने का जनदेि ददया गया था; और
यतः, जजला जनवााचन ऄजधकारी, सम्बलृुर से ददनांक 17 फरवरी, 2025 के ृत्र सं0 2990/Elec के द्वार सूजचत
दकया िज दक ईक्त कारण बताओ नोरटस श्री श्रीराम ृांडे के ृुत्र के द्वारा ददनांक 24 जनवरी, 2025 को तामील दकया गया
था; और
यतः, जजला जनवााचन ऄजधकारी, सम्बलृुर ने ृत्र सं0 2990/Elec. ददनांक 17फरवरी, 2025 के द्वारा प्रस्ट्तुत
की गइ ऄनुृूरक ररृोटा में यि बताया गया िज दक श्री श्रीराम ृांडे ने जनवााचन व्यय का लेखा प्रस्ट्तुत निीं दकया िज। आसके
ऄजतररक्त, ईक्त नोरटस की ृावती/चस्ट्ृा के ईृरांत, श्री श्रीराम ृांडे ने जवजध के ऄंतगात यथा जवजित लेखा दाजखल करने में
ऄसफलता के जलए भारत जनवााचन अयोग को न तो कोइ कारण बताया और न िी कोइ स्ट्ृष्टीकरण ददया िज; और
यत:, लोक प्रजतजनजधत्व ऄजधजनयम,1951 की धारा 10क में ईृबंजधत दकया गया िज दक :-
"यदद जनवााचन अयोग का समाधान िो जाता िज दक कोइ व्यजक्त -
(क)
जनवााचन व्ययों का लेखा ईस समय के भीतर और ईस रीजत में जजसी आस ऄजधजनयम के द्वारा या ऄधीन ऄृेजक्षत
िज, दाजखल करने में ऄसफल रिा िज; और
(ख)
ईस ऄसफलता के जलए कोइ ऄच्छा कारण ऄथवा न्यायोजचत्य निीं रखता िज, तो जनवााचन अयोग, िासकीय
राजृत्र में प्रकाजित अदेि द्वारा ईसको जनरर्नित घोजित करेगा और ऐसा व्यजक्त ईस अदेि की तारीख से तीन
विा की कालावजध के जलए जनरर्नित िोगा।“
यतः, तथ्यों और ईृलब्ध ररकाडो के अधार ृर अयोग का यि समाधान िो गया िज दक श्री श्रीराम ृांडे ऄृने
जनवााचन व्यय के लेखे दाजखल करने में ऄसफल रिे िैं ईनके ृास ऐसा करने में ऄसफल रिने के जलए कोइ भी ईजचत कारण
ऄथवा औजचत्य निी िज, और
ऄतः, ऄब लोक प्रजतजनजधत्व ऄजधजनयम, 1951 की धारा 10क के ऄनुसरण में भारत जनवााचन अयोग एतद्द्वारा
घोिणा करता िज दक ओजड़िा राज्य की लोक सभा के जलए साधारण जनवााचन, 2024 के 03-सम्बलृुर संसदीय जनवााचन
क्षेत्र से जनवााचन लड़ने वाले ऄभ्यथी श्री श्रीराम ृांडे, स्ट्थान-जूनुि ृटना, डाकघर-कॉलेज स्ट्वायर, थाना-मालगोडाईन,
जजला-कटक आस अदेि की तारीख से तीन विा की ऄवजध के जलए संसद के दकसी भी सदन ऄथवा राज्य ऄथवा संघ राज्य-
क्षेत्र की जवधान सभा ऄथवा जवधान ृररिद् का सदस्ट्य चुने जाने ऄथवा िोने के जलए जनरर्नित िोगें।

ELECTION COMMISSION OF INDIA
ORDER
New Delhi, the 12th February, 2026
O.N. 107.—WHEREAS, the General Election to Lok Sabha of Odisha, 2024 was held in pursuance of the
Election Commission of India Notification No. 464/EPS/2024/(6) dated 29th April, 2024. And
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an
election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election
Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent
under Section 77 of the said act; and
WHEREAS, the result of the above-mentioned elections for 03-Sambalpur Parliamentary Constituency of
Odisha was declared by the Returning Officer on 4th June, 2024 and hence the last date for lodging the account of
Election Expenses was 4th July, 2024; and
WHEREAS, as per the District Election Officer, Sambalpur, Odisha report dated NIL forwarded by the
Chief Electoral Officer, Odisha vide their EC-CON-COE-0103-2024-2756 (Elec.) dated 31st July, 2024, under sub-
rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Sriram Pandey, a contesting candidate from 03-
Sambalpur Parliamentary Constituency of Odisha has failed to lodge his account of election expenses, as required
under law; and
WHEREAS, on the basis of the said report of the District Election Officer, Sambalpur , a Show-Cause notice
No. 76/ODISHA/PC-03/2024/CEMS-IV, dated 04.11.2024 was issued under sub-rule (5) of Rule 89 of the Conduct
of Elections Rules, 1961 by the Election Commission of India to Sh. Sriram Pandey, for not lodging of his account
of Election Expenses; and,
WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the Conduct of
Elections Rules, 1961, Sh. Sriram Pandey, was directed to submit representation in writing to the Commission
explaining the reasons for not lodging the account and also to lodge account of election expenses with the District
Election Officer, Sambalpur within 20 days from the date of receipt of the Notice; and
Whereas, District Election Officer, Sambalpur vide his letter no. 2990/Elec dated 17.02.2025 informed that
the said notice was served to his son on 24.01.2025, and
WHEREAS, the District Election Officer, Sambalpur in his Supplementary Report, vide its letter no.
2990/Elec. dated 17.02.2025 has reported that Sh. Sriram Pandey, has not submitted his account of election
expenses. Further, after receipt of the said notice, Sh. Sriram Pandey, has neither furnished any reason nor
explanation to the Commission of India, for failure to lodged the account as prescribed under law; and
WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-
“If the Election Commission is satisfied that a person-
(a)
has failed to lodge an account of election expenses, within the time and in the manner required by or under
this Act, and
(b)
has no good reason or justification for the failure, the Election Commission shall, by order published in the
Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of
three years from the date of the order.”
WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Sriram Pandey has
failed to lodge his account of election expenses and has no good reason or justification for the failure to do so; and
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election
Commission of India hereby declares Sh. Sriram Pandey resident of At- Junush Patna, PO- College Square, PS-
Mal Godown, Dist- Cuttack, a contesting candidate from 03-Sambalpur Parliamentary Constituency of General
Election to the Lok Sabha of Odisha , 2024, to be disqualified for being chosen as and for being a member of either
House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a
period of three years from the date of this order.
