NOTIFICATION

No. F-1-5/2014/18.  In exercise of the powers conferred by sub- section (2) of Section 14 of the

Chhattisgarh Municipal Corporation Act, 1956 (No 23 of 1956) and sub-section (2) of Section 32 of the

Chhattisgarh Municipalities Act, 1961 (No 37 of 1961), the State Government, in consultation with the State

Election Commission, hereby, makes following further amendment in the Chhattisgarh Nagarpalika Nirvachan

Niyam, 1994, namely :-

AMENDMENT

In the said rules –

1.

For the words "Voters list" wherever they occur, the words "Electoral Roll" shall be substituted.

2.

In rule 3, for sub-rule (1), the following shall be substituted, namely :-

"(1)

The Election Commission shall subject to the provisions of the Act cause to be prepared in Form-1 a

wardwise list of electors in Hindi in the Devanagri script for each Municipality. The State Election

Commission may amend Form-1, as it deems necessary."

3.

For rule 10, the following shall be substituted, namely :-

"10.

Custody and destruction of papers.- (1) The preliminary Electoral roll published under rule

4, the claims and objections received under rule 5 along with the order of the Registration

Officer or Appellate Authority thereon and papers relating to the proceedings under rule 9-A

shall be preserved in the record room of the District Election Officer until after the next

revision of the list and shall then be destroyed.

(2)

For each Election Area, a copy of electoral roll, duly certified by Registration

Officer, shall be kept as permanent record in the Record Room of District Election

Officer."

4.

In rule 43, in sub-rule (2), for the words "their election symbols", the words "their photo and election

symbols" shall be substituted.

In rule 63, in sub-rule (3), after the word "names", the words "and photo" shall be inserted.

6.

In rule 73-A, after sub-rule (3), the following shall be added, namely :-

"(4)

Voter's data is recorded in two places in the control unit of the voting machine. First recorded

in memory of control unit and the second recorded in DMM (Detachable Memory Module)

attached to the control unit. Election Commission may issue instructions to seal the DMM

after the declaration of the results of elections for the purpose of court cases. Control units and

voting units can be used for upcoming elections. The procedure of sealing shall be determined

by the Commission."
