NOTIFICATION

No. F 7-27/2017/32.  In exercise of the powers conferred by sub-section (1) of Section 85 read with

sub-section (3) 0f Section 24 of the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No. 23 of 1973),

the State Government hereby, makes the following further amendment in the Chhattisgarh Bhumi Vikas

Niyam., 1984, the same having been previously published as required by sub-section (1) of Section 85 of the

said Adhiniyam, namely :-

AMENDMENT

In the said rules,-

In rule 2, after sub-rule (3), the following shall be inserted, namely :-

“(3-a) "Advertising Sign" means any surface or structure with characters, letters or illustrations applied

thereto and displayed in any manner whatsoever, outdoors, for the purpose of advertising or

giving information or to attract the public to any place, person, public performance, article, or

merchandise, and which is attached to any surface or structure, forms part of, or is connected

with any building, or is fixed to a tree or to the ground or to any pole, screen, fence or

hoarding or displayed in space, or in or over any water body included in the jurisdiction of the

Authority;”

In rule 2, after sub-rule (4), the following shall be inserted, namely:-

“(4-a) " Atrium" means a sky lighted naturally/mechanically ventilated area in buildings, with no

intermediate floors, used as circulation space or entrance foyer;”

In rule 2, after sub-rule (10), the following shall be inserted, namely:-

“(10-a) "Canopy" shall mean a cantilevered projection from the face of the wall over an entry to

the building at the lintel or slab level provided that,-

(i)

It shall not project beyond the plot line.

(ii)

It shall not be lower than 2.3 m. or 7‟-6” when measured from the ground

(iii)

There shall be no structure on it and the top shall remain open to sky;”

In rule 2, for sub-rule (25-b), the following shall be substituted, namely :-

“(25-b) "Disabled Person" means a person defined as a disabled person as per Government of India,

The Rights of Persons with Disabilities Act, 2016 (No. 49 of 2016);”

In rule 2, after sub-rule 26, the following shall be inserted, namely :-

“(26-a) "External Agencies" means all the agencies under the Government of India and/or the State

Government, and shall include the Airports Authority of India, National Monuments

Authority, Ministry of Environment, Ministry of Railways, Ministry of Defense, Central

Ground Water Authority, National Highway Authority of India, etc. or Government of

Chhattisgarh such as Fire Services, Public Works Department, Art Commission, Electricity

Board, Chief Electrical Inspector, Lift Inspector, High Rise Committee, Water Resource

Department, Public Health Engineering Department, Urban Administration and Development

Department, Panchayat and Rural Development Department, Department of Commerce and

Industries, Revenue Department, etc., who are required to do site inspection or give NOC (No

Objection Certificate) under their territorial jurisdiction for the time being in force for granting

Development Permission, Building Permission, Plinth Certificate and Completion cum

Occupancy Certificate;”

In rule 2, after sub-rule (34), the following shall be inserted, namely :-

“(34-a) "Information Technology Establishment (ITE)" means an establishment which is in the

business of developing either software or hardware relating to computers or computer

technology as approved by Director of Industries;”

In rule 2, for sub-rule (37), the following shall be substituted, namely :-

“(37) " Lift or Escalator" means an appliance designed to transport persons or materials between two

or more levels in a vertical or substantially vertical direction by means of a guided platform;”

In rule 2, after sub-rule (59), the following shall be inserted, namely:-

“(59-a) "Shopping mall" means integrated multi-storied shopping centre where commercial activity is

carried out along with sufficient public spaces, amenities, security arrangements and parking

as required in these rules;

(59-b) "Open mall" means a building or group of buildings where commercial activity is carried out

along with storage, godown, logistics, administrative facility, parking (open or covered);”

In rule 2, for sub-rule (60), the following shall be substituted, namely:-

“(60)

"Plot" means a portion of land held in one ownership and enclosed by definite boundary, area

and numbered;”

10.

In rule 2, after sub-rule (62), the following shall be inserted, namely :-

“(62-a) "Skyway" means a structure built over ground, whether covered or uncovered, which connects

two or more buildings and is used for pedestrian movement. The height of the skyway above

the ground shall depend upon use of the passage underneath;”

11.

For rule 10, the following shall be substituted, namely :-

"10.

Inspection.-The Building Officer may make or cause to be made all the required inspections or

he may accept reports of inspection of authoritative and recognized service or individuals; and

all reports of inspections shall be in writing and certified by a responsible officer of such

authoritative service or by the responsible individuals. As per rule 26, the Building Officer

may, subject to the approval of the Authority, appoint any specialist as he may deem

necessary to report upon unusual technical issues that may arise."

12.

In proviso of clause (viii) of sub rule (1) of rule 14, for the words "30 meters or ten stories", the words

"36 meters or twelve stories" shall be substituted.

13.

For rule 16, the following shall be substituted, namely:-

"16.

Application for permission for development or construction of Building.- Every person who

intends to develop, erect, re-erect or make alteration in any place in a building shall give

notice in writing to the Authority of his intention in the form given in Appendix „A‟ and such

notice shall be accompanied by plan and statement/information such as plans, undertakings,

affidavits, documents in quadruplicate, as required under rule 17. The plans may be in

ordinary prints on faro paper or any type. One set of such plans shall be cloth mounted, which

shall be retained in the office of the Authority for record after the issue of permit or a refusal.

The application shall be accompanied with documents showing proof of ownership or of any

legal right in relation to the site."

14.

In rule 17,-

(i)

in sub-rule (9), for the marginal heading" “Supervision”, the marginal heading “Supervision

Certificate”, shall be substituted;

(ii)

after sub-rule (10), the following shall be inserted, namely :-

“(10-a) The structure of the building will be submitted by the Engineer/Architect to certify

the self-signed structure of the earthquake-affected areas and the soil research report

with the terms and conditions prescribed in Section 84."

(iii)

after sub-rule (13), the following shall be added, namely:-

"(14)

Documents to be submitted.-

(i)

Indemnity Bond Cum Affidavit along with Annexure as given in Appendix R.

(ii)

Approved Layout or Land Use Certificate of Town and Country Planning

Department.

(iii)

Site Photographs.

(iv)

Estimation of Construction Cost of Building.

(v)

Existing Building Permission Certificate, if applicable.

(vi)

Last year Property Tax Payment Receipt.”

15.

Rule 20 shall be omitted.

16.

In clause (b) of sub-rule (3) of rule 21,-

(i)

in Item No. ii, the words "or industrial" shall be omitted; and

(ii)

after Item No. ii, the following shall be added, namely:-

17.

For rule 23, the following shall be substituted, namely:-

“23.

Duration of sanction-(1) In case of development permission under Section 30 of the

Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973, the sanction once accorded shall

remain valid up to three years.

(2)

The permission shall be revalidated, if expires. Such revalidation may be permitted

for two consecutive terms of one year each, after which proposals shall have to be

submitted afresh. In case the application for revalidation is submitted after the expiry

of the said period of three years, the Authority shall charge a permission fee equal to

the fee prescribed under clause (a) of sub-rule(3) of rule 21 before revalidating the

same. However no fee shall be charged if the application for revalidation is received

before the expiry of its validity. The limitation of five years shall not be relaxed.

(3)

In case the execution of the project begins during the validity of the permission

granted under Section 30 of the Act, the permission shall not be deemed to lapse

thereafter at any time and no revalidation shall be required.”

18.

After sub-rule (3) of rule 27, the following shall be added, namely :-

"(4)

The permission to construct any new building is not to be given without involving the hassle-

free provisions for the persons with disabilities, internal structure of the building such as floor

surface, empty spaces, corridors and roads, lattice, doors, windows, railing notice board and

toilets etc., arrangements should be made to keep the persons with disabilities favorable.

Similarly, external textures such as parking, bus step and roads etc. should be made to

accommodate persons with disabilities."

19.

In rule 28, after the word “notice”, the words “with its plans and statements” shall be omitted.

20.

Clause (h) of sub-rule (2) of rule 31 shall be omitted.

21.

In rule 34,-

(i)

for sub-rule (1) and (2), the following shall be substituted, namely:-

"(1)

Generally all construction or work for which permission is required shall be subject

to Single Joint inspection by the Authority/External Agencies and certain types of

constructions involving unusual hazards or requiring constant inspection shall have

continuous inspection by special Inspectors appointed by the Authority.

(2)

Single Joint Inspection, wherever required, according to risk classification as defined

in Rule 79-F, shall be made within 7 days of the receipt of application/notice by the

Authority/External Agency under rule 16, 96 and 98. The inspection report for

inspections carried out under Rule 10 shall be submitted in the format prescribed in

Appendix Q1. The inspection report for inspections by external agencies will be

submitted in the format prescribed under their laws for the time being in force. The

External Agency shall report to the authority within 10 days from the date of the

receipt of the notice and plans whether or not they have any objection to the proposed

construction, and give brief reasons for objection, if any. If no reply is received

within 10 days or within such further period as may be extended by the Authority

from the External Agency, then the authority shall be free to consider the question of

sanctioning the plan.”

(ii)

after sub-rule (2), the following shall be inserted, namely :-

“(2-a) The inspection reports under sub-rule (2) above shall be submitted and uploaded on

the designated website of the Authority/External Agency within 48 hours of the

Single Joint Inspection.”

22.

In sub-rule (a) of rule 42-A, for the figure and word "18m." and "18 metres", the figure and word "21

metres" shall be substituted respectively.

23.

In clause (1) of sub-rule (b) of rule 42-A, for the figures and words " 18 metres and upto 24m.", the

figures and words "21 metres and upto 30 metres" shall be substituted.

24.

In clause (2) of sub-rule (b) of rule 42-A, for the figure and word "24m." and "24 metres", the figure

and word "30 metres" shall be substituted respectively.

25.

After rule 47, the following shall be added, namely :-

"47-A. Establishment of Shopping Malls.– (1) Norms for establishment of Shopping Mall and

Open Mall shall be as below :

Permissibility and norms for establishment of Shopping Mall and Open Mall shall be

as mentioned in the Development Plan. Where the norms for building Shopping Mall and

Open Mall are not explicitly mentioned in the Development Plan of a town and in areas where

Development Plan is not in force, the norms for establishing Shopping Mall and Open Mall

shall be as below :-

31.

For rule 96, the following shall be substituted, namely :-

“96.

Plinth Certificate– On completion of the construction of the plinth, the owner of the building

shall give notice to the authority in the format prescribed in Appendix-F. The

Authority/External Agency within 7 days of receipt of such notice shall carry out Single Joint

Inspection provided under Rule 34 and submit the inspection reports in the format given in

Appendix – Q2 within 48 hours of the Single Joint Inspection. The Authority shall issue Plinth

Certificate prescribing conditions/ instructions to be followed by owner in format given in

Appendix–S within 8 days from the receipt of such notice failing which it will be deemed to

have been issued. The owner shall carry out such instructions as are given, failing which the

authority will be competent to demolish such part of the plinth as is under objection."

32. Rule 97 shall be omitted.

33. For rule 98, the following shall be substituted, namely :-

“98.

Completion and Occupancy Certificate.- On completion of the building and before its

occupation, the owner of the building shall give notice to the Authority in the format

prescribed in Appendix-G. The Authority/External Agency shall carry out Single Joint

Inspection provided under Rule 34 within 7 days of receipt of such notice and submit the

inspection reports in the format given in Appendix – Q3 within 48 hours of the Single Joint

Inspection.

The Authority shall issue Completion and Occupancy Certificate in format given in

Appendix – T within eight days from the receipt of such notice failing which it shall be

deemed to have been issued. Occupancy of a building for which a completion and occupancy

certificate has not been obtained shall be deemed to be a violation under Section 36 of the

Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No, 23 of 1973) and shall invite
