NOTIFICATION

No. F 5-15/2018/18.- In exercise of the powers conferred by Section 432-A read with

clause (36) of Section 427 of the Chhattisgarh Municipal Corporation Act, 1956 (No.23 of

1956); and clause (v) of sub-section (3) of Section 358 read with Section 359 of the

Chhattisgarh Municipalities Act, 1961 (No.37 of 1961); the State Government hereby makes

the following Model Bye-laws, for levy of charges in respect of deposit works andf or other

supervision and other services rendered by the municipal authorities, namely:-

MODEL BYE-LAWS

1.

Short title and commencement.-(1) These bye-laws may be called the (Name of the

City) Municipal (Collection and Ler,y of Charges in respect of Deposit Works and/or

Other Supervision and Other Services) Byelaws, 2019.

(2) These bye-laws shall come into force from the date of their adoption by the Urban

Local Body or after six months from the date of their publication in the Official

Gazette, whichever is earlier, in terms of Section 432-A of the Chhattisgarh Municipal

Corporation Act, 1956 (No.23 of 1956) or Section 359 of the Chhattisgarh

Municipalities Act, 1961 (No.37 of 1961), as the case may be.

2.

Exclusion.- Works done for the State Government shall not be deemed to be deposit

works under these bye-laws.

3.

Definitions.-(1) In these bye-laws, unless the context otherwise requires, -

(a) "Act" means, according to the context, the Chhattisgarh Municipal Corporation

Act, 1956 (No.23 of 1956) as amended from time to time; and/or Chhattisgarh

Municipalities Act, 1961 (No.37 of 196l) as amended from time to time; and

shall include the Rules and Bye-laws framed under the Act;

(b)"Clientz-means the person or authority, including public sector undertakings of

the Central and/or State Government, against whose order, the deposit/

supervision works are being carried out or are proposed to be carried out by the

ULB, against costs and charges paid or payable by such client;

(c) "Deposit Works' means works done by the Municipal authority, directly or

through an agency, for or on behalf of a client, in consideration of costs and

charges paid or payable by such client;

(d)"Supervision" means supervisory work done by the Municipal authority, directly

or through an agency, for or on behalf of a client, in consideration of costs and

charges paid;

(e) "Municipal Officer" means the Municipal Commissioner or any officer authorized

by him in the case of Municipal Corporations and the Chief Municipal Officer or

any officer authorized by him in the case of Municipalities and Nagar

Panchayats;

(0 "ULB" or "Urban Local Body' means, as the case may be, a Municipal

Corporation, Municipality or Nagar Panchayat, collectively or separately.

(2) Words and expressions used but not defined herein shall, according to the context,

shall have the same meaning as assigned to them respectively in the Act or in the

respective Rules.

Charges for Deposit Works done and/or Other Supenrision and Other Senrices

rendered.-(1) The ULB shall ler,y and collect charges, for Deposit Works done and/or

Other Supervision and Other Services rendered, from the client.

(2) The charges shall be according to the following scale:-

(3) Taxes, if applicable, shall be levied and collected in addition to above.

(4) In exceptional cases, and after recording reasons in writing and communicating to

the State Government, the ULB may, subject to prior approval of the State

Government and conditions, if any, as may be contained in such approval, levy and

collect charges above or below the charges prescribed in sub-bye-law (2).

(s)If on the date these bye-laws come into force, any ULB is doing any

deposit/supervision work for any client in terms of any agreement, the terms of

such agreement shall not be affected by anything contained in these bye-laws.

Recovery of Charges.-(1) The charges under these bye-laws shall be recovered along

with the instalment released by the client for the works.

(2) Unpaid charges, if any, shall be recovered as arrears of Municipal dues under the

Act.
