No. 2583/520lX){I-BlC. G.119.- In exercise of the powers conferred by the proviso to Article 309 of the
Constitution of India, the Governor ofChhattisgarh, hereby, makes the following further amendment in the Chhattisgarh
Judicial Service Pay Revision, Pension and Other Retirement Benefits Rules,2003, namely :-
AMENDMENT
In rule I 1-A(2), for clause ( 1 ) and (2), the following shall substituted, namely :-
"(1)
The revised pension of the retired Judicial Officer should be 50% of the minimum pay ofthe revised
pay scale of the post held by him at the time ofthe retirement, which shall be as Schedule2 and3:
Provided that at the time of revision and re-fixation, the existing pension shall be
consolidated first as follows :-
Existing pension as on l-1-2006
Dearness pension as on 1 -l -200
Dearness reliefat prevalent rate on both the existing basic pension and Dearness pension
as on l-l-2006
Provided further that the Judicial Offrcers, who have ceased to be in service due to death or
retirement after I st November, 2000 and prior to 1st January 2006, their pension, which has been
revised in accordance with the said rules, shall be revised by raising the same by 03.07 times w.e.f. I st
January 2006 which shall not be less than 50%o ofthe revised pay ofrevised pay scale equivalent to
the last pay drawn at the time ofhis retirement.
The revised pension shall be hxed at minimum 50% of the revised pay as mentioned in para (1) of
consolidated pension as calculated above, whichever is higher :
Provided that such Judicial Officer who retired after I st November, 2000 and prior to I st
January, 2006 and whose pension has been revised in accordance with the said rules, the full family
pension in respect of the family pensioners shall be revised by raising the same by 03.07 times w.e.f.
1st January 2006 which shall not be less than30o/o ofthe pay ofrevised pay scale equivalent to the
Iast pay drawn by the Judicial Officer at the time of retirement."
