NOTIFICATION

N0. F 7-Bl2O11/18 .- In exercise of the powers conferred by Section 433 read with

Sections 292-A, 292-8, 292-C, 292-F, 292-I of the Chhattisgarh Municipal Corporation Act,

1956 (No. 23 of 1956) and Sections 355 and 356 read with Sections 339-A, 339-8, 339-C,

339-F, 339-l of the Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961), the State

Government, hereby, makes the following further amendment in the Chhattisgarh

Municipal Corporation and Municipalities (Registration of Colonizer, Terms and Conditions)

Rules 2013, namely:-

In the said rules,-

1.

In rule 2, in sub-rule (1), in clause (f), after sub-clause (xvi), the foilowing shall be

added, namely:-

"(xvi-a) On all four sides of the colony and along both sides of the internal roads,

shady-tree saplings of such species as attain a minimum height of ten feet, and

girth not less than fifteen centimetres, must be planted and tree-guards duly fixed,

and the number of trees to be raised shal1 be computed according to the total area of

the colony at the rate of minimum fifty trees per hectare;"

In rule B, in sub-rule (2), for Table, the following shall be substituted, namely:-

In rule 10, in sub-rule (2), in clause (c), for the words "two kilometres", the words

"three kilometres" shall be substituted.

In rule 11, for clause (vii), the following shall be substituted, namely:-

"(vii) The colonizer must ensure the compliance of the following:

(a) A Resident's Welfare Association must be formed within three months of

receipt of the completion certificate or when fifty percent of the dwelling

units have been sold, whichever is earlier;

(b) Till such time as a Resident's Welfare Association has been formed, the

colonizer shall be responsible for maintenance of the colony;

(c) The colonizer shall ensure that all relevant rules and byelaws relating to all

types of waste including but not limited to solid waste, construction and

demolition waste, hazardous waste etc, are complied with, and shall be

liable for payment of user charges as may be fixed by the municipality from

time to time."

In rule 11, for clause (viii), the following shall be substituted, namely:-

"(viii) The information of completion of the development work of the colony shall be

given by the colonizer to the Competent Authority, on receipt of the

information the work completion certificate shall be issued by Competent

Authority within a period of fifteen days after inspection of the development

works of the colony, if the development r,vorks are found to be completed."

" l4.Effect of non-compliance of rule 11.- If prior to the receipt of permission

under rule 1 1, any colonizer starts the development work of the Colony or sells the

plots or prepares to sell the plots then in such circumstances the Competent

Authority may cancel the registration of the colonizer and take such legal action as

he decides to take under the law, which may include but shall not be restricted to

enforcement of mortgage created under clause (i) of rule 1 1, forfeiture of amounts

depositedunderclauses(ii) and(iii) of rule l1,andfilingof aFIRunderSection420

andf or other relevant Sections of the Indian Penal Code, 1860 (No.45 of 1860):

Provided that the registration shall not be cancelled nor any punitive action

taken before the colonizer has been given a reasonable opportunity of presenting his

CASC:

Provided further that the reasons for cancellation of the registration and/or

any action under any law shall be recorded in writing."
