No.F l0-30/2019/5.D.142.- ^{In exercise of the powers conferred} by sub-section

l'2) ^{ot secuon 27 and clause (0} and (p) of sub-section (1) of Section 11 of the

Chhattisgarh Right of Youth to Skill Development Act, 2oL3 (No. 17 of 2013), the

Chhattisgarh State Skill Development Authority, hereby, makes the following

amendment in the Chhattisgarh State Skill Development Authority (Vocational

Training Provider) Regulations, 2013, with effect from l"t August, zotg,

namely:-

AMENDMENT

In the said regulations, -

1- In regulation 2.2, for regulation 2.2.4, 2.2.s, 2.2.6, 2.2.2 and 2.2.g, the

following shall be substituted, namely:-

"2-2-4 Applicant institute has to submit a demand draft of Rs 10,000 (non

refundable) for registration as a VTp or in case of new courses

being added for already registered VTP a demand draft of additionat

amount Rs 1500 (non-refundable) per course has to be submitted

along with application payable to Chief Executive officer,

Chhattisgarh State Skill Development Authority. This registration

fee can be used for meeting the expenditure in inspection of

institution. Government institutes shall be exempted from this

registration fee.

2.2.5

For the purpose of inspection of applicant institution, the Chief

Executive officer may refer the sarne to such Inspection

Committee as he may deem fit.

2-2-6 During inSpection of training centers, tJ,.e inspection committee

would be able to dernand any such information which from

applicant or public servant it finds necessarJr and after deciding it

would submit its recommendation of Tpproval or non-approval to

District Collector-cum-Chairman District Skill Development

Authority. The inspection committee shall be provided honorarium

for inspection which shail be fixed by Chief Executive Oflicer,

Chhattisgarh State Skill Development Authority.

2.2.7

After duly considering the report of the Inspection committee, the

District Collector-cum-Chairman District Skill Development

Authority shall submit the report to chief Executive offi."r,

chhattisgarh State skill Development Authority with

recommendation of registration or shall reject the application after

recording the reasons thereof or refer the matter to the Inspection

Committee for such actions as he may deem fit.

After duly considering the recommendation of District Collector-

cum-chairrnan District skill Deveiopment Authority, chief

Executive officer, Chhattisgarh State Skill Development Authority

may either register the applicant as a Vocational Training provider

and assign a registration number or reject the application after

recording the reasons thereof or refer the matter to the District

Collector-cum-Chairman District Skill Development Authority for

such actions as he may deem fit.,,

In regulation 2.2, after regulation 2.2.g, the following shall be added,

namely:-

"2'2.9 In case of registration of the institution as a Vocational Training

Provider an amount of Rs 50,000/- (Fifty thousand only) has to be

deposited by applicant institution as a bank guarantee to District

Skill Development Authority. The amount shall be refundable in

case the institution itself applies for cancellation of registration or

in case of end of validity period.

Government institution shall be exempted from bank

guarantee. However, training partners of Government Institutions

shall have to deposit bank guarantee.

2'2.LO The registration shall be valid for a period of three years from the

date of assignment of the registration number, unress the

registration number is cancelled earlier.,'

In regulatior 2, for regulation 2.s, the following shall be substituted,

namely:-

'2.5 In case the chief Executive officer, chhattisgarh state skill

Development Authority is satisfied that tJle Vocational Training

Provider has failed to adhere to any provision of t]:e Act, the Rules

and Regulations framed there under, he may after giving due

opportunity of hearing to the vocational provider, can impose a

penalty maximum of Rs so,oOo (Fifty Thousand) by seizing the

bank guarantee deposited at the time of the registration or can

cancel ttre registration of the Vocational Training provider or can

suspend the registration of society/company/Iirm./industr5r as a

vocational Training provider for a maximum-period of up to three

years or can take all three actions levying penalty up to Rs.

section (2) of Section 27 and.clause (g) of sub-section (1) of Section 11of

the chhattisgarh Right of youth to skill Development Act, 2oLg (LZ of

2013), the chhattisgarh State skill Development Authority, hereby,

makes the following amendment in the Chhattisgarh State Skill

Development Authority (Third party Assessor) Regulations, 2014, with

effect from lst August,2OLg, namely:-

AMENDMENT

In the said regulations, -

1. In regulation 3, in regulation 3.1 (a), after the punctuation semi

colon";" the word "and" shall be omitted.

2. In regulation 3, a.fter regulation 3.1 (b), for the punctuation full stop

".", the punctuation semi colon ";,, shall be substituted.

3. In regulation 3, after regulation 3.1 (b), the following shall be added,

namely;

"(c) Third Party Assessment Agency shall deposit a bank guarantee

of Rs. 50,000 (fifty thousand) in the narne of chief Executive

officer, chhattisgarh State Skill Development Authority;

(d) In case the assessment agency fails to adhere to any

rule/provision, chief Executive officer can impose a maximum

penalty of Rs. 50,000 (fifty thousand); and

(e) chhattisgarh state skill Development Authority shall pay

assessment cost of minimum 10 trainees per batch to the Third

Party Assessment Agency. "
