NOTIFICATION
No. F 10-1112019116. - The following draft of amendment in Contract Labour
{Regulation and Abolifion) Chhattisgarh Rules,1973, which the State Government proposes
to make in exercise of the power conferred by Section 35 of the Contract Labour (neguLtion
and Abolition) Act, 1-970 (37 of 1970), is hereby, published as required by the said Act for
the information of all persons likely to be affected thereby and notice is irereby given that
the said draft shall be taken into consideration after the expiry of thirty days from the date
of publication of this notification in the Official Gazette;
Any objection or suggestions regarding the said draft received from any person
before the specified period, in office hours in office of the Secretary/Deputy Secietary,
Department of Labour, Government of Chhattisgarh, Mahanadi shawan, Ivtantralaya, Nawa
Raipur Atal Nagar, shall be considered by the Government of chhattisgarh.
DRAFT AMENDMENT
In the said rules,-
1.
In rule 17,-
(a) for sub-rule (1) and (2), the following shall be substituted, namely :-
"(1) The application referred to in sub-section (1) of Section 7 shall be made
o1li1e to the registering officer in Form I on the shramik sewa portal of
the labour department of the Government of chhattisgarh in which the
establishment sought to be registered is located.
(2) The payment of fees for the registration of the establishment referred in
sub-rule (1) shall be made by e-payment."
(b) sub-rule (3) shall be omitted;
(c) for sub-rule (4), the fonowing shall be substituted, namely :-
"(41 On submission of e-application referred in sub-rule (1) by the
applicant, an automated acknowledgement shall be genJrated
electronically on the web-portal specified in the said sub ruIe."
2.
In rule 18,-
(a) for sub-rule (1), the following shall be substituted, namely :-
"(1) Form II will be generated electronically on the web-portal, the
registration certificate given under sub-section 2 of Section 7.,'
(b) for sub-rule (4), the following shan be substituted, namery :-
'(41 If in relation to an establishment, there is any change in the
particulars specified in the certificate of registration, the principat employer
of the establishment shall intimate to the registering officer online on the
shramik sewa portal of labour department of the Government of
Chhattisgarh within fifteen days from the date when such change takes
place, the particulars of, and the reasons for, such change."

3.
In rule 19, for sub-rule (1) the following shall be substituted, namely:-
"(1) If any application for registration is not complete in all respects the
Registering Officer shall require the principal employer to amend the
application so as to make it complete in all respects on the shramik sewa
Portal. "
4.
In rule 20, in sub-rule (1),-
(i) after the words "paid by principal employeC, the words "by e-
payment" shall be inserted;
(ii) the words "and to produce the treasury receipt showing such
deposit" shall be omitted.
5.
In rule 21,-
(a) for sub-rule (1), the following shall be substituted, namely :-
"(1)
Every application by a contractor for the grant of a licence shall be
made online in Form IV, on the shramik sewa portal of labour department of
the Government of Chhattisgarh to the Licensing Officer of the area in which
the establishment, in relation to which he is the contractor, is located."
(b) in sub-rule {2]1, for the words "a accompanied by a certificate", the words
"accompanied by uploading a copy of the certificate" shall be inserted;
(c) sub-rule (3) shall be omitted;
(d) for sub-rule (4), the following shall be substituted, namely:-
"(41 On submission of e-application referred to in sub-rule (1) by the applicant,
an automated acknowledgement shall be generated electronically on the web-
portal
(e)
for sub-rule (5), the following shall be substituted :-
"(5) The deposit of security at the rates specified in rule 24 and the payment
of fees at the rates specified in rule 26 in respect of the application referred to in
sub-rule (1) shail be made by e-payment."
6.
In rule 23, in sub-rule {21, for clause (ii), the following shall be substituted, namely:-
'(ii)
The order shall record the reasons for the refusal and shall be
communicated to the applicant online through shramik sewa portal of labour
department of the Government Chhattisgarh."

ln rule 24,-
(a) in sub-rule (1), before the words "shall be deposited", the words " by e-
payment" shall be inserted;
(b) after sub rule (1), the following shall be inserted, namely:-
'(1A) Where the applicant is holding a license in regard to another work and
that license has expired, the licensing officer, if he is of the view that any
amount out of the security deposited in respect of that license is to be directed
to be refunded to the applicant under rule 31, an online application made for
that purpose in Form V-A annexed, by the applicant, adjust the amount an
online so to be refunded towards the security required to be deposited for the
new license and the applicant is required to deposit, in such a case, only the
balance amount, if any, after making such adjustment, through e-payment
onlY."
(c) sub-rule (2) shall be omitted.
8.
In rule 25, in sub-rule (1), for the words "every license granted" the words "every
license generated electronically" shall be substituted.
g.
In rule 26, for sub rule (2), the following shall be substituted, namely :-
.(21 The fees to be paid for the grant of a license under Section 12 shall be
one rupee per workman per month. "

For rule 27,lhLe following shall be substituted, namely:-
"27. Validity of the License - every license granted under rule 25 shall remain
in force up to the period applied for and for which the fees is deposited by the
applicant."
For rule 28, ttre following shall be substituted, namely :-
"28. Amendment in license - for amending the licence issued under rule 25,
with respect to change in the validity period of licence, number of workers or
change in address, the applicant is required to submit an application online
with requisite security amount or fees payable online through e-payment on
Shramili sewa portal the amendment shall be auto-generated and
communicated to the applicant."
Rule 29 shall be omitted.
In rule 31,-
(a) in sub-rule (1), in clause (i), after the words "licensing oflicer", the words
ionline through shramik sewa portal of labour department of the Government of
Chhattisgarh" shall be inserted.
In rule 33, in sub-rule (1), in clause (i), for the words "in person or sent to him by
registered post", the words, "online through shramik sewa portal of labour
department of the Government of Chhattisgarh" shall be substituted.
Rule 38 shall be omitted.
