THE CHHATTISGARH PANCHAYAT RAJ (SANSHODHAN) ADHINIYAM, 20 I 9.

A Aet further to amend the Chhattisgarh Panchayat Raj Adhiniyam, 1993 (No. I of 1994).

Be it enacted by the Chhattisgarh Legislature in the Seventieth Year of the Republic of Indiq as follows :-

Short title" extent and

(l) This Act may be called the Chhattisgarh Panchayat Raj (Sanshodhan)

Adhiniyam,20l9.

(2) It shall extend to the whole State of Chhattisgarh.

(3) It shall come into force from the date of its publication in the Offieial

Gazette.

In Chhattisgar,h Panchayat Raj Adhiniyam, 1993 (No. I of 1994),

(hereinafter as the Principal Act), in Section 2, after clause (xxx), the

following shall be added, namely:-

"(xxxi) "Person with disability" means a persons with disability as

defined in the Rights of Persons with Disabilities Act, 2016

(No.49 of 2016);"

In the Frincipal Act, in Section 13, after sub-section (l), the following shall

be substituted, namely :*

"Provided ^{that, where after the} election of ^{Panchayat, if tlere is no}

representation of person with disability, the State Government or any

authority authorized by it shall nominate one person with disability as

prescribed, to be eligible for being office bearer of Panchayat. Such

nominated person shall be nominated for the remaining period of that

Panchayat which shall be limited not less than the period of 2 years. The

rights and duties of such nominated person under the provisions of this act

shall be, as may be prescribed."

In the Principal Act, in Section 22, in sub-section (1), after clause (i), the

following shall be added, namely:-

"Provided that, where after the election ofPanchayat, ifthere is no

representation of person with disability, the state government or any

authority authorized by it shall nominate two persons with disability ^(one

male and one female) as prescribed, to be eligible for being office bemer of

Panchayal. Such nominated person shall be nominated for the rernaining

period of that Panchayat which shall be limited not less than the period of

I year. The rights and duties of such nominated person under the

provisions of this act shall be, as may be presuibed."

In the Frincipal Act, in Section 29, in sub-section (li, after clause (i), the

following shall be added, namely:-

"Provided ^{that, where} after ^the electi,on of Panchayat, ^{if there is no}

representation of person with disability, the state government or any

authority authorized by it shall nominate two persons with disability (one

male and one female) as prescribed, to be eligible for being office bearer of

Panchayat. Such nominated person shall be nominated for the remaining

period of that Panchayat which shall be limited not less than the period of

I year. The rights and duties of such nominated person under the

provisions ofthis act shall be, as may be prescribed."

In the Principal Act, in Section 36, in sub-section (l), for elause (n), the

following shall be substituted, namely :-

"(n) who are not literate;"

In the Frincipal Act, in Section 44,-

Amcndmcnt of Section 44.

(r)

in sub.section (2), after the words "meeting of the Panchayats", for

the punctuation full stop ".", the punctuation colon ":" shall be

substituted;

(ii) after sub-section (2), the following shall be added, namely:-

kovided that rights ^- related to participation in

meetinglproceedings of the Panchayat of nominated persons with

disability shall be, as may be prescribed but they strall not have

right to vote."

In the Principal Act, in Section 46, in sub-section (2), after the second ^{AmendmcntofScction,l6.}

proviso, the following shall be added, namely:-

"Provided frrrther that nominated persons with disability shall be

member of such Committees, as msy be prescribed."

In the Principal Act, in Section 47, in sub-section (4), after the second ^{AmendmentofSection{?.}

proviso, the following shall be added, namely:-

nProvided further that nominated persons with disability shatl be

member of such Committees, as may be prescribed."
