NOTIFICATION

No. F 7-24/2019/32.- The following further amendment in the Chhattisgarh Bhumi Vikas Niyam,

1984, which the State Government proposes to make in exercise of the powers conferred by sub-section (3) of

Section 24, read with sub-section (l) of Section 85 of the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam,

1973 (No. 23 of 1973), is hereby, published as required under sub-section (1) of Section 85 of the said

Adhiniyam, for the information of all persons likely to be affected thereby and notice is hereby given that the

said draft shall be taken into consideration after the expiry of thrty days from the date of publication of this

notification in the Official Gazette.

Any objection or suggestions regarding the said draft received from any person before the specified

period, during office hours, by the office of the Secretary, Deparlment of Housing and Environment,

Government of Chhattisgarh, Room No. S-23, Mahanadi Bhawan, Mantralaya, Nava Raipur Atal Nagar,

Raipur, shall be considered by the Government of Chhattisgarh.

DRAFT AMENDMENT

In the said rules,-

1. In rule 2, for sub-rule (53-a), the following shall be substituted, namely:-

"(53-a) "Pent House means an apartment on the roof of a building which shall have under

permissible Floor Area Ratio, one third limit of the roof."

2. After rule 16, the following shall be added, namely:-

"(16-a) "Every Person who wants to develop a residential colony under a single window system,

shall submit an application in electronic method (online) in Appendix A-1."

3. In rule 17, for sub-rule (l), the following shall be substituted, namely:-

" (l)

The Notice shall be accompanied with the key plan, site plan, building plan, service plan,

specifications, certificate of supervision and ownership title as prescribed in sub-rule (2) to

(ls)."

4. In rule 17, in sub-rule (11), after clause (c), the following shall be added, namely :-

*(d)

To develop a resident colony under single window system attached proof of title etc. in sub-

rule (l l) of rule 17 shall be verified by the Revenue Department."

5. In rule 17, in sub-rule (14), after clause (vi), the following shall be added, namely:-

"(vii)

Such other details For electronic method as may be prescribed by the authority."

6. [n rule 17, after sub-rule (14), the following shall be added, namely :-

"(15)

The Application by electronic method has to be submitted through e-signature and digital

Documents as per the prescribed procedure."

7. In rule 21, in sub-rule (3), after clause (e), the following shall be added, namely :-

"(0

On receip of online application for development license and building license by electronic

method actual expenditure incurred on printing of development license and building license

map, digital signature, S.M.S. alert etc. shall be imposed before issuing license."

8. In rule 27, after sub-rule (4), the following shall be inserted, namely :-

"(5)

Intimation of acceptance or rejection of the permisSion for Single Window System shall be

done by electronic method."

9. In rule 49, in sub-rule (l), in Table 4, below serial number 4 and entries relating thereto, the following shall
