NOTIFICATION

No. F 5-21/2019/18. ― In exercise of the powers conferred by Section 37 and Section 73 read with

Section 433 of the Chhattisgarh Municipal Corporation Act, 1956 (No. 23 of 1956), and Section 70 and 110

read with Section 355 and 356 of the Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961), the State

Government, hereby, makes the following further amendment in the Chhattisgarh Municipalities (The Conduct

of Business of Mayor-in-Council /President-in-Council and the Powers and Functions of the Authorities) Rules,

1998, namely :-

AMENDMENT

In the said rules, -

For rule 8-A, the following shall be substituted, namely :-

“8-A.

Administrative Approval in Respect of Schemes Sponsored by Central or State

Governments.─

(1)

Notwithstanding anything to the contrary contained in rule 8, in respect of schemes

sponsored by the Central or State Government, wherever the State Government is

required to grant administrative approval, the same power shall be vested in, as the

case may be, the Corporation or the Council or the Nagar Panchayat and the approval

shall be granted within a time-limit of twenty-one days.

Explanation - The time-limit of twenty-one days shall be reckoned from the date

when the proposal for administrative approval is placed before the Mayor or the

President, as the case may be, for needful further action.

(2)

If for any reason, whatsoever, the Corporation or the Council or the Nagar Panchayat,

as the case may be, fails to grant administrative approval within the time-limit

specified in sub-rule (1), the power to grant administrative approval in such cases

shall be vested in the District Collector, and the Commissioner or the Chief

Municipal Officer, as the case may be, shall obtain approval for the proposal from the

District Collector, and such approval shall be deemed to have been granted by the

Corporation or the Council or the Nagar Panchayat, as the case may be.

(3)

Before granting approval under sub-rule (1) or sub-rule (2), as the case may be, the

Mayor-in-Council or the President-in-Council, or the District Collector, as the case

may be, shall ensure that technical approval from the competent Engineer as

specified in rule 8 has been duly obtained.”
