No. F 7-24/2018/32.― In exercise of the powers conferred by sub-section (1) of Section 85 read

with sub-section (3) of Section 24 of the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No. 23 of

1973), the State Government, hereby, makes the Chhattisgarh Nagar Tatha Gram Nivesh Niyam, 2020, the same

having been previously published as required by sub-section (1) of Section 85 of the said Adhiniyam, namely:-

RULES

CHAPTER – I

PRELIMINARY

Short title, extent and commencement.- (1) These rules may be called the Chhattisgarh

Nagar Tatha Gram Nivesh Niyam, 2020.

(2)

It extends to the whole State of Chhattisgarh.

(3)

It shall come into force from the date of its publication in the Official Gazette.

Definitions.- In these rules, unless the context otherwise requires.-

(a)

"Act" means the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No. 23 of

1973);

(b)

"Convenor" means an officer appointed under clause (i) of sub-section (1) of Section

17-A of the Act;

(c)

"Form" means a Form appended to these rules;

(d)

"Population" means the population as per the latest published census reports;

(e)

"Section" means a Section of the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam,

1973 (No. 23 of 1973).

Applicability of the rules.- These rules shall be applicable to the regions, planning areas,

special areas constituted respectively under Section 4 or 13 or 64, as the case may be.

CHAPTER- II

CATEGORIES OF OFFICERS

Officers to assist the Director.- The State Government may appoint following Officers to

assist the Director, Nagar Tatha Gram Nivesh, from time to time, as it may deem appropriate:-

(a)

Assistant Director

(b)

Deputy Director

(c)

Joint Director

(d)

Additional Director and such other officers.

CHAPTER - III

REGIONAL PLANNING

Form of notice for publication of draft Regional Plan.- The notice regarding draft regional plan

prepared under sub-section (1) of Section 8 shall be published in Form-I.

Manner of publication of notice of draft Regional Plan.- The notice under rule 5, herein

above shall be published in,-

(a) the Chhattisgarh Gazette; and

(b) at least two Hindi news papers which have a wider circulation in the area of the

region.

Such notice shall also be affixed on the notice boards of the offices of the Divisional

Commissioner(s) and District Collector(s) and Town and Country Planning concerned,

inviting objections/suggestions from any person with respect to proposals of draft regional

plan.

Opportunity of hearing.- The Director shall consider all the objections and suggestions

received within the specified period and give reasonable opportunity of hearing to all the

persons interested. Thereafter, the regional Plan with such modifications, as he considers

necessary shall be prepared and will be submitted to the State Government for approval within

90 days.

Manner of publication of notice for approval of regional plan.- The notice under sub-section

(2) of Section 9 shall be in Form-II and shall be published in,-

(a)

the Chhattisgarh Gazette; and

(b)

at least two Hindi news papers which have a wider circulation in the area of the region.

Such notice shall also be affixed on the notice boards of the offices of the concerned

Divisional Commissioner(s), District Collector(s) and Town and Country Planning.

Notice for modifications in draft regional plan.- The notice of modification in the draft

regional plan required under the proviso to sub-section (2) of Section 9 shall be published in

the Official Gazette in Form-III and at least two Hindi news papers which have a wider

circulation in the area of the region.

CHAPTER-IV

PLANNING AREAS AND DEVELOPMENT PLANS

Manner of publication of notice for inviting objections to the existing land use map.- The

existing land use maps under sub- section (1) of Section 15 shall be published in Form-IV in the

Chhattisgarh Gazette and also at least in two Hindi newspapers which have a wider circulation

in the area concerned inviting objections and suggestions within a period of 30 days from the

date of publication. The existing land use maps shall be made available for inspection of the

general public during office hours in the offices of Divisional Commissioner(s), District

Collector(s), Town and Country Planning and the Urban Local Authorities concerned.

Manner of adoption and final publication of existing land use map.- A public notice under sub-

section (3) of Section 15 in Form-V shall be published in,-

(a)

the Chhattisgarh Gazette; and

(b)

at least two Hindi newspapers having wider circulation in the area of the plan,

informing that the existing land use plan has been adopted by the Director and the same

shall be available for

inspection at the offices of concerned Divisional

Commissioner(s), District Collector(s), Town and Country Planning and Local

Urban bodies, during office hours.

12.

Coordination with the committee constituted under Chhattisgarh Zila Yojna Samiti

Adhiniyam, 1995 (No.19 of 1995) in Draft Development Plan.- After the adoption of

map of existing land use prepared for the planning area under Section 14 (a) of the Act, by

the Director, the Convenor of the Committee may send to committee constituted under the

Chhattisgarh Zila Yojna Samiti Adhiniyam, 1995 (No.19 of 1995), a copy of existing land

use map adopted, for providing and including in Draft Development Plan, a plan of theirs if

any, in Form-VI of these rules.

13.

Functions of the Committee constituted under Section 17-A.- (1) The State Government

shall constitute a committee under sub-section (1) of Section 17-A which shall consider and

suggest modification and alterations in the draft development plan prepared by the Director

under Section 14 and hear the objections/suggestions received on the published draft

development plan.

(2)

The Convenor of the committee shall submit by recording modifications and alterations

according to committee constituted under Section 17-A, with the committee recommendation,

with due change to the Director and Director shall publish draft development plan.

(3)

The manner of recording objections received, conducting the meetings of the

Committee and obtaining its recommendations regarding modifications or alterations

in the draft development plan shall be as under :-

(a)

The Convenor of the Committee shall compile all objections and suggestions

which were received within 30 days of the publication of the draft development

plan in the Chhattisgarh Gazette in the format prescribed in Form-VII. Such

objections and/or suggestions which are identical or similar in nature shall,

as far as possible be classified under one category;

(b)

The Convenor shall record the names of the persons who had submitted their

objections within 30 days of the publication of the Draft D e v e l o p m e n t

Plan in Form-VII and shall also prepare a brief description of the objections

submitted;

(c)

The record prepared in Form-VII mentioned in clause (a) above shall be

compiled within fifteen days from the expiry of the period of 30 days from the

date of publication of the draft development plan.

(d)

The Convenor shall present the brief of the published draft development plan and

also of the objections and suggestions received and recorded. He shall indicate

location of suggestions and objections on draft development plan map;

(e)

The Convenor shall write down the committees opinion in every

objection/suggestions during the meeting, after consulting the members

present in the meeting of the Committee, Convenor of the committee shall

ensure that the hearing is completed within 90 days from the date of publication

of the draft development plan;

(f)

A member of the Committee shall not be allowed to nominate a representative

to attend the meeting on his behalf. No person other than the member shall be

allowed to attend the proceedings of the meeting. However, the Convenor

may permit such other officials to remain present as he considers necessary to

assist him;

(g)

Every person whose name has been included in the records prepared in Form-

VII shall be issued a notice for hearing in Form-VIII by the Convenor at least 7

days before the date fixed for such hearing;

(h)

The Convenor shall obtain the signature of the members present in the hearing.

In case a member does not sign, the Convenor shall make a note of the same in

the register;

(i)

The proceedings of the Committee shall commence on the time fixed for its

meeting and no quorum shall be required. The persons who were issued notices

for appearing before the committee may be called separately or in groups as

may be decided by the Convenor;

(j)

Any person who appears before the Committee for hearing shall be required to

sign the attendance register and if he refuses to do so, the Convenor shall make a

record of such refusal in the register. Such person may appear himself or

through his representative duly authorized in writing.

(k)

The Convenor shall prepare a brief description of any new issue that may be

raised during the hearing. The documents, if any, produced during the hearing,

shall also be recorded. This record shall be prepared in Form-IX;

(l) The committee, in addition to making recommendations on the objections

received, may also make its own suggestions for modifications or alterations with

respect to the draft development plan. Only such suggestions shall be recorded as

may have been approved by the majority of the members present and voting; and

(m) The Convenor shall submit the recommendations of the committee along with his

report duly signed in three sets along with the soft copies of the maps indicating

locations of objections and/ or suggestions to the Director so as to reach him

within six months (180 days) of the date of publication of the draft plan;

14.

Manner of publication of draft development plan.- (1) The draft development plan under

sub-section (1) of Section 18 shall be published together with a notice in Form-X inviting

objections and suggestions on the said draft plan within a period of 30 days from the date of

publication of such notice in,-

(a)

the Chhattisgarh Gazette; and

(b) at least two Hindi newspapers having wider circulation in the area concerned,

stating that the draft development plan has been prepared under Section 14 and is

available for inspection of general public at the offices of the concerned

Divisional Commissioner (s), District Collector (s), Town and Country

Planning and Local Urban bodies during office hours.

(2)

After receiving draft development plan and other documents from the committee, the Director

shall submit all documents and maps to the State Government with his recommendation

within the period of 90 days.

15.

Manner of publication of approved development plan.- A public notice under sub-section (4) of

Section 19 in Form-XI shall be published in,-

(a)

the Chhattisgarh Gazette; and

(b)

at least two Hindi newspapers having wider circulation in the area of the plan,

informing that the development plan has been approved by the State Government and

the same shall be available for inspection of general public at the offices of concerned

Divisional Commissioner(s), District Collector(s), Town and Country Planning and

Local Urban bodies during office hours.

16.

Modification in development plan.- (1) An application for modification of development

plan under clause (b) of sub-section (1) of Section 23-A shall be made to the Director in Form-

XII. Such application shall be submitted only by the owner of the land. Where the land in

question is owned jointly, the application may be submitted by any one of the owners and the

same shall be accompanied by affidavits of all other co-owners authorizing the applicant.

(2)

Every application submitted under sub-rule (1) a s above shall be accompanied with the

three copies of documents mentioned in Form-XII and also an application fee of Rs.

5000/- per Hectare or part thereof of the land will be deposited with Challan in Main Head-

0217 Urban Development Plan Town and Country Planning and its original or attested

copy over which modification has been applied shall be attached.

(3)

(a)

The Director shall send the application received to the concerned Town and Country

Planning Regional Office, for submitting a detailed factual report. The applicant shall

have to submit softcopy of the application and the documents therein such number as

required by the Director.

(b) The Regional office of Town and Country Planning shall send a copy of the application

along with the documents and its factual report thereupon to the Committee constituted

under these rules.

(c)

The concerned Joint/Deputy/Assistant Director who as Member-Secretary of the

Committee after getting orders from the Collector may seek the comments of concerned

government departments/agencies on the proposed change of land use. If the concerned

government department / agency fails to communicate its comments within a period of

21 days, its consent shall be presumed.

(4)

The committee consisting of the following officers as of table 16(1) shall examine the

factual report, the comments of the district office under clause (b) of sub-rule (3) and

responses received under clause (c) of sub-rule (3) of rule 16, namely:-

(5)

The applicant shall be given an opportunity to present his case before the Committee.

The Committee may, if so required, direct the applicant to furnish such additional

information, as may be considered necessary.

(6)

The Committee shall submit report to the Director for modifications on land use,

except road and recreational, shown in development plan on said application for

modification.

(7)

The Director on receiving the recommendations of the Committee under sub-rule (7)

may publish a public notice in Form-XIII. Such notice shall be published in such two

daily newspapers, which have wide circulation in the concerned town. The details of the

proposed modification shall be made available for inspection of general public in the

offices of Joint Director /Deputy Director/Assistant Director in-charge of the

district and the same shall also be displayed on the website of the Department. The copy

of the notice shall also be sent to the concerned Divisional Commissioner, District

Collector, Zila Panchayat and Local Urban Bodies for affixing on their notice boards.

(8)

The Director shall provide reasonable opportunity of hearing to the person who may

have submitted his objections or suggestions with regard to the proposed modification

within the stipulated time.

(9)

The Director may after considering the objections / suggestions and the

recommendations of the Committee shall as he may deem appropriate send the

proposal for modification in the scheme to the State Government for approval or

rejection. After the decision of the State Government and receiving the information

regarding the collection of levy, the Director shall publish notice in Chhattisgarh

Gazette. The modification so made shall become an integral part of the development

plan.

(10)

The State Government or Director may impose such conditions, as it may consider

appropriate while modifying the plan under sub-rule (10) above.

(11)

(a) In case the modified land use is such as mentioned in column (2) of the table 16(2)

below, the applicant shall have to pay a levy calculated as mentioned in column (3) or

(4) as the case may be, therein. Calculation of levy shall be approved by the Director.

(b) The prevailing guideline rate of the land, where the modified land use is as

(12) (a) In case the modified land use is such as mentioned in column (2) of the table

over which such land use modification is applied for is not less than that as

mentioned below, in column (3) or (4) of Table 16(3) as the case may be:-

(b) In cases where after the modification, the modified land use is other than the

residential, mixed, commercial or industrial, there shall be no condition of

minimum area for submitting an application under clause (b) of sub-section (1) of

Section 23-A. The land over which the modified land use has been applied for shall

ordinarily be in one piece.

only such land as owned by the applicant in his own name or co-owned by the applicants

in their own names shall be considered.

Note: For the purpose of removing any doubt it is clarified that two or more different

owners of different pieces of land shall not be permitted to jointly make an application for

the purpose of fulfilling the minimum requirement of land mentioned in this sub-rule.

CHAPTER-V

CONTROL OF DEVELOPMENT AND USE OF LAND

17.

Intention of development undertaken on behalf of Union or State Government. - Where the Union

or State Government intends to carry out development of any land, the authorized officer of the

concerned Government shall inform the Director in writing of such intention at least 30 days

before under sub-section (1) of Section 27 of the Act in Form-XIV of these rules, before undertaking

the proposed development. Such information shall be accompanied by the following

documents and particulars, namely:-

(1)

Description of land (Location with name of road/roads on/off which the land is situated

and its boundaries).

(2)

Khasra Plan showing Khasra numbers of the land in question and also adjoining

Khasra numbers lying within 200 meters from the outer limit of the land. The land in

question shall be shown in red in Khasra map.

(3)

Location plan, indicating the land in question in 1:1000 map scale showing main

approach roads and any other important buildings in the vicinity.

(4)

Survey plan on scale 1:1000 to be given showing boundaries of land in question and also

showing physical features within 200 meters radius such as na1a, water bodies, trees,

slopes, contour plan if the land is undulating, high tension lines, existing roads showing

the right of way, railway lines and railway boundaries, position of electric and

telephonic poles and all such other developments and features which need to be

coordinated with adjoining areas and land in question.

(5)

A plan showing all development proposals with respect to the land in question with a

general report so as to make the scheme self explanatory.

(6)

Such plan must give information regarding utilities and services like water supply,

drainage, electricity and sewerage.

(7)

Other architectural details as required by the Director.

(8)

A note indicating the type of development proposed namely residential, commercial,

industrial or indicating any other related matter.

(9)

The name and address of registered Planner/ Architect/ Engineer engaged.

18.

Form of application for permission to develop land by other people.- (1) Any person

other than the Union Government, State Government, Local Authority or Special Area

Authority, shall apply, in Form-XV of these rules, under sub-section (3) of Section 16 and

sub-section (1) of Section 29 of the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam,

1973 (No. 23 of 1973), for permission of development of land, in an area where existing

land use has been frozen under Section 16 of the Act, and or to develop the land in an area

where development plan has been adopted under Section 19 of the Act.

(2)

Any person other than Central Government, State Government, Local Authority or

Special Area Authority shall submit an application under single window system in

electronic method (online) under rule 16-A, APPENDIX A-1 of the Chhattisgarh

Bhumi Vikas Niyam, 1984, to develop a residential colony.

(3)

Fees - Alongwith the application form submitted under sub-section (3) of Section

16 and sub-section (2) of Section 29, the prescribed fee under rule 21 of the

Chhattisgarh Bhumi Vikas Niyam, 1984 shall be deposited with Challan in Main Head-

0217 Urban Development Plan Town and Country Planning and the original or

attached copy of challan of receiving such payment shall be attached with the

application.

19.

Form of permission.-(a) The permission for development of land shall be granted and

communicated to the person concerned under sub-section (3) of Section 30 in Form-XVI

and its copies shall be sent to Municipal Corporation, Municipal Council, Town and

Country Development Authority and Special Area Development Authority concerned and

any other office concerned with the development works along with the copy of the

approved plan. The plan shall be approved and signed by the Director, modifications if

any shall be shown in red lines and two copies of approved plan shall be sent to the

applicant. In case the modifications are excessive, a fresh plan shall be demanded

incorporating the revised plan showing all the modification communicated by the

Director.

(b)

The refusal of permission with grounds shall be communicated in Form-XVII and

shall be handed over to the applicant, if he is present and his acknowledgment

shall be obtained. In case he is not present, such reply shall be sent to him under

registered post with due acknowledgment.

(c)

Any applicant can submit an application in the Form-XVIII to the Director with

the affidavit under the provisions of Section 30-A of the Act for amendment in the

approved layout scheme.

20.

Merger and division.- (A) Merger of plot-(1) An application for merger of a plot with

another plot or land shall be made to the Director by the owners or a person authorized

by the owner(s) of such plot or land, as the case may be, in Form- XIX. The documents

mentioned in the form shall also be submitted along with the application. The

application fee shall be Rs 5000/- and a copy of receipt of payment of such fee

shall be submitted along with the application. In case the application of merger is

allowed the applicant shall have to pay a permission fee equivalent to Rs. 25000/- at

the time of the grant of such permission.

(2)

(1) In cases where land use premise is residential, merger of the plots shall be

allowed subject to the following conditions-

(a) plots for economically weaker sections and low income groups shall

not be merged;

(b) only contiguous plots shall be merged and the size of such merged

plots shall not exceed 1000 sq.m;

shall not exceed the sum of the dwelling units permissible in the plots that

were merged;

(2) The merger of a residential plot with land is prohibited.

(3)

(1) The contiguous plots with commercial land use premises may be

merged.

(2) The merger of a commercial plot with land is prohibited.

(4)

The contiguous plots with Public and Semi-Public land use premises may be

merged. Such plot may also be merged with contiguous land of similar land

use.

(5)

The contiguous plots with industrial land use premises may be

merged.Such plot may also be merged with contiguous land of similar land

use.

(6)

On receipt of an application for merger the Director shall issue a public

notice in Form-XX inviting objections and suggestions from persons likely to be

affected, if any, by such merger. Notice shall also be served through speed

post upon owners or occupiers of plots adjacent to those being merged.

Such persons shall be provided an opportunity of hearing and they shall be

informed at least 7 days prior to the date fixed for hearing. After the last day

fixed for receiving the objections, Director shall proceed to examine

the

objections received, if any. The Director may call for additional information

from the applicant or the objector or any public Authority that he may

consider necessary.

(7)

(i)

After considering the objections and suggestions and hearing the persons

interested, if any, the Director may either,-

(a) accept the application; or

(b) reject the application; or

(c)

accept the application with such conditions as considered appropriate.

(ii) However, an application of merger shall not be accepted, if such merger-

(a) adversely affects in any manner the right of access of any

person.

(b) violates the norms prescribed in the applicable Development Plan or

the provisions of the Act or these rules.

(8)

No application of merger shall be considered in case of plot or land with mixed

use.

(9)

Where the plot is part of a layout of a scheme developed by any State

Government agency like 'the Housing Board, Special Area Development

Authority, Town and Country Development Authority, merger may be

permitted only if the applicant furnishes the No Objection Certificate of the

concerned agency.

(B) Division of the plot:-

(1)

An application for division of a plot shall be made to the Director in

Form-XXI. The documents mentioned in the form shall also be

submitted along with the application.

(2)

The application fee shall be Rs 5000/- and a receipt of payment of such

fee shall be submitted along with the application. In case, the

application of division is allowed the applicant shall have to pay a

permission fee of Rs.25000 at the time of the grant of such permission.

(3)

Division of plot with only Public and Semi Public or industrial use

premises shall be permissible. No application of division shall be

considered in case of plot with mixed use or any other use.

(4)

On receipt of an application for division the director shall issue a

public notice in Form-XXII inviting objections/ suggestions from

persons, likely to be affected by the division applied for. Notice shall

also be served through speed post upon owners or occupiers of plots

adjacent to the plot under division, such person shall be given an

opportunity of hearing and they shall be informed at least 7 days prior to

the date fixed for hearing. After the last day fixed for receiving the

objections /suggestions, the Director shall proceed to examine

objections received, if any. The Director may call for additional

information from the applicant or the objector or any Public

Authority that he may consider necessary.

(5)

(i)

After considering the objections and suggestions and hearing the

persons interested, if any, the Director may either-

(a) accept the application; or

(b) reject the application; or

(c)

accept the application with such conditions as considered

appropriate.

(ii) However, an application of the division of the plot shall not

be accepted if such division-

(a) adversely affects in any manner, the right of access of

any person.

(b)

Violates the norms prescribed in the applicable development

plan or the provisions of the Act or these rules.

(6)

Where the plot is part of a layout of a scheme developed by any State

Government agency like the Housing Board, Special Area Development

Authority, Town and Country Development Authority, division may be

permitted only if the applicant furnishes the No Objection Certificate of

the concerned agency.

21.

Appeal.- An appeal preferred under sub-section (1) of Section 31 of the Act shall

contain,-

(a)

a copy of the order against which the appeal is being filed;

(b)

a clear statement of facts and the ground on which the appeal is made;

(c)

the relief prayed for; and

(d)

a proof of having paid a fee of Rs. 1000/- deposited with Challan in Main Head-0217

Urban Development Plan Town And Country Planning and attach its original or attested

copy.

22.

Revision.- A revision preferred under sub-section (1) of Section 32 of the Act shall

contain.-

(a)

a copy of the order against which the revision is being filed;

(b)

a clear statement of facts and the ground on which the revision is made;

(c)

the relief prayed for; and

(d)

a proof of having paid a fee of Rs. 2000/- deposited with Challan in Main Head-0217

Urban Development Plan Town And Country Planning and attach its original or attested

copy.

23.

Notice by owner to purchase interest in land.- The notice shall be served on the State

Government under sub-section (1) of Section 34 in Form-XXIII so as to reach it within a period

of 30 days from the date of publication and designation of land as subject to compulsory

acquisition by the development plan together with the documentary proof of ownership, location

plan and site plan.

24.

Permission for retention of land.- (1) The aggrieved person shall apply to the Director

for permission for retention on the land of any building or works or further continuance of

any use of land to which the notice given under sub-section(1) of Section 37 relates

together with reasons within a period of 15 days from the date of receipt of the notice and

such application shall be made in Form-XXIV.

(2)

A developer who has been served notice under section 37(1) of the Act for

removal of unauthorized development may apply under Rule 24 of Chhattisgarh

Nagar Tatha Gram Nivesh Niyam, 2020, for permission for retention on the land

of any building or works or for the continuance of any use of land to which the

notice is related, the Director after such enquiry as he deems fit, comes to the

conclusion that the permission may be granted for retention of such building or

works or for the continuation of use of such land, such permission shall be

granted only on payment of compounding fees by the said developer at the rates

prescribed as under :-

Provided that if any development/construction is made in contravention of the

provisions of the said Adhiniyam by any department of Central Government or State

Government/Local Authority or any Authority constituted under the said Adhiniyam or

any Public Sector Undertaking, Corporation, Board or any institution established by the

Central or State Government, under any Government Scheme of public purpose and

submits application for regularization of such unauthorized development/construction

under sub-section (3) of Section 37, then relaxation can be given in compounding fee as

prescribed under sub-section (5) of Section 37 of the said Adhiniyam by the State

Government:

Provided also that if development/construction is not found in accordance with

the provisions of the said Adhiniyam and rules made thereunder and the development

plan, then after removal of such part of development/ construction by the concerned

department/institution which does not qualify for regularization, remaining part shall be

regularized and disciplinary action can be taken against the authorized officer of the

concerned department/institution.

CHAPTER VI

TOWN AND COUNTRY DEVELOPMENT AUTHORITY

25.

Term of office of the Chairman, Deputy Chairman and other members.- The term of office of

the Chairman, Deputy Chairman and other members shall ordinarily be three years. The

Chairman or a members may be removed from such office by the State Government at any

time, before completion of the term, without assigning any reason thereof.

26.

Rule for providing social facilities under Section 49 (3) (e). - (a) Land up to a maximum of 10

percent can be reserved and developed for use as mentioned in Section 49 (3) (k) (a) (two).

(i)

According to Section 49 (3) (k) (a) (three), the land should be reserved for a maximum of 5

percent for social infrastructure such as school/dispensary/nursing home/fire fighting / public

facility area/police station /post office/ electrical sub-station etc.

(ii)

When there is reservation of land for school/dispensary/ nursing home, it should be kept in

mind what kind of facilities are available around the Town development scheme and what

kind of facilities are required.

(iii)

Deposits can be made according to the proposal in the Town Development Scheme of

reserved land for the school/ dispensary/ nursing home / public facility area and the money

received from the expenditure will be utilized for the purpose of providing infrastructure

facilities and for the purpose of maintenance.

27.

Preparation of Town Development Scheme.- (l) The Town and Country Development Authority

shall prepare and publish a notice under sub-section (2) of Section 50 in Form-XXV declaring the

intention of making a town development scheme in the Gazette and by means of an advertisement in

one or more local Hindi newspapers. Copies thereof shall also be available for inspection in the office

of the Town and Country Development Authority and Regional Office of Town and Country Planning

Department concerned.

(2)

Not later than two years from the date of publication of the declaration in the form of the

notice referred to in sub-rule (1) the Town and Country Development Authority shall publish

a public notice under sub-section (3) of Section 50 in Form-XXVI in the “Chhattisgarh

Gazette” and in one or more local Hindi newspaper to give due publicity intimating that the

draft town development scheme has been prepared and is available for inspection in the office

of the Town and Country Development Authority and regional office to Town and Country

Planning Department concerned during office hours inviting objections and suggestions with

respect to the said draft within a period of thirty days from the date of publication of such

notice.

(3)

The committee constituted under sub-section (5) of Section 50 shall not consist of any officer,

who was involved in the preparation of the Town Development Scheme by the authority.

(4)

The State Government shall publish a notice under sub-section (6) of Section 50 of the Act, in

Form-XXVII, to give due publicity intimating that the Town Development Scheme has been

approved and copies thereof shall be made available for inspection in the concerned office of

the Town and Country Development Authority and Town and Country Planning Department,

during office hours.

The objection or suggestions, which are received from the person likely to be

affected, if any, before 30 days from the date of their publication in the Chhattisgarh Gazette

shall be given due opportunities of hearing by the Government of Chhattisgarh.

(5)

Under sub-section (7) of Section 50 the procedure and process through which the

compensation shall be paid :–

(1)

The date of declaration of intent to make a scheme shall be considered, for the basis

of payment of compensation under sub-section (2) of Section 50 of the Act. The

application for seeking compensation for the loss of its property by the landowner

should be submitted along with such documents within one month of the publication

of the draft scheme under sub-section (3) of Section 50 to prove that the property

held by them as bhawan, chaardeewari, nalkoop, was constructed in the said form

prior to the date of publication of the scheme.

(2)

To evaluate the compensation, the Chief Executive Officer of the respective Town

and Village Development Authority will appoint a registered appraiser who, in the

presence of both the parties, evaluate the property and submit the report to the chief

executive officer of Town and Country Development Authority.

(3)

If any owner is not satisfied with the assessment then he may appeal against the order

of assessment under Section 51 of the Act within 30 days from the date of

implementation of the scheme and its publication in the Chhattisgarh Gazette of the

Final Town Development Scheme or from the date of receiving the notice of

compensation.

(6)

After receiving the final town development scheme under clause-two of sub-section (7) of

Section 50, the State Government shall publish the final Town Development Scheme in the

Form-XXVIII in Chhattisgarh Gazette and two local news papers in which one will be Hindi

and one will be English according to clause (2) of sub-section (8) of Section 50.

The process of evicting the person under Section 50-C.-(1) In the event that a person

occupies the land of the scheme even after the implementation of the final town development

scheme, the Chief Executive Officer of the Town and Country Development Authority or his

authorized official shall issue notice, to the person according to which he must remove his

possession within 15 days.

(2)

If the concerned person does not remove his occupation in the prescribed period after

getting the notice, then the Chief Executive Officer of the Town and Country

Development Authority or his authorized official shall issue a notice to him.

According to which the person must remove the occupation within 7 days.

(3)

If the concerned person does not remove his occupation even after the second notice,

then the Chief Executive Officer of the Town and Country Development Authority or

his authorized officer will issue the third and final notice, in accordance with which

the person concerned will have to remove his possession within 48 hours, and even

after such passage of time, if the occupation is not removed then in that case, the

Chief Executive officer of Town and Country Development Authority will have

power to evict the owner from the property immediately and be able to use police

force for the said purpose as soon as possible.

28.

Objection by the owner.- If due to Town Development Scheme under clause (e) of sub-section (3) of

Section 50, any property or right has been adversely affected, the owner shall submit an objection

within the period of 30 days of publication of draft scheme in sub-section (3) of Section 50 of the Act.

29.

Appointment of persons for the assistance of the Appellate Authority.- For the assistance of the

Appellate Authority the State Government shall appoint such persons, who are retired officers of

authority, not below the rank of Executive Engineer and whose technical qualification is B.E (Civil)

and has experience in planning of a Town Development Scheme, and retired officer of Town and

Country Development Authority, not below the rank of Joint Director (Planning) of the Authority.

30.

Payment of additional amount by the owner.- Under sub-section (2) of Section 58-G the payment of

additional amount, if any, by the owner to the State Government, shall be payable in the quarterly

installments from the date of publication in the Gazette of the final development scheme under Section

58-G. The first installment in which the publication is made in the Official Gazette will be due before

the 10th of the following month.

31.

Mode of levy. – (1) The Town and Country Development Authority shall publish a notice under

sub-section (1) of Section 60 of the Act in Form-XXIX in “Chhattisgarh Gazette” and in one more

local Hindi newspapers to give it due publicity declaring that the town development scheme has been

completed and the authority intends to levy development charges at the prescribed rate in the area

covered by the scheme and invites objection, if any, from the owner of the land liable to pay

development charges within a period of not less than thirty days from the date of publication of such

notice. Copies of the notice shall also be affixed in the concerned offices of the Town and Country

Development Authority and Town and Country Planning Department.

(2)

The Town and Country Development Authority shall, not later than 3 months after the

publication of notice as specified in sub-rule (1), issue a notice in Form-XXX for being served

on the person concerned either in person or by registered post, for due acknowledgment, for

the purpose of assessing the development charges due to him as specified in the said notice.

32.

Power to borrow money.- (1) The Town and Country Development Authority may, with

the previous sanction of the State Government under Section 63 of the Act, borrow money

by issuing debentures for the purposes of the Act.

(2)

The State Government shall determine,-

(a)

the amount of money to be borrowed by issue of such debentures, their issue

price, denomination, terms of maturity and the rate of interest;

(b)

the manner in which a deposit fund shall be constituted for the redemption of

debentures, report to be made in case of any failure on this account,

subscriptions to the debentures

made, the intervals at which the interest on

debentures shall be paid, debentures which by reasons of damages sustained

have become unfit for circulation shall be replaced, fresh debentures issued

to replace those lost or destroyed, the rate at which brokerage and under

writing commission may be paid;

(3)

No debentures shall be issued, except with the guarantee by the State Government,

as to the repayment of principal and payment of interest.

(4)

The authority may, with the sanction of the State Government, reserve the

debentures or bonds for issuing to any particular person or institution or have them

under written.

33.

Terms and conditions subject to which loans may be raised by the Special Area

Development Authority.- (1) The Special Area Development Authority may for the

purpose of the Act, may raise loans under sub-section (2) of Section 70, in pursuance of a

resolution passed at a special meeting convened for the purpose:

Provided that no loan shall be raised without the previous sanction of the State

Government:

Provided further that the terms upon, the period within and the method by which

the loan is to be raised and repaid shall be subject to these rules and the approval of the State

Government.

(2)

The Special Area Development Authority shall, maintain a deposit fund for the

repayment of loans raised under sub-rule(1) and shall pay every year in the

deposit fund such amount, as may be directed by the State Government.

(3)

The deposit fund or any part thereof shall be applied for any other purpose until

such loan is wholly discharged.

34.

Repeal and savings.- The Chhattisgarh Nagar Tatha Gram Nivesh Niyam, 1975 and the

amendment made therein, from time to time, hereby stand repealed:

Provided that,-

(a)

such repeal shall not affect the previous operation of the said rules or anything done or

any action taken, there under;

(b)

any application submitted under the repealed rules, pending at the commencement

of these rules shall be continued and disposed of in accordance with the provisions of

these rules;

(c)

nothing in these rules shall be construed as depriving any person to whom these rules

apply of any right of appeal which had accrued to him under the rules so repealed.
