NOTIFICATION

No. F 1-5/2014/2018.⸺ In exercise of the powers conferred by Section 433 read with sub-section (2)

of Section 14 of the Chhattisgarh Municipal Corporation Act, 1956 (No 23 of 1956) and Section 355 read with

sub-section (2) of Section 32 of the Chhattisgarh Municipalities Act, 1961 (No 37 of 1961), the State

Government, in consultation with the State Election Commission, hereby, makes following further amendment

in the Chhattisgarh Nagarpalika Nirvachan Niyam, 1994, namely:-

AMENDMENT

In the said rules,-

1. After rule 3-B, the following shall be added, namely:-

“3-C. Alignment of Municipal Voters List to the Voters List prepared by the Election Commission of

India.─ (1) The voters list for Municipal election shall be prepared by dividing, according to wards, the

voters whose names appear in the current voters list prepared by the Election Commission of India, in

respect of election booths of assembly elections falling within the municipal area.

(2) The voters list as updated by the Election Commission of India till the date prior to the

date of publication of the public notice issued by the State Election Commission for preparation of

voters list, alone shall be the basis for action under sub-rule (1).

(3) The voters list prepared in accordance with sub-rule (2) shall be published for inviting

claims and objections under Rule 4.”

2.

For sub-rule (1) of rule 5, the following shall be substituted, namely:-

“(1) Any such person whose name appears in the voters list published by the Election Commission of

India in respect of the area falling within municipal limits, but does not appear in the voters list

published by the Registration Officer under rule 4, or whose name has been entered in the wrong place

with incorrect particulars, or any person the inclusion of whose name is objected to, may before 3.00

p.m. on the last date as specified in the public notice under rule 4, submit his claim or objection to the

Registration Officer through an application duly signed by him in writing, and no claim or objection

shall be accepted if submitted thereafter:

Provided that notwithstanding anything to the contrary contained in this sub-rule, any person

whose name has been included in the Voter List for the related assembly constituency maintained by

the Election Commission of India, during the period from the date of publication of the public notice

for Voter List under sub-rule (1) of rule 4, to the specified last date for disposal under rule 6, of claims

and objections received under sub-rule (1) of rule 5, may also file application under this sub-rule for

inclusion of name in the Voters List for municipal election.”
