NOTIFICATION

The following further draft amendment in the Chhattisgarh Panchayat

Nirvachan Niyam, 1995, which the State Government proposes to make, in exercise of the powers conferred by

sub-section (1) of Section 95 read with Section 43 of the Chhattisgarh Panchayat Raj Adhiniyam, 1993 (No. 1 of 1994),

is hereby, published as required by sub-section (3) of Section 95 of the said Act, for the information of all persons likely

to be affected thereby and notice is hereby given that the said draft shall be taken into consideration after the expiry of

fifteen days from the date of publication of this notification in the Official Gazette.

Any objection or suggestion regarding the said draft received from any person, before the specified period

during office hours by the office of the Under Secretary, Panchayat And Rural Development Department, Govt. of

Chhattisgarh, Room No. AD0-7, Mantralaya, Mahanadi Bhawan, Atal Nagar, Raipur shall be considered by the

Government of Chhattisgarh.

DRAFT AMENDMENT

In the said rules,-

After rule 9-A the following shall be added, namely:-

“9-B.

Alignment of panchayat Voters List to the Voters List prepared by the Election Commission of India.-

(1) The voters list for panchayat election shall be prepared by dividing, according to panchayats, the

voters whose names appear in the current voters list prepared by the Election Commission of India, in

respect of election booths of assembly elections falling within the panchayat area;

(2) The voters list as updated by the Election Commission of India till the date prior to the date of

publication of the public notice issued by the State Election Commission for preparation of voters

list, alone shall be the basis for action under sub-rule (1);

(3) The voters list prepared in accordance with sub-rule (2) shall be published for inviting claims and

objections under rule 10.”

For sub-rule (1) of rule 11, the following shall be substituted, namely :-

“(1)

Any such person whose name appears in the voters list published by the Election

Commission of India in respect of the area falling within panchayat limits, but does not

appear in the voters list published by the Registration Officer under rule 10, or whose name

has been entered in the wrong place with incorrect particulars, or any person the inclusion of

whose name is object to, may before 3.00 p.m. on the last date as specified in the public

notice under rule 10, submit his claim or objection to the Registration Officer through an

application duly signed by him in writing, and no claim or objection shall be accepted if

submitted thereafter :

Provided that notwithstanding anything to the contrary contained in this sub-rule,

any person whose name has been included in the Voter List for the related assembly

constituency maintained by the Election Commission of India, during the period from the

date of publication of the public notice for Voter List under sub-rule (1) of rule 10, to the

specified last date for disposal under rule 12, of claims and objections received under

sub-rule (1) of rule 11, may also file application under this sub-rule for inclusion of name in

the Voters List for panchayat election.”
