No./F 8-6/2013/18.⸺ In exercise of the powers conferred by Section 292-A, 292-B,

292-C, 292-F and 292-I read with Section 433 of the Chhattisgarh Municipal Corporation

Act, 1956 (No. 23of 1956) and Section339-A, 339-B, 339-C, 339-F and 339-I read with

Section 355 and 356 of the Chhattisgarh Municipalities Act, 1961 (No. 37 of1961), the State

Government,hereby, makes the following further amendment in the Chhattisgarh Municipal

Corporation and Municipalities (Registration of Colonizer, Terms and Conditions) Rules,

2013, namely:-

AMENDMENT

In the said rules,-

1.

After rule 16, the following shall be added, namely:-

“16-A.

Special Provisions for Colonies in Panchayat Areas subsequently

included in Municipal Area.─(1) Notwithstanding anything to the

contrary contained elsewhere in these rules, when a Panchayat area is

included in a Municipal area, or a Nagar Panchayat is formed, the

residential colonies under construction in the Panchayat area shall be

dealt with as follows:-

(a) Within ninety days from the cut-off date, every colonizer holding

a valid registration granted under the Chhattisgarh Gram Panchayat

(Registration of Colonizer, Terms and Conditions) Rules, 1999, shall

apply on Form-One(A), to the competent authority, after making

payment of registration fees according to Rule 4, for grant of

registration under Rule 3 read with this Rule, accompanied by a

copy of the registration certificate granted under the Chhattisgarh

Gram Panchayat (Registration of Colonizer, Terms and Conditions)

Rules, 1999, and documents as specified in sub-rule (2) of rule 3

herein.

Explanation- „Cut-off date‟ means the date of publication of the

notification regarding inclusion of the Panchayat area in the

municipal area, or formation of the Nagar Panchayat, as the case

may be, in the Official Gazette.

(b)

On receipt of application under clause (a), the competent

authority shall, after making such inquiry as he may consider

necessary, grant registration on Form-Two(A):

Provided

that

the

colonizer

may

continue

with

the

construction work, pending receipt of registration from the

competent authority.

(c)

While granting registration under clause (b), the competent

authority shall, to the extent feasible, honour all terms and

conditions which governed the registration granted under the

Chhattisgarh Gram Panchayat (Registration of Colonizer, Terms

and Conditions) Rules, 1999.

(d)

Without prejudice to the generality of clause (c), the competent

authority shall provide that the colonizer may directly sell

developed plots/dwelling units developed/built according to the

terms of registration, for the low income group and/or the

economically weaker sections, after obtaining approval of the

competent authority for the proposed eligible beneficiaries and

sale-price.

(e)

In respect of colonizers whose registration under the

Chhattisgarh Gram Panchayat (Registration of Colonizer, Terms

and Conditions) Rules, 1999, as on the cut-off date had become

invalid because it had expired or been suspended or cancelled for

whatever reason, shall have to apply for fresh registration under

Rule 3, and the competent authority shall consider their cases as

fresh cases under these rules.

(f)

The colonizer shall have to follow all requirements under the

Real Estate (Regulation and Development) Act, 2016, as amended

from time to time.

(g)

Any person aggrieved by any order of the competent authority

under this rule, may appeal before the Mayor-in-Council or the

President-in-Council, as the case may be, within thirty days of the

receipt of such order.

(h)

Any person aggrieved by an order of the Mayor-in-Council or

the President-in-Council, as the case may be, passed under clause

(g), may appeal to the State Government, within thirty days of the

receipt of such order, and the decision of the State Government

shall be final.

(2) For the purpose of this Rule, the term „under construction‟ as used in

sub-rule (1) shall refer to any colony that has not been granted occupation

certificate as on the cut-off date.”
