NOTICE

No. F 4-7/2022/Seven-1.⸺ The following draft of the Bhumiswami Rights of the Agriculture Land

Allotted on Government Lease in Non-Urban Area Rules, 2022, which the State Government, in exercise of the

power conferred by the sub-section (1) of Section 258 read with sub-section (4) of Section 158 of the

Chhattisgarh Land Revenue Code, 1959 (No. 20 of 1959), proposes to make, is hereby published as required by

sub-section (3) of the Section 258 of the said Code, for the information of all persons likely to be effected

thereby and notice is hereby given that the said draft shall be taken into consideration after the expiry of 15 days

from the date of publication of this notice in the Official Gazette.

Any objection or suggestions regarding the said draft received from any person before the

specified period, in office hours in office of the Secretary, Government of Chhattisgarh, Department of Revenue

and Disaster Management, Room number S2-3, Mantralaya, Mahanadi Bhawan, Capitol Complex, Nava Raipur

Atal Nagar, District Raipur before the expiry of the said period:-

DRAFT RULES

Short title and commencement.- (1) These rules shall be called the Bhumiswami Rights of the

Agriculture Land Allotted on Government Lease in Non-Urban Area Rules, 2022.

(2) It shall come into force from the date of its publication in the Official Gazette.

Definitions.- In these rules, unless the context otherwise requires,-

(1)

"Code" means the Chhattisgarh Land Revenue Code, 1959 (No. 20 of 1959);

(2)

"Form" means the forms annexed with these rules.

(3)

"Section" means the Section of the Code.

Applicability.- (1) It shall to apply to the land of allotted lease for agricultural purpose in non-urban areas,

under the Revenue Book Circular Khand 4 Kramank 3.

(2) The lease under Rehabilitation and the lease under the Singhdev Scheme, allotted for agricultural

purpose, shall be included in the Government leases.

(3) The land declared surplus under the Ceiling Act, and the land received in Bhudan Yagya and

Donation, shall not be included in the said leases.

(4) The land of lease allotted under the Forest Right shall not be included.

Process.- (1) The application, in Form-A, along with the documents mention therein and the Affidavit, in

Form-B, for Bhumiswami Rights shall be given to the Collector by the Government Lessee.

(2) Before updating the land records as Bhumiswami, the validity of the lease shall be necessarily inquired

in appropriate manner by the Collector.

(3) The evaluation of the eligibility, the process and the period shall be ensured during the verification of

the leases, and the leases issued wrongly shall be declared null and void as per the rules.

(4) The Bhumiswami Rights Certificate, in Form-C, shall be issued to the Government Lessee on finding

eligible after the appropriate enquiry.

(5) The final decision shall be passed within 06 months from the receipt of the application.

Effect.- (1) All the rights and responsibilities conferred by the Code as Bhumiswami shall be imposed

upon the person receiving the Certificate.

(2) The Bhumiswami shall have right of Kisan Kitab as per the Section 114-A of the Code.
