अनिसूचिा

सं.576/एनजजट/2022/एसडीआर/खण्ड–II. ― र्तः, चुिार् आर्ोग िे नहमाचल प्रदेश और गुजरात की नर्िािसभाओं

के सािारण निर्ााचिों की अिुसूची की घोषणा कर दी गई है और घोनषत कार्ाक्रम के अिुसार इि दोिों राज्र्ों में आम चुिार्ों

की अनिसूचिा िीचे उनल्लनखत तारीखों पर जारी की गई थी:

1. 17.10.2022 को नहमाचल प्रदेश, एर्ं

2. 05.11.2022 और 10.11.2022 को गुजरात

र्तः, चुिार् आर्ोग िे अपिे प्रेस िोट संख्र्ा ईसीआई/पीएि/83/2022 ददिांक 05.11.2022 के तहत उत्तर प्रदेश के

21- मैिपुरी संसदीर् निर्ााचि क्षेत्र, उडीसा के 01 – पदमपुर नर्िािसभा निर्ााचि क्षेत्र, राजस्थाि के 21 - सरदारशहर नर्िाि

सभा निर्ााचि क्षेत्र, नबहार के 93 - कुढ़िी नर्िाि सभा निर्ााचि क्षेत्र, छत्तीसगढ़ के 80 – भािुप्रतापपुर (अ.ज.जा.) नर्िाि

सभा निर्ााचि क्षेत्र, और उत्तर प्रदेश के 37 - रामपुर नर्िाि सभा निर्ााचि क्षेत्र में उप-निर्ााचि के नलए कार्ाक्रम की घोषणा की

है एर्ं प्रेस िोट संख्र्ा ईसीआई/पीएि/87/2022 ददिांक 08.11.2022 के तहत उत्तर प्रदेश के 15 – खतौली नर्िाि सभा

निर्ााचि क्षेत्र में उप-निर्ााचि के नलए कार्ाक्रम की घोषणा की है।

र्तः, चुिार् आर्ोग िे अपिे प्रेस िोट संख्र्ा ईसीआई/पीएि/88/2022 ददिांक 10.11.2022 के तहत उत्तर प्रदेश के

37 - रामपुर नर्िाि सभा निर्ााचि क्षेत्र में उप-निर्ााचि के नलए कार्ाक्रम को संशोनित दकर्ा है।

र्तः, लोक प्रनतनिनित्र् अनिनिर्म 1951 (संक्षेप में लो.प्र.अनिनिर्म, 1951) की िारा 126क में र्ह निर्दाष्ट दकर्ा

गर्ा है दक " (1) कोई भी व्यनि कोई निगाम मत सर्ेक्षण िहीं करेगा और दकसी निगाम मत सर्ेक्षण के पररणाम का, ऐसी अर्नि

के दौराि जो निर्ााचि आर्ोग द्वारा इस संबंि में अनिसूनचत की जाए, प्प्रंट र्ा इलैजरॉनिक मीनडर्ा के माध्र्म से प्रकाशि र्ा

प्रचार र्ा दकसी भी प्रकार की अन्र् रीनत में प्रसार िहीं करेगा।

(2) निर्ााचि आर्ोग, उपिारा (1) के प्रर्ोजि के नलए, निम्ननलनखत को ध्र्ाि में रखते हुए सािारण आदेश द्वारा

तारीख और समर् अनिसूनचत करेगा, अथाात :-

(क) सािारण निर्ााचि की दशा में, र्ह अर्नि मतदाि के पहले ददि को मतदाि के नलए निर्त समर् के आरंभ होिे से

प्रारंभ हो सकेगी और सभी राज्र्ों और संघ राज्र् क्षेत्रों में मतदाि समाप्त होिे के आिे घंटे तक जारी रह सकेगी;

(ख) दकसी उप-निर्ााचि र्ा एक साथ कराए जािे र्ाले अिेक उप-निर्ााचिों की दशा में र्ह अर्नि मतदाि के पहले

ददि से ही मतदाि के नलए निर्त समर् के आरंभ होिे से प्रारंभ हो सकेगी और मतदाि समाप्त होिे के पश्चात् आिे घंटे तक जारी

रह सकेगी:

परंतु नभन्न-नभन्न ददिों पर एक साथ कराए जािे र्ाले अिेक उप-निर्ााचिों की दशा में, र्ह अर्नि मतदाि के पहले

ददि को मतदाि के नलए निर्त समर् के आरंभ होिे से प्रारंभ हो सकेगी और अंनतम मतदाि समाप्त होिे के पश्चात आिे घंटे तक

जारी रह सकेगी।

(3) ऐसा कोई व्यनि, जो इस िारा के उपबंिों का उल्लंघि करेगा ऐसी अर्नि के कारार्ास से, जो दो र्षा तक की हो

सकेगी र्ा जुमाािे से र्ा दोिों से, दंडिीर् होगा।"

5. र्त:, आर्ोग िे 12.11.2022 (शनिर्ार) को पूर्ााहि 8.00 बजे से 05.12.2022 (सोमर्ार) को अपराह्ि 5.30 बजे तक के

बीच की अर्नि को, ऐसी अर्नि के रूप में अनिसूनचत दकर्ा था, नजसके दौराि नहमाचल प्रदेश और गुजरात की नर्िािसभाओं

के र्तामाि सािारण निर्ााचिों के संबंि में दकसी भी प्रकार के एनजजट पोल का आर्ोजि करिे तथा प्प्रंट र्ा इलेजरॉनिक मीनडर्ा

द्वारा इसके पररणाम के प्रकाशि र्ा प्रचार अथर्ा दकसी भी अन्र् तरीके से उसका प्रचार-प्रसार करिा प्रनतबंनित था ।

अब, इसनलए, आर्ोग के प्रेस िोट संख्र्ा ईसीआई/पीएि/83/2022 ददिांक 05.11.2022 एर्ं संख्र्ा ईसीआई/

पीएि/87/2022 ददिांक 08-11-2022 द्वारा उप निर्ााचि की घोषणा के दृनष्टगत,लोक प्रनतनिनित्र् अनिनिर्म, 1951 की

िारा 126क की उपिारा (1) के अिीि शनिर्ों का प्रर्ोग करते हुए, निर्ााचि आर्ोग, उि िारा की उप-िारा (2) के उपबंिों

के दृनष्टगत, अनिसूचिा संख्र्ा 576/एनजजट/2022/एसडीआर/खंड.I ददिांक 10.11.2022 के अनिक्रमण में, 12.11.2022

(शनिर्ार) को पूर्ााहि 8.00 बजे से 05.12.2022 (सोमर्ार) को अपराह्ि 6.30 बजे तक के बीच की अर्नि को,ऐसी अर्नि

के रूप में अनिसूनचत करता है नजसके दौराि उपर्ुाि नहमाचल प्रदेश और गुजरात की नर्िािसभाओं के सािारण निर्ााचिों एर्ं

उपर्ुाि उप-निर्ााचिों के संबंि में दकसी भी प्रकार के एनजजट पोल का आर्ोजि करिे तथा प्प्रंट र्ा इलेजरॉनिक मीनडर्ा द्वारा

इसके पररणाम के प्रकाशि र्ा प्रचार अथर्ा दकसी भी अन्र् तरीके से उसका प्रचार-प्रसार करिे पर प्रनतबंि होगा।

7. र्ह भी स्पष्ट दकर्ा जाता है दक लोक प्रनतनिनित्र् अनिनिर्म, 1951 की िारा 126 (1) (ख) के अिीि उपर्ुाि नहमाचल

प्रदेश और गुजरात की नर्िािसभाओं के सािारण निर्ााचिों एर्ं उपर्ुाि उप-निर्ााचिों में संबंनित मतदाि क्षेत्रों में मतदाि की

समानप्त के नलए निर्त समर् पर समाप्त होिे र्ाले 48 घंटों के दौराि दकसी भी इलेजरानिक मीनडर्ा में दकसी भी ओनपनिर्ि

पोल र्ा दकसी अन्र् मतदाि सर्ेक्षण के पररणामों सनहत दकसी भी प्रकार के निर्ााचि संबंिी मामले के प्रदशाि पर प्रनतबंि होगा।

NOTIFICATION

No. 576/EXIT/2022/SDR/Vol.II -― Whereas, the Election Commission has already announced the

program for General Elections to the Legislative Assemblies of Himachal Pradesh and Gujarat as per the

schedule announced and Notifications for the General Elections in these two States were issued on the dates

mentioned below: -

(i) Himachal Pradesh on 17.10.2022, and

(ii) Gujarat on 05.11.2022 and 10.11.2022

Whereas, the Election Commission vide its Press Note No. ECI/PN/83/2022 dated 05-11-2022, has

announced schedule for bye-elections in 21-Mainpuri Parliamentary Constituency of Uttar Pradesh, 01-

Padampur Assembly Constituency of Odisha, 21-Sardarshahar Assembly Constituency of Rajasthan, 93-

Kurhani Assembly Constituency of Bihar, 80-Bhanupratappur(ST) Assembly Constituency of Chhattisgarh &

37-Rampur Assembly Constituency of Uttar Pradesh and vide its Press Note No. ECI/PN/87/2022 dated 08-11-

2022, has announced schedule for bye-election in 15-Khatauli Assembly Constituency of Uttar Pradesh.

Whereas, the Election Commission vide its Press Note No. ECI/PN/88/2022 dated 10-11-2022, has

revised the schedule of bye-election in 37-Rampur Assembly Constituency of Uttar Pradesh.

Whereas, Section 126A of The Representation of the People Act, 1951(in short R.P. Act, 1951)

specifies that “(1) No person shall conduct any exit poll and publish or publicise by means of the print or

electronic media or disseminate in any other manner, whatsoever, the result of any exit poll during such period,

as may be notified by the Election Commission in this regard.

(2) For the purposes of sub-section (1), Election Commission shall, by a general order, notify the date

and time having due regard to the following, namely: —

(a) in case of a general election, the period may commence from the beginning of the hours fixed for

poll on the first day of poll and continue till half an hour after closing of the poll in all the States and Union

territories;

(b) In case of a by-election or a number of bye-elections held together, the period may commence from

the beginning of the hours fixed for poll on and from the first day of poll and continue till half an hour after

closing of the poll;

Provided that in case of a number of bye-elections held together on different days, the period may

commence from the beginning of the hours fixed for poll on the first day of poll and continue till half an hour

after closing of the last poll.

(3) Any person who contravenes the provisions of this section shall be punishable with imprisonment

for a term which may extend to two years or with fine or with both.”

Whereas, the Commission had notified the period between 8:00 A.M. on 12-11-2022 (Saturday) and

5.30 P.M. on 05-12-2022 (Monday) as the period during which conducting any Exit Poll and publishing or

publicizing by means of the print or electronic media or dissemination in any other manner, whatsoever, the

result of any exit poll in connection with the current General Elections to the Legislative Assemblies of

Himachal Pradesh and Gujarat; were prohibited.

Now, therefore, in view of announcement of bye election vide Commission’s Press Note No.

ECI/PN/83/2022 dated 05-11-2022 and No. ECI/PN/87/2022 dated 08-11-2022, in exercise of the powers under

sub-section (1) of Section 126A of the Representation of the People Act, 1951, the Election Commission, having

regard to the provisions of sub-section (2) of the said Section, in supersession of its notification No.

576/EXIT/2022/SDR/Vol.I, dated 10-11-2022, hereby notifies the period between 8:00 A.M. on 12-11-2022

(Saturday) and 6:30 P.M. on 05-12-2022 (Monday) as the period during which conducting any Exit Poll and

publishing or publicizing by means of the print or electronic media or dissemination in any other manner,

whatsoever, the result of any exit poll in connection with the aforesaid General elections to the Legislative

Assemblies of Himachal Pradesh and Gujarat and abovementioned bye-elections, shall be prohibited.

It is further clarified that under Section 126(1)(b) of the R.P. Act, 1951, displaying any election matter,

including results of any Opinion Poll or any other poll survey, in any electronic media, would be prohibited

during the period of 48 hour ending with the hours fixed for conclusion of poll in connection with the aforesaid

General elections to the Legislative Assemblies of Himachal Pradesh and Gujarat and abovementioned bye-

elections.
