आदेश

सं. 3/4/आईडʟ /2023/एसडʟआर/ खĊड-I.- 1. यतः लोक Śɚतəनɚधċव अɚधəनयम, 1951 कʡ धारा 61 मȶ यह उपबंɚधत है

əक əनवाùचकाȶ के ŚɚतȤपण का əनवारण करने कʡ Ƞɚȉ से, ताəक उüत अɚधəनयम कʡ धारा 62 के अधीन वाĚतəवक əनवाùचकाȶ का उनके

मत देने के अɚधकार को और अɚधक Śभावी बनाया जा सके, मतदान के समय əनवाùचकाȶ कʡ पहचान सुəनɝȄत करने के साधन के ȥप मȶ

əनवाùचकाȶ के ɛलए əनवाùचक फोटो पहचान पŕ के उपयोग हेतु əनयमाȶ के Ȁारा उपबंध əकए जा सकते हɀ, तथा

यतः əनवाùचकाȶ का रɜजɠĚŐकरण əनयम, 1960 का əनयम 28 əनवाùचन आयोग को, इस Ƞɚȉ से əक əनवाùचकाȶ के ŚɚतȤपण का

əनवारण हो सके तथा मतदान के समय उनकʡ पहचान को सरल बनाया जा सके, əनवाùचको को राăय कʡ लागत पर फोटोयुüत əनवाùचक

फोटो-पहचान पŕ जारʟ करने के ɛलए əनदेश देने कʡ शɡüत Śदान करता है; तथा

यतः, əनवाùचनाȶ का संचालन əनयम, 1961 के əनयम 49 ज(3) और 49 ट(2) (ख) मȶ यह उपबंɚधत है əक जहाँ əकसी əनवाùचन

Zेŕ के əनवाùचकाȶ को əनवाùचक रɜजɠĚŐकरण əनयम, 1960, के əनयम 28 के उüत उपबंधाȶ के अधीन əनवाùचक फोटो पहचान-पŕ ɘदए गए

हɀ, वहां əनवाùचकाȶ को मतदान केďŗ मȶ अपना əनवाùचक फोटो पहचान-पŕ ɘदखाना होगा तथा उनकʡ ओर से उन əनवाùचक फोटो पहचान पŕाȶ

को नहʢ ɘदखाए जाने या ɘदखाने मȶ असमथù होने पर उďहȶ मत डालने कʡ अनुमɚत देने से इďकार əकया जा सकता है; तथा

यतः, उüत अɚधəनयम और əनयमाȶ के उपयुùüत उपबंधाȶ को ɚमलाकर एवं सामंजĚयपूणù ढंग से उनके अĎययन से यह ĚĐȉ होता है

əक यǾəप मत देने का अɚधकार əनवाùचक नामावली मȶ नाम के होने से ही होता हɀ, यह əनवाùचन आयोग Ȁारा राăय कʡ लागत पर, मतदान

के समय उनकʡ पहचान सुəनɝȄत करने के साधन के ȥप मȶ Śदान करवाए गए əनवाùचक फोटो पहचान पŕ के Śयोग पर भी əनभùर करता

है, तथा दोनाȶ का एक साथ Śयोग करना होता है; तथा

यतः, əनवाùचन आयोग ने एक समयबǹ कायùņम के अनुसार सभी əनवाùचकाȶ को əनवाùचक फोटो पहचान-पŕ ई.पी.आई.सी. जारʟ

करने का əनदेश देते ȩए 28 अगĚत, 1993 को एक आदेश जारʟ əकया है; तथा

यतः, ɚमजोरम, छǴीसगढ़, मĎय Śदेश, राजĚथान, तेलंगाना एवं नागालɀड राăयाȶ मȶ लगभग 100% əनवाùचकाȶ को əनवाùचक फोटो

पहचान पŕ जारʟ əकए जा चुके हɀ, तथा

अतः अब, सभी संबǹ कारकाȶ तथा əवɚधक एवं तČयाċमक ɠĚथɚतयाȶ को Ďयान मȶ रखते ȩए, əनवाùचन आयोग, एतǸ्वारा, यह

əनदेश देता है əक ɘदनांक 13-10-2023, 21-10-2023, 30-10-2023 एवं 03-11-2023 को अɚधसूɚचत/अɚधसूɚचत होने वाले

ɚमजोरम, छǴीसगढ़, मĎय Śदेश, राजĚथान, तेलंगाना के चालू साधारण əनवाùचन और नागालैĊड के 43-तापी (अ.ज.जा.) əवधानसभा

əनवाùचन Zेŕ के उप əनवाùचन मȶ, सभी əनवाùचक ɜजďहȶ əनवाùचक फोटो पहचान पŕ जारʟ əकए गए हɀ, से अपेZा कʡ जाती है əक वे मतदान

Ěथल पर अपना मत डालने से पहले अपनी पहचान सुəनɝȄत करने हेतु अपना əनवाùचक फोटो पहचान पŕ ɘदखाएंगे। ऐसे əनवाùचक जो

अपना əनवाùचक फोटो पहचान पŕ ŚĚतुत नहʢ कर पाते हɀ, उďहȶ अपनी पहचान Ěथाəपत करने के ɛलए əनĔनɛलɝखत वैकɠĖपक फोटो

पहचान दĚतावेजाȶ मȶ से कोई एक ŚĚतुत करना होगा:-

आधार काडù।

ii.

मनरेगा जॉब काडù,

iii.

बɀको/डाकघराȶ Ȁारा जारʟ əकए गए फोटोयुüत पासबुक,

iv.

ţम मंŕालय कʡ योजना के अďतगùत जारʟ ĚवाĚČय बीमा ȋाटù काडù,

Œाइɥव͆ग लाइसेďस,

vi.

पैन काडù,

vii.

एनपीआर के अंतगùत आरजीआई Ȁारा जारʟ əकए गए ȋाटù काडù,

viii. भारतीय पासपोटù;

ix.

फोटोयुüत पȶशन दĚतावेज,

केďŗ/राăय सरकार/लोक उपņम/पɠĒलक ɛलɚमटेड कंपəनयाȶ Ȁारा अपने कमùचाɗरयाȶ को जारʟ əकए गए फोटोयुüत सेवा

पहचान पŕ,

xi.

सांसदो/əवधायकाȶ/əवधान पɗरषद् सदĚयाȶ को जारʟ əकए गए सरकारʟ पहचान पŕ, और

xii.

यूəनक əडसएəबɛलटी आईडʟ (यूडʟआईडʟ) काडù, सामाɜजक ďयाय एवं अɚधकाɗरता मंŕालय, भारत सरकार ।

एəपक के संबंध मȶ, लेखन अशुɛǹ, वतùनी कʡ अशुɛǹ, इċयाɘद को नजरअंदाज कर देना चाəहए बशतȼ əनवाùचक कʡ पहचान एəपक

से सुəनɝȄत कʡ जा सके। यɘद कोई əनवाùचक फोटो पहचान पŕ Śदɿश͆त करता है, जो əक əकसी अďय सभा əनवाùचन Zेŕ के əनवाùचक

रɜजĚŐीकरण अɚधकारʟ Ȁारा जारʟ əकया गया हɀ, ऐसे एəपक भी पहचान Ěथाəपत करने हेतु Ěवीकृत əकए जाएंगे बशतȼ उस əनवाùचक का

नाम जहां वह मतदान करने आया है उस मतदान कȶ ŗ से संबंɚधत əनवाùचक नामावली मȶ उपलĒध हो। यɘद फोटोňाफ इċयाɘद के बेमेल होने

के कारण əनवाùचक कʡ पहचान सुəनɝȄत करना संभव न हो तब əनवाùचक को उपयुùüत पैरा 7 मȶ वʀण͆त əकसी एक वैकɠĖपक फोटो

दĚतावेज को ŚĚतुत करना होगा।

उüत पैरा 7 मȶ əकसी बात के होते ȩए भी, Śवासी əनवाùचकाȶ को जो अपने पासपोटù मȶ əववरणाȶ के आधार पर लोक Śɚतəनɚधċव

अɚधəनयम, 1950 कʡ धारा 20क के अधीन əनवाùचक नामावɛलयाȶ मȶ पंजीकृत हɀ, मतदान केďŗ मȶ केवल उनके मूल पासपोटù (तथा कोई

अďय पहचान दĚतावेज नहʢ) के आधार पर ही पहचाना जाएगा ।

ORDER

No.3/4/ID/2023/SDR/VOL.I.- 1. Whereas, Section 61 of the Representation of the People Act, 1951

provides that with a view to preventing personation of electors, so as to make the right of genuine electors to

vote under section 62 of that Act more effective, provisions may be made by rules under that Act for use of

Electors Photo Identity Card for electors as the means of establishing their identity at the time of polling; and

Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election Commission to

direct, with a view to preventing personation of electors and facilitating their identification at the time of poll,

issue of Electors Photo Identity Card to electors bearing their photographs at State cost; and

Whereas, Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that where the

electors of a constituency have been supplied with Electors' Photo Identity Card under the said provisions of

Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Elector Photo Identity Card

at the polling station and failure or refusal on their part to produce those Elector Photo Identity Card may result

in the denial of permission to vote; and

Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the Rules,

makes it clear that although the right to vote arises by the existence of the name in the electoral roll, it is also

dependent upon the use of the Elector Photo Identity Card, where provided by the Election Commission at State

cost, as the means of establishing their identity at the time of polling and that both are to be used together; and

Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue of

Electors' Photo Identity Card (EPIC) to all electors, according to a time bound programme; and

Whereas, Electors' Photo Identity Card have been issued to approximate 100% electors in the States of

Mizoram, Chhattisgarh, Madhya Pradesh, Rajasthan, Telangana and Nagaland, and

Now, therefore, after taking into account all relevant factors and the legal and factual position, the

Election Commission hereby directs that for the current general elections to the Legislative Assemblies of

Mizoram, Chhattisgarh, Madhya Pradesh, Rajasthan, Telangana and bye election in 43-Tapi(ST) Assembly

Constituency of Nagaland, notified/to be notified on 13-10-2023, 21-10-2023, 30-10-2023 & 03-11-2023, all

electors who have been issued EPIC are expected to produce the EPIC for their identification at the polling

stations before casting their votes. Those electors who are not able to produce the EPIC shall produce one of the

following alternative photo identity documents for establishing their identity: -

(i)

Aadhaar Card,

(ii)

MNREGA Job Card,

(iii)

Passbooks with photograph issued by Bank/Post Office,

(iv)

Health Insurance Smart Card issued under the scheme of Ministry of Labour,

(v)

Driving License,

(vi)

PAN Card,

(vii) Smart Card issued by RGI under NPR,

(viii) Indian Passport,

(ix)

Pension document with photograph,

(x)

Service Identity Cards with photograph issued to employees by Central/State Govt./PSUs/Public

Limited Companies,

(xi)

Official identity cards issued to MPs/MLAs/MLCs, and

(xii)

Unique Disability ID (UDID) Card, M/o Social Justice & Empowerment, Government of India

In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided the identity of the

elector can be established by the EPIC. If an elector produces an EPIC which has been issued by the Electoral

Registration Officer of another Assembly Constituency, such EPIC shall also be accepted for identification

provided that the name of that elector finds place in the electoral roll pertaining to the polling station where the

elector has turned up for voting. If it is not possible to establish the identity of the elector on account of

mismatch of photograph, etc. the elector shall have to produce one of the alternative photo documents

mentioned in Para 7 above.

Notwithstanding anything in Para 7 above, overseas electors who are registered in the electoral roll under

Section 20A of the Representation of the People Act, 1950, based on the particulars in their Indian Passport,

shall be identified on the basis of their original passport only (and no other identity document) at the polling

station.
