यतः ननलााचन आयोग के प्रेव नोट वंख्या ईवीआई/प्रे.

नो/57/2023 एलं वंख्या ईवीआई/प्रे. नो./58/2023 दोनाों ददनांनकत 9 अजतूबर, 2023 के तशत छत्तीवगढ़, मध्य-प्रदेळ, ममजोरम,

राजस्थान ऒर तेऱंगाना की नलधान वभाआों के चाऱू वाधारण ननलााचन ऒर नागाऱैण्ड के 43- ताऩी (अ.ज.जा.) नलधानवभा ननलााचन

क्षेत्र के उऩ ननलााचन के कायाक्रमाों की घोऴणा कर दी गई शै।

यतः, ऱोक प्रमतननमधत्ल अमधननयम 1951 (वंक्षेऩ मों ऱो. प्र. अमधननयम, 1951) की धारा 126क मों यश ननर्दिष्ट नकया गया शै

नक " (1) कोई भी व्यक्जत कोई ननगाम मत वलेक्षण नशीं करेगा ऒर नकवी ननगाम मत वलेक्षण के ऩररणाम का, ऐवी अलमध के दौरान जो

ननलााचन आयोग द्वारा इव वंबंध मों अमधवूमचत की जाए, प्प्रिट या इऱैजरॉननक मीनडया के माध्यम वे प्रकाळन या प्रचार या नकवी भी प्रकार

की अन्य रीमत मों प्रवार नशीं करेगा।

(2) ननलााचन आयोग, उऩधारा (1) के प्रयोजन के लऱए, ननम्नलऱखखत को ध्यान मों रखते हुए वाधारण आदेळ द्वारा तारीख ऒर

वमय अमधवूमचत करेगा, अथाात् :-

(क) वाधारण ननलााचन की दळा मों, लश अलमध मतदान के ऩशऱे ददन को मतदान के लऱए ननयत वमय के आरंभ

शोने वे प्रारंभ शो वकेगी ऒर वभी राजयाों ऒर वंघ राजय क्षेत्राों मों मतदान वमाप्त शोने के आधे घंटे तक जारी रश वकेगी;

(ख) नकवी उऩ-ननलााचन या एक वाथ कराए जाने लाऱे अनेक उऩ-ननलााचनाों की दळा मों लश अलमध मतदान के ऩशऱे

ददन वे शी मतदान के लऱए ननयत वमय के आरंभ शोने वे प्रारंभ शो वकेगी ऒर मतदान वमाप्त शोने के ऩश्चात् आधे घंटे तक

जारी रश वकेगी.

ऩरंतु लभन्न-लभन्न ददनाों ऩर एक वाथ कराए जाने लाऱे अनेक उऩ-ननलााचनाों की दळा मों, लश अलमध मतदान के ऩशऱे

ददन को मतदान के लऱए ननयत वमय के आरंभ शोने वे प्रारंभ शो वकेगी ऒर अंमतम मतदान वमाप्त शोने के ऩश्चात आधे घंटे

तक जारी रश वकेगी।

(3) ऐवा कोई व्यक्जत, जो इव धारा के उऩबंधाों का उल्ऱंघन करेगा ऐवी अलमध के कारालाव वे, जो दो लऴा तक की शो वकेगी

या जुमााने वे या दोनाों वे, दंडनीय शोगा। "

3. अब, इवलऱए, ऱोक प्रमतननमधत्ल अमधननयम, 1951 की धारा 126क की उऩधारा (1) के अधीन ळक्जतयाों का प्रयोग करते हुए

ननलााचन आयोग उजत धारा की उऩ-धारा (2) के उऩबंधाों के दृमष्टगत, 7 नलंबर, 2023 (मंगऱलार) को ऩूलााशन 7:00 बजे वे 30 नलंबर,

2023 ( गुरुलार) को अऩराशन 6.30 बजे के बीच की अलमध को, ऐवी अलमध के रूऩ मों अमधवूमचत करता शै जजवके दौरान ऊऩर

उक्ल्ऱखखत वाधारण ननलााचनाों एलं उऩ-ननलााचन के वंदभा मों नकवी भी प्रकार के एग्जजट ऩोऱ का आयोजन करने तथा प्प्रिट या इऱेजरॉननक

मीनडया द्वारा इवके ऩररणाम के प्रकाळन या प्रचार अथला नकवी भी अन्य तरीके वे उवका प्रचार- प्रवार करने ऩर प्रमतबंध शोगा।

4. यश भी स्ऩष्ट नकया जाता शै नक ऱोक प्रमतननमधत्ल अमधननयम, 1951 की धारा 126 (1) ( ख) के अधीन उऩयुाजत वाधारण

ननलााचनाों एलं उऩ-ननलााचन मों वंबंमधत मतदान क्षेत्राों मों मतदान की वमाप्प्त के लऱए ननयत वमय ऩर वमाप्त शोने लाऱे 48 घंटाों के दौरान

नकवी भी इऱेजराननक मीनडया मों नकवी भी ऑनऩननयन ऩोऱ या नकवी अन्य मतदान वलेक्षण के ऩररणामाों वनशत नकवी भी प्रकार के

ननलााचन वंबंधी मामऱे के प्रदळान ऩर प्रमतबंध शोगा ।

NOTIFICATION

No. 576/EXIT/2023/SDR/Vol.I.⸺ Whereas, the schedules for the current general elections to the

Legislative Assemblies of Chhattisgarh, Madhya Pradesh, Mizoram, Rajasthan Telangana and bye- election in

43-Tapi (ST) Assembly Constituency of Nagaland, have been announced by the vide Election Commission's

Press Note No. ECI/PN/57/2023 and No. ECI/PN/58/2023 both dated 9th October, 2023.

Whereas, Section 126A of The Representation of the People Act, 1951(in short R.P. Act, 1951)

specifies that "(1) No person shall conduct any exit poll and publish or publicise by means of the print or

electronic media or disseminate in any other manner, whatsoever, the result of any exit poll during such period,

as may be notified by the Election Commission in this regard.

(2) For the purposes of sub-section (1), the Election Commission shall, by a general order, notify the

date and time having due regard to the following, namely:-

(a) in case of a general election, the period may commence from the beginning of the hours

fixed for poll on the first day of poll and continue till half an hour after closing of the poll in all the

States and Union territories;

(b) In case of a bye-election or a number of bye-elections held together, the period may

commence from the beginning of the hours fixed for poll on and from the first day of poll and continue

till half an hour after closing of the poll;

Provided that in case of a number of bye-elections held together on different days, the period

may commence from the beginning of the hours fixed for poll on the first day of poll and continue till

half an hour after closing of the last poll.

(3) Any person who contravenes the provisions of this section shall be punishable with imprisonment

for a term which may extend to two years or with fine or with both."

Now, therefore, in exercise of the powers under sub-Section (1) of Section 126A of the R.P. Act, 1951,

the Election Commission, having regard to the provisions of sub-Section (2) of the said Section, hereby notifies

the period between 7:00A.M on 7th November, 2023(Tuesday) and 6.30 PM on 30th November, 2023

(Thursday) as the period during which conducting and publishing or publicizing exit poll by means of the print

or electronic media or dissemination in any other manner whatsoever, the result of any exit poll in connection

with the aforesaid General Elections and bye election, shall be prohibited.

It is further clarified that under Section 126(1)(b) of the R.P. Act, 1951, displaying any election matter

including results of any opinion poll or any other poll survey, in any electronic media, would be prohibited

during the period of 48 hours ending with the hours fixed for the conclusion of the poll in connection with the

aforesaid general elections and bye election.
