NOTICE

No. F 07-22/2023/32.— The following draft further to amend the Chhattisgarh Bhumi

Vikas Niyam, 1984, which the State Government proposes to make in exercise of the powers

conferred by sub-section (1) of Section 85 read with sub-section (3) of Section 24 of the

Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No. 23 of 1973), is hereby,

published as required under sub-section (1) of Section 85 of the said Adhiniyam, for the

information of all persons likely to be affected thereby and notice is hereby given that the

said draft shall be taken into consideration after expiry of thirty days from the date of

publication of this notification in the Official Gazette.

Any objection or suggestion regarding the said draft received from any person before

the specified period during office hours, by Office of the Secretary, Department of Housing

and Environment, Government of Chhattisgarh, Room No. S-2-23, Mantralaya, Mahanadi

Bhawan, Nava Raipur Atal Nagar, shall be considered by the Government of Chhattisgarh.

DRAFT AMENDMENT

In the said rules,-

1. For sub-rule (1) and (2) of rule 21, the following sub-rule shall be substituted,

namely:-

“(1) Every application referred to in rule 16 shall be accompanied by the application

fees prescribed under sub-rule (2), and an attested copy of the receipt of such

payment shall be attached with the application. An application received without

such a receipt shall be deemed in-valid and shall be rejected.

(2)

Application Fee: The application shall be accompanied by the fees as follows:

(i)

For Development Permission: ₹ 5000 per hectare or part thereof, area will

be calculated by rounding off to the nearest integer. For example, 1.499

hectares will be considered as 1 hectare, and 1.5 hectare will be

considered as 2 hectares.

(ii)

For Building Permission: ₹ 1.00 per square meter of the proposed built-up

area.

(iii) Application fees shall not be refunded under any circumstances.”

2. For clause (a) of sub-rule (3) of rule 21, the following clause shall substituted,

namely:-

“(a) In case of an application under sub-section (1) of Section 29 of the Act

(excluding applications under sub-section (3) of Section 29), the

permission fee for the development of any land shall be as follows:-

For rule 25, the following rule shall be substituted, namely:-

“25.

Revocation of permission.- (1) The Authority may suspend or revoke

any permission granted under the provisions of these rules if it has

reasons to believe that such permission has been obtained based on a

false statement or misrepresentation of any material fact, if the

conditions imposed in the permission have been violated, or that the

provisions of the Act or the rules made there under have not been

observed:

Provided that no adverse order shall be passed unless the person

who obtained such permission has been given an opportunity to be

heard:

Provided further that such order of revocation or suspension may be

annulled if the applicant cures the violation of the Act or the rules, or any

conditions imposed in the permission. However, where the permission

has been obtained based on a false statement or misrepresentation of any

material fact, no such order of revocation shall be annulled.”

4.

After sub-rule (3) of rule 34, the following sub-rule shall be added, namely:-

“(4)

In the case of non-compliance such as deviations from the provisions of

these rules, action may be taken to seal the building.”

5.

In clause (a) of rule 42-A, for the words and figures “12.5 m.” and “21 meters", the

words and figures “15 meters” and “24 meters" shall be substituted, respectively.

6.

In sub-clause (i) of clause (a) of rule 42-A, for the figure and symbol “30%”, the figure

and symbol “40%” shall be substituted.

7.

In clause (b) of rule 42-A,-

(i)

in sub-clause (1), for the figure and word "21 meters", the figure and

word "24 metres" shall be substituted;

(ii)

in entry (i) of sub-clause (1), for the figure and symbol "30%", the figure

and symbol "40%" shall be substituted; and

(iii)

in entry (i) of sub-clause (2), for the figure and symbol "30%", the figure

and symbol "40%" shall be substituted.

8.

After sub-rule (6) of rule 47, the following sub-rule shall be added, namely:-

“(7) Community open spaces shall be reserved for recreational purposes in the

layout or sub-division in accordance with the norms prescribed in the

town development scheme or the development regulations for the schemes

under clause (o) sub-section (3) of Section 49 of the Act for the town

development scheme.”

After sub-rule (2) of rule 48, the following sub-rule shall be added, namely:-

"(3) Hostels and Dormitories shall be permissible in any plot, layout or sub

division of land in the Industrial Zone.”

10. After clause (b) of rule 50, the following sub-clause shall be inserted, namely:-

“(i) F.A.R and ground coverage area shall be calculated on the entire land.

(ii) In the above 09/15-metre open area, road and open parking activities will

be acceptable above the drain limit/ highest flood mark. Covered parking in

these open parking areas will not be acceptable under any circumstances.”

11.

In Table 7 of rule 61, for the entries relating to the Remarks column of serial number

12. After note (7) of rule 61, the following note shall be added, namely:-

“(8) In case of commercial plot(s) having area of 5 acre or more with approach

road width of 100 meter or more, FAR of 5.0 shall be permissible. In case of

such commercial plots located in Central Business Districts (CBD) or

Transit Oriented Development (TOD) zones as defined in the respective

development plan(s), additional FAR of 2.0 shall be permissible.”

13. After rule 98, the following paragraph shall be added, namely:-

“The Authority may, subject to Rule 24 and Rule 24(A), accept deviation up to a

maximum of 10%, in the building and impose penalty as per Appendix-V thereon and

issue a completion and Occupancy Certificate in the format given in Appendix-U,

failure to do so shall be deemed to have been issued.”

14. After rule 98, the following rule shall be added, namely:-

“99. Precedence of Development Control Regulations of the Development Plans

or Town Development Schemes.- The specific provisions of Development

Control Regulations (both for layouts and Buildings) notified along with the

Development Plans or Town Development Schemes under the sections of the

Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No.23 of 1973) shall

take

precedence

over

the

aforementioned

general

provisions

of

the

Chhattisgarh Bhumi Vikas Niyam as and where applicable.”

For Appendix-A, the following Appendix shall be substituted, namely:-
