NOTIFICATION
No. 2563/22-1/2021/5125.— The following further draft amendment in the
Chhattisgarh Panchayat Nirvachan Niyam, 1995, which the State Government proposes to
make, in exercise of the powers conferred by sub-section (1) of Section 95 read with Section
43 of the Chhattisgarh Panchayat Raj Adhiniyam, 1993 (No. 1 of 1994), in consultation with
the State Election Commission, is hereby, published as required by sub-section (3) of
Section 95 of the said Adhiniyam, for the information of all persons likely to be affected
thereby and notice is hereby given that the said draft shall be taken into consideration after
the expiry of Seven days from the date of publication of this notice in the Official Gazette.
Any objection or suggestion regarding the said draft received from any person,
before the specified period, during office hours by the office of the Under Secretary,
Government of Chhattisgarh, Department of Panchayat and Rural Development, Room No.
AD0-C8, Mantralaya, Mahanadi Bhavan, Nava Raipur Atal Nagar, District Raipur shall be
considered by the Government of Chhattisgarh.
DRAFT AMENDMENT
In the said rules, –
1.
After sub-rule (2) of rule 9-B, the following explanation shall be inserted, namely:-
"Explanation:- Due to any reason if the current electoral roll is not received, then
ward wise division of voters and the action under sub-rule (1) and (2) will be taken on
the basis of the previously published available electoral roll.”
2.
In sub-rule (2) of rule 14, for the words "the first day of January of the year", the
words "the date decided by the Commission under the provisions of rule 9B" shall be
substituted.
3.
In sub-rule (3) of rule 14, for the words "in relation to the first day of January whereof
the list", the word "updated electoral roll" shall be substituted.
4.
After rule 15A, the following rule shall be added, namely:-
“15B. Addition of entries in the voters list in certain cases.- (1) If the Registration
Officer, on an application submitted to him or suo moto, after making such inquiry as
he thinks fit, is satisfied that before the final publication of the electoral roll of the
Gram Panchayat, the name of the person concerned therewith should be added on the
ground that the entry of a person, earlier available electoral roll of The Election
Commission of India, has been omitted for any reason, the Registration Officer shall,
subject to the general or special instructions, if any, given by the Commission in this
behalf, add such entry:
Provided that the registering officer shall give the person concerned a reasonable
opportunity of being heard, before the action proposed to be taken, in respect thereof.
(2) The registering officer shall record the reasons for his decision to add an entry
under sub-rule (1) and shall forthwith make available a copy of such decision free of
charge on demand by the person concerned.
(3) Any person aggrieved by a decision of the registering officer under sub-rule (1) may
appeal against such decision in accordance with sub-rule (5) of rule 12 of the said
rule.
(4) The appellate authority shall, after giving the appellant an opportunity of being
heard and after such inquiry as it may deem fit, pass appropriate orders on the
appeal and the order of the appellate authority shall be final.”
5.
Sub-rule (3) of rule 19 shall be omitted.
6.
In rule 20, the words "other than the Zila Panchyat" shall be omitted.
7.
