No. F 5-3/VIII-Trans./2016. - In exercise of the powers conferred by sub-rule (7) of rule 115 of the

Central Motor Vehicles Taxation Rules, 1989, the State Government, hereby, makes amendment in the

Chhattisgarh Motor Vehicles Pollution Testing Centre Scheme, 2001 issued by Notification No. 526/Transport

Department/2001 dated 10 September 2001 and amended by Notification No. F 6-3/8-Part/2016 dated 20 July

2016 by deleting the clauses of serial number (1) of the following list and establishing serial number (2),

namely:-

4. Procedure for issuing authorization etc. -

(1) A committee consisting of the Collector,

Superintendent of Police and Transport Officer of the

concerned district shall, having regard to the number

of motor vehicles registered in the district and

considering the requirement of the local area, propose

the maximum number of pollution testing centres to

be established in that district and the number so

approved by the Collector shall be the maximum

number of pollution testing centres in that district.

Transport Officer shall, keeping in view the number of

motor vehicles registered in the district and considering

the requirement of the local area, propose the maximum

number of pollution testing stations to be set up in that

district and the number so approved by the Additional

Transport Commissioner/Transport Commissioner shall

be the maximum number of pollution testing stations in

that district.

(2) Subject to the maximum number so approved, the

Collector

shall,

consultation

with

the

Superintendent of Police and the Transport Officer of

the concerned district, determine the places where

pollution testing stations shall be set up in the

concerned district. The Collector shall take into

account the traffic density and other relevant factors

while deciding the pollution testing station.

(2) Subject to the maximum number so approved, the

Officer. The Additional Transport Commissioner/

(3) For setting up pollution testing stations under this

scheme, the concerned Transport Officer of the

district shall publish a general advertisement in the

local or regional newspaper and invite applications in

Form-1 along with the application fee prescribed in

sub-rule (6).

(4) The applications so received shall be examined by

the Committee mentioned in sub-rule (1). The

Collector shall provide an opportunity of being heard

and select the applicants.

(4) The applications thus received shall be examined by

the Regional/Additional Regional/District Transport

Officer. The application shall thereafter be proposed to

the Transport Commissioner for approval. The

5. Duration of authorization letter, renewal etc. -

(1) The authorization letter issued for pollution

testing centre shall be valid for three years and may

be renewed by the Collector from time to time for a

maximum period of one year.

for renewal of authorization letter to the Collector for

opportunity of being heard to the owner of the

pollution testing centre, renew the authorization letter

for reasons to be recorded in writing or refuse to issue

the same. The Transport Officer of the concerned

district shall issue a renewal letter in Form-3.

Transport Commissioner/Transport Commissioner for

approval. After approval, the Transport Officer may

renew the authorization letter or refuse to issue the

authorization letter after giving an opportunity of being

heard to the owner of the testing centre, recording the

reasons in writing. The Transport Officer of the

concerned district shall issue the renewal letter in

Form-3.

(4) The applicant or the owner of the pollution testing

centre may file an appeal against the order of refusal

to issue/refusal to renew the authorization letter

passed by the Collector, before the Transport

Commissioner, Chhattisgarh, Raipur, within 30 days

of the date of the order along with the prescribed fee.

The order passed in such appeal shall be final.

(4) The applicant or the owner of the pollution testing

centre may file an appeal against the order of refusal to

issue/refusal to renew the authorization letter passed by

the Collector before the Transport Commissioner,

Chhattisgarh, Raipur within 30 days of the date of the

order along with the prescribed fee. The order passed in

such appeal shall be final.

(5) The owner of an authorized pollution testing

station may surrender the authorization letter to the

Collector at any time and the authorization shall be

deemed to have been cancelled from the date of such

surrender.

authorization letter.

station authorized under this Scheme does not comply

(3) An appeal against the suspension order passed by

the Transport Officer of the concerned District shall

appeal shall lie to the Transport Commissioner and

the order passed in the appeal shall be final.

(1) For the purpose of sub-rule (7) of rule 115, the

owner of the authorized pollution testing centre shall

issue pollution under control certificate in Form-4 to

the owner of the vehicle which shall be valid for six

months.

(1) The owner of the authorized pollution testing centre

shall issue pollution under control certificate to the

owner of the vehicle in Form-4 for the purpose of sub-

rule (7) of rule 115, which shall be valid for six months.

(2) For issuing such certificate, the owner of the

authorized pollution testing centre shall charge fee

from the owner of the vehicle at the following rates-

8. Inspection of Pollution Testing Centre-

(1) Any gazetted officer of the Transport Department,

the Collector of the District or any gazetted officer

authorized by him may inspect the pollution testing

centre within their respective jurisdiction and shall

send a report of such inspection to the District

Collector and the Transport Commissioner.

(1) Any officer not below the rank of Transport Sub

Inspector or Transport Commissioner or any officer

authorized by him may inspect pollution testing centre

and send the report of such inspection to Regional/

Additional Regional/ District Transport Officer.

9. Maintenance of Register-

Transport Officer shall maintain a register in Form-5

containing the details of pollution testing centres

authorized within his jurisdiction and shall send a

statement on the basis of the same to the Transport

Commissioner.

Transport Officer shall maintain the details of pollution

testing centres authorized within his jurisdiction in a

pollution testing shall be done while conducting the

pollution test which shall be mandatory to be presented

during inspection and on the basis of this a statement

shall be sent to the Transport Commissioner.

11. Compliance of Instructions-

The

State

Government

and

the

Transport

Commissioner may issue necessary instructions from

time to time to the Collector, Transport Officers and

authorized pollution testing centre for smooth

implementation of this scheme. Such instructions

shall

complied

with

the

concerned

officer/person.

The State Government and Transport Commissioner

may issue necessary instructions from time to time to

the Transport Officers and Authorized Pollution

Testing Centers for smooth enforcement of this

scheme. Such instructions will be complied with by the

concerned officer/person.

This notification will come into effect from the date of publication in the Gazette.
