NOTIFICATION

File No. RULE-801/6/2026-MRD. In exercise of the powers conferred by Section 15 of the Mines

and Minerals (Development and Regulation) Act, 1957 (No. 67 of 1957), the State Government, hereby, makes

the following amendment in the Chhattisgarh Minor Mineral Ordinary Sand (Quarrying and Trade) Rules, 2025,

namely:—

AMENDMENT

In the said rules,—

1. In sub-rule (2) of rule 5, after the words “Bank Guarantee”, the words “or FDR” shall be inserted.

2. In the proviso of sub-rule (2) of rule 6, for the figure and words “60 days”, the figure and words “1 year”

shall be substituted.

3. after clause (ii) of sub-rule (4) of rule 7, the following shall be inserted, namely:—

“An amount of ₹ 10,000.00 shall be deposited under the prescribed head as a non-refundable

processing fee.”

4. After sub-rule (3) of rule 8, the following proviso shall be inserted, namely:—

“Provided that, where the conditions specified in sub-rule (3) are not fulfilled within the specified

period, the letter of intent shall be deemed to be automatically cancelled and performance security

furnished by the preferred bidder shall be forfeited.

Provided further that, where the holder of the letter of intent submits an application along with a fee

of ₹ 10,000 and satisfies the Director that there was a sufficient cause for non-fulfilment of conditions of

sub-rule (3) within the specified period, the Director may grant an additional extension of 1 year for

fulfilment of conditions of sub-rule (3).”

5. After rule 8, the following shall be added, namely:—

“8A. Reservation of sand quarry for Public Sector Undertakings of the Central or State Government.-

The State Government may, by notification in the Official Gazette, reserve any sand quarry as identified and

declared by the District Level Committee of a particular district, for the purposes of environmental

protection,conservation, development of mineral and minerals areas, determination of stock and excavation

by a Government Corporation or Company established by the Central or State Government within the

meaning of sub-section (45) of Section 2 of the Companies Act, 2013 (No. 18 of 2013).”

6. For sub-rule (23) of rule 11, the following shall be substituted, namely:-

“(23) In the event of violation of any terms and conditions of the lease deed or the provisions of these

rules, other than the violations specified under sub-rule (24), the Performance Security, wholly or

partly, may be confiscated by the Collector.”

7. After sub-rule (23) of rule 11, the following shall be added, namely:—

“(24) Where the lessee or his transferee or assignee contravenes the provisions contained in sub-rules (1),

(2), (4), (5), (6) or (11) or obstructs or refuses entry into, or inspection of, the lease area, the

Competent Authority shall issue a notice to such lessee, transferee or assignee specifying the

grounds of such contravention and requiring him to show cause as to why penalty should not be

imposed and the breach be not remedied within fifteen days from the date of receipt of such notice.

In the event of failure to show sufficient cause or to remedy the breach within the aforesaid period,

the Competent Authority may, without prejudice to any other action that may be taken under these

rules or any other law for the time being in force, cancel the lease.”

8. After rule 11, the following shall be added, namely:—

“11A. Lapse of Mining Lease.— Subject to other provisions of these rules, where the mining

operations have not commenced within a period of one year from the date of execution of the lease, or

after commencement, such operations are discontinued for a continuous period of twelve months, the

competent authority may, by order, declare the mining lease as lapsed, and shall communicate such

declaration to the lessee.”
