announced by Election Commission of India vide Press Note No. ECI/PN/23/2019 dated 10th March, 2019. As per

the schedule, date of Counting was 23rd May, 2019.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candi-

date has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer,

from the date of election returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including

05-Bilaspur Parliamentary Constituency on 23rd May, 2019. As such the last date for lodging of account of election

expenses was 22nd June, 2019.

AND WHEREAS, as per the report dated 24th June, 2019 submitted by the District Election Officer, Bilaspur

District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No. 21/øÊ⁄U/‹Ê.‚.øÈ./EEM/

2019/6169 dated 26th June, 2019, Shri Horilal Anant, Independent contesting candidate from 05-Bilaspur Parlia-

mentary Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Bilaspur District, Chhattisgarh

and the Chief Electoral Officer, Chhattisgarh a Show Cause notice dated 14th August, 2019 was issued by Election

Commission of India under sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Horilal Anant for

non-submission of Election expenses ;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice dated 14th August, 2019, Shri Horilal Anant was directed to submit his representation in

writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of

election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned

within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Horilal Anant on 4th September, 2019. Acknowl-

edgment receipt obtained from the candidate have been submitted to the Commission by District Election Officer,

Bilaspur vide his letter No. ÁŸ.¬./‹Ê.‚.ÁŸ./√ÿÿ ‹πÊ/wÆv~/yvx| dated 25th September, 2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Bilaspur vide his

letter No. ÁŸ.¬./‹Ê.‚.ÁŸ.-v~/√ÿÿ ‹πÊ/wÆwÆ/y{yÆ dated 12th March, 2020 has stated that Shri Horilal Anant, has not

submitted any representation or his account of election expenses, duly signed along with original vouchers etc. till

date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the due

notice to the Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Shri Horilal Anant has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :—

“If the Election Commission in satisfied that a person:

(a)

Has failed to lodge an account of election expenses within the time and in the manner required by

law or under this Act, and

(b)

Has no good reason or justification for the failure the Election Commission shall by order pub-

lished in the official Gazette, declare him to be disqualified an any such person shall be disquali-

fied for a period of three years from date of the under;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the people Act 1951, the Elec-

tion Commission of India hereby declares Shri Horilal Anant, resident of Village Chakla, Post Office Daukapa,

Lormi, Chhattisgarh and the contesting Independent candidate for General Election to Lok Sabha of Chhattisgarh,

2019 from 05-Bilaspur Parliamentary Constituency of the state of Chhattisgarh to be disqualified for being chosen as

Commission of India under sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Krishna Kant

Nagvanshi for non-submission of Election expenses ;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice dated 8th August 2019, Shri Krishna Kant Nagvanshi was directed to submit his representa-

tion in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his

No. CG-HP/ES-I/08/2019.—WHEREAS, the General Election to Lok Sabha of Chhattisgarh, 2019 was

announced by Election Commission of India vide Press Note No. ECI/PN/23/2019 dated 10th March, 2019. As per

the schedule, date of Counting was 23rd May, 2019.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candi-

date has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer,

from the date of election returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including

08-Raipur Parliamentary Constituency on 23rd May, 2019. As such the last date for lodging of account of election

expenses was 22nd June, 2019.

AND WHEREAS, as per the report dated 22nd June, 2019 submitted by the District Election Officer,

Raipur District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No. 21/øÊ⁄U/‹Ê.‚.øÈ./

EEM/2019/6169 dated 26th June, 2019, Shri Ikram Saifi, Ambedkarite Party of India contesting candidate from 08-

Raipur Parliamentary Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as

required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Raipur District, Chhattisgarh

and the Chief Electoral Officer, Chhattisgarh a Show Cause notice dated 14th August, 2019 was issued by Election

Commission of India under sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Ikram Saifi for

non-submission of Election expenses ;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice dated 14th August 2019, Shri Ikram saifi was directed to submit his representation in writing

in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election

expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20

days form the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Ikram Saifi on 27th August, 2019. Acknowledgment

receipt obtained from the candidate have been submitted to the Commission by District Election Officer, Raipur vide

his letter No. 2806/ÁŸﬂÊ¸./ÁŸ.¬./wÆv~ dated 31st August, 2019.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Raipur vide his letter

No. 7396/ÁŸﬂÊ¸./ÁŸ.¬./wÆwÆ dated 9th March, 2020 has stated that Shri Ikram Saifi, has not submitted any representa-

tion or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has

furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election

Commission of India as well;

AND WHEREAS, the Commission satisfied that Shri Ikram Saifi has failed to lodge an account of election

expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the representation of the People Act, 1951 stipulates that :—

“If the Election Commission in satisfied that a person:

(a)

Has failed to lodge an account of election expenses within the time and in the manner required by

law or under this Act, and

(b)

Has no good reason or justification for the failure the Election Commission shall by order pub-

lished in the official Gazette, declare him to be disqualified and any such person shall be disquali-

date has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer,

from the date of election returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including

11- Kanker (ST) Parliamentary Constituency on 23rd May, 2019. As such the last date for lodging of account of

election expenses was 22nd June, 2019.

AND WHEREAS, as per the report dated 25th June, 2019 submitted by the District Election Officer, North

Bastar Kanker District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No. 21/øÊ⁄U/

‹Ê.‚.øÈ./EEM/2019/6169 dated 26th June, 2019, Shri Umashankar Bhandari, Shiv Sena contesting candidate from

11-Kanker (ST) Parliamentary Constituency of Chhattisgarh, has failed to lodge any account of his election expenses

as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, North Bastar Kanker District,

Chhattisagrh and the Chief Electoral Officer, Chhattisgarh, a Show Cause notice dated 14th August, 2019 was issued

by Election Commission of India under sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri

Umashankar Bhandadi for non-submission of Election expenses ;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice dated 14th August 2019, Shri Umashankar Bhandari was directed to submit his representa-

tion in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his ac-

counts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer

concerned within 20 days form the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Umashankar Bhandari on 31st August, 2019.

Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election

Officer, North Bastar Kanker vide this letter No. ‚Ê./ÁŸﬂÊ¸./‹Ê.‚.ÁŸ. √ÿÿ/wÆv~/|x dated 31st January 2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, North Bastar Kanker

vide his letter No. ‚Ê./ÁŸﬂÊ¸./‹Ê‚ÁŸ-wÆv~/wÆwÆ/vzÆ dated 13th March, 2020 has stated that Shri Umashankar Bhandari,

has not submitted any representation or his account of election expenses, duly signed along with original vouchers

etc. till date. Further, he has furnished neither any reason nor explanation for the said failure even after receipt of the

due notice to the Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Shri Umashankar Bhandari has failed to lodge an account

of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the representation of the People Act, 1951 stipulates that :—

“If the Election Commission is satisfied that a person:

(a)

Has failed to lodge an account of election expenses within the time and in the manner required by

law or under this Act, and

(b)

Has no good reason or justification for the failure the Election Commission shall by order pub-

lished in the official Gazette, declare him to be disqualified and any such person shall be disquali-

fied for a period of three years from date of the under;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the people Act 1951, the Elec-

tion Commission of India hereby declares Shri Umashanakr Bhandari, resident of Village-Gadhpichhvadi, Tehsil-

Kanker, District-Uttar Bastar Kanker, Chhattisgarh and the contesting candidate of Shiv Sena for General Election

to Lok Sabha of Chhattisgarh, 2019 from 11-Kanker (ST) Parliamentary Constituency of the state of Chhattisgarh to

be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Parlia-

and the Chief Electoral Officer, Chhattisgarh, a Show Cause notice dated 19th August, 2019 was issued by Election

said Show Cause Notice dated 19th August 2019, Shri Anoop Kumar Pandey was directed to submit his representa-

tion in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his ac-

counts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer

concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Anoop Kumar Pandey on 30th August, 2019.

Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election

Officer, Durg vide his letter No. xyyx/ÁŸ.¬./wÆv~ dated 27th September, 2019.

AND WHEREAS, in the supplementary report submitted by District Eection Officer, Durg vide his letter

No. w}Æ/ÁŸ.¬./wÆwÆ dated 6th March, 2020 has stated that Shri Anoop Kumar Pandey, has not submitted any represen-

tation or his account of election expenses, duly signed along with original vouchers etc. till date. Further, he has

furnished neither any reason nor explanation for the said failure even after receipt of the due notice to the Election

Commission of India as well;

AND WHEREAS, the Commission is satisfied that Shri Anoop Kumar Pandey has failed to lodge an ac-

count of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the representation of the People Act, 1951 stipulates that :—

“If the Election Commission in satisfied that a person:

Has failed to lodge an account of election expenses within the time and in the manner required by

law or under this Act, and

(b)

Has no good reason or justification for the failure the Election Commission shall by order pub-

lished in the official Gazette, declare him to be disqualified an any such person shall be disquali-

fied for a period of three years from date of the under;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the people Act 1951, the Elec-

tion Commission of India hereby declares Shri Anoop Kumar Pandey, resident of 41,Arya Nagar, Durg, Chhattisgarh

and the contesting Independent candidate for General Election to Lok Sabha of Chhattisgarh, 2019 from 07-Durg

and the Chief Electoral Officer, Chhattisgarh a Show Cause notice dated 28th August, 2019 was issued by Election

Commission of India under sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Sant Ram Rathiya

for non-submission of Election expenses ;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice dated 28th August 2019, Shri Sant Ram Rathiya was directed to submit his representation in

writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of

election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned

within 20 days form the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Sant Ram Rathiya on 7th September, 2020.

Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election

No. 189/ÁŸﬂÊ¸.¬ÿ¸./wÆwÆ dated 14th July, 2020 has stated that Shri Sant Ram Rathiya, has not submitted any represen-

tation or his account of election expenses, till date. Further, he has furnished neither any reason nor explanation for

the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Shri Sant Ram Rathiya has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the representation of the People Act, 1951 stipulates that :—

“If the Election Commission in satisfied that a person:

Has failed to lodge an account of election expenses within the time and in the manner required by

law or under this Act, and

(b)

Has no good reason or justification for the failure. The Election Commission shall by order pub-

lished in the official Gazette, declare him to be disqualified an any such person shall be disquali-

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including

69-Bemetara Assembly Constituency on 11th December, 2018. As such, the last date for lodging of account of

election expenses was 10th January, 2019.

AND WHEREAS, as per the report dated 11th January, 2019 submitted by the District Election Officer,

Bemetara District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No. 21/øÊ⁄U/Áﬂ.‚.øÈ./

ß¸U.ß¸U.∞◊/2019/85 dated 29th Junuary, 2019, Shri Saiyad Faruque Ali, Aam Aadmi Party contesting candidate from 69-

Bemetara Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election expenses as re-

quired by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Bemetara District, Chhattisgarh

and the Chief Electoral Officer, Chhattisgarh a Show Cause notice dated 19th March, 2020 was issued by Election

Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Saiyad Faruque

Ali for non-submission of Election expenses in the manner as required by law;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice dated 19th March, 2020, Shri Saiyad Faruque Ali was directed to submit his representation

in writing in the Commission and to rectify the defects in his accounts and submit the same to the District Election

Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by brother of Shri Saiyad Faruque Ali on 16th April, 2020.

Acknowledgment receipt obtained from the candidate have been submitted to the Commission by District Election

Officer, Bemetara vide his letter No. 499/Áﬂ‚.ÁŸ./√ÿÿ ‹πÊ/wÆwÆ dated 19th May, 2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Bemetara vide his

letter No. 2738/Áﬂ.‚.ÁŸ./√ÿÿ ‹πÊ/wÆwÆ dated 10th August, 2020 has stated that Shri Saiyad Faruque Ali has not

submitted any representation till date. Further, he has furnished neither any reason nor explanation for the said

failure of election expenses as required by law even after receipt of the due notice to the Election Commission of

India as well;

AND WHEREAS, the Commission is satisfied that Shri Saiyad Faruque Ali has failed to lodge his account

of election expenses in the manner as required by law and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the representation of the People Act, 1951 stipulates that :—

“If the Election Commission in satisfied that a person:

(a)

Has failed to lodge an account of election expenses within the time and in the manner required by

law or under this Act, and

(b)

Has no good reason or justification for the failure. The Election Commission shall by order pub-

lished in the official Gazette, declare him to be disqualified and any such person shall be disquali-

fied for a period of three years from date of the under;”

NOW THEREFORE, in pursuance of Section 10A of the Representation of the people Act 1951, the Elec-

tion Commission of India hereby declares Shri Saiyad Faruque Ali, resident of House No. 43, Sadar & Mahamaya

Road Bemetara, Thana, Tehsil & District-Bemetara, Chhattisgarh and the contesting candidate of Aam Aadmi Party

for General Election to Legislative Assembly of Chhattisgarh, 2018 from 69-Bemetara Assembly Constituency of

New Delhi, dated 14th September, 2020—23 Bhadrapada, 1942 (Saka)

No. CG-LA/ES-1/69/2018.—WHEREAS, the General Election to Legislative Assembly of Chhattisgarh,

2018 was announced by Election Commission of India vide Press Note No. ECI/PN/66/2018 dated 6th October,

2018. As per the schedule, date of Counting was 11th December, 2018.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candi-

date has to lodge a true copy of his account of election expenses within 30 days with the District Election Officer,

from the date of election returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning Officer including

69-Bemetara Assembly Constituency on 11th December, 2018. As such, the last date for lodging of account of

election expenses was 10th January, 2019.

AND WHEREAS, as per the report dated 11th January, 2019 submitted by the District Election Officer,

Bemetara District, Chhattisgarh and forwarded by Chief Electoral Officer, Chhattisgarh vide letter No. 21/øÊ⁄U/Áﬂ.‚.øÈ./

ß¸U.ß¸U.∞◊/2019/85 dated 29th Junuary, 2019, Shri Sohan Lal Nishad Nirbal Indian Shoshit Hamara Aam Dal contesting

candidate from 69-Bemetara Assembly Constituency of Chhattisgarh, has failed to lodge any account of his election

expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Bemetara District, Chhattisgarh

and the Chief Electoral Officer, Chhattisgarh a Show Cause notice dated 19th March, 2020 was issued by Election

Commission of India under sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Sohan Lal Nishad

for non-submission of Election expenses in the manner as required by law ;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above

said Show Cause Notice dated 19th March, 2020, Shri Sohan Lal Nishad was directed to submit his representation in

writing in the Commission and to explaining the reason for non-submission of accounts and also to lodge his ac-

counts of rectify the defects in his accounts and submit the same to the District Election Officer concerned within 20

days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Sohan lal Nishad on 16th April, 2020. Acknowledg-

ment receipt obtained from the candidate have been submitted to the Commission by District Election Officer,

Bemetara vide his letter No. 499/Áﬂ‚.ÁŸ./√ÿÿ ‹πÊ/wÆwÆ dated 19th May, 2020.

AND WHEREAS, in the supplementary report submitted by District Election Officer, Bemetara vide his

letter No. 2738/Áﬂ.‚.ÁŸ./√ÿÿ ‹πÊ/wÆwÆ dated 10th August, 2020 has stated that Shri Sohan Lal Nishad has not submit-

ted any representation till date. Further, he has furnished neither any reason nor explanation for the said failure of

election expenses as required by law even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission is satisfied that Shri Sohan Lal Nishad has failed to lodge his account of

election expenses in the manner as required by law and has no good reason or justification for the failure;

AND WHEREAS, Section 10A of the Representation of the People Act, 1951 stipulates that :—

“If the Election Commission in satisfied that a person:

(a)

Has failed to lodge an account of election expenses within the time and in the manner required by

law or under this Act, and

(b)

Has no good reason or justification for the failure The Election Commission shall by order pub-

lished in the official Gazette, declare him to be disqualified and any such person shall be disquali-

fied for a period of three years from date of the under;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the people Act 1951, the Elec-

tion Commission of India hereby declares Shri Sohan Lal Nishad, resident of B.T.I. Colony, Rani Laxmi Bai, ward

10, Tehsil & District Bemetara Chhattisgarh and the contesting candidate of Nirbal Indian Shoshit Hamara Aam Dal

for General Election to Legislative Assembly of Chhattisgarh, 2018 from 69-Bemetara Assembly Constituency of

the state of Chhattisgarh to be disqualified for being chosen as and for being a member of either House of Parliament

or the Legislative Assembly or legislative Council of a State or Union Tarritory for a period of three years from the

date of this order.
