NOTIFICATION

New Delhi, the 17th March, 1981

S.O. 190(E).—In exercise of the powers conferred by sub-section (1)

of

section 29B of the Industries (Development and Regulation) Act, 1951 (65 of

1951), the Central Government hereby exempts from the operation of clause (d)

of sub-section (1) of section 13 of the said Act and the rules made thereunder,

all Industrial undertakings registered under the said Act or in respect of which

a licence or permission has been issued under the said Act. subject to the

following conditions, namely :—

(D that the entire production in excess of registered Or licensed or per-

mitted capacity, as the case may be, Is exported;

(11) that the industrial undertaking shall not instal additional machinery,

indigenous or Imported, only for the purpose of such production for

export:

Provided that where such production in excess of licensed or registered

or permitted capacity be undertaken and is exported, it shall not

bo undertaken in respect of a product specified in Schedule I to

the notification of the Government of India in the Ministry

2. The provisions contained in this notification shall be Jn addition to and

not in derogation of the provisions contained in the notification of the Govern-

ment of India in the Ministry of Industry (Department of Industrial Develop-

ment) No. S.O. 98(E)/IDRA/29B/73/l. dated the 16th February, 1973, ex-

cept that the exemption granted by the present notification shall be available

notwithstanding the locational constraints specified In the second proviso under

item (3) of the said notification No SO. 98(E)/IDRA/29B/73/l, dated the 16th

February, 1973.
