SO 216{E)—Whereas by the notification of the Govern-

ment of India in the Ministry of Energy (Department of

Coal) No S O 842 dated the 8th March, 1978, under sub-

seUion (1) of section 4 of the Coal Bearing Areas (Acquisi-

tion and Development) Act, 1957 (20 of 1957), the Central

Government gdvL notice of its intention to prospect for

coal the lands measuiing 385 00 acres .approximately)

155 80 hecta'es (appioximately) in the locality specified in

the schedule appended to that notification ,

And whereas by the notification of the Government of

Iid'a m the late Mimstiy of Steel, Mines and Coal (Depart-

ment of Coal! No SO 133 dated the 27th December, 1979,

under sub-section (1) of section 7 of the said Act, the Cential

Government save notice specifying a further period of one

Note 2 : Attention is hereby invited

the provisions of

section 8 of the Coal Bearing Area (Acquisition

and Development) Act, 1957 (20 of 1957),

whkh

provides as follows :—

'8(1) Any person interested in any land in respect of

which a notilication undei section 7 has been issued

may, within thirty days of the issue of the notifica-

tion, object to the acquisition of the whole or any

part of the land or of any lights in or over such

land.

Explanation : It shall not be an objection within the mean-

ing of this section for any poison to say that he

himsell desires to

undertake mininR operations

in the land for the production of coul and that

such opeiations should not be undertaken by the

Central Government or by any other person.

(2) Every objection under sub-section (.1) shall be made

to the competent authority in writing, and the com-

petent authority shall give the objector and oppor-

tunity of being hcatd either in person or by a legal

practitioner and shall, after heaririR all such objec-

tions and after

making such further inquiry,

any, as he thinks necessary, either make a repoit

in respect of the land which has been notified under

sub-section (1) of section 7 or of rights in or over

such land, oi make different reports in respect of

different parcels of such kind oi lights in or over

such land, to the Central Government, containing

his recommendations on the objections, together

with the record of the proceedings held by him,

for the decision of that Government,

(3) For the purpose of this section, a peison shall be

deemed to be interested in land who would be

entitled to claim an interest in compensation if the

land or any rights in or over such land were acquired

under this Act.

Note 3 : The Coal Controller. 1, Council House Street,

Calcutta, has been appointed by the Central Govern-

ment as the competent authority under the Act.
