NOTIFICATION

In exercise of the powers conferred by the provision to Article 309 of the Constitution,

read with Govt. of India, Ministry of Home Affairs order No. 7/1/65-Estt(A) dated 16^th February,

1965 and in supersession of the existing recruitment rules for the posts, and all other powers

enabling him in this behalf, the Administrator of Dadra & Nagar Haveli and Daman & Diu, is

hereby pleased to make the following rules regarding the method of recruitment to Group ‘C’

Non-Gazetted, Non Ministerial posts of Basic Health Worker / Vaccinator, in the Directorate of

Medical & Health Services, U.T. Administration of Dadra & Nagar Haveli and Daman & Diu

namely:-

SHORT TITLE AND COMMENCEMENT :

(i) These rules may be called the Administration of Dadra & Nagar Haveli and Daman & Diu,

Directorate of Medical & Health Services, Basic Health Worker / Vaccinator, (Group ‘C’

Non-Gazetted / Non-Ministerial) posts Recruitment Rules, 2021.

(ii) They shall apply to the posts specified in column - 1 of the schedule to these rules.

(iii) These rules will come into effect from the date of publication of this notification in the

Official Gazette and will related to appointment to the various posts made on or after this

date.

NUMBER OF POSTS, CLASSIFICATION AND LEVEL IN THE PAY MATRIX :-

The number of the said post, its classification and the Level in the pay matrix attached thereto

shall be as specified in columns 2 to 4 of the Schedule annexed to these rules. Provided that,

the Administrator of Dadra & Nagar Haveli and Daman & Diu may vary the number of posts

in column 2 of the said Schedule from time to time subject to exigencies of work.

METHOD OF RECRUITMENT, AGE LIMIT, OTHER QUALIFICATIONS ETC :-

The method of recruitment, age limit, qualifications and other matters relating to the said

posts shall be as specified in columns 5 to 13 of the aforesaid Schedule.

DISQUALIFICATION :-

No person, (a) who has entered into or contracted a marriage with a person having a spouse

living or; (b) who having a spouse living, has entered into or contracted a marriage with any

person shall be eligible for appointment to the service.

Provided that, the Administrator of Dadra and Nagar Haveli and Daman & Diu, may,

if satisfied that such marriage is permissible under the personal law applicable to such person

and the other party to the marriage and that there are other grounds for so doing, exempt any

person from the operation of this rule.

POWER TO RELAX :-

Where the Administrator is of the opinion that, it is necessary or expedient so to do, it may,

by order, and for reasons to be recorded in writing, relax any of the provisions of these rules

with respect to any class or category of persons.

Saving :-

Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions

required to be provided for the Scheduled Castes and Scheduled Tribes, and the other special

categories or persons in accordance with the orders issued by the Central Government from

time to time in this regard.

DECLARATION

WHEREAS, vide Preliminary Notification No. 3/89/LND-ACQ/2020-21/2960 dated

10/06/2021, it was Notified under section 11 of the Right to Fair compensation and Transparency in

Land Acquisition, Rehabilitation and Resettlement Act, 2013, that the lands described in the Schedule

annexed with the said Notification was needed or likely to needed for the public purpose, namely for

the purpose of Acquisition of land for Development of Transport Nagar at Village Bhimpore, Nani

Daman.

WHEREAS, as required under sub section (2) of section 15 of the Right to Fair compensation

and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, objection were

accorded personal hearing by the Collector, Daman on 20/08/2021, and a report was submitted to the

Government Authority i.e. Administration of Dadra & Nagar Haveli and Daman & Diu for the

proceed with acquisition process and the same has been approved by the Appropriate Government i.e.

Administrator of Dadra & Nagar Haveli and Daman & Diu.

AND WHEREAS, the UT Administration of Dadra & Nagar Haveli and Daman & Diu is

satisfied on the basis of the Right to Fair compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013, that the said land as described in the schedule hereto

hereafter referred to as the said land/lands is need for the public purpose.

NOW, THEREFORE, it is hereby declared under the Provision of Section 19 of the Land

Acquisition & Rehabilitation Act that the said lands are required for the public purpose, namely,

Whereas, it appears to the appropriate Government that a total of 888.00 Sq. Mtrs. land is

required in the Nani Daman, Daman District for public purpose, namely, widening of existing

Pond at Dabhel Water supply project, Daman (Balance Proposal).

3. This Notification is made under the provisions of Section-11(1) of the Right to Fair

Compensation and transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30

of 2013), to all whom it may concern.

4. A plan of the land may be inspected in the Office of the Collector, Dholar, Moti Daman

and Executive Engineer, PWD, Work Division No.1, Moti Daman (Requiring Body) during the

working day and working hours.

5. The Government is pleased to authorize Mamlatdar, Daman and his Talathi to enter

upon and survey land, take levels of any land, dig or bore into the sub-soil and do all other acts

required for the proper execution of their work as provided and specified in Section-12 of the said

Act.

6. Under Section-11(4) of the Act, no person shall make any transaction or cause any

transaction of land i.e. sale / purchase, etc. or create any encumbrances on such land from the date of

publication without prior approval of the Collector.

7. Objections to the acquisition, if any, may be filed by the person interested within 60 (Sixty

Days) from the date of publication of this notification as provided under Section-15 of the Act before

Collector.

CORRIGENDUM

In partial modification to the notification read above the Union Territory Administration of

Dadra & Nagar Haveli and Daman & Diu is pleased to amend the clause 8 and clause 12(i) of the

notification as below :

or district office of the Registrar of Births & Deaths or

Baptism certificate ; or Birth certificate from the school

(Govt. / Recognized) last attended by the applicant or

any other recognized educational institution; or if a

person is class 10 or more pass, he should give a copy

of the mark sheet of class 10, if it contains date of birth

as a proof of date of birth; or Mark sheet of class 8 if it

contains date of birth; or Mark sheet of class 5 if it

contains date of birth; or Indian Passport; or PAN

card; or Driving License; or Aadhaar letter/Card

issued by UIDAI.

8. Special/General Conditions/Scheme guidelines

‘In exceptional circumstances, where the

competent authority approving the pension has any

doubt regarding age of the beneficiary or any

complaint has been received regarding the same, the

same shall be referred to the Medical Board

(Government Hospital) of the concerned district for

verification of age’

This issues with the approval of the Hon’ble Administrator, Dadra & Nagar Haveli and

Daman & Diu vide Dairy No. 814023 dated: 28/12/2021
