अंतगगत भारत सरकार, गृह मंत्रालय, नई ददल् ली की अशिसूचना सं. 7/1/65-स्था(ए), ददनांक 16 फरवरी,

1965 तथा काशमगक एवं प्रशशक्षण ववभाग, नई ददल्ली के कायागलय ज्ञापन सं. ए.बी.-14017/13/2016-

स्था(भ.शन.), ददनांक 18 जनवरी, 2017 के तहत प्रदत् त शवियों का प्रयोग करते हुए संघ प्रदेश दादरा

एवं नगर हवेली तथा दमण एवं दीव प्रशासन के तकनीकी शैक्षक्षक संस्थानों (दिप्लोमा), संघ प्रदेश दादरा

एवं नगर हवेली तथा दमण एवं दीव में व्याख्याता के सामान्य केन्रीय सेवा, समूह-‘क’ (राजपवत्रत एवं

अशलवपकीय) पद पर भती की पद्धशत को ववशनयशमत करने के शलए शनम् नशलक्षित शनयम बनाते हैं :-

संक्षक्षप्त नाम, अनुप्रयोग एवं प्रारंभ :-

(i) इन शनयमों को ‘’संघ प्रदेश दादरा एवं नगर हवेली तथा दमण एवं दीव प्रशासन द्वारा

व्याख्याता, सामान्य केन्रीय सेवा, समूह-‘क’ (राजपवत्रत एवं अशलवपकीय) पद के शलए

भती शनयम, 2024’’ कहा जाएगा ।

(ii) ये शनयम इन शनयमों की अनुसूची के कॉलम 1 में शनददगष्ट पदों पर लागू होंगे।

(iii) ये शनयम सरकारी राजपत्र में इस अशिसूचना के प्रकाशन की तारीि से प्रभावी होंगे और

इस शतशथ को या उसके बाद ववशभन्न पदों पर शनयुवि के शलए प्रयुि होंगे ।

पदों की संख्या, वगीकरण एवं वेतनमान :-

इससे संबद्ध पदों की संख्या, उनका वगीकरण और वेतनमान वही होंगे, जो इस शनयम

के साथ संलग्न अनुसूची के कॉलम-2 से 4 में ववशनददगष्ट हैं : बशते दक संघ प्रदेश दादरा एवं

नगर हवेली तथा दमण एवं दीव प्रशासन कायग की आकक्षस्मकताओं के मद्देनज़र समय-समय

पर उि अनुसूची के कॉलम - 2 में पदों की संख्या में पररवतगन कर सकता है ।

भती पद्धशत, आयु सीमा एवं अन्य अहगताएं :-

उि पदों पर भती की पद्धशत, आयु सीमा, अहगताएं और उनसे संबंशित अन्य बातें वही

होंगी, जो उि अनुसूची के कॉलम-5 से 13 में ववशनददगष्ट हैं ।

अनहगता :-

ऐसा कोई व्यवि, (क) क्षजसने दकसी ऐसे व्यवि से वववाह दकया हो या वववाह का

अनुबंि दकया हो, क्षजसकी पत्नी/क्षजसका पशत जीववत हो, या (ि) क्षजसने अपनी पत्नी/अपने

पशत के जीववत रहते हुए दकसी अन्य व्यवि से वववाह दकया हो या वववाह का अनुबंि दकया

हो, वह उि पद पर शनयुवि का पात्र नहीं होगा । परन्तु यदद प्रशासक, दादरा एवं नगर हवेली

तथा दमण एवं दीव इससे संतुष्ट हो जाएं दक ऐसा वववाह उस व्यवि और वववाह के अन्य

पक्षकार को लागू स्वीय ववशि (पसगनल लॉ) के तहत स्वीकायग है और यह दक ऐसा करने के

शलए अन्य आिार हैं, तो वह दकसी व्यवि को इस शनयम के प्रवतगन से छूट दे सकते हैं ।

शशशथल करने की शवि :-

जहां प्रशासक, दादरा एवं नगर हवेली तथा दमण एवं दीव की यह राय हो दक ऐसा

करना आवश्यक या समीचीन है, तो वहां वे आदेश द्वारा और उसके शलए जो कारण हैं, उन्हें

लेिबद्ध करके इन शनयमों के दकसी भी उपबंि को दकसी वगग या श्रेणी के व्यवियों के संबंि

में शशशथल कर सकेंगे ।

व्यावृवि :-

इन शनयमों की कोई बात, ऐसे आरक्षण, आयु सीमा में छूट और अन् य ररयायतों पर

प्रभाव नहीं िालेगी, क्षजनका केन् रीय सरकार द्वारा इस संबंि में समय-समय पर जारी दकए गए

आदेशों के अनुसार अनुसूशचत जाशतयों तथा अनुसूशचत जनजाशतयों एवं अन्य ववशेष वगग के

व्यवियों के शलए उपबंि करना अपेक्षक्षत है ।

इसे नोट सं. 10781, ददनांक 26/09/2024 के अनुसार संघ लोक सेवा आयोग (यूपीएससी),

नई ददल् ली के अनुमोदन से जारी दकया जाता है ।

In exercise of the powers conferred under proviso to Article 309 of the Constitution delegated

to him vide Government of India, Ministry of Home Affairs, New Delhi’s Notification No.7/1/65-

Est(A) dated 16^th February, 1965 and Department of Personnel and Training, New Delhi O.M. No. AB-

14017/13/2016-Estt. (RR) dated 18^th January, 2017, the Administrator of Dadra & Nagar Haveli and

Daman & Diu is pleased to make the following Rules regulating the method of recruitment to the

General Central Service, Group “A” (Gazetted & Non-Ministerial) post of Lecturers in Technical

Educational Institutions (Diploma) under the U.T. Administration of Dadra & Nagar Haveli and Daman

& Diu are as under: -

SHORT TITLE APPLICATION AND COMMENCEMENT: -

(i)

These rules may be called by the Administration of Dadra & Nagar Haveli and Daman &

Diu, for Lecturers General Central Services Group ‘A’ (Gazetted, Non-Ministerial) posts

Recruitment Rules, 2024.

(ii) They shall apply to the posts specified in column 1 of the Schedule to these Rules.

(ii) These rules will come into effect from the date of publication of this Notification in the

Official Gazette and will relate to appointment to the various posts made on or after this

date.

NUMBER OF POSTS, CLASSIFICATION AND SCALE OF PAY: - The number of posts,

classification of the said posts and the scales of pay attached thereto shall be as specified in

Column 2 to 4 of the Schedule to these rules: Provided that, the U.T. Administration of Dadra

& Nagar Haveli and Daman & Diu may vary the number of posts in Column No.2 of the said

schedule from time to time subject to exigencies of the work.

METHOD OF RECRUITMENT, AGE LIMIT AND OTHER QUALIFICATION: -

The method of recruitment to the said posts, age limits, qualifications and other matters

connected therewith shall be as specified in Column 5 to 13 of the aforesaid Schedule.

DISQUALIFICATION:- No Person (a) Who has entered into or contracted a marriage with a

person having a spouse living, or (b) Who, having spouse living, has entered into or contracted

a marriage with any person shall be eligible for appointment to the service Provided that, the

Administrator of Dadra & Nagar Haveli and Daman & Diu may, if satisfied that such marriage

is permissible under the personnel law applicable to such person and other party to the marriage

and that there are other grounds for so doing, exempt any person form the operation of this rule.

POWER TO RELAX: - Where the Administrator of Dadra & Nagar Haveli and Daman & Diu

is of the opinion, that it is necessary or expedient so to do, it may, by order and for reasons to be

recorded in writing relax any of the provision of these rules with respect to any class or category

of persons.

SAVING: - Nothing in these rules shall affect reservation, relaxation of age limit and other

concessions required to be provided for Scheduled Castes and Scheduled Tribes and other

Special Categories of persons in accordance with the orders issued by the Central Government

from time to time in this regard.

In exercise of the powers conferred by sub-section (1) of Section 4 of the Right to Fair

Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013

(Central Act 30 of 2013) read with sub-rule (1) of Rule 3 of Right to Fair Compensation and

Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and

Consent) Rules, 2014 (hereinafter referred to the “said Rules”) the appropriate Government, hereby

issues this Notification in accordance with Part-B of Form I appended to the said Rules, for carrying

out Social Impact Assessment in the manner and from the date specified herein below:-

(1) Name of project developer: The Director of Education, DNH & DD.

(2) Purpose of proposed project: Acquisition of land bearing Survey No.7/2 admeasuring 700 Sq.

mtrs for construction of a New School building for Government School, Kachigam.

PRELIMINARY NOTIFICATION

Whereas, it appears to the appropriate Government that a total of 5301 Sq. Mtrs. (Private

land) (standard measurement) land is required in Khanvel Village of Dadra and Nagar Haveli for public

purpose, namely, for the Development of School Campus in Khanvel Village, D&NH. The Social

Impact Assessment study was carried out by Social Impact Assessment (SIA) Unit and a report

submitted/preliminary investigation was conducted by a team constituted by Collector as laid down

under rule 4. The Summary of the Social Impact Assessment Report/preliminary investigation is as

follows (Copy attached):

i. The proposed land acquisition is the bare minimum needed for the project, and there are no

other options for the project. These parcels of land are owned by a number of private parties

and the RFCTLARR Act requires compensation in the form of the value of unoccupied land

and other assets.

ii. One of the main purposes of the Social Impact Assessment Report is to find out if the

project will help the public. Based on this estimate, the Construction/Development of

School Campus Should support development of education facility and increase in sports

activity.

iii. The project will encourage Construction/Development of School Campus under the SIA

project will serve as a cornerstone for fostering quality education and holistic

development. With its modern infrastructure, eco-friendly design, and student-centric

facilities, the campus will create an ideal environment for learning, innovation, and

growth. This initiative reflects a commitment to empowering future generations and

building a brighter, more educated community. Due to the establishment of employment

opportunities both during and after the project's implementation, Benefits could be

realized which are both tangible and intangible. Also, it will also have socioeconomic

advantages.

iv. The planned project's impact on various types of structures, as well as the acquisition of

private land, may entail social disturbance and economic loss for project-affected

families/people. While implementing the project, it is necessary to consider the project's

disruptions and losses, as well as their impact on people's socioeconomic conditions. If

there are any alternatives to the proposed land acquisition, they should be investigated. A

plan of action for implementing mitigation measures to lessen the severity of negative

impacts can be developed. According to the results of the socioeconomic survey, project

affected families are willing to give up their land for the project only if they are adequately

compensated under the RFCTLARR Act 2013 or the RFCTLARR (Rehabilitation and

Resettlement, Development Plan) Rules 2014 of the Administration of Dadra and Nagar

Haveli.

The number of families that may/are likely to be displaced due to the land acquisition will be

known only after the survey for R&R initiated U/s 16 of the RFCTLARR Act 2013.

The Resident Deputy Collector, Khanvel is appointed as Administrator for the purpose of

Rehabilitation and Resettlement of the affected families vide Notification no. LAQ/RFCTLARRA,

2013-2015/174 dated 11/08/2015 u/s 44 (1) and Section 43(1) of the Act-2013. Therefore, it is notified

that for the above-said project in Dadra & Nagar Haveli District, a piece of land Admeasuring 5301 sq.

This Notification is made under the provisions of Section-11(1) of the Right to Fair

Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30

of 2013), to all whom it may concern.

A plan of the land may be inspected in the Office of the Collector, Silvassa, Dadra &

Nagar Haveli and the District Education Officer, DNH (Requiring Body) during the working day

and working hours.

The Government is pleased to authorize Mamlatdar, Khanvel and his Talathi to enter upon

and survey land, take levels of any land, dig or bore into the sub-soil and do all other acts required for

the proper execution of their work as provided and specified in Section-12 of the said Act.

Under Section-11(4) of the Act, no person shall make any transaction or cause any

transaction of land i.e. sale/purchase, etc. or create any encumbrances on such land from the date of

publication of such notification without prior approval of the Collector.

Objections to the acquisition, if any, may be filed by the person interested within 60 (Sixty

Days) from the date of publication of this notification as provided under Section-15 of the Act before

Collector.

Report of the Administrator for Rehabilitation and Resettlement Scheme u/s 16 of The Right to

Fair Compensation and Transparency in Land Acquisition Act, 2013 in respect of Acquisition of

land for Development of Government Campus, Nani Daman.

Preface:-

Vide Notiﬁcation No. 3/124/LND-ACQ/2024-25/3448 dated 08.08.2024 proposal for land

acquisition area admeasuring private land is 22209.00 Sq.mtrs. and 1876.00 Sq.mtrs. of Government

land total area admeasuring 24085.00 Sq.mtrs of Dunetha, Nani Daman was notiﬁed u/s 11(1) of the

Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement

Act, 2013 for a public purpose, namely, Acquisition of land for Development of Government Campus,

Nani Daman. The Collector, Daman is the Land Acquisition Collector under the RFCTLARR Act 2013.

Vide Notiﬁcation No.5/2/COL/Land/RFCTLARR/2015-16/2296 dated 04/08/2015, the Deputy

Collector (HQ), Daman was appointed as the Administrator under sub section (1) of Section 43 of the

said act for Rehabilitation and Resettlement of affected families due to acquisition of the said land as

mentioned above.

Introduction:-

Upon receiving the proposal of Land Acquisition from the Requiring Department, i.e. the

Director, Higher and Technical Education, DNH & DD a meeting was conducted by the SIA Committee

on 24.04.2024. The affected parties and families were explained in detail the reasons for the land

acquisition, and the process that shall be followed in the calculation of the compensation as per the

provisions of the RFCTLARR Act 2013. During the Public meeting, particulars of lands and immovable

properties being acquired of each affected family, Livelihoods primarily dependent on the lands being

acquired, Public utilities likely to be affected, Common property resources, etc were discussed. A

meeting of the Expert Group u/s 7 of the Act was held on 02/07/2024.

Methodology:-

As per section 16 of the RFCTLARR Act 2013, the Preparation of Rehabilitation and

Resettlement Scheme should be done by the Administrator. Therefore, the undersigned directed to the

Mamlatdar, Daman to visit each affected families and gather the details of their properties, livelihood

and other relevant information as required by the Act. Accordingly, the staff of the Mamlatdar, Daman

visited 42 Private lands and 10 Government lands and collected the details as required.

Rehabilitation & Resettlement Plan:-

Based on the survey Reports, a draft Rehabilitation and Resettlement scheme was prepared.

This Rehabilitation and Resettlement scheme is drafted in consonance with provisions of the

RFCTLARR (Compensation, Rehabilitation and Resettlement and Development Plan) Rules 2015.

Findings:-

As per the Section 3(k) of RFCTLARR Act 2013, "Displaced Family” means any family who

on the account of acquisition of land has to be relocated and resettled from the affected area to the

resettlement area. In the present case, it is evident that the affected family does not need relocation and

resettlement since no family is being displaced from their residential house/commercial land. The land

being acquired is for the purpose of Acquisition of land for Development of Government Campus, Nani

Daman for which compensation shall be paid as and when the Land Acquisition Collector pass the

Award. Hence, a Rehabilitation and Resettlement Scheme is not required.

4 Rehabilitation and Resettlement entitlements

1. Provision of housing units in case of displacement

(1) If a house is lost in rural areas, a constructed house shall be provided as per the Indira Awas Yojana specifications. If a house is lost in urban areas,

a constructed house shall be provided, which will be not less than 50 sq. mts. in plinth area.

(2) The benefits listed above shall be extended to any affected family which is without homestead land and which has been residing in the area and which

has been involuntarily displaced from such area:

Provided that any such family in urban areas which opts not to take the house offered, shall get a one-time assistance for house construction, which shall

not be less than one lakh fifty thousand rupees:

Provided further that if any affected family in rural areas so prefers, the entitlement cost of the house may be offered in lieu of the constructed house:

Provided also that no family affected by acquisition shall be given more than one house under the provisions of this Act.

Recommendation:

Not Applicable as no housing units have been affected.

2. Land for land

In case of Irrigation project, as far as possible and in lieu of compensation to be paid for land acquired, each affected family owning agriculture land in

the affected area and whose land has been acquired or lost, or who has, as a consequence of the acquisition or loss of land, been reduced to the status of

a marginal farmer or landless, shall be allotted, in the name of each person included in the records or rights with regard to the affected family, a minimum

of one acre of land in the command area of the project for which the land is acquired:

Provided that in every project those person losing land and belonging to the Scheduled Castes or Scheduled Tribes will be provided land equivalent to

land acquired or two and a half-acres, whichever is lower.

Recommendation-

Not Applicable as it is not an irrigation project.

3. Offer for developed land

In case the land is acquired for urbanization purposes, twenty five percent of the developed land will be reserved and offered to land owing project

affected families, in proportion to the area of their land acquired and at a price equal to the cost of acquisition and the cost of development.

Provided that in case the land owing project affected family wishes to avail this offer, an equivalent amount will be deducted from the land acquisition

compensation package payable to it.

Recommendation-

Not Applicable as land is not being acquired for urbanization purpose.

4. Choice of annuity or Employment

The appropriate government shall ensure that the affected families are provided with following option: -

(a) Job may be given to at least one member per affected family in the project or arrange for a job in such other project as may be required and

providing suitable training and skill development in the required field or make provision for employment at a rate not lower than the minimum

wages provided for in any other law for the time being enforced. or

(b) One time grant of ₹.5 lakh rupees per affected family. Or

(c) The affected family will be provided with an annuity payment of Rupees 2000 per month per family for twenty years (this will be adjusted for

inflation annually).

Recommendation:

Not Applicable as no annuity or Employment has been affected.

5. Subsistence grant for displaced families for a period of one year

Each affected family which is displaced from the land acquired shall be given a monthly subsistence allowance equivalent to three thousand rupees per

month for a period of one year from the date of award.

In addition to this amount, the Scheduled Castes and the Scheduled Tribes displaced from Scheduled Areas shall receive an amount to fifty thousand

rupees.

In cases of displacement from the Scheduled Areas, as far as possible, the affected families shall be relocated in a similar ecological zone, so as to preserve

the economic opportunities, language, culture and community life of the tribal communities.

Recommendation:

Not Applicable as there is no displacement.

6. Transportation cost for displaced families

Each affected family which is displaced shall get one-time financial assistance of fifty thousand rupees as transportation cost for shifting of the family,

building materials, belongings and cattle.

Recommendation-

Not Applicable as there is no displacement.

7. Cattle shed/ petty shops cost

Each affected family having cattle or having a petty shop shall get one-time financial assistance of such amount as the appropriate Government may, by

notification, specify subject to a minimum of twenty-five thousand rupees for construction of cattle shed or petty shop as the case may be.

Recommendation- Not Applicable as there is no Cattle shed/ petty shop

8. One-time grant to artisan, small traders and certain others

Each affected family of an artisan, small trader or self-employed person or an affected family which owned non-agricultural land or commercial, industrial

or institutional structure in the affected area due to land acquisition, shall get one-time financial assistance of such amount as the appropriate Government

may, by notification specify subject to a minimum of twenty-five thousand rupees.

Recommendation- Not Applicable as there are no artisans, small traders, and certain others are affected.

9. Fishing Rights

In cases of Irrigation or hydel projects, the affected families may be allowed fishing rights in the reservoirs, in such manner as may be prescribed by the

appropriate government.

Recommendation-

Not Applicable as it is not an irrigation or hydel project.

10. One-time Resettlement Allowance

Each Affected family shall be given one time “Resettlement Allowance” of fifty thousand rupees only.

Recommendation:

Not Applicable as there is no displacement.

11. Stamp duty and registration fee

(1) The stamp duty and other fees payable for registration of the land or house allotted to the affected families shall be borne by the Requiring Body.

(2) The land for house allotted for the affected families shall be free from all encumbrances.

(3) The land or house allotted may be in the joint names of wife and husband of the affected families.
