4 Rehabilitation and Resettlement entitlements
1. Provision of housing units in case of displacement
(1) If a house is lost in rural areas, a constructed house shall be provided as per the Indira Awas Yojana specifications. If a house is lost in urban areas,
a constructed house shall be provided, which will be not less than 50 sq. mts. in plinth area.
(2) The benefits listed above shall be extended to any affected family which is without homestead land and which has been residing in the area and which
has been involuntarily displaced from such area:
Provided that any such family in urban areas which opts not to take the house offered, shall get a one-time assistance for house construction, which shall
not be less than one lakh fifty thousand rupees:
Provided further that if any affected family in rural areas so prefers, the entitlement cost of the house may be offered in lieu of the constructed house:
Provided also that no family affected by acquisition shall be given more than one house under the provisions of this Act.
Recommendation:
As the land to be acquired is in a Rural area, each displaced families shall be granted entitlement cost of the house of ₹.1,50,000/- in lieu of the constructed
house.
Therefore, 08 displaced families shall be granted ₹.12,00,000/- or they may apply for a house under Pradhan Mantri Awas Yojana.

2. Land for land
In case of Irrigation project, as far as possible and in lieu of compensation to be paid for land acquired, each affected family owning agriculture land in
the affected area and whose land has been acquired or lost, or who has, as a consequence of the acquisition or loss of land, been reduced to the status of
a marginal farmer or landless, shall be allotted, in the name of each person included in the records or rights with regard to the affected family, a minimum
of one acre of land in the command area of the project for which the land is acquired:
Provided that in every project those person losing land and belonging to the Scheduled Castes or Scheduled Tribes will be provided land equivalent to
land acquired or two and a half-acres, whichever is lower.
Recommendation-
Not Applicable as it is not an irrigation project.

3. Offer for developed land
In case the land is acquired for urbanization purposes, twenty five percent of the developed land will be reserved and offered to land owing project
affected families, in proportion to the area of their land acquired and at a price equal to the cost of acquisition and the cost of development.
Provided that in case the land owing project affected family wishes to avail this offer, an equivalent amount will be deducted from the land acquisition
compensation package payable to it.
Recommendation-
Not Applicable as land is not being acquired for urbanization purpose.
4. Choice of annuity or Employment
The appropriate government shall ensure that the affected families are provided with following option: -
(a) Job may be given to at least one member per affected family in the project or arrange for a job in such other project as may be required and
providing suitable training and skill development in the required field or make provision for employment at a rate not lower than the minimum
wages provided for in any other law for the time being enforced. or
(b) One time grant of ₹.5 lakh rupees per affected family. Or
(c) The affected family will be provided with an annuity payment of Rupees 2000 per month per family for twenty years (this will be adjusted for
inflation annually).
Recommendation:
One time grant of ₹.5 lakh shall be granted to each affected family amounting to ₹.1,40,00,000/- for 28 affected families.

5. Subsistence grant for displaced families for a period of one year
Each affected family which is displaced from the land acquired shall be given a monthly subsistence allowance equivalent to three thousand rupees per
month for a period of one year from the date of award.
In addition to this amount, the Scheduled Castes and the Scheduled Tribes displaced from Scheduled Areas shall receive an amount to fifty thousand
rupees.
In cases of displacement from the Scheduled Areas, as far as possible, the affected families shall be relocated in a similar ecological zone, so as to preserve
the economic opportunities, language, culture and community life of the tribal communities.
Recommendation:
The District is not a Scheduled area. Therefore, each affected family shall be granted a subsistence allowance of ₹.36,000/- (Rs. 3,000 per month) for a
period of one year from the date of award, amounting to ₹.2,88,000/- for 08 affected families and 04 Scheduled Tribes and 01 Scheduled Castes
are not residing in the Scheduled area thus the additional amount is NIL.

6. Transportation cost for displaced families
Each affected family which is displaced shall get one-time financial assistance of fifty thousand rupees as transportation cost for shifting of the family,
building materials, belongings and cattle.

Recommendation-
Each affected family shall be granted one-time financial assistance of ₹.50,000/- as transportation cost for shifting of the family, building materials, and
belongings amounting to ₹.4,00,000/- for 08 affected families.
7. Cattle shed/ petty shops cost
Each affected family having cattle or having a petty shop shall get one-time financial assistance of such amount as the appropriate Government may, by
notification, specify subject to a minimum of twenty-five thousand rupees for construction of cattle shed or petty shop as the case may be.
Recommendation- Nil
8. One-time grant to artisan, small traders and certain others
Each affected family of an artisan, small trader or self-employed person or an affected family which owned non-agricultural land or commercial, industrial
or institutional structure in the affected area due to land acquisition, shall get one-time financial assistance of such amount as the appropriate Government
may, by notification specify subject to a minimum of twenty-five thousand rupees.
Recommendation- Nil
9. Fishing Rights
In cases of Irrigation or hydel projects, the affected families may be allowed fishing rights in the reservoirs, in such manner as may be prescribed by the
appropriate government.
Recommendation-
Not Applicable as it is not an irrigation or hydel project.
10. One-time Resettlement Allowance
Each Affected family shall be given one time “Resettlement Allowance” of fifty thousand rupees only.
Recommendation:
Each affected family shall be given one-time Resettlement Allowance of ₹.50,000/- amounting to ₹.4,00,000/- for 08 affected families.

11. Stamp duty and registration fee
(1) The stamp duty and other fees payable for registration of the land or house allotted to the affected families shall be borne by the Requiring Body.
(2) The land for house allotted for the affected families shall be free from all encumbrances.
(3) The land or house allotted may be in the joint names of wife and husband of the affected families.

2. તર્સ્થાપનના તકસ્સામાં આર્ાસ એકમોની જોગર્ાઈ
(3) જો ગ્રામીણ ક્તવસ્તારોમાં ઘર ગ માવે છે, તો ઈક્તદદરા આવાસ યોજનાના સ્પષ્ટીકરણો અન સાર બાંધવામાં આવેલ ઘર આપવામાં આવશે. જો શહેરી ક્તવસ્તારોમાં ઘર ગ માવે છે, તો
બાંધવામાં આવેલ ઘર આપવામાં આવશે, જે ક્તલલદથ ક્તવસ્તારમાં 50 ચોરસ મીટરથી ઓછ ં ન હોય..
(4) ઉપર સૂક્તચબદ્ધ લાભો એવા કોઈપણ અસરગ્રસ્ત ક ટ ંબને આપવામાં આવશે જે ઘરની જમીન વગરના હોય અને જે આ ક્તવસ્તારમાં રહેતા હોય અને જે આવા ક્તવસ્તારમાંથી
અનૈક્તછછક રીતે ક્તવસ્થાક્તપત થયા હોય:
જો કે શહેરી ક્તવસ્તારોમાં આવા કોઈપણ ક ટ ંબ કે જે ઓફર કરેલ મકાન લેવાન ં પસંદ ન કરે , તેને મકાન બાંધકામ માટે એક વખતની સહાય મળશે, જે એક લાખ પચાસ હજાર
રૂક્તપયાથી ઓછી ન હોવી જોઈએ:

જો કે જો ગ્રામીણ ક્તવસ્તારોમાં કોઈપણ અસરગ્રસ્ત ક ટ ંબ આ રીતે પસંદ કરે છે, તો બાંધવામાં આવેલા મકાનના બદલે મકાનની હકદાર ક્તકંમત ઓફર કરી શકાય છે:
આ કાયદાની જોગવાઈઓ હેઠળ સંપાદનથી પ્રભાક્તવત કોઈપણ ક ટ ંબને એક કરતાં વધ મકાન આપવામાં આવશે નહીં.
ર્ભલામણ:
સંપાક્તદત કરવાની જમીન ગ્રામ્ય ક્તવસ્તારમાં હોવાથી, દરેક ક્તવસ્થાક્તપત પક્તરવારોને ઘરની હકદાર ક્તકંમત .₹.1,50,000/- આપવામાં આવશે, બાંધેલા મકાનના બદલામાં.
જેથી, 08 ક્તવસ્થાક્તપત પક્તરવારોને ₹.12,00,000/- આપવામાં આવશે અથવા તો તેઓ પ્રધાનમંત્રી આવાસ યોજના હેઠળ ઘર માટે અરજી કરી શકે છે.

2. જમીન માટે જમીન
ક્તસંચાઈ યોજનાના ક્તકસ્સામાં, શક્ય હોય તયાં સ ધી અને સંપાક્તદત જમીન માટે વળતર ચૂકવવાના બદલામાં, અસરગ્રસ્ત ક્તવસ્તારમાં ખેતીની જમીન ધરાવતો પ્રતયેક અસરગ્રસ્ત પક્તરવાર
અને જેની જમીન સંપાક્તદત થયેલ છે અથવા ગ માવેલ છે, અથવા જેના પક્તરણામ સ્વરૂપે, જમીનન ં સંપાદન અથવા ન કસાન, સીમાંત ખેર્ૂત અથવા જમીનક્તવહોણાના દરજ્જામાં
ઘટાર્ી દેવામાં આવ્ય ં છે, અસરગ્રસ્તોના સંદભવમાં, રેકોર્વ અથવા અક્તધકારોમાં સમાક્તવષ્ટ દરેક વ્યક્તિના નામે ફાળવવામાં આવશે. ક ટ ંબ, પ્રોજેક્ટના કમાદર્ એક્તરયામાં જેના માટે
જમીન સંપાક્તદત કરવામાં આવી છે તેના ઓછામાં ઓછી એક એકર જમીન ફાળવવામાં આવશે :
જો કે દરેક પ્રોજેક્ટમાં જમીન ગ માવનાર જો અન સૂક્તચત જાક્તત અથવા અન સૂક્તચત જનજાક્તતની વ્યક્તિઓ હોય તો એમને સંપાક્તદત કરેલી જમીન અથવા અઢી એકર, બેમાંથી જે
ઓછ ં હોય તેના સમકક્ષ જમીન આપવામાં આવશે.

અંહી લાગ પર્ત ં નથી કારણ કે આ ક્તસંચાઈ યોજના નથી.
3. તર્કતસિ જમીન માટે ઓફર
જો જમીન શહેરીકરણના હેત ઓ માટે સંપાક્તદત કરવામાં આવી હોય તો, ક્તવકક્તસત જમીનના પચીસ ટકા અનામત રાખવામાં આવશે અને પ્રોજેક્ટ અસરગ્રસ્ત પક્તરવારોને તેમની
સંપાક્તદત જમીનના ક્ષેત્રફળના પ્રમાણમાં અને સંપાદનની ક્તકંમતની અને ક્તવકાસની ક્તકંમતની સમાન ક્તકંમતે જમીનની ઓફર કરવામાં આવશે.
જો જમીન લેનાર પ્રોજેક્ટ અસરગ્રસ્ત પક્તરવાર આ ઓફરનો લાભ લેવા ઈછછે તો, તેને ચૂકવવાપાત્ર જમીન સંપાદન વળતર પેકેજમાંથી સમકક્ષ રકમ બાદ કરવામાં આવશે.
ર્ભલામણ-
અંહી લાગ પર્ત ં નથી કારણ કે શહેરીકરણ હેત માટે જમીન સંપાક્તદત કરવામાં આવી નથી.
4. ર્ાતષવકી અથર્ા રોજગારની પસંદગી
યોગ્ય સરકાર ખાત્રી કરશે કે અસરગ્રસ્ત પક્તરવારોને નીચેના ક્તવકલ્પ પૂરા પાર્વામાં આવે: -
(a) પ્રોજેક્ટમાં અસરગ્રસ્ત ક ટ ંબ દીઠ ઓછામાં ઓછા એક સભ્યને નોકરી આપવામાં આવી શકે છે અથવા આવા અદય પ્રોજેક્ટમાં નોકરીની વ્યવસ્થા કરી શકે છે અને જરૂરી
ક્ષેત્રમાં યોગ્ય તાલીમ અને કૌશલ્ય ક્તવકાસ પ્રદાન કરી શકે છે અથવા તેનાથી ઓછા ન હોય તેવા દરે, રોજગાર માટેની જોગવાઈ કરી શકે છે. અદય કોઈપણ કાયદામાં લાગ
કરવામાં આવતા સમય માટે લઘ ત્તમ વેતન આપવામાં આવ્ય ં છે. અથવા
(b) અસરગ્રસ્ત પક્તરવાર દીઠ એક વખતની ગ્રાદટ ₹. 5 લાખ રૂક્તપયા. અથવા
(c) અસરગ્રસ્ત પક્તરવારને વીસ વર્વ સ ધી ક ટ ંબ દીઠ દર મક્તહને રૂ. 2000 ની વાક્તર્વકી ચ કવણી આપવામાં આવશે (આ વાક્તર્વક ફ ગાવા માટે એર્જસ્ટ કરવામાં આવશે).
ર્ભલામણ:
દરેક અસરગ્રસ્ત પક્તરવારને એક વખતની ગ્રાદટ ₹. 5 લાખની રકમ આપવામાં આવશે જેથી 28 અસરગ્રસ્િ પતરર્ારો માટે ₹. 1,40,00,000/-.

સંપાક્તદત કરેલી જમીનમાંથી ક્તવસ્થાક્તપત થયેલા દરેક અસરગ્રસ્ત ક ટ ંબને એવોર્વની તારીખથી એક વર્વના સમયગાળા માટે દર મક્તહને ત્રણ હજાર રૂક્તપયા જેટલ ં માક્તસક ક્તનવાવહ ભથથ ં
આપવામાં આવશે.
આ રકમ ઉપરાંત, અન સૂક્તચત ક્તવસ્તારોમાંથી ક્તવસ્થાક્તપત થયેલા અન સૂક્તચત જાક્તત અને અન સૂક્તચત જનજાક્તતને પચાસ હજાર રૂક્તપયાની રકમ મળશે.
અન સૂક્તચત ક્તવસ્તારોમાંથી ક્તવસ્થાપનના ક્તકસ્સામાં, શક્ય હોય તયાં સ ધી, અસરગ્રસ્ત પક્તરવારોને સમાન ઇકોલોજીકલ ઝોનમાં સ્થાનાંતક્તરત કરવામાં આવશે, જેથી આક્તદવાસી
સમ દાયોની આક્તથવક તકો, ભાર્ા, સંસ્ક ક્તત અને સામ દાક્તયક જીવનને સાચવી શકાય.
ર્ભલામણ:
આ પ્રદેશ એ અન સૂક્તચત ક્તવસ્તાર નથી. તેથી, દરેક અસરગ્રસ્ત પક્તરવારને પ રસ્કારની તારીખથી એક ર્ષવના સમયગાળા માટે, ક્તનવાવહ ભથથ ં ₹. 36,000/- (રૂ. 3,000 પ્રતિ માસ)
આપવામાં આવશે, જે 08 અસરગ્રસ્િ પતરર્ારો માટે ₹. 2,88,000/- જેટલી રકમ થાય છે અને 04 અન સૂક્તચત જાક્તતઓ અને 01 અન સૂક્તચત જાક્તત જેઓ અન સૂક્તચત ક્તવસ્તારમાં
રહેતા ન હોવાથી તેવા લોકો માટે વધારાની રકમ શૂદય છે.

દરેક અસરગ્રસ્ત પક્તરવારને ક ટ ંબના સ્થળાંતર માટે પક્તરવહન ખચવ તરીકે, મકાન સામગ્રી અને સામાનની રકમ તરીકે એક વખતની આક્તથવક સહાય ₹. 50,000/- આપવામાં આવશે.
જે 08 અસરગ્રસ્ત પક્તરવારો માટે ₹.4,00,000/- જેટલી રકમ થાય છે.
7. ઢોરના શેડ/ નાની દુકાનોની તકંમિ
પશ ઓ ધરાવનાર અથવા નાની દ કાન ધરાવતા દરેક અસરગ્રસ્ત ક ટ ંબને પશ ઓના શેર્ અથવા તો નાની દ કાનના બાંધકામ માટે, ઉક્તચત સરકાર વતી, સૂચના દ્વારા ક્તનક્તદવષ્ટ કરવામાં
આવનાર રકમને આધીન, એક વખતની નાણાકીય સહાય જે ઓછામાં ઓછા પચીસ હજાર રૂક્તપયા હોઈ શકે છે, તે મળશે.

8. કારીગર, નાના ર્ેપારીઓ અને અમુક અન્ય લોકોને એક ર્ખિની ગ્રાન્ટ
કારીગર, નાના વેપારી અથવા સ્વ-રોજગારી વ્યક્તિ અથવા અસરગ્રસ્ત ક ટ ંબ કે જે જમીન સંપાદનને કારણે અસરગ્રસ્ત ક્તવસ્તારમાં ક્તબન-ખેતી જમીન અથવા વ્યાપારી, ઔદ્યોક્તગક
અથવા સંસ્થાકીય માળખ ં ધરાવે છે તેના પ્રતયેક અસરગ્રસ્ત ક ટ ંબને, ઉક્તચત સરકાર વતી, સૂચના દ્વારા ક્તનક્તદવષ્ટ કરેલ રકમ ને આધીન ઓછામાં ઓછા પચીસ હજાર રૂક્તપયા જેટલી
રકમની, એક વખતની નાણાકીય સહાય મળશે.

9. માછીમારીના અતિકારો
ક્તસંચાઈ અથવા હાઈર્લ પ્રોજેક્ટના ક્તકસ્સામાં, અસરગ્રસ્ત પક્તરવારોને યોગ્ય સરકાર દ્વારા ક્તનધાવક્તરત કરવામાં આવે તે રીતે, જળાશયોમાં માછીમારીના અક્તધકારોની મંજૂરી આપવામાં
આવી શકે છે.
ર્ભલામણ-
લાગ પર્ત ં નથી કારણ કે તે ક્તસંચાઈ અથવા હાઈર્લ પ્રોજેક્ટ નથી.
10. ર્ન-ટાઇમ તરસેટલમેન્ટ એલાઉન્સ (પુનઃસ્થાપન ર્ભથથું)
દરેક અસરગ્રસ્ત પક્તરવારને માત્ર પચાસ હજાર રૂક્તપયાન ં એક વખતન ં "પ નઃસ્થાપન ભથથ ં" આપવામાં આવશે.
ર્ભલામણ:
દરેક અસરગ્રસ્ત પક્તરવારને એક વખતન ં પુનઃસ્થાપન ર્ભથથું પેટે ₹.50,000/-આપવામાં આવશે જે 08 અસરગ્રસ્િ પતરર્ારો માટે ₹.4,00,000/- જેટલી રકમ થાય છે.

(1) અસરગ્રસ્ત પક્તરવારોને ફાળવવામાં આવેલી જમીન અથવા મકાનની નોંધણી માટે ચૂકવવાપાત્ર સ્ટેમ્પ ડ્ય ટી અને અદય ફી નો ખચવ, જરૂરી સંસ્થા દ્વારા ભોગવવામાં કરવામાં
આવશે.
(2) અસરગ્રસ્ત પક્તરવારો માટે મકાન માટે ફાળવવામાં આવેલી જમીન તમામ બોજા થી મ િ રહેશે.
(3) ફાળવેલ જમીન અથવા મકાન અસરગ્રસ્ત પક્તરવારોના પક્તત અને પત્નીના સંય િ નામે હોઈ શકે છે.
