NOTICE

WHEREAS, vide Preliminary Notification No. 65-03-LAQ-2022-23/690 dated 30/08/2024, it

was notified under Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013, that the land described in the schedule hereto (thereafter

referred to as the said land) were needed or likely to be needed for the public purpose, namely Land

Acquisition from Diu Circle to Be-Otli Strengthening and Widening of NH-251 from Km 11.000 to

Km 22.770 at District Diu;

AND WHEREAS, a report was submitted to the appropriate Government i.e. Hon’ble

Administrator of Dadra & Nagar Haveli and Daman & Diu to proceed with the acquisition process and

the same has been approved;

AND WHEREAS, vide Declaration No. 65-03-LAQ-2022-23/189 dated 23/04/2025, it was

declared under the provision of Section 19 of the Right to Fair Compensation, Transparency in Land

Acquisition, Rehabilitation and Resettlement Act, 2013 that the said land is required for the public

purpose, namely Land Acquisition from Diu Circle to Be-Otli Strengthening and Widening of NH-251

from Km 11.000 to Km 22.770 at District Diu;

AND WHEREAS, in connection with acquisition of land admeasuring 3031.00 sq. mtrs. for

Land Acquisition from Diu Circle to Be-Otli Strengthening and Widening of NH-251 from Km 11.000

to Km 22.770 at District Diu, the Administration of Dadra & Nagar Haveli and Daman & Diu intends

to take possession of the land, the particulars of which is given in the declaration u/s 19(1) No. 65-01-

LAQ-2022-23/189 dated 23/04/2025 of the Right to Fair Compensation & Transparency in Land

Acquisition Rehabilitation and Resettlement (RFCTLARR) Act, 2013;

AND WHEREAS, under Section 21 of the RFCTLARR Act 2013, the Government intends to

take possession of the land on 26/05/2025 at 16.00 hrs., and all claims to compensations and

Rehabilitation and Resettlement for all interests in the said land, has to be submitted to the Collector

for disposal on or before 23/05/2025 at 18.00 hrs;

AND WHEREAS, the details of compensation on the land acquisition as per the Annexure –

I, II, III are enclosed herewith;

AND WHEREAS, under sub section (1) & (2) of Section 22 of the said Act, the Collector may

also require any such person to make or deliver to him/her a statement containing the name of every

other person possessing any interest in the land or any part thereof as co-proprietor, sub-proprietor,

mortgage, tenant or otherwise, and of the nature of such interest, and of the rents and profits, if any

received or receivable on account thereof for three years next preceding the date of statement;

NOW THEREFORE, to facilitate causation of the above requirements, public notice is hereby

served under section 21 of the RFCTLARR Act, 2013 that all persons having interest in the said land

to appear personally or by agent or advocate before the Collector, Diu on 26/05/2025 at 13.00 hrs., and

to state in writing and signed by the party or his agent, the following:

a) The nature of their respective interest in their land;

b) The amount and particulars of their claims to compensation for such interests;

c) Their objection if any to the measurements made and marked on the referred area.

Please take notice that as provided under sub section 22 of the aforesaid Act, every person

required to make or deliver a statement under this section shall be deemed to be legally bound to do so

within the meaning of section 175 and 178 of the Indian Penal Code (45 of 1860).

1. Provision of housing units in case of displacement

(1) If a house is lost in rural areas, a constructed house shall be provided as per the Indira Awas Yojana specifications. If a house is lost in urban areas,

a constructed house shall be provided, which will be not less than 50 sq. mts. in plinth area.

(2) The benefits listed above shall be extended to any affected family which is without homestead land and which has been residing in the area and which

has been involuntarily displaced from such area:

Provided that any such family in urban areas which opts not to take the house offered, shall get a one-time assistance for house construction, which shall

not be less than one lakh fifty thousand rupees:

Provided further that if any affected family in rural areas so prefers, the entitlement cost of the house may be offered in lieu of the constructed house:

Provided also that no family affected by acquisition shall be given more than one house under the provisions of this Act.

Recommendation:

As the land to be acquired is in a Rural area, each displaced families shall be granted entitlement cost of the house of ₹.1,50,000/- in lieu of the constructed

house.

Therefore, 08 displaced families shall be granted ₹.12,00,000/- or they may apply for a house under Pradhan Mantri Awas Yojana.

2. Land for land

In case of Irrigation project, as far as possible and in lieu of compensation to be paid for land acquired, each affected family owning agriculture land in

the affected area and whose land has been acquired or lost, or who has, as a consequence of the acquisition or loss of land, been reduced to the status of

a marginal farmer or landless, shall be allotted, in the name of each person included in the records or rights with regard to the affected family, a minimum

of one acre of land in the command area of the project for which the land is acquired:

Provided that in every project those person losing land and belonging to the Scheduled Castes or Scheduled Tribes will be provided land equivalent to

land acquired or two and a half-acres, whichever is lower.

Recommendation-

Not Applicable as it is not an irrigation project.

3. Offer for developed land

In case the land is acquired for urbanization purposes, twenty five percent of the developed land will be reserved and offered to land owing project

affected families, in proportion to the area of their land acquired and at a price equal to the cost of acquisition and the cost of development.

Provided that in case the land owing project affected family wishes to avail this offer, an equivalent amount will be deducted from the land acquisition

compensation package payable to it.

Recommendation-

Not Applicable as land is not being acquired for urbanization purpose.

4. Choice of annuity or Employment

The appropriate government shall ensure that the affected families are provided with following option: -

(a) Job may be given to at least one member per affected family in the project or arrange for a job in such other project as may be required and

providing suitable training and skill development in the required field or make provision for employment at a rate not lower than the minimum

wages provided for in any other law for the time being enforced. or

(b) One time grant of ₹.5 lakh rupees per affected family. Or

(c) The affected family will be provided with an annuity payment of Rupees 2000 per month per family for twenty years (this will be adjusted for

inflation annually).

Recommendation:

One time grant of ₹.5 lakh shall be granted to each affected family amounting to ₹.1,40,00,000/- for 28 affected families.

5. Subsistence grant for displaced families for a period of one year

Each affected family which is displaced from the land acquired shall be given a monthly subsistence allowance equivalent to three thousand rupees per

month for a period of one year from the date of award.

In addition to this amount, the Scheduled Castes and the Scheduled Tribes displaced from Scheduled Areas shall receive an amount to fifty thousand

rupees.

In cases of displacement from the Scheduled Areas, as far as possible, the affected families shall be relocated in a similar ecological zone, so as to preserve

the economic opportunities, language, culture and community life of the tribal communities.

Recommendation:

The District is not a Scheduled area. Therefore, each affected family shall be granted a subsistence allowance of ₹.36,000/- (Rs. 3,000 per month) for

a period of one year from the date of award, amounting to ₹.2,88,000/- for 08 affected families and 04 Scheduled Tribes and 01 Scheduled Castes

are not residing in the Scheduled area thus the additional amount is NIL.

6. Transportation cost for displaced families

Each affected family which is displaced shall get one-time financial assistance of fifty thousand rupees as transportation cost for shifting of the family,

building materials, belongings and cattle.

Recommendation-

Each affected family shall be granted one-time financial assistance of ₹.50,000/- as transportation cost for shifting of the family, building materials, and

belongings amounting to ₹.4,00,000/- for 08 affected families.

7. Cattle shed/ petty shops cost

Each affected family having cattle or having a petty shop shall get one-time financial assistance of such amount as the appropriate Government may, by

notification, specify subject to a minimum of twenty-five thousand rupees for construction of cattle shed or petty shop as the case may be.

8. One-time grant to artisan, small traders and certain others

Each affected family of an artisan, small trader or self-employed person or an affected family which owned non-agricultural land or commercial, industrial

or institutional structure in the affected area due to land acquisition, shall get one-time financial assistance of such amount as the appropriate Government

may, by notification specify subject to a minimum of twenty-five thousand rupees.

9. Fishing Rights

In cases of Irrigation or hydel projects, the affected families may be allowed fishing rights in the reservoirs, in such manner as may be prescribed by the

appropriate government.

Recommendation-

Whereas, it appears to the appropriate Government that a total of 73678 Sq. Mtrs. (standard

measurement) the land is required in the Diu City, Diu District for a public purpose, namely, the

Acquisition Land for the project of Extension of Airport at Diu of Diu District. The details of the

land/lands for the above said project in the Diu City of Diu District is enclosed herewith as Annexure-

I. The Social Impact Assessment (SIA) was carried out by the Gujarat Environment Management

Institute (GEMI) (An Autonomous Institute of Government of Gujarat), GEMI BHAVAN, Plot Number

B-246 & 247, Electronic Estate, GIDC, Sector-25, Gandhinagar, an Agency appointed by the Additional

District Magistrate, Diu vide Order No.65-01-LAQ-2022-23/4925 dated 19/12/2022 and a report

submitted/ preliminary investigation was conducted by a team constituted by Collector as laid down

under rule 4. The summary of the Social Impact Assessment Report/ preliminary investigation is as

follows (copy attached):

The land proposed for the project of acquisition of land for the project of Extension of Airport

at Diu of Diu District is required for regional connectivity, boosts economic growth, and improves

operational efficiency by accommodating large aircraft. It fosters job creation, tourism, and investment,

driving overall regional development. The project aligns with national infrastructure goals and

international standards, ensuring long-term benefits for public welfare and economic progress.

It will also facilitate development of the region as the major tourist spotin West Coast of India

specially to attract tourists from India as well as Foreigners as Diu has beautiful Beaches, Forts and

Churches made with Portuguese art and culture and which will boost Tourism Sector and due tothis

more livelihood options may be created and this will become morebeneficial to manage traffic and boost

economy and income sources of the U.T.

The Dy. Collector, Diu is appointed as Administrator for the purpose of Rehabilitation and

Resettlement of the affected families vide Notification dated 04/05/2015 u/s 43 of the Act. Therefore, it

is notified that for the above-said project in Diu District, a piece of land measuring 73678 Sq. Mtrs. of

standard measurement, whose detail description is as following is under acquisition:

This Notification is made under provisions of Section-11(1) of the Right to Fair Compensation

and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 Of 2013), to all

whom it may concern.

A plan of the land may be inspected in the Office of the Collector, Fort Road, Diu, and the

Deputy Secretary, Civil Aviation, DNH & DD, Daman (Requiring Body) during the working day

and working hours.

The Government is pleased to authorize Mamlatdar, Diu and his Talathi to enter upon and

survey land, take levels of any land, dig or bore into the sub-soil, and do all other acts required for the

proper execution of their work as provided and specified in Section-12 of the said Act.

Under Section - 11 (4) of the Act, no person shall make any transaction or cause any transaction

of land i.e. Sale/purchase, etc. or create any encumbrances on such land from the date of publication of

such notification without prior approval of the Collector.

Objections to the acquisition, if any, may be filed by the person interested within 60 (Sixty

Days) from the date of publication of this notification as provided under Section 15 of the Act before

NOTICE

(Under Section 21 of RFCTLARR Act, 2013)

WHEREAS, vide Preliminary Notification No. LAQ/SMC/Panchayat Market/Road/ SSCL

/2022/991 dated 16.08.2024, it was Notified under section 11 of the Right to Fair compensation and

Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, that the land described

in the schedule hereto (thereafter referred to as the said land/lands) were needed or likely to be needed

for the public purpose, namely for the purpose for Development of Road Under Silvassa Smart City

Limited for Providing Access to New Panchayat Market.

AND WHEREAS, a report was submitted to the Appropriate Government i.e. Hon’ble

Administrator, Dadra & Nagar Haveli and Daman & Diu to proceed with acquisition process and the

same has been approved by the Appropriate Government i.e. Administrator of Daman& Diu and Dadra

& Nagar Haveli;

AND WHEREAS, vide Declaration No. LAQ/SMC/Panchayat Market/Road/SSCL/

2022/166 dated 02/04/2025 it was declared under the provision of Section 19 of the Land Acquisition

and Rehabilitation Act that the said lands are required for the public purpose, and namely purpose for

Development of Road Under Silvassa Smart City Limited for Providing Access to New Panchayat

Market;

AND WHEREAS, in connection with acquisition of Government and Private land

admeasuring 2462.25 Sq. Mtrs. (standard measurement) for Development of Road Under Silvassa

Smart City Limited for Providing Access to New Panchayat Market, the Administration of Dadra

and Nagar Haveli intends to take possession of land, the particulars of which are given in the declaration

u/s 19(1) of the Right to Fair compensation & Transparency in land Acquisition Rehabilitation and

Resettlement (RFCTLARR) Act, 2013;

AND WHEREAS, under section 21 of the RFCTLARR Act, 2013, the Government intends to

take possession of the land within 30 days from the date of issue of this Notice, and claims to

compensations and rehabilitation and resettlement for all interests in the land, has to be submitted to the

Collector for disposal within 30 days from the date of issue of this Notice;

AND WHEREAS, the details of compensation on the land acquisition as per the Annexure-

I, II and III is enclosed herewith.

AND WHEREAS, under sub section (1) & (2) of Section 22 of the said Act, the Collector may

also require any such person to make or deliver to him/her a statement containing the name of every

other person possessing any interest in the land or any part thereof as co-proprietor, mortgage, tenant

or otherwise, and of the nature of such interest, and of the rents and profits, if any received or receivable

on account thereof for three years next preceding the date of statement, every person required to make

or deliver a statement under this section shall be deemed to be legally bound to do so within the meaning

of section 175 and176 of the Indian Penal Code (45 of 1860);

NOW THEREFORE, to facilitate causation of the above requirements, public notice is hereby

served under section 21 of the RFCTLARR Act, 2013 that all persons having interest in the said land

to appear personally or by agent or advocate before the Collector, Dadra and Nagar Haveli on

30/05/2025 and to state in writing and signed by the party of his agent, the following:

a) The nature of their respective interest in their land;

b) The amount and particulars of their claims to compensation for such interest;

c) Their objection if any to the measurements made and marked on the referred area.

Please take notice that as provided under sub section 22 of the aforesaid Act, every person

required to make or deliver a statement under this section shall be deemed to be legally bound to do so

within the meaning of section 175 and 178 of the Indian Penal Code (45 of 1860).
