Final Report of the Administrator for Rehabilitation and Resettlement

Scheme u/s 16 of the Right to Fair Compensation and Transparency in Land

Acquisition of Private Land for the project of Extension of Airport at Diu.

Preface:-

Vide Preliminary Notification No. 65-03-LAQ-2024-25/249 dated 30/04/2025 (Copy attached

as Annexure-A), land admeasuring total of 73678.00 Sq. mts. in Diu District was notified u/s 11(1) of

the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement

Act, 2013, project for namely “Land Acquisition of Private Land for the project of Extension of Airport

at Diu of District Diu”, for public purpose as defined in Section 2(1) (vi) of the RFCTLARR Act, 2013.

Vide Notification No. 5/2/COL/Land/RFCTLARR/2015-16/2296 dated 04/08/2015, the

undersigned has been appointed as the Administrator under sub section (1) of Section 43 of the said act

for Rehabilitation and Resettlement of affected families due to acquisition of the said land parcels.

As per section 16 of RFCTLARR Act 2013, Preparation of Rehabilitation and Resettlement

Scheme by the Administrator should be done.

Methodology:-

As per Chapter VI, procedure and manner of Rehabilitation and Resettlement Section 43 of

RFCTLARR Act, 2013, the undersigned has been appointed as the Administrator to prepare the

Rehabilitation and Resettlement scheme.

Therefore, vide order No. 65-03-LAQ-2024-25/416 dated 29/05/2025, a committee was

constituted to obtain a report on Section 16 of the RFCTLARR Act 2013 and Rule 7 of RFCTLARR

(Compensation, Rehabilitation and Resettlement and Development Plan) Rules 2015, to conduct a field

survey of proposed land. On 02/09/2025, with concerned Talathi of the area, Planning Assistant, Diu,

BDO, Diu and Mamlatdar, Diu had visited the sites. The report dated 23/09/2025 have been received

from Mamlatdar, Diu.

Details of Public Hearing & the Discussion

At the outset, the undersigned welcomed all present affected families.

The undersigned discussed the draft Rehabilitation and Resettlement Scheme with the affected

families in the public hearing, and public objections were taken one by one, and points were discussed

as below:

1. The Draft Rehabilitation and Resettlement Scheme was prepared based on a field survey as per

Section 16 and Rule 9 of the RFCTLARR Act, 2013, and Rule 2015 conducted by the

committee on 23/09/2025.

2. The Draft Report of Rehabilitation and Resettlement was published in the prescribed manner

as per the RFCTLARR Act, 2013.

3. The Rehabilitation and Resettlement benefit is provided as mentioned in the Second Schedule

of the RFCTLARR Act, 2013 (enclosed herewith)

4. The Rehabilitation and Resettlement entitlements will be given to the affected family after the

Collector published the award under section 31 of the RFCTLARR Act, 2013.

greenfield

project

for

which

the

necessary

approvals/ clearances are

not in place. The proposal

is

for

a

brownfield

extension of the airstrip,

hence,

the

sideward

parallel transfer Option is

not feasible. Also, the

cost will be increased in

greenfield

concrete

laying, and huge forest

area will be lost.

6. The undersigned ended the public hearing with vote of thanks to the affected parties.

Other Measure:-

Based on the survey conducted by the Rehabilitation and Resettlement Committee and report

vide No.4-1-LND-III-11/2025-26/922 dated 23/09/2025 received from Mamlatdar, Diu, the

Rehabilitation and Resettlement Scheme is worked out, which is detailed below: -

Rehabilitation and Resettlement Plan

As per Chapter VI, procedure and manner of Rehabilitation and Resettlement Section 43 of

RFCTLARR Act, 2013, the Rehabilitation and Resettlement scheme (RR Scheme) is drafted in

consonance with section 16 and Second Schedule of the RFCTLARR Act, 2013, and Rule 7 of

RFCTLARR (Compensation, Rehabilitation and Resettlement and Development Plan) Rules, 2015.

Findings:-

As per section 3(k) of the RFCTLARR Act 2013, “Displaced Family” means any family who

on account of the acquisition of land has to be relocated and resettled from the affected area to the

resettlement area. In the present case, the land being acquired is agricultural and Residential, for which

compensation shall be paid as and when the Collector, Diu, announces the Award. A list of family

losing their complete residential due to proposed land acquisition is given at para 5(b) above.

Rehabilitation and Resettlement entitlements

1. Provision of housing units in case of displacement

(1) If a house is lost in rural areas, a constructed house shall be provided as per the Indira

Awas Yojana specifications. If a house is lost in urban areas, a constructed house shall

be provided, which will be not less than 50 sq. mts. in plinth area.

(2) The benefits listed above shall be extended to any affected family which is without

homestead land and which has been residing in the area and which has been involuntarily

displaced from such area:

Provided that any such family in urban areas which opts not to take the house offered, shall

get one-time assistance for house construction, which shall not be less than one lakh fifty

thousand rupees:

Provided further that if any affected family in rural areas so prefers, the equivalent cost of

the house may be offered in lieu of the constructed house:

Provided also that no family affected by acquisition shall be given more than one house

under the provisions of this Act.

Recommendation-

The land to be acquired is in rural area, so the equivalent cost of the house may be offered in

lieu of the constructed house or a house under Pradhan Mantri Awas Yojana/Indira Awas Yojana

i. e. Suryodaya Awas Yojana shall be provided.

2. Land for land

In case of Irrigation project, as far as possible and in lieu of compensation to be paid for land

acquired, each affected family owning agriculture land in the affected area and whose land has

been acquired or lost, or who has, as a consequence of the acquisition or loss of land, been

reduced to the status of a marginal farmer or landless, shall be allotted, in the name of each

person included in the records or rights with regard to the affected family, a minimum of one

acre of land in the command area of the project for which the land is acquired:

Provided that in every project those people losing land and belonging to the Scheduled Castes

or Scheduled Tribes will be provided land equivalent to land acquired or two and a half-acre,

whichever is lower.

Recommendation-

Not Applicable, as it is not an irrigation project.

3. Offer for developed land

In case the land is acquired for urbanization purposes, twenty five percent of the developed land

will be reserved and offered to land owing project affected families, in proportion to the area of

their land acquired and at a price equal to the cost of acquisition and the cost of development.

Provided that in case the land owing project affected family wishes to avail this offer, an

equivalent amount will be deducted from the land acquisition compensation package payable to

it.

Not Applicable, as land is not being acquired for urbanization purpose.

4. Choice of annuity or Employment

The appropriate government shall ensure that the affected families are provided with following

option: -

(a) Job may be given to at least one member per affected family in the project or arrange

for a job in such other project as may be required and providing suitable training and

skill development in the required field or make provision for employment at a rate not

lower than the minimum wages provided for in any other law for the time being

enforced. Or

(b) One time grant of 5 lakh rupees per affected family. Or

(c) The affected family will be provided with an annuity payment of Rupees 2000 per month

per family for twenty years (this will be adjusted for inflation annually).

Recommendation-

One time grant of Rs. 5 lakhs shall be granted to each affected family amounting Rs.5,00,000/-

for 1 affected families, details mentioned in para 5(b)

5. Subsistence grant for displaced families for a period of one year.

Each affected family which is displaced from the land acquired shall be given a monthly

subsistence allowance equivalent to three thousand rupees per month for a period of one year

from the date of award.

In addition to this amount, the Scheduled Castes and the Scheduled Tribes displaced from

Scheduled Areas shall receive an amount to fifty thousand rupees.

In cases of displacement from the Scheduled Areas, as far as possible, the affected families shall

be relocated in a similar ecological zone, so as to preserve the economic opportunities, language,

culture and community life of the tribal communities.

Recommendation-

The territory is not a scheduled area. Therefore, five displaced families may be granted a

subsistence allowance of Rs. 36,000/- (Rs. 3,000/- per month) for a period of one year from the

date of award, amounting Rs. 36,000/- as mentioned in para 5(b).

6. Transportation cost for displaced families

Each affected family which is displaced shall get one-time financial assistance of fifty thousand

rupees as transportation cost for shifting of the family, building materials, belon gings and cattle.

Recommendation-

Five displaced families should be granted one-time financial assistance of Rs. 50,000/- as

transportation cost for shifting of the family building materials belongings amounting

Rs, 50,000/- as per para 5(b).

7. Cattle shed/ petty shops cost

Each affected family having cattle or having a petty shop shall get one-time financial assistance

of such amount as the appropriate Government may, by notification, specify subject to a

minimum of twenty-five thousand rupees for construction of cattle shed or petty shop as the case

may be.

Not Applicable, as non of the cattle shed/petty shop is getting affected.

8. One-time grant to artisan, small traders and certain others

Each affected family of an artisan, small trader or self-employed person or an affected family

which owned non-agricultural land or commercial, industrial or institutional structure in the

allected area due to land acquisition, shall get one-time financial assistance of such amount as

the appropriate Government may, by notification specify subject to a minimum of twenty-five

thousand rupees.

9. Fishing Rights

In cases of Irrigation or hydel projects, the affected families may be allowed fishing rights in

10. One-time Resettlement Allowance

11. Stamp duty and registration fee

(1) The stamp duty and other fees payable for registration of the land or house allotted to

the affected families shall be borne by the Requiring Body.

(2) The land for house allotted for the affected families shall be free from all encumbrances.

(3) The land or house allotted may be in the joint names of wife and husband of the affected

families.

Recommendation: -

If any, to be borne by the Requiring body i. e. Civil Aviation Department, DNH & DD, Daman.

ORDER

In exercise of powers under Section 26 of Goa, Daman & Diu Land Revenue Code, 1968 read

with Rule 34 of the Goa, Daman & Diu Land Revenue (Disposal of Govt. Lands) Rules, 1971, the

Hon'ble Administrator, U.T. of Dadra & Nagar Haveli and Daman & Diu is pleased to permit the

Collector, Diu to grant the lease period of Government Land bearing New City Survey PTS

No.44/1(Part), admeasuring area 5000 sq. mts. in favour of Omnibus Industrial Development

Corporation (OIDC) at near the Bus stand, Diu for the construction of the proposed OIDC Wholesale

liquor Warehouse at the rate of Rs. 1/-per annum as Lease Rent from 01/12/2025 to 30/11/2058 for

period of 33 years from the date of issue of this order subject to the following conditions :-

1.

All Acts and rules particularly Revenue related are applicable to the licensee with all future

changes, modifications and amendments related to land.

2.

The department shall make sure that there are no revenue leakages and timely deposit to

consolidated fund of India and also make sure that imposition of fine/levies of penalty in case of

default/delay as applicable.

3.

The Lease extension is for OIDC as the Lessee only and further Extension of sub lease shall be on

merit and only for industrially utilized plots by the Lessee/OIDC.

4.

Strict compliance, of all applicable GFRs, other Rules and terms and conditions as finalized, by

the department from time to time.

Whereas, it appears to the appropriate Government that a total of 165 Sq. Mtrs. (standard

measurement) the land is required in the Diu City, Diu District for a public purpose, namely, the

Acquisition Land for Tent City at Swarn Jayanti Lake, Gandhipara, Diu of Diu District. The

details of the land/lands for the above said project in the Diu City of Diu District is enclosed herewith

as Annexure – I. Social Impact Assessment Study was carried out by Social Impact Assessment

(SIA) Unit and a report submitted/ preliminary investigation was conducted by a team constituted by

Collector as laid down under rule 4. The summary of the Social Impact Assessment Report/ preliminary

investigation is as follows (copy attached):

A total of 01 family is likely to be displaced due to the land acquisition. The reason

necessitating such displacement is given.

The Dy. Collector, Diu, is appointed as Administrator for the purpose of Rehabilitation and

Resettlement of the affected families vide Notification dated 04/05/2015 u/s 43 of the Act. Therefore,

it is notified that for the above-said project in Diu of Diu District, a piece of land measuring 165 Sq.

Mtrs. of standard measurement, whose detailed description is as follows, is under acquisition:

This Notification is made under the provisions of Section 11 (1) of the Right to Fair

Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30

Of 2013), to all whom it may concern.

A plan of the land may be inspected in the Office of the Collector, Fort Road, Diu, and the

Additional Director, Tourism Department, Diu (Requiring Body) during the working day and

working hours.

The Government is pleased to authorize Mamlatdar, Diu, and his Talathi to enter upon and

survey land, take levels of any land, dig or bore into the sub-soil, and do all other acts required for the

proper execution of their work as provided and specified in Section 12 of the said Act.

Under Section 11 (4) of the Act, no person shall make any transaction or cause any transaction

of land, i.e. Sale/purchase, etc., or create any encumbrances on such land from the date of publication

of such notification without prior approval of the Collector.

Objections to the acquisition, if any, may be filed by the person interested within 60 (Sixty

Days) from the date of publication of this notification as provided under Section 15 of the Act before

the Collector.

NOTICE

(Under Section 21 of RFCTLARR Act, 2013)

WHEREAS, vide Preliminary Notification No.LAQ/Naroli-AnklasBorder/101/2021/524

dated 19.12.2024, it was Notified under section 11 of the Right to Fair compensation and Transparency

in Land Acquisition, Rehabilitation and Resettlement Act, 2013, that the land described in the schedule

hereto (thereafter referred to as the said land/lands) were needed or likely to be needed for the public

purpose, namely for Road widening from Naroli Junction to Kanadi Junction to Anklas Border

for public purpose.

AND WHEREAS, a report was submitted to the Appropriate Government i.e. Hon’ble

Administrator, Dadra & Nagar Haveli and Daman & Diu to proceed with acquisition process and the

same has been approved by the Appropriate Government i.e. Administrator of Dadra & Nagar Haveli

and Daman & Diu;

AND WHEREAS, vide Declaration No.LAQ/ Naroli-AnklasBorder/ 101/2021/074 dated

24.11.2025 it was declared under the provision of Section 19 of the Land Acquisition and Rehabilitation

Act that the said lands are required for the public purpose, and namely for Road widening from Naroli

Junction to Kanadi Junction to Anklas Border for public purpose;

AND WHEREAS, in connection with acquisition of land admeasuring 8070.50 Sq. Mtrs. for

Road widening from Naroli Junction to Kanadi Junction to Anklas Border for public purpose,

the particulars of which are given in the declaration u/s 19(1) of the Right to Fair compensation &

Transparency in land Acquisition Rehabilitation and Resettlement (RFCTLARR) Act, 2013;

AND WHEREAS, under section 21 of the RFCTLARR Act, 2013, the Government intends to

take possession of the land and claims for compensations and rehabilitation and resettlement for all

interests in the land, has to be submitted to the Collector for disposal within 30 days from the date of

issue of this Notice;

The details of compensation on the land acquisition as per the Annexure- I, II and III are

enclosed herewith.

AND WHEREAS, under sub section (1) & (2) of Section 22 of the said Act, the Collector may

also require any such person to make or deliver to him/her a statement containing the name of every

other person possessing any interest in the land or any part thereof as co-proprietor, mortgage, tenant

or otherwise, and of the nature of such interest, and of the rents and profits, if any received or receivable

on account thereof for three years next preceding the date of statement, every person required to make

or deliver a statement under this section shall be deemed to be legally bound to do so within the meaning

of section 175 and176 of the Indian Penal Code (45 of 1860);

NOW THEREFORE, to facilitate causation of the above requirements, public notice is hereby

served under section 21 of the RFCTLARR Act, 2013 that all persons having interest in the said land

to appear personally or by agent or advocate before the Collector, Dadra and Nagar Haveli on

16/01/2026 and to state in writing and signed by the party of his agent, the following:

a) The nature of their respective interest in their land;

b) The amount and particulars of their claims to compensation for such interest;

c) Their objection, if any, to the measurements made and marked on the referred area.

Please take notice that as provided under sub section 22 of the aforesaid Act, every person

required to make or deliver a statement under this section shall be deemed to be legally bound to do so

within the meaning of section 175 and 178 of the Indian Penal Code (45 of 1860).
