(Below Exh. 1)
(Delivered on 06/12/2025)
This is a reference received from the Commissioner (Labour) under section 10 (1) (c) of The
Industrial Disputes Act, 1947. It has been mentioned in the reference that an industrial dispute exists
between M/s Dev Enterprise and its workman Shri Vakil Kumar & Ors. The management of the
company and the workmen were called for conciliation. The workmen appeared for conciliation, but
the management was absent. Therefore, no conciliation could be reached out during the conciliation
proceeding. Hence the Conciliation Officer has made this reference to the Labour Court to decide the
issue “Whether the demand of the applicants for wages/ salary is justified? If yes, what relief the
workman is entitled to?”
2)
After receiving this reference, notices were issued to the workmen (second party) and the
company (first party). Summons could not be served to the first party company and the second party
No. 3 to 5 as they left the given address. The second party No. 1 appeared and filed a pursis vide Exh.
4 that they do not wish to proceed further with the matter. Report at Exh. 3 shows that the first party
has left address. Therefore, there is no evidence from both the sides to decide this reference. Hence, I
answer the reference in the negative and accordingly I pass the following order:
ORDER
(1) The reference is answered in the negative.
(2) A copy of the order be forwarded to the Commissioner (Labour) for information and necessary
action.
