NOTIFICATION
No. ATP/DMN/AMEN.TCP ACT 1974/259/2026/328 Dated: - 17.06.2026
WHEREAS, in exercise of the powers conferred by Article 240 of the Constitution of India,
the President hereby makes the following Regulation to amend the Dadra and Nagar Haveli and Daman
and Diu Town and Country Planning Act, 1974.
AND WHEREAS, following thorough deliberations and detailed analysis of the sections of
the regulation, and with the invaluable assistance of a legal team, a suggestive amendment to section
42 of the regulation was prepared.
NOW THEREFORE, a copy of draft regulation “Dadra and Nagar Haveli and Daman and
Diu Town and Country Planning (Amendment) Regulation, 2026 is published herewith for inviting
comments from all stakeholders/. If there is any comment/ view/ suggestion, the same may be forwarded
to the Office of the Joint Secretary (UD), Urban Development, Secretariat, Vidyut Bhawan, Kachigam,
Nani Daman within 30 days of issue of this notification.

TOWN AND COUNTRY PLANNING (AMENDMENT)
REGULATION, 2026.
Promulgated by the President in the Seventy-Sixth Year of
the Republic of India.

Regulation
Regulation to amend the Dadra and Nagar Haveli and
Daman and Diu Town and Country Planning Act, 1974.
In exercise of the powers conferred by Article 240 of the
Constitution, the President is pleased to promulgate the
following Regulation made by him:-
1. (1) This Regulation may be called the Dadra and Nagar
Haveli and Daman and Diu Town and Country Planning
(Amendment) Regulation, 2026.
(2) It shall come into force on such date as the Central
Government may, by notification in the Official Gazette,
appoint.
Short title, extent,
and
commencement
42. Land use to conform to Development Plan:
“On and from the date on which a public notice of the
preparation of a Development Plan is published under sub-
section (1) of section 35 till the Development Plan is notified
under section 37, the existing Development Plan in force
immediately prior to such draft publication shall continue to
remain in operation and shall be deemed to be in force for the
above said period for all purposes under this act.
Provided that the Planning and Development Authority
may allow the continuance, for a period not exceeding ten
years of the use, upon such terms and conditions as may be
prescribed by regulations made in this behalf, of any land to
the extent to which it was used on the date on which such
public notice is published.
