(िजसे इस आदेश म इसके प ात् उ# अिधिनयम कहा गया है) क( धारा 52 क( उपधारा (4) म यह उपबंिधत है क ,-येक ,चालक, जो
उपधारा (1) म िविन/द01 रकम का सं2हण करता है, उसके 4ारा क( जाने वाली माल या सेवा6 या दोन8 क( जावक पू:त0य8, िजसके
अंतग0त उसके 4ारा वापस क( गई माल या सेवा6 या दोन8 क( पू:त0यां भी ह=, के >यौरे और मास के दौरान उपधारा (1) के अधीन
संगृहीत रकम के >यौर8 को अंत:व01 करते Aए ऐसे ,Dप और ऐसी रीित म , जो िविहत क( जाए, ऐसे मास के अंत के प ात् दस दन के
भीतर इलैEFािनक Dप से एक िववरण ,Gतुत करेगा ;
और कितपय ,चालक, जो सामाIय पोट0ल पर उनके 4ारा तकनीक( कKठनाईय8 का सामना करने के कारण रिजGFीकरण
अिभ,ाM करने म असमथ0 रहे थे Oकंतु उIह8ने अ#ूबर, नवंबर और दसंबर, 2018 मास के िलए रकम का सं2हण कया था, िजसके
पKरणामGवDप उ# अिधिनयम क( धारा 52 क( उपधारा (4) के अधीन वे िववरण ,Gतुत नहP कर सके और िजसके कारण उ# उपधारा
के उपबंध8 को ,भावी करने म कितपय कKठनाईयां उQभूत Aई ह=;

अत: अब, राRीय राजधानी SेT दली के उपराUयपाल, दली माल और सेवा कर अिधिनयम, 2017 क( धारा 172 4ारा
,दV शि#य8 का ,योग करते Aए, पKरषद् क( िसफाKरश8 पर कKठनाईय8 को दूर करने के िलए िनZिलिखत आदेश करती है, अथा0त् :—
1. संिSM नाम—इस आदेश का संिSM नाम दली माल और सेवा कर (ि4तीय कKठनाईय8 को दूर करना) आदेश,
2019 है ।
2. दली माल और सेवा कर अिधिनयम, 2017 क( धारा 52 क( उप-धारा (4) के Gप1ीकरण म , “31 जनवरी, 2019”
अंक8 और श>द8 के Gथान पर “07 फरवरी, 2019” और श>द रखे जाएंगे ।
2. यह आदेश फ़रवरी 01, 2019 से लागू माना जाएगा।

THE DELHI GOODS AND SERVICES TAX (REMOVAL OF DIFFICULTIES)
Delhi, the 3rd September, 2019
No. 02/2019-State Tax
F. No. 3 (41)/Fin (Rev-I)/2019-20/ DS-VI/405.—WHEREAS, sub-section (4) of section 52 of the Delhi
Goods and Services Tax Act, 2017 (03 of 2017) (hereafter in this Order referred to as the said Act) provides that every
operator who collects the amount specified in sub-section (1) shall furnish a statement, electronically, containing the
details of outward supplies of goods or services or both effected through it, including the supplies of goods or services
or both returned through it, and the amount collected under sub-section (1) during a month, in such form and manner as
may be prescribed, within ten days after the end of such month;
AND WHEREAS, certain operators, were unable to obtain registration because of technical issues being faced
by them on the common portal but they collected the amount for the months of October, November and December
2018, as a result whereof, the statement under subsection (4) of section 52 of the said Act could not be furnished and
because of that certain difficulties have arisen in giving effect to the provisions of the said sub-section;
NOW, THEREFORE, in exercise of the powers conferred by section 172 of the Delhi Goods and Services Tax
Act, 2017, the Lt. Governor of National Capital Territory of Delhi, on recommendations of the Council, hereby makes
the following Order, to remove the difficulties, namely: ––
1.
Short title. ––This Order may be called the Delhi Goods and Services Tax (Second Removal of
Difficulties) Order, 2019.
2.
In section 52 of the Delhi Goods and Services Tax Act, 2017, in sub-section (4), in the Explanation,
for the figures, letters and word “31st January, 2019”, the figures, letters and word “07th February,
2019” shall be substituted.
2. This Order shall come into force with effect from the 01st day of February, 2019.
