राष्ट्रीय रािधानी क्षेत्र पररवहन जनगम, िो दक उपभोगी संस्ट्था के रूप में संिर्भात है, को सात वर्ा की अवजध के जलए पौधों के संपूणा जवकास
एवं रखरखाव हेतु जनम्नानुसार 6,94,26,000 /- रूपये (छ: करोड़ चौरानवे लाख छब्बीस हिार मात्र) की राजि अजिम रूप में िमा
करवानी होगी।

उपभोगी संस्ट्था द्वारा 327 वृक्षों का प्रत्यारोपण िो साइट पर खड़े है, यमुना ररवर फ्रंट, जनयर खिूरी चौक, पुस्ट्ता रोड, नई दिल्ली पर
उपलब्ि भूजम मे दकया िाएगा ।

उपरोि 1 (क) के अनुसार, िेिी प्रिाजतयों के 12180 पौधो का 100 % प्रजतपूरक वृक्षारोपण और उनका सात वर्ो तक रखरखाव
उत्तरी वन मण्डल द्वारा दकया िायेगाA इस वृक्षारोपण के सफलतापूवाक स्ट्थापना के बाि उत्तरी वन मण्डल द्वारा जनगरानी की
िाएगी A
3. 1218 वृक्षो को काटे/ प्रत्यारोपण दकए िाने के बिले मे 1:10 के अनुपात मे स्ट्विेिी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले 12180 पौधो
का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी होने के तीन महीने के अंिर जनधााररत की गई
भूजम पर अजतररि उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा और उनका रखरखाव
उत्तरी वन मण्डल द्वारा उपभोगी संस्ट्था द्वारा िमा की गई धनराजि से दकया िाएगा ।
4.
उपभोगी संस्ट्था द्वारा अजतररि साइट सुधार खचों को िमा दकया िाएगा िो दक वृक्ष अजधकारी ¼उत्तर½ द्वारा गणना के अनुसार
वृक्षारोपण के जलए उपयुि बनाने के जलए आवश्यक हो सकता है ।
5.
प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण काया की गजतजवजधयों को लागू दकया िाएगा ।
6.
उपभोगी संस्ट्था के द्वारा यह सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तात नहीं दकया िाएगा ।
7.
उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण साइट को अजतक्रमण और बायोरटक हस्ट्तक्षेप (यदि हो) से सुरजक्षत करना होगा ।
8.
उपभोगी संस्ट्था द्वारा िहां कहीं भी आवश्यक हो, मृिा तैयार करने के जलए व्यापक हस्ट्तक्षेप के आवश्यकता अनुसार अजतररि बिट
दिया िाएगा ।
9.
िो भूजम प्रजतपूरक वृक्षारोपण के जलया आवंरटत है, उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकार की स्ट्वीकृजत के जबना नहीं
दकया िाएगा ।
10. अनुमजत िारी होने के तुरंत बाि वृक्षो का प्रत्यारोपण िुरू दकया िाएगा और इसे तीन महीने के अंतराल में पूणा दकया िाएगा ।
प्रत्यारोपण प्रदक्रया के पूणा होने का बाि एक सम्पूणा ररपोटा संबजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की िायेगी । प्रत्यारोपण स्ट्थल मे
प्रत्यारोजपत वृक्षो की िूरी 4 मीटर (लबंिु से लबंिु) से कम नहीं होनी चाजहए ।
11. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया िाएगा ।
12. वृक्षो को प्रत्यारोपण/ काटने के जलए अनुमजत उनके स्ट्वयं के िोजखम पर और दकसी भी अन्य व्यजि के िावे के पक्षपात के जबना, िो वृक्षो
और भूजम पर सही हो सकती है, िी िा रही है ।
13. उपभोगी संस्ट्था द्वारा वृक्षो को प्रत्यारोपण/ काटने का काया सभी वैधाजनक मंिूररयों को लेने के बाि ही िुरू दकया िाएगा ।

14. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण की प्रगजत ररपोटा संबंजधत जनरीक्षण अजधकारी के माध्यम से वृक्ष अजधकारी को प्रस्ट्तुत की
िाएगी ।
15. उपभोगी संस्ट्था द्वारा वृक्षो को काटने के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे प्राप्त धनराजि को सरकार के खाते
मे रािस्ट्व के रूप में िमा की िाएगीA
16. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िाखाओं dks dkVs tkus ds i“pkr izkIr लकजड़यों को मुफ्त में जनकटतम lkoZtfud “konkgksa esa
iz;ksx gsrq सौपी िाएगी और इसकी सूचना वृक्ष अजधकारी (उत्तर) को भी िी िाएगी ।
17. उपभोगी संस्ट्था द्वारा वृक्षो को काटने के स्ट्थल से लकजड़यों को ys tkus ls iwoZ o`{k vf/kdkjh ¼उत्तर½ ls <qykbZ vuqefr izkIr djuh

18. उपभोगी संस्ट्था द्वारा 1218 वृक्षो के अलावा दकसी भी वृक्ष की प्रत्यारोपण/ कटाई दिल्ली वृक्ष laj{k.k अजधजनयम, 1994 के तहत एक
अपराध होगा ।
19. उपभोगी संस्ट्था द्वारा 891 वृक्षो को काटने से पूवा प्रत्यारोपण दकया िाएगा । वृक्षो की अनुमजत 327 वृक्षो के सफल प्रत्यारोपण और mi&
ou laj{kd (उत्तर) को अनुपालन प्रमाण पत्र प्रस्ट्तुत करने के बाि िी िायेगी ।
20. उपभोगी संस्ट्था द्वारा वृक्षो का प्रत्यारोपण/ कटाई और उसमें पैिा होने वाली काष्ठ को सावािजनक श्मिान मे 90 दिनों के भीतर पूरा दकया
िाएगा ।
21. उपभोगी संस्ट्था द्वारा जवस्ट्तृत वृक्षारोपण अनुसूची को दिल्ली वृक्ष laj{k.k अजधजनयम, 1994 की धारा 12 के अनुपालन में वृक्ष
अजधकारी ¼उत्तर½ को प्रस्ट्तुत दकया िाएगा ।
22. उपभोगी संस्ट्था द्वारा वृक्षो को प्रत्यारोपण/ काटने का काया िुरू करने से पहले साइट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत
योिना प्रस्ट्तुत करेगी ।
23. उपभोगी संस्ट्था के द्वारा यह सुजनजित दकया िायेगा दक वृक्षो की कटाई से पूवा कोई लंजबत मुकिमेबािी या स्ट्थगन आिेि दकसी भी
न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ हो ।
24. उपभोगी संस्ट्था के द्वारा पयाावरण मंिूरी में उजल्लजखत सभी ितों का पालन दकया िाएगा ।

Delhi, the 26th February, 2021
F.No. 14/NFD/TC/Felling/2019-20/11713-21.—In exercise of the powers conferred by section 29 of the
Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi,
hereby, in public interest exempts an area of 15.1743 ha. as detailed below for implementation of Regional Rapid
Transit System in Delhi-Ghaziabad-Meerut Corridor RRTS alignment, from the provision of sub-section (3) of section
9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-

1. Delhi National Capital Region Transport Corporation (NCRTC), herein referred to as User Agency, shall
make an advance deposit of an amount of Rs. 6,94,26,000 /- (Rupees Six Crore Ninety Four Lakh Twenty
Six Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a
period of Seven years as follows,

(b)
Transplantation of 327 no. of trees which are standing on site shall be done by User Agency in the same
land.
2. 100% Compensatory Plantation of 12180 saplings of native species shall be raised and maintained by North
Forest Division for Seven years and monitored till its successful establishment as indicated at 1 (a) above.
3. Plants saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of
1:10 on non-forest land in lieu of transplantation/ felling of 1218 no. of trees. The plantation shall be done by
following site specific plantation techniques with additional measures on identified land within three months
of issue of tree removal permission and maintenance shall be carried out thereafter, by North Forest Division
utilizing the deposits made by User Agency.
4. The User Agency shall also deposit extra site improvement expenses which may be required to make the site
suitable for plantation as calculated by Tree Officer concerned (as deposits).
5. Improved soil moisture conservation activities on compensatory plantation/ transplantation sites shall be
implemented.
6. The User Agency shall ensure that the plan of this proposal shall not be changed.
7. Compensatory Plantation/ Transplantation sites shall have to be secured from encroachment/ and undesired
biotic interference if any by User Agency
8. Extensive interventions if any required to be undertaken for soil preparation, shall be carried out and
additional budget if needed, shall be provided by User Agency
9. The land over which compensatory plantation raised shall not be utilized for other purpose without the
approval of State Government.
10. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not
later than three months, after which a completion report has to be submitted to the Tree Officer. The spacing
of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.
11. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User
Agency.
12. Permission for transplantation/ felling of all tress is being granted at their own risk and without prejudice to
the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
13. Before the transplantation/ felling of trees from the site is commenced all requisite statutory clearances shall
necessarily be obtained by the User Agency.

14. The progress report of transplantation shall be submitted through inspection officer concerned along with
complete details of trees.
15. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to
the Government account by the User Agency.
16. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same
should be reported to DCF (North) by User Agency.
17. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood
shall be obtained from the DCF (North) by User Agency.
18. Transplantation/ felling of any tree apart from 1218 trees by User Agency shall constitute an offence under
Delhi Preservation of Trees Act, 1994.
19. The transplantation shall be carried out prior to felling of 891 nos. of trees permitted herein. The 891 trees
shall be removed/ felled after successful transplantation of 327 trees and submission of compliance certificate
to Deputy Conservator of Forests (North).
20. Transplantation/ felling of trees and transportation of forest produce arising therefrom to the public
crematorium shall be completed within 90 days.
21. Detailed plantation schedule shall be submitted by User Agency in compliance with Section 12 of Delhi
Preservation of Trees Act, 1994 before initiating transplantation/ felling.
22. The User Agency shall submit a detailed plan for site preparation and plantation before initiating
transplantation/ felling.
23. The user agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other
authority before undertaking felling of trees.
24. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, and
other clearances, if any obtained, shall be followed scrupulously.
