एफ.3(600/टैररफ-जित्त./डीईआरसी/2019-20/6705/063.—जिद्युत अजधजनयम, 2003 की धारा 181 के साथ

परित धारा 61 और 86(1)(बी) के तहत प्रदत्त िजि का प्रयोग करते हुए तथा इसके ओर से अन्य सभी िजियों से सक्षम

होते हुए, ददल्ली जिद्युत जिजनयामक आयोग ने एतद्द्वारा ददल्ली जिद्युत जिजनयामक आयोग (व्यिसाय योिना) जिजनयम,

2019 (इसके बाद "प्रधान जिजनयमों" के रूप में संदर्भभत) को संिोजधत करने हेतु जनम्नजलजखत जिजनयम बनाए हैं:

1.0 संजक्षप्त नाम और प्रारंभन:

(1) इन जिजनयमों को ददल्ली जिद्युत जिजनयामक आयोग (व्यिसाय योिना) (प्रथम संिोधन) जिजनयम, 2021 कहा

िाएगा।

(2) ये जिजनयम अजधसूचना की जतजथ से प्रभािी होंगे।

2.0

जिजनयमों के जिजनयम 27 के उप-जिजनयम (1) में संिोधन:

27 (1) डीईआरसी (टैररफ जनधाारण हेतु जनयम एिं ितें) जिजनयम, 2017 के जिजनयम 124 के संदभा में, जितरण

लाइसेंसधारी के जित्तीय िर्ा 2020-21 से 2022-2023 तक के जलए निीकरणीय क्रय दाजयत्ि (एचपीओ) हेतु

लक्ष्यों (आरपीओ) की गणना अपने आपूर्भत क्षेत्र में अपने खुदरा उपभोिाओं को जबिली की कुल जबक्री के प्रजतित

के रूप में की िाएगी, जिसमें िल जिद्युत क्रय िाजमल नहीं है,लेदकन इसमेंिल जिद्युत क्रय दाजयत्ि (एचपीओ) की

पूर्भत के तहत योग्यिल जिद्युत को अलग नहीं दकया गया है। आरपीओ का लक्ष्य जिजभन्न निीकरणीय ऊिाा स्रोतों

अथिा निीकरणीय ऊिाा प्रमाणपत्रों ('आरईसी') या िल जिद्युत ऊिाा प्रमाणपत्रों ('एचईसी') अथिा दोनों के

संयोिन से जबिली की खरीद के िररये पूरा दकया िाएगा, और िो जनम्न प्रकार होगा:

जिजनयमों के जिजनयम 27(2) के प्रािधान 2 में संिोधन:

बिते दक यदद अन्य गैर-सौर आरपीओ अनुकूलता की प्राजप्त उपयुाि उप-जिजनयम (1) में जनर्ददष्ट 85% और उससे

अजधक की सीमा तक होती है, तो िेर् कमी, यदद कोई हो, तो इसे उस जिजिष्ट िर्ा हेतु सौर आरपीओ या एचपीओ

के अलािा, उपभोग की गई अजतररि सौर ऊिाा / सौर आरईसी / उपयुि िल जिद्युत ऊिाा की क्रय से पूरा दकया

िा सकता है:

4.0 मुख्य जिजनयमों के जिजनयम 27(2) के प्रािधान 3 से पूिा नए प्रािधान का अंतिेिन:

बिते दक, एचपीओ अनुकूलता की प्राजप्त 85% सीमा तक और उससे अजधक होने पर, िेर् कमी,यदद कोई हो, तो

इसे उस जिजिष्ट िर्ा हेतु सौर आरपीओ या अन्य गैर-सौर आरपीओ के अलािा,उपभोग की गई अजतररि सौर या

अन्य गैर-सौर ऊिाा द्वारा पूरा दकया िा सकता है।

5.0

मुख्य जिजनयमों के जिजनयम 27(2) के तहत मौिूदा प्रािधान (3) में संिोधन:

बिते दक जितरण लाइसेंसधारी प्रासंजगक जित्तीय िर्ा के पूणा होने की जतजथ से तीन महीनों के भीतर दकसी भी

जित्तीय िर्ा हेतु अपने कुल आरपीओ लक्ष्यों में दकसी भी प्रकार की कमी को पूरा करने के जलए जिजभन्न

निीकरणीय ऊिाा स्रोतों या आरईसी अथिा एचईसी या संयोिन से ऊिाा क्रय कर सकती हैं।

6.0

मुख्य जिजनयमों के जिजनयम 27(2) के बाद नए जिजनयम 27(2)(अ) का अंतिेिन:

27(2)(अ) िल जिद्युत क्रय दाजयत्ि (एचपीओ) लक्ष्यों को जनम्नजलजखत तरीकों से पूणा दकया िाएगा-

क) एचपीओ लाभ, योग्य एलएचपी (>25 मेगािाट) जिनमें पम्प्ड स्ट्टोरेि पररयोिनाएं िाजमल हैं, अथाात्

जिनकी आरंभ होने की जतजथ 08/03/2019 या इसके बाद तथा 31/03/2030 तक है (12 िर्ों की

अिजध में कुल उत्पाददत ऊिाा की 70% क्षमता तक) के माध्यम से प्राप्त उपार्भित ऊिाा से दकए िा सकते

है।

ख) इसके अजतररि एचपीओ के अनुपालन को सुजिधा प्रदान करने के जलए, िल जिद्युत ऊिाा प्रमाणपत्र

दक्रयाजिजध के रूप में जितरण लाइसेंसधारी द्वारा, उपलब्ध होने पर उपयोग की िाएगी।

ग) एचपीओ रिेक्टरी का सत्यापन िार्भर्क आधार पर दकया िाएगा, िो िल जिद्युत पररयोिनाओं के

आरंभ की संिोजधत समय-सारणी पर जनभार करता है।

घ) एचपीओ को पूरा करने के जलए भारत के बाहर से आयात की गई िल जिद्युत ऊिाा पर जिचार नहीं

दकया िाएगा।

7.0 मुख्य जिजनयमों के जिजनयम 27 के उप-जिजनयम (5) में संिोधन:

“(5)दकसी बाध्यकारी कंपनी/संस्ट्था द्वारा एचपीओ लक्ष्यों के अलािा, आरपीओ लक्ष्यों का गैर-अनुपालन करने

की जस्ट्थजत में, आरपीओ में न्यूनता (िॉटाफॉल) के भाग हेतु संबंजधत िर्ा में केंद्रीय जिद्युत जिजनयामक आयोग

(सीईआरसी) द्वारा जनर्ददष्ट सौर तथा गैर-सौर निीकरणीय ऊिाा प्रमाणपत्र के भाररत औसतन न्यूनतम मूल्य

का 10% की दर से िुमााना आरोजपत होगा। यदद, संबंजधत िर्ा हेतु सीईआरसी द्वारा जनर्ददष्ट न्यूनतम मूल्य

िून्य है, तो आरपीओ में न्यूनता (िॉटाफॉल) के भाग हेतु सीईआरसी के जनधाारणानुसार सौर तथा गैर-सौर

निीकरणीय ऊिाा के भाररत औसतन सजहष्णुता मूल्य का 10% की दर से िुमााना आरोजपत होगा।

Delhi Electricity Regulatory Commission (Business Plan)

(First Amendment) Regulations, 2021

F.3(600)/Tariff-Fin./DERC/2019-20/6705/063.—In exercise of powers conferred under Section

181 read with Section 61 and Section 86(1)(b) of the Electricity Act, 2003 (Act 36 of 2003) and all other

powers enabling it in this behalf, the Delhi Electricity Regulatory Commission hereby makes the following

Regulations to amend the Delhi Electricity Regulatory Commission (Business Plan) Regulations, 2019

(hereinafter referred to as “the Principal Regulations”):

1.0 Short Title and Commencement:

(1) These Regulations may be called the Delhi Electricity Regulatory Commission (Business Plan)

(First Amendment) Regulations, 2021.

(2) These Regulations shall come into effect from the date of notification.

2.0

Amendment of sub-Regulation (1) of Regulation 27 of Principal Regulations:

27 (1) The targets for Renewable Purchase Obligation (RPO) in terms of Regulation 124 of the

DERC (Terms and Conditions for Determination of Tariff) Regulations, 2017 of a Distribution

Licensee from FY 2020-21 to FY 2022-23, shall be computed as a percentage of total sale of

power, to its retail consumers in its area of supply, excluding procurement of hydro power, but not

excluding hydro power eligible under fulfilment of Hydro Purchase Obligation (HPO). The target

for RPO shall be met through purchase of power from various Renewable Energy Sources or

purchase of Renewable Energy Certificates („REC‟) or purchase of Hydro Energy Certificates

(„HEC‟) or combination, and shall be as follows:

Amendment of Proviso 2 of Regulation 27(2) of Principal Regulations:

Provided further that on achievement of Other Non-Solar RPO compliance as specified in aforesaid

sub-Regulation (1) to the extent of 85% and above, remaining shortfall if any, can be met by excess

Solar energy/Solar REC/eligible Hydro Energy purchased beyond Solar RPO or HPO for that

particular year:

4.0

Insertion of new Proviso before Proviso 3 of Regulation 27(2) of Principal Regulations

Provided further that, on achievement of HPO compliance to the extent of 85% and above,

remaining shortfall, if any, can be met by excess Solar or Other Non-Solar energy consumed

beyond specified Solar RPO or Other Non Solar RPO for that particular year.

5.0

Amendment of existing Proviso (3) under Regulation 27(2) of Principal Regulations:

Provided also that the Distribution Licensee may purchase power from various Renewable Energy

sources or RECs or HECs or combination for any shortfall in meeting their total RPO targets for

any financial year within three months from the date of completion of the relevant financial year.

6.0

Insertion of new Regulation (27)(2)(a)afterRegulation 27(2) of Principal Regulations:

27(2)(a) The HPO Targets shall be fulfilled in the following manner –

a) HPO benefits may be met from the power procured from eligible LHPs (> 25 MW)

including pumped storage projects i.e. those commissioned on and after 08/03/2019 and

upto 31/03/2030 in respect of 70% of the total generated capacity for a period of 12 years

from the date of commissioning.

b) Further to facilitate compliance of HPO, Hydro Energy Certificate mechanism as available

to be utilized by Distribution Licensees.

c) The HPO Trajectory shall be trued up on an annual basis depending on the revised

commissioning schedule of Hydro projects.

d) Hydro power imported from outside India shall not be considered for meeting HPO.

7.0 Amendment of sub-Regulation (5) of Regulation 27 of Principal Regulations:

“(5) Non-compliance of the RPO targets, other than HPO Target, by an Obligated Entity shall

attract penalty at the rate of 10% of the weighted average Floor Price of Solar and Non- Solar

Renewable Energy Certificate, as specified by Central Electricity Regulatory Commission

(CERC) for the relevant year, for quantum of shortfall in RPO. If the Floor price as specified

by CERC is zero for the year then the penalty shall be at the rate of 10% of the weighted

average Forbearance Price of Solar and Non- Solar Renewable Energy, as determined by

CERC, for quantum of shortfall in RPO.”
