रािधानी क्षेत्र दिल्ली सरकार, एतद्द्वारा संजिधान के अनुच्छेि 239एए की तंड (4) के प्रािधानों के संिभव में जनम्नजलजतत

मामलों में मंत्रीपररषि अथिा दकसी मंत्री के जनणवय के अनुपालन में दकसी कायविाही के जनष्पािन से पूिव रािधानी में लागू

दकसी कानून के तहत, उपराज्यपाल की राय प्राप्त करने के जलए जनर्िवष्ट करते हैं, तादक सरकार, राज्य सरकार, उपयुि

सरकार, उपराज्यपाल, प्रिासक अथिा मुख्य आयुि, िो भी लागू हो, की िजियों का अनुपालन हो सके, अथावत:-

1.

संसि द्वारा जनर्मवत अथिा केंद्र सरकार द्वारा राष्ट्रीय रािधानी क्षेत्र के जलए जिस्ट्ताररत दकसी जिजध के अंतगवत आने

िाले, राज्य की सूची अथिा संजिधान की सातिीं अनुसूची की समिती सूची में उद्धृत मामले के संबंध में;

2.

दिल्ली जिधानसभा द्वारा जिजध के तहत जिजनर्मवत आने िाले जनम्नजलजतत मामलेः

(क)

ऐसे मामले जिनका ऐसे दकन्हीं जिषयों पर प्रत्यक्ष अथिा अप्रत्यक्ष प्रभाि पड़ता हो, जिनके संबंध में उपराज्यपाल

को राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार अजधजनयम, 1991 के अनुच्छेि 41 अथावत, पुजलस, लोक व्यिस्ट्था, भूजम, सेिाओं

इत्यादि संबंधी के जलए अपने जििेक से कायविाही करनी हो;

(त)

अधीनस्ट्थ कानूनों अथावत जनयम, जिजनयम, स्ट्कीम, उपजिजध इत्यादि बनाना;

(ग)

जिजधक जनकायों िैसे प्राजधकरण, बोडव, सजमजत, आयोग इत्यादि की स्ट्थापना अथिा गठन/पुनगवठन करना;

(घ)

दिल्ली जित्त आयोग अजधजनयम, 1994 के तहत गरठत दिल्ली जित्त आयोग की जसफाररिों से संबंजधत मामले;

(ङ)

दिल्ली िेल अजधजनयम, 2000 तथा उसके अंतगवत बने जनयमों के तहत पेरोल प्रिान करना;

3.

राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार के रांिेक्िन ऑफ जबिनेस रूल, 1993 के जनयम 23 के तहत जिजनर्िवष्ट

मामले।

Delhi, the 28th April, 2021

No. F. 25(10)/21-RN/142/A-1190-99.—In exercise of the powers conferred by proviso to sub-section

(2) of section 44 of the Government of National Capital Territory of Delhi Act, 1991, as amended by the

Government of National Capital Territory of Delhi (Amendment) Act, 2021, the Lieutenant Governor of the

National Capital Territory of Delhi, hereby, specifies the following matters for obtaining opinion of the

Lieutenant Governor in terms of proviso to clause (4) of article 239AA of the Constitution, before taking

any executive action in pursuance of the decision of the Council of Ministers or a Minister, to exercise

powers of Government, State Government, Appropriate Government, Lieutenant Governor, Administrator

or Chief Commissioner, as the case may be, under any law in force in the Capital , namel y:-

1.

The matters falling under any law, made by Parliament or extended to the National Capi tal Territory of

Delhi by the Central Government, with respect to any matter enumerated in the State List or Concurrent List

of Seventh Schedule of the Constitution;

2.

The following matters falling under any Jaw made by Legislative Assembly of Delhi :

(a) The matters having, direct or indirect, effect on any of the subjects on which the Lieutenant

Governor is to act in his discretion in accordance with section 41 of the Government of National

Capital Territory of Delhi Act, 1991 i.e. Police, Public Order. Land, Services, etc.

(b) The mak ing of subordinate legislations i.e. rules, regulations, schemes, bye-laws, etc.

(c) Establishment or Constitution/re-constitution of statutory bodies, such as Authority, Board,

Committee, Commission, etc.

(d) Matters relating to recommend ations of the Delhi Finance Commission constituted und er the Delhi

Finance Commission Act, 1994;

(e) Grant of parole under the Delhi Prisons Act, 2000 and rules made thereunder.

3. The matters specified under rule 23 of the Transaction of Business of the Government of National Capital

Territory of Delhi Rules, 1993.
