्ास्ट्तज्क जन्ाानकों का ईनके मत देने के ऄजधकार को और ऄजधक प्रभा्ी बनाया िा सके, मतदान के समय जन्ाानकों की
पहनान सुजनजित करने के साधन के रुप में जन्ाानकों के जलए जन्ाानक फोटो पहनान पत्र के ईपयोग हेतु जनयमों के द्वारा

यतः जन्ाानकों का रजिजस्ट्रकरण जनयम, 1960 का जनयम 28 जन्ाानन अयोग को, आस दृजि से दक जन्ाानकों के
प्रजतरुपण का जन्ारण हो सके तथा मतदान के समय ईनकी पहनान को सरल बनाया िा सके, जन्ाानको को राज्य की
लागत पर फोटोयुक्त जन्ाानक फोटो-पहनान पत्र िारी करने के जलए जनदेि देने की िजक्त प्रदान करता है; तथा

यतः, जन्ााननों का संनालन जनयम, 1961 के जनयम 49 ि(3) और 49 ट(2) (ख) में यह ईपबंजधत है दक िहााँ दकसी
जन्ाानन क्षेत्र के जन्ाानकों को जन्ाानक रजिजस्ट्रकरण जनयम, 1960, के जनयम 28 के ईक्त ईपबंधों के ऄधीन जन्ाानक
फोटो पहनान-पत्र ददए गए हैं, ्हां जन्ाानकों को मतदान केन्द्र में ऄपना जन्ाानक फोटो पहनान-पत्र ददखाना होगा तथा
ईनकी ओर से ईन जन्ाानक फोटो पहनान पत्रों को नहीं ददखाए िाने या ददखाने में ऄसमथा होने पर ईन्द्हें मत डालने की
ऄनुमजत देने से आन्द्कार दकया िा सकता है; तथा

यतः, ईक्त ऄजधजनयम, और जनयमों के ईपयुाक्त ईपबंधों को जमलाकर ए्ं सामंिस्ट्यपूणा ढंग से ईनके ऄध्ययन से यह
स्ट््षट होता है दक यद्यजप मत देने का ऄजधकार जन्ाानक नामा्ली में नाम के होने से ही होता हैं, यह जन्ाानन अयोग
द्वारा राज्य की लागत पर, मतदान के समय ईनकी पहनान सुजनजित करने के साधन के रुप में प्रदान कर्ाए गए जन्ाानक
फोटो पहनान पत्र के प्रयोग पर भी जनभार करता है, तथा दोनों का एक साथ प्रयोग करना होता है; तथा

यतः, जन्ाानन अयोग ने एक समयबद्ध कायाक्रमम के ऄनुसार सभी जन्ाानकों को जन्ाानक फोटो पहनान-पत्र
इ0पी0अइ0सी0 िारी करने का जनदेि देते हुए 28 ऄगस्ट्त, 1993 को एक अदेि िारी दकया है; तथा

यतः, पंिाब, ईत्तरप्रदेि, जत्रपुरा, अंध्रप्रदेि, राष्ट्रीय रािधानी क्षेत्र ददल्ली और झारखण़् राज्यों/केन्द्र िाजसत प्रदेि
के जन्ाानकों को 100% जन्ाानक फोटो पहनान पत्र िारी दकए िा नुके हैं, तथा
7. ऄतः, ऄब, सभी संबद्ध कारकों तथा ज्जधक ए्ं तथ्यात्मक जस्ट्थजतयों को ध्यान में रखते हुए, जन्ाानन अयोग,
एतद्द्वारा, यह जनदेि देता है दकददनांक 30.05.2022को ऄजधसूजनत पंिाब के 12-संगरूर संसदीय जन्ाानन क्षेत्र,
ईत्तरप्रदेि के 7-रामपुर ए्ं 69-अिमगढ़ संसदीय जन्ाानन क्षेत्रों, जत्रपुरा के 6-ऄगरतला, 8-टाईन बोरडो्ाली, 46-
सुरमा (ऄ.िा.) ए्ं 57-िुबरािनगर ज्धानसभा जन्ाानन क्षेत्रों, अंध्रप्रदेि के 115-ऄट्माकुर ज्धानसभा जन्ाानन क्षेत्र,
राष्ट्रीय रािधानी क्षेत्र ददल्ली के 39-राजिन्द्र नगर ज्धानसभा जन्ाानन क्षेत्र और झारखण़् के 66-मान्द्डर
(ऄ.ि.िा.)ज्धान सभा जन्ाानन क्षेत्र के नालू ईप जन्ााननों के जलए सभी जन्ाानक जिन्द्हें जन्ाानक फोटो पहनान पत्र
िारी दकए गए हैं, मतदान स्ट्थल पर ऄपना मत डालने से पहले ऄपनी पहनान सुजनजित करने हेतु ऄपना जन्ाानक फोटो
पहनान पत्र ददखाएंगे। ऐसे जन्ाानक िो ऄपना जन्ाानक फोटो पहनान पत्र प्रस्ट्तुत नहीं कर पाते हैं, ईन्द्हें ऄपनी पहनान
स्ट्थाजपत करने के जलए जनम्नजलजखत ्ैकजल्पक फोटो पहनान दस्ट्ता्ेिों में से कोइ एक प्रस्ट्तुत करना होगाः-
i.
अधार काडा।
ii.
मनरेगा िॉब काडा,
iii.
बैंको / डाकघरों द्वारा िारी दकए गए फोटोयुक्त पासबुक,
iv.
श्रम मंत्रालय की योिना के ऄन्द्तगात िारी स्ट््ास्ट्थ्य बीमा स्ट्माटा काडा,
v.
ड्राआव्ग लाआसेन्द्स,
vi.
पैन काडा,
vii.
एनपीअर के ऄंतगात अरिीअइ द्वारा िारी दकए गए स्ट्माटा काडा,
viii.
भारतीयपासपोटा;
ix.
फोटोयुक्त पेंिन दस्ट्ता्ेि,
x.
केन्द्र/ राज्य सरकार/ लोक ईपक्रमम/पज लक जलजमटेड कम्पजनयों द्वारा ऄपने कमानािरयों को िारी दकए गए
फोटोयुक्त से्ा पहनान-पत्र, और
xi.
सांसदो/ ज्धायकों / ज्धान पिरषद् सदस्ट्यों को िारी दकए गए सरकारी पहनान पत्र,
xii.
यूजनक जडसएजबजलटी अइडी (यूडीअइडी) का़ा, सामाजिक न्द्याय ए्ं ऄजधकािरता मंत्रालय, भारत

8.
एजपक के संबंध में, लेखन ऄिुजद्ध, ्तानी की ऄिुजद्ध आत्यादद को निरऄंदाि कर देना नाजहए बितें जन्ाानक की
पहनान इपीअइसी से सुजनजित की िा सके। यदद कोइ जन्ाानक फोटो पहनान पत्र प्रदजिता करता है, िो दक दकसी ऄन्द्य
सभा जन्ाानन-क्षेत्र के जन्ाानक रजिस्ट्रीकरण ऄजधकारी द्वारा िारी दकया गया हैं, ऐसे एजपक भी पहनान स्ट्थाजपत करने
हेतू स्ट््ीकृत दकए िाएंगे बितें ईस जन्ाानक का नाम िहां ्ह मतदान करने अया है ईस मतदान
केंर से संबंजधत जन्ाानक नामा्ली में ईपल ध हो। यदद फोटोग्राफ आत्यादद के बेमेल होने के कारण जन्ाानक की पहनान
सुजनजित करना संभ् न हो तब जन्ाानक को ईपयुाक्त पैरा 7 में ्र्णणत दकसी एक ्ैकजल्पक फोटो दस्ट्ता्ेि को प्रस्ट्तुत
करना होगा।
9. ईक्त पैरा 7 में दकसी बात के होते हुए भी, प्र्ासी जन्ाानकों को िो ऄपने पासपोटा में ज््रणों के अधार पर
लोक प्रजतजनजधत्् ऄजधजनयम, 1950 की धारा 20क के ऄधीन जन्ाानक नामा्जलयों में पंिीकृत हैं, मतदान केन्द्र में के्ल
ईनके मूल पासपोटा (तथा कोइ ऄन्द्य पहनान दस्ट्ता्ेि नहीं) के अधार पर ही पहनाना िाएगा।

ORDER
New Delhi, the 6th June, 2022
No. 3/4/ID/2022/SDR/VOL.II.—1. Whereas, Section 61 of the Representation of the People Act,
1951 provides that with a view to preventing impersonation of electors, so as to make the right of genuine
electors to vote under section 62 of that Act more effective, provisions may be made by rules under that
Act for use of Electors Photo Identity Card for electors as the means of establishing their identity at the
time of polling; and
2. Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election
Commission to direct, with a view to preventing impersonation of electors and facilitating their
identification at the time of poll, the issue of Electors Photo Identity Card to electors bearing their
photographs at State cost; and
3. Whereas, Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that
where the electors of a constituency have been supplied with Electors Photo Identity Card under the said
provisions of Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Elector
Photo Identity Card at the polling station and failure or refusal on their part to produce those Elector Photo
Identity Card may result in the denial of permission to vote; and
4. Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the
Rules, makes it clear that although the right to vote arises by the existence of the name in the electoral roll,
it is also dependent upon the use of the Elector Photo Identity Card, where provided by the Election
Commission at State cost, as the means of establishing their identity at the time of polling and that both are
to be used together; and
5. Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue
of Elector Photo Identity Card (EPIC) to all electors, according to a time bound programme; and

6. Whereas, Elector Photo Identity Card have been issued to approximate 100% electors in the
States/UT of Punjab, Uttar Pradesh, Tripura, Andhra Pradesh, NCT of Delhi & Jharkhand; and
7. Now, therefore, after taking into account all relevant factors and the legal and factual position,
the Election Commission hereby directs that for the current bye-elections in 12-Sangrur Parliamentary
Constituency of Punjab, 7-Rampur Parliamentary Constituency & 69-Azamgarh Parliamentary
Constituency of Uttar Pradesh, 06-Agartala, 08-Town Bordowali, 46-Surma(SC) & 57-Jubarajnagar
Assembly Constituencies of Tripura, 115-Atmakur Assembly Constituency of Andhra Pradesh, 39-
Rajinder Nagar Assembly Constituency of NCT of Delhi and 66-Mandar(ST) Assembly Constituency
of Jharkhand,
Notified on 30-05-2022, all electors who have been issued EPIC shall produce the EPIC for their
identification at the polling station before casting their votes. Those electors who are not able to produce
the EPIC shall produce one of the following alternative photo identity documents for establishing their
identity: -
(i)
Aadhaar Card,
(ii)
MNREGA Job Card,
(iii)
Passbooks with photograph issued by Bank/Post Office,
(iv) Health Insurance Smart Card issued under the scheme of Ministry of Labour,
(v)
Driving License,
(vi) PAN Card,
(vii) Smart Card issued by RGI under NPR,
(viii) Indian Passport,
(ix) Pension document with photograph,
(x) Service Identity Cards with photograph issued to employees by Central/State
Govt./PSUs/Public Limited Companies, and
(xi) Official identity cards issued to MPs/MLAs/MLCs.
(xii) Unique Disability ID (UDID) Card, M/o Social Justice & Empowerment, Government of
India

In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided the
identity of the elector can be established by the EPIC. If an elector produces an EPIC which has been
issued by the Electoral Registration Officer of another Assembly Constituency, such EPIC shall also be
accepted for identification provided the name of that elector finds place in the electoral roll pertaining to
the polling station where the elector has turned up for voting. If it is not possible to establish the identity of
the elector on account of mismatch of photograph, etc. the elector shall have to produce one of the
alternative photo documents mentioned in Para 7 above.
9.
Notwithstanding anything in Para 7 above, overseas electors who are registered in the
electoral roll under Section 20A of the Representation of the People Act, 1950, based on the particulars in
their Indian Passport, shall be identified on the basis of their original passport only (and no other identity
document) in the polling station.
