उपभोगी संस्ट्था द्वारा पररयोजना स्ट्थल से 590 वृक्षों का प्रत्यारोपण जनम्नजलजखत स्ट्थानों पर अपने स्ट्वयं की लागत पर दकया
जाएगा:-
(i) एसडीएमसी गल्सा स्ट्कूल छतरपुर, नई ददल्ली।
(ii) एसडीएमसी बॉयज स्ट्कूल छतरपुर, नई ददल्ली।
(iii) डीडीए ग्राम सभा पॉकेट-1, छतरपुर, नई ददल्ली।
(iv) डीडीए ग्राम सभा पॉकेट-2, छतरपुर, नई ददल्ली।
(v) श्री आध्याय कात्यानी िजिपीठ मंददर रस्ट्ट, छतरपुर, नई ददल्ली।
(vi) सवोदय जवद्यालय गल्सा, मंडी गांव, नई ददल्ली।
(vii) गवनामेंट बॉयज़ सीजनयर सेकेंडरी स्ट्कूल, सेक्टर-3, आर.के. पुरम, नई ददल्ली।
(viii) ददल्ली गवनामेंट जडस्ट्पेंसरी, जोनापुर जवलेज, नई ददल्ली।
जनयम एवं ितें
1. ददल्ली मेरो रेल कॉपोरेिन, जो दक उपभोगी संस्ट्था के रूप में संदर्भभत िै, को सात वर्षों की अवजध के जलए पौधों के सम्पूणा जवकास
एवं रखरखाव िेतु उपरोिानुसार 4,41,18,000/- रुपये ¼चार करोड़ इकतालीस लाख अठारि िजार मात्र@रु. 57000/- प्रजत
वृक्ष) की राजि अजग्रम रूप से जमा करवानी िोगी और यदद उपभोगी संस्ट्था द्वारा 2, 3 और 4 में उजल्लजखत जनयमों और ितों का
पालन निीं दकया जाता िै, तो इस राजि को जब्त कर जलया जाएगा और इस राजि को वन जवभाग द्वारा वृक्षारोपण के जलए
उपयोग दकया जाएगा ।
2. उपभोगी संस्ट्था द्वारा वृक्षों की कटाई/ प्रत्यारोपण िुरू करने से पिले जनम्नजलजखत ितों को पूरा दकया जाएगा:-
a. ददल्ली वृक्ष संरक्षण अजधजनयम, 1994 की धारा 12 के अनुपालन में उपभोगी संस्ट्था द्वारा संबंजधत वृक्ष अजधकारी को जवस्ट्तृत
वृक्षारोपण कायाक्रम प्रस्ट्तुत प्रस्ट्तुत दकया जाएगा ।
b. उपभोगी संस्ट्था द्वारा साइट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योजना प्रस्ट्तुत दकया जाएगा ।
c. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक वृक्षों की कटाई/ प्रत्यारोपण से पूवा कोई लंजबत मुकदमेबाजी या
स्ट्थगन आदेि दकसी भी न्यायालय/अन्य प्राजधकरण द्वारा पाररत न हुआ िो।

d. उपभोगी संस्ट्था द्वारा वृक्षो को कटाई/ प्रत्यारोपण का काया सभी वैधाजनक मंजूररयों को लेने के बाद िी िुरू दकया जाएगा।
e. उपभोगी संस्ट्था के द्वारा वन मंजूरी में और अन्य मंजूरी में उजल्लजखत सभी ितों ितों, यदद कोई िो, का जनष्ठापूवाक पालन
दकया जाएगा ।
f.
यि उस पररयोजना का जिस्ट्सा िै जजसमें वन (संरक्षण) अजधजनयम के तित वन भूजम का व्यपवतान (diversion) िाजमल िै।
इसजलए, उपभोगी संस्ट्था (https://parivesh.nic.in/writereaddata /FC /HAND BOOK_GUIDELINES
/HANDBOOK_GUIDELINES18_03_2019.pdf) द्वारा वन (संरक्षण) अजधजनयम की िैंडबुक के अनुसार ददिाजनदेिों
का जनष्ठापूवाक पालन दकया जायेगा ।
g. ररज मैनेजमेंट बोडा (आरएमबी) द्वारा स्ट्वीकृत और माननीय सवोच्च न्यायालय द्वारा अनुमोददत पररयोजना के जलए जनधााररत
पररयोजना लागत का 5% आरएमबी के पास उपभोगी संस्ट्था द्वारा जमा दकया जायेगा और इसे वृक्ष अजधकारी (दजक्षण) को
अवगत कराया जाये।
3. वृक्षों की कटाई/ प्रत्यारोपण के दौरान जनम्नजलजखत ितों को पूरा दकया जाएगा:-
a.

2 में ितों के संतुष्ट िोने के तुरंत बाद उपभोगी संस्ट्था द्वारा वृक्षो का प्रत्यारोपण िुरू दकया जाएगा और इसे
छ: मिीने के अंतराल में पूणा दकया जाएगा । प्रत्यारोपण प्रदक्रया के पूणा िोने का बाद एक सम्पूणा ररपोटा संबजन्धत वृक्ष
अजधकारी को प्रस्ट्तुत की जायेगी । प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत वृक्षो की दूरी 4 मीटर (बबदु से बबदु) से कम निीं
िोनी चाजिए ।
b. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया जाएगा ।
c.
उपभोगी संस्ट्था द्वारा 184 वृक्षो को काटने से पूवा प्रत्यारोपण दकया जाएगा ।184 वृक्षो की अनुमजत 590 वृक्षो के सफल
प्रत्यारोपण और उप- वन संरक्षक (दजक्षण) को अनुपालन प्रमाण पत्र प्रस्ट्तुत करने के बाद दी जायेगी।
d. प्रजतरोपण/कटाई की प्रगजत ररपोटा जनरीक्षण अजधकारी के माध्यम से संबंजधत वृक्ष अजधकारी को वृक्षों के पूणा जववरण के
साथ प्रस्ट्तुत की जाएगी।
e.
यदद दकसी वृक्ष में पजक्षयों का घोंसला पाया जाता िै तो उसे तब तक निीं काटा/प्रत्यारोपण दकया जाएगा जब तक दक
पक्षी उसे छोड़ न दें।
f.
उपभोगी संस्ट्था द्वारा 774 वृक्षो के अलावा दकसी भी वृक्ष की कटाई/प्रत्यारोपण ददल्ली वृक्ष संरक्षण अजधजनयम, 1994
के अन्तगात एक अपराध िोगा।
g. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए जाने के उपरान्त प्राप्त लकजड़यों की नीलामी की जाएगी और उससे प्राप्त धन राजि
को सरकार के खाते मे राजस्ट्व के रूप में जमा की जाएगी।
h. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िाखाओं को काटे जाने के उपरान्त प्राप्त लकजड़यों को मुफ्त में जनकटतम सावाजजनक
िवदािों में प्रयोग िेतु सौपी जाएगी और इसकी सूचना वृक्ष अजधकारी (दजक्षण) को भी दी जाएगी।
i.
उपभोगी संस्ट्था द्वारा वृक्षो को िटाए जाने के स्ट्थल से लकजड़यों को को ले जाने से पूवा वृक्ष अजधकारी (दजक्षण) से ढुलाई
अनुमजत प्राप्त करनी िोगी।
j.
उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण/ कटाई और उसमें पैदा िोने वाली वन उपज को सावाजजनक िमिान मे 90
ददनों के अंदर पूरा दकया जाएगा ।
k. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक इस प्रस्ट्ताव की योजना को पररवर्भतत निीं दकया जाएगा ।
l.
उपभोगी संस्ट्था के द्वारा वन मंजूरी में और अन्य मंजूरी में उजल्लजखत सभी ितों, यदद कोई िो, का जनष्ठापूवाक पालन
दकया जाएगा ।
m. उपभोगी संस्ट्था के द्वारा अनुमोददत वृक्ष संरक्षण योजना के अंतगात प्रस्ट्तुत सभी गजतजवजधयों का जनष्ठापूवाक पालन दकया
जाएगा ।
n. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जाएगा दक वृक्ष प्रत्यारोपण नीजत 2020 की धारा 4 (6-बी) के अंतगात
सभी प्रावधानों का जनष्ठापूवाक पालन दकया गया िै और इसका जववरण संबंजधत वृक्ष अजधकारी को प्रस्ट्तुत दकया जाएगा
।

o. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जाएगा दक सभी प्रजतरोजपत वृक्षों के जलए जो 15 फीट ऊंचाई और कम से
कम 6 इंच व्यास वाले स्ट्वदेिी वृक्ष प्रजाजतयों में जीजवत निीं रि पाते िैं, तो उन्िें 1:5 के अनुपात में लगाया जाएगा ।
आवश्यक अजतररि भूजम उपभोगी संस्ट्था द्वारा प्रदान की जाएगी और वृक्षारोपण स्ट्वयं की लागत पर दकया जाएगा ।
4. वृक्ष अजधकारी द्वारा सफल वृक्षारोपण और जमानत राजि जारी करने पर जवचार करने के जलए जनम्नजलजखत ितों को पूरा
दकया जाएगा:
a. उपरोि ताजलका 1 (क) और (ख) के अनुसार, देिी प्रजाजतयों के 7740 पौधो का 100 % प्रजतपूरक वृक्षारोपण और
उनका सात वर्षो तक रखरखाव उपभोगी संस्ट्था द्वारा दकया जायेगा। इस वृक्षारोपण के सफलता पूवाक स्ट्थापना के बाद
उपभोगी संस्ट्था द्वारा जनगरानी की जाएगी।
b. 774 वृक्षो के प्रत्यारोपण/ काटे दकए जाने के बदले मे 1:10 के अनुपात मे स्ट्वदेिी प्रजाजतयों के 6-8 फीट की ऊाँचाई वाले
7740 पौधो का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया जाएगा । वृक्षारोपण की अनुमजत के जारी िोने के तीन
मिीने के अंदर जनधााररत की गई भूजम पर अजतररि उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण
तकनीकों के द्वारा दकया जाएगा और अजग्रम सात (7) वर्षों के जलए रखरखाव तथा उसके बादउनका रखरखाव उपभोगी
संस्ट्था द्वारा अपनी स्ट्वयं की लागत पर दकया जाएगा ।
c. यदद उपभोगी संस्ट्था सफलतापूवाक प्रजतपूरक वृक्षारोपण करने में जवफल रिती िै। उपभोगी संस्ट्था द्वारा अजतररि साइट
सुधार खचों को जमा दकया जाएगा जो दक वृक्ष अजधकारी (दजक्षण) द्वारा गणना के अनुसार वृक्षारोपण के जलए उपयुि
बनाने के जलए आवश्यक िो सकती िै।
d. जो भूजम प्रजतपूरक वृक्षारोपण/वृक्ष प्रत्यारोपण के जलए आवंरटत िै, उसका उपयोग दकसी अन्य कायो के जलए राज्य
सरकार की स्ट्वीकृजत के जबना निीं दकया जाएगा।
e. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यजीव जवभाग राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार को
जनधााररत करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वर्षा के अंत में वृक्ष अजधकारी ¼दजक्षण½ को प्रस्ट्तुत की जाएगी ।
f.
भूजम स्ट्वाजमत्व एजेंसी यि सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोई अजतक्रमण न िो ।
g. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृदा नमी संरक्षण काया की गजतजवजधयों को दकया
जाएगा।
h. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक इस प्रस्ट्ताव की योजना को पररवर्भतत निीं दकया जाएगा ।
i.
यदद पररयोजना लागत संिोजधत िो जाती िै, तो अजतररि सुरक्षा राजि जारी करने के अनुरोध से पिले उपभोगी संस्ट्था
के द्वारा आर एमबी के पास जमा कर दीजाए।
5. 774 वृक्षो को प्रत्यारोपण/काटने के जलए अनुमजत उनके स्ट्वयं के जोजखम पर और दकसी भी अन्य व्यजि के दावे के पक्षपात के
जबना, जो वृक्षो और भूजम पर सिी िो सकती िै, दी जा रिी िै ।
यि माननीय पयाावरण एवं वन मंत्री राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार के पूवा अनुमोदन से जारी दकया जाता िै ।

F. No. 5642/TO(S)/TC-Felling/2019-20/6489-96.—In exercise of the powers conferred by section 29 of the
Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi,
hereby, in public interest exempts an area of 3.322 ha approx. for construction of Chattarpur Mandir, Neb Sarai Metro
Station of IGD T-1 to Saket Block (excluding) corridor of MRTS Project, Phase-IV, New Delhi from the provision of
sub-section (3) of section 9 of the said Act.

Transplantation of 590 No. of trees which are standing on site shall be done by User Agency at the
following locations with their own funds:-
(i) SDMC Girls School Chhatarpur, New Delhi.
(ii) SDMC Boys School Chhatarpur, New Delhi.
(iii) DDA Gram Sabha Pocket-1, Chhatarpur, New Delhi.
(iv) DDA Gram Sabha Pocket-2, Chhatarpur, New Delhi.
(v) Shri Adhya Katyani Shaktipith Mandir Trust, Chhatarpur, New Delhi.
(vi) SarvodayaVidyalaya Girls, Mandi Village, New Delhi.
(vii) Govt. Boys Sr. Sec. School, Sec-3, R.K. Puram, New Delhi.
(viii) Delhi Govt. Dispensary, Jonapur Village, New Delhi.
TERMS & CONDITIONS
1. Delhi Metro Rail Corporation (DMRC) herein referred to as User Agency, shall make an advance deposit
of an amount of Rs. 4,41,18,000/- (rupees Four Crore Forty One Lakh Eighteen Thousand Only @ Rs.
57000/- per tree) towards security deposit for creation and maintenance of compensatory plantation for a
period of Seven (7) years and the same shall be forfeited and utilized for plantation by the Forest Department
if terms and conditions mentioned at 2, 3 & 4 are not followed by User Agency.
2. The following conditions shall be fulfilled before starting felling/transplantation of trees by User
Agency:
a.
Detailed plantation schedule shall have to be submitted by User Agency to concerned Tree Officer in
compliance with Section-12 of Delhi Preservation of Trees Act, 1994.
b. User Agency shall submit a detailed plan for site preparation and plantation.

c.
The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/
other authority before undertaking felling/ transplantation of trees.
d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall
necessarily be obtained by the User Agency.
e.
It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other
clearances, if any obtained, shall be followed scrupulously.
f.
This is part of project in which diversion of forest land under Forest (Conservation) Act is involved.
Hence, guidelines as per Handbook of FCA should be followed scrupulously by User Agency

_03_2019.pdf).
g. 5% of the project cost as prescribed for project cleared by Ridge Management Board (RMB) and
approved by Hon’ble Supreme Court should be deposited with RMB and the same is conveyed to Tree
Officer (South).
3. The following conditions shall be fulfilled during the felling/ transplantation of trees:
a.
Transplantation of trees shall be initiated immediately after conditions in point No. 2 is satisfied and
should be completed not later than six (06) months of such date, after which a completion report has to
be submitted to the Tree Officer concerned. The spacing of the transplantation of trees shall not be less
than 4 meter (point to point) at transplantation site.
b. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by
User Agency.
c.
The transplantation shall be carried out prior to felling of 184 Nos. of trees permitted herein. The 184
trees shall be removed/felled after successful transplantation of 590 trees and submission of compliance
certificate to DCF (South).
d. The progress report of transplantation/felling shall be submitted through inspection officer to concerned
Tree Officer along with complete details of trees.
e.
If any tree is found to have nest of birds it should not be felled/transplanted till the same is abandoned by
the birds.
f.
Transplantation/felling of any tree apart from 774 trees by User Agency shall constitute an offence under
Delhi Preservation of Trees Act (DPTA), 1994.
g. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue
to the Government account by the User Agency.
h. The lops & tops of the trees shall be sent/supplied to the nearest crematorium free of cost and the same
should be reported to DCF (South) by User Agency.
i.
Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said
wood shall be obtained from the DCF (South) by User Agency.
j.
Transplantation / felling of trees and transportation of forest produce arising there from to the public
crematorium shall be completed within 90 days.
k. The User Agency shall ensure that the plan of this proposal shall not be changed.
l.
It should be ensured by the User Agency that all the conditions mentioned in forest clearance and other
clearances, if any obtained, shall be followed scrupulously.
m. All activities as submitted under approved Tree Preservation Plan should be followed scrupulously.
n. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy 2020 have
been followed and details of the same should be submitted to the Tree Officer concerned.
o. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with
15 feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land required should be
provided by User Agency & plantation has to be done at own cost.
4. The following conditions shall be fulfilled for considering successful plantation & release of Security
Deposit by the Tree officer:
a.
100% Compensatory Plantation of 7740 saplings of native species shall be raised and maintained by User
Agency for Seven years and monitored till its successful establishment as mentioned on table above.

b. 7740 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in
ratio of 1:10 on non-forest land in lieu of felling/ transplantation 774 No. of trees. The plantation shall be
done by following site specific plantation techniques with additional measures on identified land within
three months of issue of tree removal permission and maintenance for next Seven (7) years shall be
carried out there after by User Agency with their own funds.
c.
If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also
deposit extra site improvement expenses which may be required to make the site suitable for plantation
as calculated by Tree Officer concerned (as deposits).
d. The land over which compensatory plantation/ Tree transplantation raised shall not be utilized for other
purpose without the approval of the State Government.
e.
User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife,
Govt. of NCT of Delhi and a copy of the same shall be submitted to the Tree Officer (South) at the end
of every financial year.
f.
Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory
plantation/ transplantation.
g. The User Agency shall implement the improved soil moisture conservation activities on compensatory
plantation/ transplantation site.
h. The User Agency shall ensure that the plan of this proposal shall not be changed.
i.
If project costs get revised, the additional amount should be deposited with RMB before requesting for
release of security deposit.
5. Permission for transplantation/ felling of 774 Nos. of tress is being granted to the User Agency at their own
risk and without prejudice the claim(s) of any other person(s) who may be having any right(s) over the land
or the trees.
This issues with prior approval of Hon’ble Minister (Environment & Forests), Govt. of NCT of Delhi.
