ईपभोगी संस्ट्था द्वारा पररयोजना स्ट्थल से 247 वृक्षों का प्रत्यारोपण इको पाकग बदरपुर, नइ ददल्ली में ऄपने स्ट्वयं

की लागत पर दकया जाएगा।

जनयम एवं ितें

1. केंद्रीय लोक जनमागण जवभाग, जो दक ईपभोगी संस्ट्था के रूप में संदर्भभत िै, को सात वर्षों की ऄवजध के जलए पौधों

के सम्पूणग जवकास एवं रखरखाव िेतु ईपरोिानुसार 1,40,79,000/- रुपये ¼एक करोड़ चालीस लाख ईनासी

िजार मात्र @ रु. 57000/- प्रजत वृक्ष) की राजि ऄजिम रूप से जमा करवानी िोगी और यदद ईपभोगी संस्ट्था

द्वारा 2, 3 और 4 में ईजल्लजखत जनयमों और ितों का पालन निीं दकया जाता िै, तो आस राजि को जब्त कर

जलया जाएगा और आस राजि को वन जवभाग द्वारा वृक्षारोपण के जलए ईपयोग दकया जाएगा ।

2. ईपभोगी संस्ट्था द्वारा वृक्षों का प्रत्यारोपण िुरू करने से पिले पूरी की जाने वाली अव‍यक ितें:-

a. ददल्ली वृक्ष संरक्षण ऄजधजनयम, 1994 की धारा 12 के ऄनुपालन में ईपभोगी संस्ट्था द्वारा संबंजधत वृक्ष

ऄजधकारी / ईप- वन संरक्षक (पजिम) को जवस्ट्तृत वृक्षारोपण कायगक्रम प्रस्ट्तुत दकया जाएगा ।

b. ईपभोगी संस्ट्था द्वारा साआट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योजना प्रस्ट्तुत दकया

जाएगा ।

c. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक वृक्षो की कटाइ/ प्रत्यारोपण से पूवग कोइ लंजबत

मुकदमा या स्ट्थगन अदेि दकसी भी न्यायालय / ऄन्य प्राजधकरण द्वारा पाररत न हुअ िो।

d. ईपभोगी संस्ट्था द्वारा वृक्षो को िटाने का कायग सभी वैधाजनक मंजूररयों को लेने के बाद िी िुरू दकया

जाएगा।

e. ईपभोगी संस्ट्था के द्वारा वन मंजूरी में और ऄन्य मंजूरी में ईजल्लजखत सभी ितों, यदद कोइ िो, का

जनष्ठापूवगक पालन दकया जाएगा ।

3. वृक्षों के प्रत्यारोपण के दौरान पूरी की जाने वाली अव‍यक ितें:-

a. क्र

2 में ितों के ऄनुपालन िोने के तुरंत बाद ईपभोगी संस्ट्था द्वारा वृक्षों का प्रत्यारोपण िुरू दकया

जाएगा और आसे छ: मिीने के ऄंतराल में पूणग दकया जाएगा । प्रत्यारोपण प्रदक्रया के पूणग िोने का बाद

एक सम्पूणग ररपोटग वृक्ष ऄजधकारी/ ईप- वन संरक्षक (पजिम) को प्रस्ट्तुत की जायेगी । प्रत्यारोपण स्ट्थल

मे प्रत्यारोजपत वृक्षों की दूरी 4 मीटर (सबदु से सबदु) से कम निीं िोनी चाजिए ।

b. ईपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत, 2020 में ईजल्लजखत सभी ितों का पालन दकया

जाएगा ।

c. ईपभोगी संस्ट्था द्वारा प्रत्यारोपण वृक्षों की प्रगजत ररपोटग संबंजधत वृक्ष ऄजधकारी / ईप- वन संरक्षक

(पजिम) को वृक्षों के पूणग जववरण के साथ प्रस्ट्तुत की जाएगी।

d. यदद दकसी वृक्ष में पजक्षयों का घोंसला पाया जाता िै तो ईसे तब तक निीं काटा/ प्रत्यारोपण दकया

जाएगा जब तक दक पक्षी ईसे स्ट्वतः छोड़ न दें।

e. ईपभोगी संस्ट्था द्वारा 247 वृक्षों के ऄलावा दकसी भी वृक्ष की कटाइ / प्रत्यारोपण ददल्ली वृक्ष संरक्षण

ऄजधजनयम, 1994 के ऄन्तगगत एक ऄपराध िोगा।

f. ईपभोगी संस्ट्था द्वारा वृक्षों को िटाए जाने के ईपरान्त प्राप्त लकजड़यों की नीलामी की जाएगी और

ईससे प्राप्त धनराजि को सरकार के खाते मे राजस्ट्व के रूप में जमा की जाएगी।

g. ईपभोगी संस्ट्था द्वारा वृक्षों के उपरी िाखाओं को काटे जाने के ईपरान्त प्राप्त लकजड़यों को मुफ्त में

जनकटतम सावगजजनक िवदािों में प्रयोग िेतु सौपी जाएगी और आसकी सूचना वृक्ष ऄजधकारी/ईप- वन

संरक्षक (पजिम) को भी दी जाएगी

h. ईपभोगी संस्ट्था द्वारा वृक्षों को िटाए जाने के स्ट्थल से लकजड़यों को को ले जाने से पूवग वृक्ष

ऄजधकारी/ईप- वन संरक्षक (पजिम) से ढुलाइ ऄनुमजत प्राप्त करनी िोगी।

ईपभोगी संस्ट्था द्वारा वृक्षों की प्रत्यारोपण और ईसमें पैदा िोने वाली वन ईपज को सावगजजनक ‍मिान

मे 90 ददनों के ऄंदर पूरा दकया जाएगा ।

ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक आस प्रस्ट्ताव की योजना को पररवर्भतत निीं

दकया जाएगा ।

k. ईपभोगी संस्ट्था के द्वारा वन मंजूरी में और ऄन्य मंजूरी में ईजल्लजखत सभी ितों ितों, यदद कोइ िो, का

जनष्ठापूवगक पालन दकया जाएगा ।

ईपभोगी संस्ट्था के द्वारा ऄनुमोददत वृक्ष संरक्षण योजना के ऄंतगगत प्रस्ट्तुत सभी गजतजवजधयों का

जनष्ठापूवगक पालन दकया जाएगा ।

m. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जाएगा दक वृक्ष प्रत्यारोपण नीजत, 2020 की धारा 4 (6-

बी) के ऄंतगगत सभी प्रावधानों का जनष्ठापूवगक पालन दकया गया िै और आसका जववरण संबंजधत वृक्ष

ऄजधकारी/ईप- वन संरक्षक (पजिम) को प्रस्ट्तुत दकया जाएगा ।

n. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जाएगा दक सभी प्रजतरोजपत वृक्षों के जलए जो 15 फीट

उंचाइ और कम से कम 6 आंच व्यास वाले स्ट्वदेिी वृक्ष प्रजाजतयों में जीजवत निीं रि पाते िैं, तो ईन्िें

1:5 के ऄनुपात में लगाया जाएगा । अव‍यक ऄजतररि भूजम ईपभोगी संस्ट्था द्वारा प्रदान की जाएगी

और वृक्षारोपण स्ट्वयं की लागत पर दकया जाएगा।

वृक्ष ऄजधकारी /ईप- वन संरक्षक द्वारा सफलतापूवगक वृक्षारोपण और सुरक्षा जमा राजि जारी करने पर जवचार

करने के जलए अव‍यक ितें:-

ईपरोि ताजलका 1 (क) और (ख) के ऄनुसार, देिी प्रजाजतयों के 2470 पौधों का 100% प्रजत पूरक

वृक्षारोपण और ईनका सात वर्षो तक रखरखाव ईपभोगी संस्ट्था द्वारा दकया जायेगा। आस वृक्षारोपण के

सफलतापूवगक स्ट्थापना के बाद ईपभोगी संस्ट्था द्वारा जनगरानी की जाएगी।

247 वृक्षों के प्रत्यारोपण दकए जाने के बदले मे 1:10 के ऄनुपात मे स्ट्वदेिी प्रजाजतयों के 6-8 फीट की

उाँचाइ वाले 2470 पौधो का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया जाएगा । वृक्षारोपण की

ऄनुमजत के जारी िोने के तीन मिीने के ऄंदर जनधागररत की गइ भूजम पर ऄजतररि ईपायों के साथ

वृक्षारोपण स्ट्थल के ऄनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया जाएगा और ऄजिम सात (7)

वर्षों के जलए रखरखाव तथा ईसके बाद ईनका रखरखाव ईपभोगी संस्ट्था द्वारा ऄपनी स्ट्वयं की लागत

पर दकया जाएगा ।

यदद ईपभोगी संस्ट्था सफलतापूवगक प्रजतपूरक वृक्षारोपण करने में जवफल रिती िै। ईपभोगी संस्ट्था द्वारा

ऄजतररि साआट सुधार खचों को जमा दकया जाएगा जो दक सम्बंजधत वृक्ष ऄजधकारी/ईप- वन संरक्षक

¼पजिम½ द्वारा गणना के ऄनुसार वृक्षारोपण के जलए ईपयुि बनाने के जलए अव‍यक िो सकती िै।

ईपभोगी संस्ट्था द्वारा 2X2X2 मीटर और 4X4X4 मीटर के अकार के गड्ढे में जमीन की भारी तैयारी

के ईपायों ऄथागत ऄच्छी जमट्टी को भरने का कायग दकया जायेगा आन कायो को दकए जाने के बाद वृक्ष

ऄजधकारी/ईप-वन संरक्षक (पजिम) द्वारा जारी पत्र ददनांक 31.05.2022 के ऄनुसार प्रजतपूरक

वृक्षारोपण और प्रत्यारोपण के जलए भूजम पर जवचार दकया जायेगा।

जो भूजम प्रजतपूरक वृक्षारोपण/ वृक्ष प्रत्यारोपण के जलए अवंरटत िै, ईसका ईपयोग दकसी ऄन्य कायो

के जलए राज्य सरकार की स्ट्वीकृजत के जबना निीं दकया जाएगा।

ईपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यजीव जवभाग राष्ट्रीय राजधानी क्षेत्र ददल्ली

सरकार को जनधागररत करेंगी और आसकी एक प्रजत प्रत्येक जवत्तीय वर्षग के ऄंत में वृक्ष ऄजधकारी/ ईप-वन

संरक्षक (पजिम) को प्रस्ट्तुत की जाएगी ।

भूजम स्ट्वाजमत्व एजेंसी यि सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोइ

ऄजतक्रमण न िो ।

ईपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/प्रत्यारोपण स्ट्थल में मृदा नमी संरक्षण कायग की गजतजवजधयों

को दकया जाएगा।

5. 247 वृक्षो को प्रत्यारोपण के जलए ऄनुमजत ईनके स्ट्वयं के जोजखम पर और दकसी भी ऄन्य व्यजि के दावे के

पक्षपात के जबना, जो वृक्षो और भूजम पर सिी िो सकती िै, दी जा रिी िै ।

राष्ट्रीय राजधानी क्षेत्र ददल्ली के

ईपराज्यपाल के अदेि से तथा ईनके नाम पर,

Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Lt. Governor of National Capital Territoryof Delhi,

hereby, in public interest exempts an area of 2.6086 ha approx.for construction of Member of Parliament Flat at

Baba Kharak Singh (BKS) Marg, New Delhi from the provision of sub-section (3) of section 9 of the said Act.

Transplantation of 247 numbers of trees which are standing on site shall be done by User Agency at

Eco Park Badarpur, New Delhi with their own funds.

TERMS AND CONDITIONS

1. Central Public Works Department (CPWD) herein referred to as User Agency, shall make an advance

deposit of an amount of Rs.1,40,79,000 /- (Rupees One Crore Forty Lakh Seventy Nine Thousand Only @

Rs. 57000/- per tree) towards security deposit for creation and maintenance of compensatory plantation for

a period of Seven (7) years and the same shall be forfeited and utilized for plantation by the Forest

Department if terms and conditions mentioned at 2, 3 & 4 are not followed by User Agency.

2. The conditions required to be fulfilled before starting transplantation of trees by User Agency:-

Detailed plantation schedule shall have to be submitted by User Agency to concerned Tree Officer/

Deputy Conservator of Forests (West) in compliance with Section-12 of Delhi Preservation of Trees

Act, 1994.

b. User Agency shall submit a detailed plan for site preparation and plantation.

The User Agency shall ensure that there is no pending litigation or stay order passed by any court of

law/ other authority before undertaking felling/ transplantation of trees.

d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall

necessarily be obtained by the User Agency.

It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other

clearances, if any obtained, shall be followed scrupulously.

3. The conditions required to be fulfilled during the transplantation of trees:-

Transplantation of trees shall be initiated immediately after conditions in point no. 2 is satisfied and

should be completed not later than six (06) months of such date, after which a completion report has to

be submitted to theTree Officer/ Deputy Conservator of Forests (West). The spacing of the

transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.

b. All the conditions mentioned in Tree Transplantation Policy, 2020 shall be followed scrupulously by

User Agency.

The progress report of transplantation shall be submitted to concern Tree Officer/ Deputy Conservator

of Forests(West) along with complete details of trees by the User Agency.

d. If any tree is found to have nest of birds it should not be felled / transplanted till the same is abandoned

by the birds.

Transplantation / felling of any tree apart from 247 trees by User Agency shall constitute an offence

under Delhi Preservation of Trees Act (DPTA), 1994.

The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as

revenue to the Government account by the User Agency.

g. The lops& tops of the trees shall be sent / supplied to the nearest crematorium free of cost and the same

should be reported to Tree Officer / Deputy Conservator of Forests (West) by User Agency.

h. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said

wood shall be obtained from the Tree Officer/ Deputy Conservator of Forests(West) by User Agency.

Transplantation of trees and transportation of forest produce arising there from to the public

crematorium shall be completed within 90 days.

The User Agency shall ensure that the plan of this proposal shall not be changed.

k. It should be ensured by the User Agency that all the conditions mentioned in forest clearance and other

clearances, if any obtained, shall be followed scrupulously.

All activities as submitted under approved Tree Preservation Plan should be followed scrupulously.

m. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy, 2020 have

been followed and details of the same should be submitted to the Tree Officer/ Deputy Conservator of

Forests (West) concerned.

n. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with

15 feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land required should be

provided by User Agency & plantation has to be done at own cost.

4. The conditions required to be fulfilled for considering successful plantation & release of Security

Deposit by the Tree officer/ Deputy Conservator of Forests:-

100% Compensatory Plantation of 2470 saplings of native species shall be raised and maintained by

User Agency for Seven years and monitored till its successful establishment as mentioned on table

above.

b. 2470 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in

ratio of 1:10 on non-forest land in lieu of transplantation 247numbers of trees. The plantation shall be

done by following site specific plantation techniques with additional measures on identified land

within three months of issue of tree removal permission and maintenance for next Seven (7) years shall

be carried out there after by User Agency with their own funds.

If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also

deposit extra site improvement expenses which may be required to make the site suitable for plantation

as calculated by Tree Officer / Deputy Conservator of Forests (West) concerned (as deposits).

d. The User Agency shall implement heavy ground preparation measures i.e. filling of good earth in the

pit of size 2X2X2 Mtr. and 4X4X4 Mtr. after these measures are carried out the land shall be

considered for raising Compensatory Plantation and Transplantation as communicated vide letter dated

31.05.2022 issued by Tree Officer / Deputy Conservator of Forests (West).

The land over which compensatory plantation/ Tree transplantation raised shall not be utilized for other

purpose without the approval of the State Government.

User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife,

Government of National Capital Territory of Delhi and a copy of the same shall be submitted to the

Tree Officer / Deputy Conservator of Forests (West) at the end of every financial year.

g. Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory

plantation/ transplantation.

h. The User Agency shall implement the improved soil moisture conservation activities on compensatory

plantation/ transplantation site.

The User Agency shall ensure that the plan of this proposal shall not be changed.

5. Permission for transplantationof 247numbers of tress is being granted to the User Agency at their own risk

and without prejudice the claim(s) of any other person(s) who may be having any right(s) over the land or

the trees.
