उपभोगी संस्ट्था द्वारा पररयोिना स्ट्थल से 1512 वृक्षों का प्रत्यारोपण 6 िेक्टेयर क्षेत्र में सुल्तानपुर डबास,
ददल्ली के रािस्ट्व गांव में स्ट्वयं की लागत पर दकया िाएगा।
जनयम एवं ितें
1. अजखल भारतीय आयुर्तवज्ञान संस्ट्थान (एम्स), िो दक उपभोगी संस्ट्था के रूप में संदर्तभत ि।,कोसात वर्षतों की अवजध
के जलए पौधों के सम्पूणव जवकास एवं रखरखाव िेतुउपरोिानुसार12,21,51000/-रुपये (बारि करोड़ इक्कीस लाख
इक्यावन ििार मात्र @ रु. 57000/- प्रजत वृक्ष की राजि अजिम रूप से िमा करवानी िोगी और यदद उपभोगी
संस्ट्था द्वारा 2, 3 और 4 में उजल्लजखत जनयमों और िततों का पालन निीं दकया िाता ि।, तो इस राजिकोिब्त कर
जलया िाएगा और इस राजि को वन जवभाग द्वारा वृक्षारोपण के जलए उपयोग दकया िाएगा ।
2. उपभोगी संस्ट्था द्वारा वृक्षोंका प्रत्यारोपण /कटाई िुरू करने से पिले पूरी की िाने वाली आवयक ितें:-
a. ददल्ली वृक्ष laj{k.k अजधजनयम, 1 4 की धारा 12 के अनुपालन में उपभोगी संस्ट्था द्वारा संबंजधत वृक्ष
अजधकारी / उप- वन संरक्षक (दजक्षण) को जवस्ट्तृत वृक्षारोपण कायवक्रम प्रस्ट्तुत प्रस्ट्तुत दकया िाएगा ।
b. उपभोगी संस्ट्था द्वारा साइट की त।यारी और वृक्षारोपण के जलए एक जवस्ट्तृत योिना प्रस्ट्तुत दकया
िाएगा ।
c. उपभोगी संस्ट्था केद्वारा यि सुजनजित दकया िायेगा दक वृक्षो की कटाई/ प्रत्यारोपण से पूवव कोई लंजबत
मुकदमेबािी या स्ट्थगन आदेि दकसी भी न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ िो।
d. उपभोगी संस्ट्था द्वारा वृक्षो को कटाई/ प्रत्यारोपण का कायव सभी व।धाजनक मंिूररयों को लेने के बाद िी
िुरू दकया िाएगा।
e. उपभोगी संस्ट्था के द्वारा वनमंिूरी में और अन्य मंिूरी में उजल्लजखत सभी िततों िततों , यदद कोई िो, का
जनष्ठापूववक पालन दकया िाएगा ।
3. वृक्षों के प्रत्यारोपण/कटाई के दौरान पूरी की िाने वाली आवयक ितें:-

और इसे ू:मिीने के अंतराल में पूणव दकया िाएगा । प्रत्यारोपण प्रदक्रया के पूणव िोने का बाद एक सम्पूणव

ररपोटव वृक्ष अजधकारी / उप- वन संरक्षक¼दजक्षण)को प्रस्ट्तुत की िायेगी । प्रत्यारोपण स्ट्थल मे
प्रत्यारोजपत वृक्षो की दूरी 4 मीटर 3बबदु से बबदु से कम निीं िोनी चाजिए ।
b. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी िततों का पालन दकया िाएगा ।
c. उपभोगी संस्ट्था द्वारा 631 वृक्षों को काटने से पूवव प्रत्यारोपण दकया िाएगा । 631 वृक्षों की अनुमजत
1512वृक्षो के सफल प्रत्यारोपण और वृक्ष अजधकारी / उप- वन संरक्षक (दजक्षण) को अनुपालन प्रमाण
पत्र प्रस्ट्तुत करने के बाद दी िायेगी।
d. प्रत्यारोपण /कटाई की प्रगजत ररपोटव संबंजधत वृक्ष अजधकारी / उप- वन संरक्षक¼दजक्षण)को वृक्षों के पूणव
जववरण के साथ प्रस्ट्तुत की िाएगी।
e. यदद दकसी वृक्ष में पजक्षयों का घोंसला पाया िाता ि। तो उसे तब तक निीं काटा/ प्रत्यारोपण दकया
िाएगा िब तक दक पक्षी उसे ूोड़ न दें।
f. उपभोगी संस्ट्था द्वारा 2143वृक्षो के अलावा दकसी भी वृक्ष की कटाई / प्रत्यारोपण ददल्ली वृक्ष laj{k.k
अजधजनयम, 1 4के अन्तगवत एक अपराध िोगा।
g. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िाने के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे
प्राप्तधन राजि को सरकार के खाते मे रािस्ट्व के रूप में िमा की िाएगी।
h. उपभोगी संस्ट्थाद्वारावृक्षों के ऊपरी िाखाओंको काटे िाने केउपरान्त प्राप्तलकजड़यों को मुफ्त में जनकटतम
सावविजनक िवदािों में प्रयोग िेतु सौपी िाएगीऔर इसकी सूचना वृक्ष अजधकारी / उप-वन संरक्षक
(दजक्षण) को भी दी िाएगी।
i.
उपभोगी संस्ट्थाद्वारावृक्षो को िटाए िाने के स्ट्थल से लकजड़यों को को ले िाने से पूवव वृक्ष अजधकारी /
उप- वन संरक्षक (दजक्षण) से ढुलाई अनुमजत प्राप्त करनी िोगी।
j.
उपभोगी संस्ट्थाद्वारावृक्षो की प्रत्यारोपण/ कटाई और उसमें प।दा िोने वाली वन उपि को सावविजनक
मिान मे 0 ददनों के अंदर पूरा दकया िाएगा ।
k. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्ततत निीं
दकया िाएगा ।
l.
उपभोगी संस्ट्था के द्वारा वनमंिूरी में और अन्य मंिूरी में उजल्लजखत सभी िततों िततों , यदद कोई िो, का
जनष्ठापूववक पालन दकया िाएगा ।
m. उपभोगी संस्ट्था के द्वारा अनुमोददत वृक्ष संरक्षण योिना के अंतगवतप्रस्ट्तुत सभी गजतजवजधयों का
जनष्ठापूववक पालन दकया िाएगा ।
n. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िाएगा दक वृक्षप्रत्यारोपण नीजत 2020 की धारा 4 (6-बी
के अंतगवतसभी प्रावधानों का जनष्ठापूववक पालन दकया गया ि। और इसका जववरण वृक्ष अजधकारी /
उप- वन संरक्षक (दजक्षण) को प्रस्ट्तुत दकया िाएगा ।
o. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िाएगा दक सभी प्रजतरोजपत वृक्षों के जलए िो 15 फीट
ऊंचाई और कम से कम 6 इंच व्यास वाले स्ट्वदेिी वृक्ष प्रिाजतयों में िीजवत निीं रिपाते िैं, तो उन्िें 1:5
के अनुपात में लगाया िाएगा । आवयक अजतररि भूजम उपभोगी संस्ट्था द्वारा प्रदान की िाएगी और
वृक्षारोपण स्ट्वयं की लागत पर दकया िाएगा।
4. वृक्ष अजधकारी/ उप- वन संरक्षक द्वारा सफलतापूववक वृक्षारोपण और सुरक्षा िमा राजि िारी करने पर जवचार
करने के जलए आवयक ितें:-
a. उपरोि ताजलका 1 (क और 3ख के अनुसार, देिी प्रिाजतयों के 21430 पौधो का 100 % प्रजतपूरक
वृक्षारोपण और उनका सात वर्षो तक रखरखाव उपभोगी संस्ट्था द्वारा दकया िायेगा। इस वृक्षारोपण के
सफलतापूववक स्ट्थापना के बाद उपभोगी संस्ट्था द्वारा जनगरानी की िाएगी।
b. 2143 वृक्षों के प्रत्यारोपण/ काटे दकए िाने के बदले मे 1:10 के अनुपात मे स्ट्वदेिी प्रिाजतयों के
6-8 फीट की ऊाँचाई वाले 21430 पौधो का प्रजतपूरक वृक्षारोपण ग।र-वन भूजम पर दकया िाएगा ।

वृक्षारोपण की अनुमजत के िारी िोने के तीन मिीने के अंदर जनधावररत की गई भूजम पर अजतररि उपायों
के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा और अजिम सात
37 वर्षतों के जलए रखरखाव तथा उसके बादउनका रखरखाव उपभोगी संस्ट्था द्वाराअपनी स्ट्वयं की लागत
पर दकया िाएगा ।
c. िो भूजम प्रजतपूरक वृक्षारोपण/ वृक्ष प्रत्यारोपण के जलए आवंरटत ि।, उसका उपयोग दकसी अन्य कायो के
जलए राज्य सरकारकी स्ट्वीकृजत के जबना निीं दकया िाएगा।
d. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षेत्र ददल्ली
सरकार को जनधावररत करेंगी और इसकी एक प्रजत प्रत्येक जवत्तीय वर्षव के अंत में वृक्ष अजधकारी / उप- वन
संरक्षक (दजक्षण) को प्रस्ट्तुत की िाएगी ।
e. भूजम स्ट्वाजमत्व एिेंसी यि सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोई
अजतक्रमण न िो ।
f. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृदा नमी संरक्षण कायव की गजतजवजधयों
को दकया िाएगा।
g. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्ततत निीं
दकया िाएगा ।
5. 2143 वृक्षों को प्रत्यारोपण/ काटने के जलए अनुमजत उनके स्ट्वयं के िोजखम पर और दकसी भी अन्य व्यजि के दावे
के पक्षपात के जबना, िो वृक्षों और भूजम पर सिी िो सकती ि।, दी िा रिी ि। ।

Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Lt. Governor of National Capital
Territory of Delhi, hereby, in public interest exempts an area of 62.17 ha approx.involving 56.12 ha for
land in East Ansari Nagar Campus & 6.05 ha in South Ansari Nagar campus for implementation of Master
Plan of AIIMS New Delhi to convert it into World Class Medical University, New Delhifrom the provision
of sub-section (3) of section 9 of the said Act.

(b)
Transplantation of 1512 numbersof trees which are standing on site shall be done by User Agency at
Revenue Village of SultanpurDabas, Delhi in 6 ha area with their own funds.
TERMS & CONDITIONS
1. All India Institute of Medical Sciences (AIIMS) herein referred to as User Agency, shall make an
advance deposit of an amount of Rs.12,21,51000/- (Rupees Twelve Crore Twenty One Lakh Fifty
One Thousand Only @ Rs. 57000/- per tree) towards security deposit for creation and maintenance
of compensatory plantation for a period of Seven (7) years and the same shall be forfeited and
utilized for plantation by the Forest Department if terms and conditions mentioned at 2, 3 & 4 are
not followed by User Agency.
2. The conditions required to be fulfilled before starting transplantation / felling of trees by
User Agency:-
a. Detailed plantation schedule shall have to be submitted by User Agency to Tree Officer/
Deputy Conservator of forests (South) in compliance with Section-12 of Delhi Preservation of
Trees Act, 1994.
b. User Agency shall submit a detailed plan for site preparation and plantation.
c. The User Agency shall ensure that there is no pending litigation or stay order passed by any
court of law/ other authority before undertaking felling/ transplantation of trees.
d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall
necessarily be obtained by the User Agency.
e. It should be ensured by the User Agency that all the conditions mentioned in Forest clearance
and other clearances, if any obtained, shall be followed scrupulously.
3. The conditions required to be fulfilled during the transplantation / felling of trees:-
a. Transplantation of trees shall be initiated immediately after conditions in point no. 2 is satisfied
and should be completed not later than six (06) months of such date, after which a completion
report has to be submitted to the Tree Officer / Deputy Conservator of Forests (South). The
spacing of the transplantation of trees shall not be less than 4 meter (point to point) at
transplantation site.
b. All the conditions mentioned in Tree Transplantation Policy, 2020 shall be followed
scrupulously by User Agency.

c. The transplantation shall be carried out prior to felling of 631 nos. of trees permitted herein.
The 631 trees shall be removed / felled after successful transplantation of 1512 trees and
submission of compliance certificate to Tree Officer / Deputy Conservator of Forests (South).
d. The progress report of transplantation / felling shall be submitted through inspection officer to
concerned Tree Officer / Deputy Conservator of Forests (South) along with complete details of
trees.
e. If any tree is found to have nest of birds it should not be felled / transplanted till the same is
abandoned by the birds.
f. Transplantation / felling of any tree apart from 2143 trees by User Agency shall constitute an
offence under Delhi Preservation of Trees Act (DPTA), 1994.
g. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited
as revenue to the Government account by the User Agency.
h. The lops& tops of the trees shall be sent / supplied to the nearest crematorium free of cost and
the same should be reported to Tree Officer / Deputy Conservator of Forests (South) by User
Agency.
i.
Before shifting of timber, if any, from site of removal of trees, permission for transportation of
the said wood shall be obtained from the Tree Officer / Deputy Conservator of Forests (South)
by User Agency.
j.
Transplantation / felling of trees and transportation of forest produce arising there from to the
public crematorium shall be completed within 90 days.
k. The User Agency shall ensure that the plan of this proposal shall not be changed.
l.
It should be ensured by the User Agency that all the conditions mentioned in forest clearance
and other clearances, if any obtained, shall be followed scrupulously.
m. All activities as submitted under approved Tree Preservation Plan should be followed
scrupulously.
n. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy,
2020 have been followed and details of the same should be submitted to Tree Officer / Deputy
Conservator of Forests (South) concerned.
o. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree
species with 15 feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land
required should be provided by User Agency & plantation has to be done at own cost.
4. The conditions required to be fulfilled for considering successful plantation & release of
Security Deposit by the Tree officer:-
a. 100% Compensatory Plantation of 21430 saplings of native species shall be raised and
maintained by User Agency for Seven years and monitored till its successful establishment as
mentioned on table above.
b. 21430 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory
plantation in ratio of 1:10 on non-forest land in lieu of transplantation/ felling 2143 numbers of
trees. The plantation shall be done by following site specific plantation techniques with
additional measures on identified land within three months of issue of tree removal permission
and maintenance for next Seven (7) years shall be carried out there after by User Agency with
their own funds.
c. The land over which compensatory plantation/ Tree transplantation raised shall not be utilized
for other purpose without the approval of the State Government.
d. User Agency shall maintain plantation journals as prescribed by Department of Forests and
Wildlife, Government of National Capital Territory of Delhi and a copy of the same shall be
submitted to the Tree Officer / Deputy Conservator of Forests (South) at the end of every
financial year.

e. Land Owning agency shall ensure that there is no encroachment in area proposed for
compensatory plantation/ transplantation.
f. The User Agency shall implement the improved soil moisture conservation activities on
compensatory plantation/ transplantation site.
g. The User Agency shall ensure that the plan of this proposal shall not be changed.
5. Permission for transplantation / felling of 2143 numbers of tress is being granted to the User
Agency at their own risk and without prejudice the claim(s) of any other person(s) who may be
having any right(s) over the land or the trees.
