1. ददल्ली मेरो रेल कॉपोरेिन, जो दक ईपभोगी संस्ट्था के रूप में संदर्भभत िै, को सात वर्षों की ऄवजध के जलए पौधों

के सम्पूणा जवकास एवं रखरखाव िेतु ईपरोिानुसार 5,73,42,000/- रुपये) पााँच करोड़ जतित्तर लाख बयालीस

िजार @ रु. 57000/- प्रजत वृक्ष) की राजि ऄजिम रूप से जमा करवानी िोगी और यदद ईपभोगी संस्ट्था द्वारा

2, 3 और 4 में ईजल्लजखत जनयमों और ितों का पालन निीं दकया जाता िै, तो आस राजि को जब्त कर जलया

जाएगा और आस राजि को वन जवभाग द्वारा वृक्षारोपण के जलए ईपयोग दकया जाएगा ।

2. ईपभोगी संस्ट्था द्वारा वृक्षों का प्रत्यारोपण / कटाइ िुरू करने से पिले पूरी की जाने वाली अव‍यक ितें:-

a. ददल्ली वृक्ष संरक्षण ऄजधजनयम, 1994 की धारा 12 के ऄनुपालन में ईपभोगी संस्ट्था द्वारा संबंजधत वृक्ष

ऄजधकारी /ईप-वन संरक्षक (दजक्षण) को जवस्ट्तृत वृक्षारोपण कायाक्रम प्रस्ट्तुत दकया जाएगा ।

b. ईपभोगी संस्ट्था द्वारा साआट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योजना प्रस्ट्तुत दकया

जाएगा।

c. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक वृक्षों की कटाइ/ प्रत्यारोपण से पूवा कोइ लंजबत

मुकदमा या स्ट्थगन अदेि दकसी भी न्यायालय / ऄन्य प्राजधकरण द्वारा पाररत न हुअ िो।

d. ईपभोगी संस्ट्था द्वारा वृक्षों को कटाइ/ प्रत्यारोपण का काया सभी वैधाजनक मंजूररयों को लेने के बाद िी

िुरू दकया जाएगा।

e. ईपभोगी संस्ट्था के द्वारा वन मंजूरी में और ऄन्य मंजूरी में ईजल्लजखत सभी ितों, यदद कोइ िो, का

जनष्ठापूवाक पालन दकया जाएगा ।

f. यि ईस पररयोजना का जिस्ट्सा िै जजसमें वन (संरक्षण) ऄजधजनयम, 1980 के तित वन भूजम का

व्यपवतान (diversion) िाजमल िै। आसजलए, ईपभोगी संस्ट्था (https://parivesh.nic.in/writereaddata/

FC/HANDBOOK_GUIDELINES/HANDBOOK_GUIDELINES18_03_2019.pdf)

द्वारा

वन

(संरक्षण) ऄजधजनयम की िैंडबुक के ऄनुसार ददिाजनदेिों का जनष्ठापूवाक पालन दकया जायेगा ।

g. ररज मैनेजमेंट बोडा (अरएमबी) द्वारा स्ट्वीकृत और माननीय सवोच्च न्यायालय द्वारा ऄनुमोददत

पररयोजना के जलए जनधााररत पररयोजना लागत का 5% ररज मैनेजमेंट बोडा के पास ईपभोगी संस्ट्था

द्वारा जमा दकया जायेगा और आसे वृक्ष ऄजधकारी /ईप-वन संरक्षक (दजक्षण) को ऄवगत कराया जाये।

3. वृक्षों के कटाइ के दौरान पूरी की जाने वाली अव‍यक ितें:—

a. क्र

2 में ितों के ऄनुपालन िोने के तुरंत बाद ईपभोगी संस्ट्था द्वारा वृक्षों का प्रत्यारोपण िुरू दकया

जाएगा और आसे छ: मिीने के ऄंतराल में पूणा दकया जाएगा । प्रत्यारोपण प्रदक्रया के पूणा िोने का बाद

एक सम्पूणा ररपोटा वृक्ष ऄजधकारी /ईप-वन संरक्षक (दजक्षण) को प्रस्ट्तुत की जायेगी । प्रत्यारोपण स्ट्थल में

प्रत्यारोजपत वृक्षों की दूरी 4 मीटर (बबदु से बबदु) से कम निीं िोनी चाजिए ।

b. ईपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में ईजल्लजखत सभी ितों का पालन दकया जाएगा ।

c. ईपभोगी संस्ट्था द्वारा 151 वृक्षों को काटने से पूवा प्रत्यारोपण दकया जाएगा । 151 वृक्षों की ऄनुमजत

855 वृक्षों के सफल प्रत्यारोपण और वृक्ष ऄजधकारी /ईप-वन संरक्षक (दजक्षण) को ऄनुपालन प्रमाण पत्र

प्रस्ट्तुत करने के बाद दी जायेगी ।

d. ईपभोगी संस्ट्था द्वारा प्रत्यारोपण /काटे जाने वाले वृक्षों की प्रगजत ररपोटा संबंजधत वृक्ष ऄजधकारी /

ईप-वन संरक्षक (दजक्षण) को वृक्षों के पूणा जववरण के साथ प्रस्ट्तुत की जाएगी।

e. यदद दकसी वृक्ष में पजक्षयों का घोंसला पाया जाता िै तो ईसे तब तक निीं काटा/ प्रत्यारोपण दकया

जाएगा जब तक दक पक्षी ईसे स्ट्वतः छोड़ न दें।

f. ईपभोगी संस्ट्था द्वारा 1006 वृक्षो के ऄलावा दकसी भी वृक्ष की कटाइ / प्रत्यारोपण ददल्ली वृक्ष संरक्षण

ऄजधजनयम, 1994 के ऄन्तगात एक ऄपराध िोगा।

g. ईपभोगी संस्ट्था द्वारा वृक्षों को िटाए जाने के ईपरान्त प्राप्त लकजड़यों की नीलामी की जाएगी और ईससे

प्राप्त धनराजि को सरकार के खाते में राजस्ट्व के रूप में जमा की जाएगी।

h. ईपभोगी संस्ट्था द्वारा वृक्षों के उपरी िाखाओं को काटे जाने के ईपरान्त प्राप्त लकजड़यों को मुफ्त में

जनकटतम सावाजजनक िवदािों में प्रयोग िेतु सौपी जाएगी और आसकी सूचना वृक्ष ऄजधकारी /ईप-वन

संरक्षक (दजक्षण) को भी दी जाएगी

ईपभोगी संस्ट्था द्वारा वृक्षों को िटाए जाने के स्ट्थल से लकजड़यों को को ले जाने से पूवा वृक्ष ऄजधकारी /

ईप-वन संरक्षक (दजक्षण) से ढुलाइ ऄनुमजत प्राप्त करनी िोगी।

ईपभोगी संस्ट्था द्वारा वृक्षों की प्रत्यारोपण और ईसमें पैदा िोने वाली वन ईपज को सावाजजनक ‍मिान

मे 90 ददनों के ऄंदर पूरा दकया जाएगा ।

k. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक आस प्रस्ट्ताव की योजना को पररवर्भतत निीं

दकया जाएगा ।

ईपभोगी संस्ट्था के द्वारा वन मंजूरी में और ऄन्य मंजूरी में ईजल्लजखत सभी ितों, यदद कोइ िो, का

जनष्ठापूवाक पालन दकया जाएगा ।

m. ईपभोगी संस्ट्था के द्वारा ऄनुमोददत वृक्ष संरक्षण योजना के ऄंतगात प्रस्ट्तुत सभी गजतजवजधयों का

जनष्ठापूवाक पालन दकया जाएगा ।

n. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जाएगा दक वृक्ष प्रत्यारोपण नीजत 2020 की धारा 4 (6बी)

के ऄंतगात सभी प्रावधानों का जनष्ठापूवाक पालन दकया गया िै और आसका जववरण संबंजधत वृक्ष

ऄजधकारी /ईप-वन संरक्षक (दजक्षण) को प्रस्ट्तुत दकया जाएगा ।

o. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जाएगा दक सभी प्रजतरोजपत वृक्षों के जलए जो 15 फीट

उंचाइ और कम से कम 6 आंच व्यास वाले स्ट्वदेिी वृक्ष प्रजाजतयों में जीजवत निीं रिपाते िैं, तो ईन्िें

1:5 के ऄनुपात में लगाया जाएगा । अव‍यक ऄजतररि भूजम ईपभोगी संस्ट्था द्वारा प्रदान की जाएगी

और वृक्षारोपण स्ट्वयं की लागत पर दकया जाएगा।

4. वृक्ष ऄजधकारी/ ईप- वन संरक्षक द्वारा सफलतापूवाक वृक्षारोपण और सुरक्षा जमा राजि जारी करने पर जवचार

करने के जलए अव‍यक ितें:-

a. ईपरोि ताजलका 1 (क) और (ख) के ऄनुसार, देिी प्रजाजतयों के 10060 पौधों का 100% प्रजतपूरक

वृक्षारोपण और ईनका सात वर्षों तक रखरखाव ईपभोगी संस्ट्था द्वारा दकया जायेगा। आस वृक्षारोपण के

सफलतापूवाक स्ट्थापना के बाद ईपभोगी संस्ट्था द्वारा जनगरानी की जाएगी।

b. 1006 वृक्षों के प्रत्यारोपण/काटे दकए जाने के बदले मे 1:10 के ऄनुपात मे स्ट्वदेिी प्रजाजतयों के 6-8

फीट की उाँचाइ वाले 10060 पौधों का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया जाएगा ।

वृक्षारोपण की ऄनुमजत के जारी िोने के तीन मिीने के ऄंदर जनधााररत की गइ भूजम पर ऄजतररि ईपायों

के साथ वृक्षारोपण स्ट्थल के ऄनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया जाएगा और ऄजिम सात

(7) वर्षों के जलए रखरखाव तथा ईसके बाद ईनका रखरखाव ईपभोगी संस्ट्था द्वारा ऄपनी स्ट्वयं की

लागत पर दकया जाएगा ।

c. यदद ईपभोगी संस्ट्था सफलतापूवाक प्रजतपूरक वृक्षारोपण करने में जवफल रिती िै। ईपभोगी संस्ट्था द्वारा

ऄजतररि साआट सुधार खचों को जमा दकया जाएगा जो दक सम्बंजधत वृक्ष ऄजधकारी /ईप-वन संरक्षक

(दजक्षण) द्वारा गणना के ऄनुसार वृक्षारोपण के जलए ईपयुि बनाने के जलए अव‍यक िो सकती िै।

d. जो भूजम प्रजतपूरक वृक्षारोपण/ वृक्ष प्रत्यारोपण के जलए अवंरटत िै, ईसका ईपयोग दकसी ऄन्य कायों के

जलए राज्य सरकार की स्ट्वीकृजत के जबना निीं दकया जाएगा।

e. ईपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यजीव जवभाग राष्ट्रीय राजधानी क्षेत्र ददल्ली

सरकार को जनधााररत करेंगी और आसकी एक प्रजत प्रत्येक जवत्तीय वर्षा के ऄंत में वृक्षऄजधकारी /ईप-वन

संरक्षक (दजक्षण) को प्रस्ट्तुत की जाएगी ।

f. भूजम स्ट्वाजमत्व एजेंसी यि सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण / प्रत्यारोपण के जलए प्रस्ट्ताजवत क्षेत्र

में कोइ ऄजतक्रमण न िो ।

g. ईपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृदा नमी संरक्षण काया की गजतजवजधयों

को दकया जाएगा।

h. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक आस प्रस्ट्ताव की योजना को पररवर्भतत निीं

दकया जाएगा ।

यदद पररयोजना लागत संिोजधत िो जाती िै, तो ऄजतररि सुरक्षा राजि जारी करने के ऄनुरोध से पिले

ईपभोगी संस्ट्था के द्वारा ररज मैनेजमेंट बोडा के पास जमा कर दीजाए।

5. 1006 वृक्षों को प्रत्यारोपण/ कटाइ के जलए ऄनुमजत ईनके स्ट्वयं के जोजखम पर और दकसी भी ऄन्य व्यजि के दावे

के पक्षपात के जबना, जो वृक्षों और भूजम पर सिी िो सकती िै, दी जा रिी िै ।

the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Lt. Governorof National Capital Territory of

Delhi, hereby, in public interest exempts an area of 10.79ha approx.for construction of Saket-G Block to Khanpur

Section of Aerocity to Tughlakabad corridor of Delhi MRTS, Project Phase-IV, New Delhifrom the provision of sub-

section (3) of section 9 of the said Act.

Transplantation of 855 numbers of trees which are standing on site shall be done by User Agency

atDMRCPlan Defenceland, Pocket-C, and Pocket- K (A) near DMRC Staff quarters, Majlis Park,

Delhiin area of 1.12 hawith their own funds.

The details of the compensatory plantation are as under:-

TERMS & CONDITIONS

1. Delhi Metro Rail Corporation (DMRC) herein referred to as User Agency, shall make an advance deposit of an

amount ofRs.5,73,42,000/- (Rupees Five Crore Seventy Three Lakh Forty Two Thousand Only @ Rs. 57000/-

per tree) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven

(7) years and the same shall be forfeited and utilized for plantation by the Forest Department if terms and

conditions mentioned at 2, 3 & 4 are not followed by User Agency.

2. The conditions required to be fulfilled before starting transplantation/ felling of trees by User Agency:-

Detailed plantation schedule shall have to be submitted by User Agency to Tree Officer/Deputy

Conservator of Forest (South) in compliance with Section-12 of Delhi Preservation of Trees Act, 1994.

b. User Agency shall submit a detailed plan for site preparation and plantation.

The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/

other authority before undertaking felling/ transplantation of trees.

d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall

necessarily be obtained by the User Agency.

It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other

clearances, if any obtained, shall be followed scrupulously.

This is part of project in which diversion of forest land under Forest (Conservation) Act, 1980 is

involved. Hence, guidelines as per Handbook of FCA should be followed scrupulously by User Agency

(https://parivesh.nic.in/writereaddata/FC/HANDBOOK_GUIDELINES/HANDBOOK_GUIDELINES18

_03_2019.pdf).

g. 5% of the project cost as prescribed for project cleared by Ridge Management Board (RMB) and

approved by Hon’ble Supreme Court should be deposited with Ridge Management Board and the same

is conveyed to Tree Officer/Deputy Conservator of Forest (South).

3. The conditions required to be fulfilled during the transplantation / felling of trees:-

Transplantation of trees shall be initiated immediately after conditions in point no. 2 is satisfied and

should be completed not later than six (06) months of such date, after which a completion report has to

be submitted to Tree Officer/Deputy Conservator of Forest (South). The spacing of the transplantation of

trees shall not be less than 4 meter (point to point) at transplantation site.

b. All the conditions mentioned in Tree Transplantation Policy, 2020 shall be followed scrupulously by

User Agency.

The transplantation shall be carried out prior to felling of 151 nos. of trees permitted herein. The 151

trees shall be removed / felled after successful transplantation of 855 trees and submission of compliance

certificate to Tree Officer/Deputy Conservator of Forest (South).

d. The progress report of transplantation/ fellingshall be submitted to Tree Officer/Deputy Conservator of

Forest (South)along with complete details of trees by the User Agency.

If any tree is found to have nest of birds it should not be felled / transplanted till the same is abandoned

by the birds.

Transplantation / felling of any tree apart from 1006 trees by User Agency shall constitute an offence

under Delhi Preservation of Trees Act (DPTA), 1994.

g. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue

to the Government account by the User Agency.

h. The lops& tops of the trees shall be sent / supplied to the nearest crematorium free of cost and the same

should be reported to Tree Officer/Deputy Conservator of Forest (South)by User Agency.

Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said

wood shall be obtained from the Tree Officer/Deputy Conservator of Forest (South)by User Agency.

Transplantation/ fellingof trees and transportation of forest produce arising there from to the public

crematorium shall be completed within 90 days.

k. The User Agency shall ensure that the plan of this proposal shall not be changed.

It should be ensured by the User Agency that all the conditions mentioned in forest clearance and other

clearances, if any obtained, shall be followed scrupulously.

m. All activities as submitted under approved Tree Preservation Plan should be followed scrupulously.

n. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy 2020 have

been followed and details of the same should be submitted to Tree Officer/Deputy Conservator of Forest

(South).

o. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with

15 feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land required should be

provided by User Agency & plantation has to be done at own cost.

4. The conditions required to be fulfilled for considering successful plantation & release of Security

Deposit by the Tree Officer / Deputy Conservator of Forests :-

100% Compensatory Plantation of 10060 saplings of native species shall be raised and maintained by User

Agency for Seven years and monitored till its successful establishment as mentioned on table above.

b. 10060 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in

ratio of 1:10 on non-forest land in lieu of felling/ transplantation 1006 numbers of trees. The plantation

shall be done by following site specific plantation techniques with additional measures on identified land

within three months of issue of tree removal permission and maintenance for next Seven (7) years shall

be carried out there after by User Agency with their own funds.

If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also

deposit extra site improvement expenses which may be required to make the site suitable for plantation

as calculated by Tree Officer/Deputy Conservator of Forest (South)(as deposits).

d. The land over which compensatory plantation/ Tree transplantation raised shall not be utilized for other

purpose without the approval of the State Government.

User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife,

Government of National Capital Territory of Delhi and a copy of the same shall be submitted to the Tree

Officer/Deputy Conservator of Forest (South) at the end of every financial year.

Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory

plantation/ transplantation.

g. The User Agency shall implement the improved soil moisture conservation activities on compensatory

plantation/ transplantation site.

h. The User Agency shall ensure that the plan of this proposal shall not be changed.

If project costs get revised, the additional amount should be deposited with Ridge Management Board

before requesting for release of security deposit.

5. Permission for transplantation/ felling of 1006 numbers of tress is being granted to the User Agency at their

own risk and without prejudice the claim(s) of any other person(s) who may be having any right(s) over the

land or the trees.
