ईपभोगी संस्ट्था द्वारा पररयोजना स्ट्थल से 921 वृक्षों का प्रत्यारोपण ग्राम पुर, आलाक्वा िाहदरा (बुरारी), ददल्ली के राजस्ट्व
ररकॉडच में खसरा नंबर 1, 2 जमन, 11 और 45 पर ऄपने स्ट्वयं की लागत पर दकया जाएगा।
जनयम एवं ितें
1. गुजरमल मोदी हॉजस्ट्पटल एंड ररसचच सेंटर, मंददर मागच साकेत, नइ ददल्ली, जो दक ईपभोगी संस्ट्था के रूप में
संदर्भभत है, को सात वषों की ऄवजध के जलए पौधों के सम्पूणच जवकास एवं रखरखाव हेतु ईपरोिानुसार
7,39,86,000/- रुपये (सात करोड़ ईनतालीस लाख जछयासी हजार@ रु. 57000/- प्रजत वृक्ष) की राजि ऄजग्रम
रूप से जमा करवानी होगी और यदद ईपभोगी संस्ट्था द्वारा 2, 3 और 4 में ईजल्लजखत जनयमों और ितों का पालन
नहीं दकया जाता है, तो आस राजि को जब्त कर जलया जाएगा और आस राजि को वन जवभाग द्वारा वृक्षारोपण के
जलए ईपयोग दकया जाएगा ।
2. ईपभोगी संस्ट्था द्वारा वृक्षों का प्रत्यारोपण / कटाइ िुरू करने से पहले पूरी की जाने वाली अवश्यक ितें:-
a. ददल्ली वृक्ष संरक्षण ऄजधजनयम, 1994 की धारा 12 के ऄनुपालन में ईपभोगी संस्ट्था द्वारा संबंजधत वृक्ष
ऄजधकारी/ईप- वन संरक्षक को जवस्ट्तृत वृक्षारोपण कायचक्रम प्रस्ट्तुत दकया जाएगा ।
b. ईपभोगी संस्ट्था द्वारा साआट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योजना प्रस्ट्तुत दकया जाएगा ।
c. ईपभोगी संस्ट्था के द्वारा यह सुजनजित दकया जायेगा दक वृक्षों की कटाइ/प्रत्यारोपण से पूवच कोइ लंजबत
मुकदमा या स्ट्थगन अदेि दकसी भी न्यायालय/ऄन्य प्राजधकरण द्वारा पाररत न हुअ हो।
d. ईपभोगी संस्ट्था द्वारा वृक्षों को कटाइ/प्रत्यारोपण का कायच सभी वैधाजनक मंजूररयों को लेने के बाद ही िुरू
दकया जाएगा।
e. ईपभोगी संस्ट्था के द्वारा वन मंजूरी में और ऄन्य मंजूरी में ईजल्लजखत सभी ितों, यदद कोइ हो, का जनष्ठापूवचक
पालन दकया जाएगा ।
3. वृक्षों के कटाइ के दौरान पूरी की जाने वाली अवश्यक ितें:-
a. क्र

2 में ितों के ऄनुपालन होने के तुरंत बाद ईपभोगी संस्ट्था द्वारा वृक्षों का प्रत्यारोपण िुरू दकया
जाएगा और आसे छ: महीने के ऄंतराल में पूणच दकया जाएगा । प्रत्यारोपण प्रदक्रया के पूणच होने का बाद एक
सम्पूणच ररपोटच सम्बंजधत वृक्ष ऄजधकारी/ईप-वन संरक्षक को प्रस्ट्तुत की जायेगी । प्रत्यारोपण स्ट्थल मे
प्रत्यारोजपत वृक्षों की दूरी 4 मीटर (बबदु से बबदु) से कम नहीं होनी चाजहए ।
b. ईपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत, 2020 में ईजल्लजखत सभी ितों का पालन दकया जाएगा ।

c. ईपभोगी संस्ट्था प्रजतरोजपत वृक्षों का न्यूनतम तीन वषों तक ईसी प्रत्यारोपण एजेंसी के माध्यम से ऄनुरक्षण
करेगी जजनके द्वारा प्रत्यारोपण दकया गया था ।
d. ईपभोगी संस्ट्था द्वारा 377 वृक्षों को काटने से पूवच प्रत्यारोपण दकया जाएगा । 377 वृक्षों की ऄनुमजत 921
वृक्षों के सफल प्रत्यारोपण और सम्बंजधत वृक्ष ऄजधकारी/ईप-वन संरक्षक को ऄनुपालन प्रमाण पत्र प्रस्ट्तुत
करने के बाद दी जायेगी।
e. ईपभोगी संस्ट्था द्वारा प्रत्यारोपण/काटे जाने वाले वृक्षों की प्रगजत ररपोटच संबंजधत वृक्षऄजधकारी/ईप-वन
संरक्षक को वृक्षों के पूणच जववरण के साथ प्रस्ट्तुत की जाएगी।
f. यदद दकसी वृक्ष में पजक्षयों का घोंसला पाया जाता है तो ईसे तब तक नहीं काटा/प्रत्यारोपण दकया जाएगा
जब तक दक पक्षी ईसे स्ट्वतः छोड़ न दें।
g. ईपभोगी संस्ट्था द्वारा 1298 वृक्षों के ऄलावा दकसी भी वृक्ष की कटाइ/प्रत्यारोपण ददल्ली वृक्ष संरक्षण
ऄजधजनयम, 1994 के ऄन्तगचत एक ऄपराध होगा।
h. ईपभोगी संस्ट्था द्वारा वृक्षों को हटाए जाने के ईपरान्त प्राप्त लकजड़यों की नीलामी की जाएगी और ईससे प्राप्त
धनराजि को सरकार के खाते मे राजस्ट्व के रूप में जमा की जाएगी।
i.
ईपभोगी संस्ट्था द्वारा वृक्षों के उपरी िाखाओं को काटे जाने के ईपरान्त प्राप्त लकजड़यों को मुफ्त में जनकटतम
सावचजजनक िवदाहों में प्रयोग हेतु सौपी जाएगी और आसकी सम्बंजधत वृक्षऄजधकारी/ईप-वन संरक्षक को भी
दी जाएगी।
j.
ईपभोगी संस्ट्था द्वारा वृक्षों को हटाए जाने के स्ट्थल से लकजड़यों को को ले जाने से पूवच सम्बंजधत
वृक्षऄजधकारी/ईप-वन संरक्षक से ढुलाइ ऄनुमजत प्राप्त करनी होगी।
k. ईपभोगी संस्ट्था द्वारा वृक्षों की प्रत्यारोपण/कटाइ और ईसमें पैदा होने वाली वन ईपज को सावचजजनक श्मिान
मे 90 ददनों के ऄंदर पूरा दकया जाएगा ।
l.
ईपभोगी संस्ट्था के द्वारा यह सुजनजित दकया जायेगा दक आस प्रस्ट्ताव की योजना को पररवर्भतत नहीं दकया
जाएगा।
m. ईपभोगी संस्ट्था के द्वारा वन मंजूरी में और ऄन्य मंजूरी में ईजल्लजखत सभी ितों, यदद कोइ हो, का जनष्ठापूवचक
पालन दकया जाएगा ।
n. ईपभोगी संस्ट्था के द्वारा ऄनुमोददत वृक्ष संरक्षण योजना के ऄंतगचत प्रस्ट्तुत सभी गजतजवजधयों का जनष्ठापूवचक
पालन दकया जाएगा ।
o. ईपभोगी संस्ट्था के द्वारा यह सुजनजित दकया जाएगा दक वृक्ष प्रत्यारोपण नीजत 2020 की धारा 4 (6-बी) के
ऄंतगचत सभी प्रावधानों का जनष्ठापूवचक पालन दकया गया है और आसका सम्बंजधत वृक्ष ऄजधकारी/ईप-वन
संरक्षकको प्रस्ट्तुत दकया जाएगा ।
p. ईपभोगी संस्ट्था के द्वारा यह सुजनजित दकया जाएगा दक सभी प्रजतरोजपत वृक्षों के जलए जो 15 फीट उंचाइ
और कम से कम 6 आंच व्यास वाले स्ट्वदेिी वृक्ष प्रजाजतयों में जीजवत नहीं रह पाते हैं, तो ईन्हें 1:5 के ऄनुपात
में लगाया जाएगा । अवश्यक ऄजतररि भूजम ईपभोगी संस्ट्था द्वारा प्रदान की जाएगी और वृक्षारोपण स्ट्वयं
की लागत पर दकया जाएगा।
4. वृक्ष ऄजधकारी/ ईप-वन संरक्षक द्वारा सफलतापूवचक वृक्षारोपण और सुरक्षा जमा राजि जारी करने पर जवचार
करने के जलए अवश्यक ितें:-
a. ईपरोि ताजलका 1(क) और (ख) के ऄनुसार, देिी प्रजाजतयों के 12980 पौधो का 100% प्रजतपूरक
वृक्षारोपण और ईनका सात वषों तक रखरखाव ईपभोगी संस्ट्था द्वारा दकया जायेगा। आस वृक्षारोपण के
सफलतापूवचक स्ट्थापना के बाद ईपभोगी संस्ट्था द्वारा जनगरानी की जाएगी।
b. 1298 वृक्षों के प्रत्यारोपण/काटे जाने के बदले मे 1:10 के ऄनुपात मे स्ट्वदेिी प्रजाजतयों के 6-8 फीट की
उाँचाइ वाले 12980 पौधों का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया जाएगा । वृक्षारोपण की ऄनुमजत
के जारी होने के तीन महीने के ऄंदर जनधाचररत की गइ भूजम पर ऄजतररि ईपायों के साथ वृक्षारोपण स्ट्थल के

ऄनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया जाएगा और ऄजग्रम सात (7) वषों के जलए रखरखाव
तथा ईसके बाद ईनका रखरखाव ईपभोगी संस्ट्था द्वारा ऄपनी स्ट्वयं की लागत पर दकया जाएगा ।
c. यदद ईपभोगी संस्ट्था सफलतापूवचक प्रजतपूरक वृक्षारोपण करने में जवफल रहती है। ईपभोगी संस्ट्था द्वारा
ऄजतररि साआट सुधार खचों को जमा दकया जाएगा जो दक सम्बंजधत वृक्ष ऄजधकारी/ईप-वन संरक्षक द्वारा
गणना के ऄनुसार वृक्षारोपण के जलए ईपयुि बनाने के जलए अवश्यक हो सकती है।
d. जो भूजम प्रजतपूरक वृक्षारोपण/वृक्ष प्रत्यारोपण के जलए अवंरटत है, ईसका ईपयोग दकसी ऄन्य कायों के जलए
राज्य सरकार की स्ट्वीकृजत के जबना नहीं दकया जाएगा।
e. ईपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यजीव जवभाग राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार
को जनधाचररत करेंगी और आसकी एक प्रजत प्रत्येक जवत्तीय वषच के ऄंत में सम्बंजधत वृक्ष ऄजधकारी/ईप-वन
संरक्षक को प्रस्ट्तुत की जाएगी । प्रारूप की एक प्रजत https://www.treeremoval.delhigovt.nic.in पर
ईपलब्ध है।
f. भूजम स्ट्वाजमत्व एजेंसी यह सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोइ
ऄजतक्रमण न हो ।
g. ईपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/प्रत्यारोपण स्ट्थल में मृदा नमी संरक्षण कायच की गजतजवजधयों को
दकया जाएगा।
h. ईपभोगी संस्ट्था के द्वारा यह सुजनजित दकया जायेगा दक आस प्रस्ट्ताव की योजना को पररवर्भतत नहीं दकया
जाएगा।
5. यदद ईपरोि में से कोइ भी ितच ईपभोगी संस्ट्था द्वारा पूरी नहीं की जाती है, तो संबंजधत वृक्ष ऄजधकारी/ईप-वन
संरक्षक द्वारा ददल्ली वृक्ष संरक्षण ऄजधजनयम, 1994 की धारा 12 के ऄनुसार कारचवाइ की जाएगी ।
6. 1298 वृक्षो को प्रत्यारोपण/ कटाइ के जलए ऄनुमजत ईनके स्ट्वयं के जोजखम पर और दकसी भी ऄन्य व्यजि के दावे
के पक्षपात के जबना, जो वृक्षों और भूजम पर सही हो सकती है, दी जा रही है ।

Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Lt. Governor of National Capital Territory of Delhi,
hereby, in public interest exempts an area of 5.81 ha for construction of GujarmalModi Hospital and Research Center,
Mandir Marg Saket, New Delhi from the provision of sub-section (3) of section 9 of the said Act.

Transplantation of 921numbers of trees which are standing on site shall be done by User Agency Khasra No.
1, 2 min, 11 & 45 in the Revenue record of Village Pur, IllaquaShahdra (Burari), Delhiwith their own funds.
TERMS & CONDITIONS
1. GujarmalModi Hospital and Research Center, Mandir Marg Saket, New Delhi herein referred to as
User Agency, shall make an advance deposit of an amount of Rs. 7,39,86,000/-/- (SevenCroreThirty Nine
Lakh Eighty Six Thousand Only, i.e., /- @ Rs. 57000/- per tree) towards security deposit for creation and
maintenance of compensatory plantation for a period of Seven (7) years and the same shall be forfeited and
utilized for plantation by the Forest Department if terms and conditions mentioned at 2, 3 &4 are not
followed by User Agency.
2. The conditions required to be fulfilled before starting transplantation/ felling of trees by User
Agency:-
a.
Detailed plantation schedule shall have to be submitted by User Agency to concerned Tree Officer/
Deputy Conservator of Forests in compliance with Section-12 of Delhi Preservation of Trees Act, 1994.
b. User Agency shall submit a detailed plan for site preparation and plantation.
c.
The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/
other authority before undertaking felling/ transplantation of trees.
d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall
necessarily be obtained by the User Agency.
e.
It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other
clearances, if any obtained, shall be followed scrupulously.
3. The conditions required to be fulfilled during the felling of trees:-
a.
Transplantation of trees shall be initiated immediately after conditions in point no. 2 is satisfied and
should be completed not later than six (06) months of such date, after which a completion report has to
be submitted to theconcerned Tree Officer/Deputy Conservator of Forests. The spacing of the
transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.
b. All the conditions mentioned in Tree Transplantation Policy, 2020 shall be followed scrupulously by
User Agency.
c.
User Agency shall maintain the transplanted trees for minimum three years by engaging the same
transplantation agency which has carried out the transplantation.
d. The transplantation shall be carried out prior to felling of 377numbersof trees permitted herein. The
377 trees shall be removed / felled after successful transplantation of 921 trees and submission of
compliance certificate to the concerned Tree Officer / Deputy Conservator of Forests.
e.
The progress report of transplantation/ fellingshall be submitted to concerned Tree Officer/Deputy
Conservator of Forests along with complete details of trees by the User Agency.
f.
If any tree is found to have nest of birds it should not be felled / transplanted till the same is abandoned
by the birds.
g. Transplantation/felling of any tree apart from 1298 trees by User Agency shall constitute an offence
under Delhi Preservation of Trees Act (DPTA), 1994.

h. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue
to the Government account by the User Agency.
i.
The lops & tops of the trees shall be sent /supplied to the nearest crematorium free of cost and the same
should be reported to concernedTree Officer / Deputy Conservator of Forests by User Agency.
j.
Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said
wood shall be obtained from the concerned Tree Officer/Deputy Conservator of Forests by User Agency.
k. Transplantation of trees and transportation of forest produce arising there from to the public crematorium
shall be completed within 90 days.
l.
The User Agency shall ensure that the plan of this proposal shall not be changed.
m. It should be ensured by the User Agency that all the conditions mentioned in forest clearance and other
clearances, if any obtained, shall be followed scrupulously.
n. All activities as submitted under approved Tree Preservation Plan should be followed scrupulously.
o. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy, 2020 have
been followed and details of the same should be submitted to the Tree Officer / Deputy Conservator of
Forests concerned.
p. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with
15 feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land required should be
provided by User Agency & plantation has to be done at own cost.
4. The conditions required to be fulfilled for considering successful plantation & release of Security
Deposit by the Tree Officer/Deputy Conservator of Forests :-
a.
100% Compensatory Plantation of 12980 saplings of native species shall be raised and maintained by User
Agency for Seven years and monitored till its successful establishment as mentioned on table above.
b. 12980 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in
ratio of 1:10 on non-forest land in lieu of felling/ transplantation 1298 no. of trees. The plantation shall
be done by following site specific plantation techniques with additional measures on identified land
within three months of issue of tree removal permission and maintenance for next Seven (7) years shall
be carried out there after by User Agency with their own funds.
c.
If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also
deposit extra site improvement expenses which may be required to make the site suitable for plantation
as calculated by Tree Officer /Deputy Conservator of Forests concerned (as deposits).
d. The land over which compensatory plantation/ Tree transplantation raised shall not be utilized for other
purpose without the approval of the State Government.
e.
User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife,
Government of NCT of Delhi and a copy of the same shall be submitted to the concerned Tree Officer /
Deputy Conservator of Forestsat the end of every financial year. A copy of format is available in
https://www.treeremoval.delhigovt.nic.in.
f.
Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory
plantation/ transplantation.
g. The User Agency shall implement the improved soil moisture conservation activities on compensatory
plantation/ transplantation site.
h. The User Agency shall ensure that the plan of this proposal shall not be changed.
5. If any of the above condition is not fulfilled by the User Agency, concerned Tree Officer/Deputy Conservator
of Forests shall initiate action as per section 12 of Delhi Preservation of Trees Act, 1994.
